Site -specific rezones that require accompanying amendments of the Comprehensive Plan and Zoning Map are legislative matters under state law; however, Tukwila Municipal Code 18.104.010(5) provides that all four rezone requests are quasi-judicial matters, with the City Council acting as the decision -maker based on the information and record presented at this meeting, similar to the process used by a Hearing Examiner nrJudge. Quasi-judicial matters do not follow the standard Council agenda process of Council Committee, Committee ofthe Whole, and Regular Meetings. Genens|ly, individuals are penndhad up to 5 minutes each for public testimony. |f1Oormore people sign up to speak at a specific hearing, then each speaker at that hearing will be limited to 3 minutes. Development Supervisor, explained the City has received an application for o rezone from Low Density Residential (LDR) to Commercial/Light Industrial (C/Ll) on two vacant parcels located at 14000 Interurban Avenue 3outh, to bring the subject parcels into the same C/L| zoning district as neighboring parcels. He noted the rezone isconsistent with the Comprehensive P|on'a policies; the City currently uses the George Long property (including the LDR portion) in a manner consistent with the C/LI allowable uses; rezoning to C/L| will remove the isolated LOR zoning and bring the zoning into agreement with surrounding properties; and would positively affect the community by allowing for consolidation with adjacent lots. Staff therefore recommends approving the rezone from LDR to C/L|. The Deputy City Clerk stated that presentation by the applicant's representative. He explained the City intends to combine the four parcels at the George Long property and right-of-way into one larger parcel with one zoning classification due to issues with permitting, allowable uses, and applicable Shoreline designation. Breyden Jager, Associate Planner, explained the City has received an application to rezone a parcel located at 6250 South 153rd Street from Low Density Residential (LDR) to Medium Density Residential (K8OR), in conjunction with a proposed boundary line adjustment, to eliminate the nonconforming condition of having apartment parking on an LDR-zoned property and create more logical, vertical boundary between the MDR and LDRzones. Henoted the rezone request isconsistent with the Comprehensive Plan's policies; the proposed amendment is consistent with the description and purpose of the zone classification applied for; there are changed conditions since the previous zoning became effective that warrants the proposed amendment; and the proposed amendment would positively affect the community byproviding needed housing capacity. Staff therefore recommends approving the rezone from LDR1oMDR. Kari Sand, City Attorney, indicated Councilmember Mcleod has disclosed any potential conflicts he may have, and she asked if this affects his ability to be an impartial decisionmaker on this matter. RECUSAL Councilmember McLeod stated the conflict does not affect his ability to be fair and impartial, he does not have any inbapeat, and does not stand to gain or lose by this matter. The Deputy City Clerk stated the applicant will now have 15 minutes to provide their presentation on the Anne Anderson, Evergreen Public Relations, onbehalf ofthe applicant Schneider Homes, presented an overview of the applicant's request to rezone the project site from LDR to MDR. The proposed zoning change supports the intent of the City's Comprehensive Plan, provides the opportunity for additional affordable homeownership options in the City, and allows for a middle ground between the area's higher density apartment complexes and intermixed single-family homes. The Deputy City Clerk asked if either staff or the applicant had any other comments. The Deputy City Clerk referenced into the record an email received from Nick Webb on October 23, 2023. Copies of the email were distributed to the Council. 2. Hugh Tobin requested the Council deny this rezone application and expressed concern regarding inconsistency with the surrounding neighbnrhood, the rezone criteria not being met, sanitary sewer issues, ntormwaVerissues, and tree preservation. 3. Brandon Miles, Business Relations Manager, explained the City owns a parcel north of Tukwila Sounder Station that included a parking easement on an adjacent parcel in the City of Renton. Unico Properties has since purchased the adjacent parcel and has filed suit against the City seeking to terminate the easement on its property. Mayor Ekberg provided an update on the asylum seekers at Riverton Park United Methodist Church and shared the City recently met with Congressman Adam Smith. The Mayor also visited Washington, D.C., to meet with the Deputy Cabinet Secretary of the White House. The City will be having additional meetings with the White House and with Senator Cantwell's Office about how the Federal government can assist with the asylee crisis in the City. b. Council Councilmember Hougardy reported the Planning and Community Development Committee received an update on the Economic Development Strategy, and reviewed an ordinance establishing Rental Housing Protections that will be opened up for a public comment period. Councilmember Quinn relayed the Planning and Community Development Committee is seeking to engage the public regarding the draft ordinance establishing Rental Housing Protections per the commitment made to residents. He attended a Sound Cities Association Board meeting where they discussed partnership opportunities related to the asylee crisis in Tukwila. Council President Delostrinos Johnson attended the South King Housing and Homelessness Partners Executive Board meeting where they reviewed project applications to the Housing Capital Fund and discussed 2024 legislative priorities. She thanked Nora Gierloff, Community Development Director, and her staff for the considerable work in preparation for tonight's Quasi -Judicial hearings. Councilmember Kruller was invited to meet with the Honorable Reysal Korane Abshir, a member of the Somalian Parliament on her tour to the United States, at an event hosted by local businessman Abdiwali Mohamed. Parliament -member Abshir's message to the Somali -American community inspired hope. Councilmember Kruller also participated in a quiet ceremony honoring Former Mayor Jim Haggerton with an honorary street designation. Councilmember Abdi shared he will be participating in an event supporting the East African community. He reported he recently accepted a position with Puget Sound Sage as a Program Manager and thanked Council President Delostrinos Johnson for being his reference. He will be attending the upcoming National League of Cities City Summit with Mayor Ekberg and Councilmember Kruller. Councilmember Sharp reported the Transportation and Infrastructure Services Committee received an update on the Public Works Operations Campus Phase 2, and reviewed a stormwater capacity grant from the Department of Ecology, a street vacation resolution, a supplemental agreement for the Transportation Element of the Comprehensive Plan, and a resolution to surplus City equipment. c.
