The regular meeting of the Tukwila City Council was called to order by
Mayor Stan D. Minkler at 8 :00 P.M. Council members present were:
R. A. Bowen, D. R. Gardner, L. E. Crostick, J. R. Johanson, G. D. Hill,
P. F. Dunning and A. G. Radford.
The minutes of the previous meeting were approved
PUBLIC HEARING AMENDMENT TO ORDINANCE 251
The Public Hearing on the amendment to Ordinance 251 in regard to
variances was held. Mr. Johanson explained the proposed changes in
variance procedures. Some discussion followed to further clarify the
proposed changes. There being no objections raised., Mr. Dunning made
a motion the Public Hearing be closed. Motion seconded by Mr. Johanson
and carried.
ORDINANCE 608 Amendment to 251 VARIANCES
A proposed ordinance amending Ordinance 251 establishing the criteria
and procedure for the issuance of variances, was introduced. Mr. Johanson
made a motion the proposed ordinance be placed on its first reading.
Motion seconded by Mr. Hill and carried. Mr. Hill made a motion the
proposed ordinance be placed on its second reading by title only. Motion
seconded by Mr. Dunning and carried. Mr. Hodge pointed out there were
two minor corrections to be made in wording to clarify the meaning.
Mr. Dunning made a motion the proposed ordinance be placed on its third
and final reading as corrected, by title only. Motion seconded by Mr
Hill and carried. This being Ordinance 608.
N. P. EASEMENT FOR WATER LINE CONSTRUCTION
Correspondence was received from Hill, Ingman, Chase Company enclosing
a proposed permit from the Northern Pacific Railway covering the
location of a portion of the 18" water line, and recommending that the
permit be accepted with the conditions stated therein.
Discussion followed with Mr. Jon Stack of Hill, Ingman, Chase Company
explaining a portion of the line would be a temporary installation due
to the fact a rock hill prohibits laying the water line along property
lines. It will be necessary to lay the line around the rock hill and
then at a later date when the hill has been removed by the railway, the
water line will have to be relocated. He could not obtain definite
information from the railroad company as to when the removal of the
rock was contemplated.
Mr. Hill made a motion the Council accept the proposed easement agreement
from the Northern Pacific Railway. Motion seconded by Mr. Dunning and
carried.
APPROVAL OF CLAIMS:
Mr. Bowen made a motion claims approved by the Finance Committee be paid
with warrants drawn in their respective amounts. Motion seconded by
Mr. Gardner and carried.

ASSIGNMENT AND BILL OF SALE ON SEWER LINE BY NORTHERN PACIFIC
An assignment and bill of sale by the Northern Pacific Railway Company
conveying to the City of Tukwila a sewer line and right of way therefor
along an undedicated road in Tukwila known as 48th Avenue South was
presented. Mayor Minkler requested a recommendation on accepting this
line from the City Consulting Engineers. Mr. Stack reported the sewer
line had been inspected and was built to City specifications, however,
the metering station was not completely satisfactory as yet.. Mr. Zepp
reported Northern Pacific has agreed they will come up with a satisfactory
metering system, but they have not worked out the problems as yet. The
members of the Council concurred the acceptance of the sewer line would
be held in abeyance for the present.

SEWER CONNECTION CHARGE ORDINANCE
A proposed ordinance on sewer connection charges was introduced. Mr.
Gardner made a motion the proposed ordinance be placed on its first
reading by title only Motion seconded by Mr. Johanson and carried.
ANNEXATION PETITION NORTHERN PACIFIC PROPERTIES
A petition for annexation to the City of Tukwila certain properties
owned by the Northern Pacific Railway Company was presented. Mayor
Minkler turned the petition over to the Annexation Committee for study.
SALES TAX
Mayor Minkler reported on the adoption by the State Legislature of
HB21 authorizing the levying of 4% sales tax by counties and cities.
He further reported the City will have to take steps to insure the taxes
collected within the City boundaries are returned to the City. There
could be some problem due to the Seattle, Renton and Kent address of
some of the business places within the City.
OLYMPIC PIPE LINE FRANCHIBE
Correspondence was received from the Olympic Pipe Line Company requesting
permission to install a 12" pipe line under SR 181 and across the Orillia
bridge prior to the highway construction. Since the bids have been let
for construction, this installation must be made immediately. The letter
set forth the following provisions the company would abide by if permission
is granted: (1) obtain approval of Mr. Harry R. Powell of the engineering
details for the bridge crossing, (2) obtain approval from the State
Highway Commission of the SR -181 crossing permit, and (3) Olympic Pipe
Line would install the line on a contigent basis and remove or abandon
the line in the event the franchise amendment is not approved.
Mr. Baker stated the property owners on South 180th are concerned and
will be in attendance at the Public Hearing on the franchise March 2nd.
Mr. Hodge proposed the following stipulations be added: Plan approval
by Harry R. Powell would be entirely at Olympic Pipe Line's expense,
and the company would have no vested rights and the line could not be
put into operation.
Mr. Durbin of Olympic Pipe Line Company stated his acceptance of the
stipulations as set forth in their letter of February 16th and the
additional stipulations set forth by Mr. Hodge.
Mr. Hodge recommended an agreement be drafted setting forth the terms as
agreed upon.
Mr. Dunning made a motion the Council approve the request as set forth
in the letter from Olympic Pipe Line Company, along with the stipulations
set forth by Mr. Hodge, subject to the signing of an agreement by
Olympic Pipe Line Company. Motion seconded by Mr. Hill. Mr. Hodge also
recommended the installation of this line be subject to the City of
Tukwila Engineer's approval. The question was called and the motion
carried.
There being no further business, the meeting adjourned at 9 :30 P.M.
