The regular meeting of the Tukwila City Council was called to order by
Mayor Stan D. Minkler at 8 :00 P.M. The following Council members were in
attendance: R. A. Bowen, D. R. Gardner, J. R. Johanson, G. D. Hill,
P. F. Dunning and A. G. Radford.
Mr. Bowen made a motion the absence of Councilman L. E. Crostick be
excused. Motion seconded by Mr. Dunning and carried.
Minutes of the previous meeting were approved.
CONTINUATION OF PUBLIC HEARING LID 13 and LID 15
Mayor Minkler reconvened the Public Hearing on the Final Assessment Rolls
for LID 13 and LID 15. Mr. Bob Hawkins, Consulting Engineer, pointed out
the boundaries of the two LIDs and explained the purpose of the projects.
Mr. Marvin Boys of Southcenter Corporation requested explanation as to
determination of the LID boundaries.
Mr. Hodge, City Attoreny, presented a copy of a letter dated March 2, 1970
which he had sent to Mr. James P. Curran, attorney representing the
Makami interests, indicating the City's willingness to resolve certain
unfinished construction items set forth by the Makamis in their letter
of February 5th.
Mr. Hodge further reported the agreement had been reached on the
Schoenbachler property and a signed agreement would be forthcoming.
There being no protests presented at this time, Mr. Johanson made a
motion the Public Hearing be closed. Motion seconded by Mr. Hill and
carried.
Mr. Hawkins reported an earlier protest from Mrs. Paul Joientz had been
discussed with Mrs. Joientz and she was satisfied with the explanation
of costs.
Mr. Hill made a motion to overrule the protest received and direct the
bond attorney to prepare the ordinance in accordance with the assessment
roll as mailed. Motion seconded by Mr. Dunning and carried.
PUBLIC HEARING OLYMPIC PIPE LINE FRANCHISE AMENDMENT
Mayor Minkler opened the Public Hearing on the amendment to Ordinance 496
granting Olympic Pipe Line Company a franchise for a pipe line through
the City of Tukwila, The amendment was due to a request for a change in
the location of the pipe line.
Mr. Hodge presented a proposed ordinance amending Ordinance No. 496,
granting certain franchise rights to Olympic Pipe Line Company.. Mr. Hill
made a motion the proposed ordinance be placed on its first reading.
Motion seconded by Mr. Bowen and carried. Mr. Hodge read the proposed
ordinance explaining the sections to be amended.
Mr. Stanley Kasperson, 1103 Norton Building, representing Samamish
Commercial and River's Bend developers, spoke protesting the proposed
location of the pipe line. He questioned the legality of placing the
proposed pipe line in the utility easement area, stating the present
easement corridors are over burdened and mechanical problems could
arise. He also raised the question of the posibility of an increase in
insurance rates for buildings adjacent to the pipe line area.
Mr. Jerry Durbin spoke for Olympic Pipe Line Company, stating their
original proposal was to lay the line within the City street right of
way, but the utility corridor seemed more feasible. There is presently
a 16" Washington Natural Gas transmission line within the corridor.
Mr. Kasperson stated utility corridors should be used for utilities that
are to serve adjacent properties and the streets are heavily traveled
and should not be torn up.
Mr. Durbin explained the Port of Seattle was currently faced with
traffic congestion problems at the air port since they must truck in
jet fuel. It taked 80 -86 trucks per day presently and in 10 years the
traffic will double. The original plans had called for the tank farm
to be located on the North end of the field but since plans have been
changed allowing for location of the tank farm on the South end of the
field, the transmission lines must be located accordingly.

William E. Boeing, Jr. protested the location of the proposed line,
stating there was already a large gas line and now with a propesed jet
fuel line there could be an insurance problem. He further stated the
location of this line could cause requirements for set backs of buildings
in ah' area where set backs are not now required.
Mr. Durbin replied he was not aware of any increase in insurance rates due
to installation of lines. Olympic currently has lines in other cities
which traverse congested areas and there are no known insurance problems./
Mr. Jack Link of Tri Land Developers protested the location of the fuel
line stating there were already four utilities located in the corridor.
He reported the Washington Utilities Commission was considering rules
as to how close together gas and fuel lines should be located.
Mario Segale, 18010 Southcenter Parkway, stated he was vigorously opposed
to the pipe line. He stated it would impare and increase the cost of
future development in the area. When construction is necessary in an
area where a fuel line is located construction costs rise. He further
stated easements must be used for utilities beneficial to the general
public.
Iry Iverson of Samamish Commercial questioned if the location of the
water line on Sperry Drive and the bridge area had been taken into
consideration.
Jack Link stated concern by property owners, restriction to development,
lessening of property values should be of concern to the City Council.
Mr. Charles 0. Baker, Tukwila Industrial Council stated the developers
have worked on a good development, now they are asking Council consideratio]
to help them complete the development. Set backs may be necessary
where not formerly required and there was also the danger involved in
location adjacent to a jet fuel line.
Mr. Durbin stated there was room to place the line in the utility corridor
without interference with present facilities or future facilities as
currently forseen. Olympic would be responsible for the relocation of
any pipe line due to construction. Relocation would be at the sole
expense of Dlympic Pipe Line Company.
Mr. Marvin Boys of Southcenter Corporation also expressed concern at the
pipe line going through the city.
Mr. Hodge stated he felt the following seven items were questions for
Council consideration brought forth by the discussion at this Public
Hearing:
1. Will there be insurance rating problems?
2. Will set backs be required due to the location of the line?
3. Is Olympic Pipe Line a utility?
4. Is the utility corridor legaly available to Olympic Pipe Line?
5. If the utility corridor is legaly available, is it over burdened or
will there be conflicting uses?
6. Assuming the corridor is not available, should we use City Streets?
7. Is the fee appropriate in light of the present developments?
Mayor Minkler requested all persons present to submit any information
available to assist the council in their determinations.
Mr. Bowen made a motion the Public Hearing be closed. Motion seconded
by Mr. Gardner and carried.
Mayor Minkler turned the matter over to the License Committee for further
study and a report back to the Council.
PUBLIC NUSIANCE GARBAGE PROBLEM
A letter was received from Mr. Frank Zepp, City Supervisor, requesting
permission from the Council to proceed with abatement proceedings if a
garbage problem is not cleared up by Mr. Hemmerling within a 10 day period.
Mr. Gardner made a motion if Mr. Hemmerling does not take care of the
matter, Mr. Zepp be authorized to proceed with abatement proceedings.
Motion seconded by Mr. Dunning and carried.
CURRENT CLAIMS
Mr. Bowen made a motion claims approved by the Finance Committee be paid
with warrants drawn in their respective amounts. Motion seconded by
Mr. Gardner and carried. Following the claims:

WATER W/S CONST.
SEWER LID 11
ARTERIAL STREET
SEWER CONNECTION ORDINANCE.
Mayor Minkler announced the Sewer Connection Ordinance would be ready
for its final reading at the March 16th meeting.
BUILDING PERMITS
Mr. Zepp reported 9 permits had been issued for the month of February
with a valuation of $310,775 and permit fees of $757.50.
There being no further business, Mr. Bowen moved the meeting be adjourned.
