The regular meeting of the Tukwila City Council was called to order by
Mayor Stan D. Minkler at 8:00 P. M. The following Council members were
in attendance: R. A. Bowen, D. R. Gardner, L. E. Crostick, J. R. Johanson,
G. D. Hill, P. F. Dunning and A. G. Radford.
The minutes of the previous meeting were approved.
CIVIL AIR PATROL:
Mayor Minkler introduced Capt. Whitney of the Tukwila Squadron, Civil Air
Patrol who presented Capt. Russell and members of the Tukwila Squadron.
Mayor Minkler congratulated the members and staff of the squadron on their
receiving of a trophy at the recent Annual Wing Conference.
OLYMPIC PIPE COMPANY FRANCHISE
The Olympic Pipe Line Company's request for a franchise within the City of
Tukwila was discussed. Mayor Minkler expressed thanks to those who had
brought forth the necessary details for Council study into this question.
Mr. Dunning requested a legal opinion from the City Attorney as to whether
Olympic Pipe Line Company was a public utility and, if so, do they have
the right to use the utility easement corridor for installation of their line.
Mr. Hodge reported by statutory definition Olympic Pipe Line Company was a
public utility citing a Skagit County Superior Court ruling which granted
them the right of eminent domain. As to their right to use the utility
corridor, Mr. Hodge stated the utility easements conveyed the right to use
the easements for utilities and since Olympic Pipe Line Company is a utility
they could be granted this right.
The question was raised as to whether the 15 foot easement was large enough
to put in the pipe line. Mr. Fukiki answered the easement was large enough
but he had some reservations as to cooperation between utilities. He
recommended the City retain the right to request relocation of the pipe
line if necessary at Olympic Pipe Line Company's expense.
It was further specified any request, for moving of the line should specify
a time limit for accomplishing the moving and set forth penalties for any
unnecessary delay.
Mr. Crostick asked the minimum and maximum gallonage that would go through
the line. Mr. Durbin replied there would be 16,000 barrels per day average
in 1970 and 30,000 barrels per day average by 1980. The line would be in
operation 10 hours each 36 hour cycle.
Mr. Bowen asked Fire Chief Boulanger what knowledge the Fire Department
would have to have as to the operation. Mr. Boulanger replied the Fire
Department would have to know when the line was in operation. This would
be an added burden on the Department.
Mr. Durbin stated Olympic Pipe Line Company would issue a published
schedule of operation to the Fire and Police Chiefs.
Mr. Bowen stated something should be spelled out to protect the property
owners if they would have to use the utility easement for their purposed.
Olympic Pipe Line Company should have to stand the costs of all relocation
and the fee rate should be increased.
It was further established Olympic Pipe Line Company would have to reimburse
the City for any out of pocket expense caused by installation and constructior
of the line such as engineering costs.
Mr. Crostick stated in order to justify the granting of the franchise the
following conditions should be included:
1. 1 per barrel franchise fee
2. 1 12 3/4 inch line would be allowed with no above ground pertinents
3. a preventive maintenance program would be scheduled
4. the franchise be granted for a 25 year period/
5. Olympic Pipe line Company will respond to any request to riove the line
or relocate it with no undue delay.
Mr. Durbin stated the 1/$¢ per barrel would be about $7,300. per year and
sou tded like an unreasonable figure. Mr. Crostick pointed out he pipe
line would be of no direct benefit to the City, yet would take up part of
the utility easement so the City should receive some renumeration.
Mr. Dunning made a motion the Council instruct the City Attorney to draft
an ordinance amending the original franchise ordinance incorporating the
details spelled out in the discussion. Motion was seconded by Mr. Bowen
and carried.

APPROVAL OF CLAIMS
Mr. Bowen made a motion claims approved by the Finance Committee be paid
with warrants drawn in their respective amounts. Motion seconded by Mr.
Gardner and carried.

CALL FOR BID RESTROOM FACILITIES
Mayor Minkler reported the City was ready to call for bids on construction
of the new restroom facilities for the park. Mr. Crostick made a motion the
clerk be instructed to call for bids for construction of restroom facilities
in the park with bids to be opened App °il 29th at 5:00 P.M. Motion seconded
by Mr. Johanson and carried.
CALL FOR BIDS STREET WATER EQUIPMENT
Mayor Minkler reported the City would have to call for bids for the street
and water department trucks since the county or state could not fulfill the
city's request. Mr. Bowen made a motion bids be called for two trucks with
bids to be opened April 24th at 2:0C P.M. Motion seconded by Mr. Hill and
carried.
1970 POPULATION CENSUS
Mayor Minkler read a letter of thanks to Mr. Mrs. Frank Kreidler for the
fine job they did in taking the 1970 population census for the City of
Tukwila. The population if now 3081.
FIRE MARSHALL COMMENDATION
Mayor Minkler also commended Hubert Crawley, Fire Marshall, for his fine
work.
RESOLUTION 242 MUTUAL AID AGREEMENTS
A proposed resolution was presented authorizing the Mayor to enter into
mutual aid agreements with other govermental bodies. Mr. Dunning made a
motion the proposed resolution be read for adoption. Motion seconded by
Mr. Johanson and carried. This being Resolution No. 242
ORDINANCE 612 ESTABLISHING A 40 M.P.H. SPEED LIMIT ON INTERURBAN
A proposed ordinance establishing a 40 M ?P.H. speed limit on Interurban
Avenue South was introduced. Mr. Hill made: a motion the proposed ordinance
be placed on its first reading. Motion seconded by Mr. Bowen and carried.
Mr. Johanson made a motion the proposed ordinance be placed on its second
reading by title only. Motion seconded by Mr. Hill and carried. Mr. Hill
made a motion the proposed ordinance be placed on its third and final
reading for adoption, by title only. Motion seconded by Mr. Bowen and
carried. This being Ordinance 612.
ORDINANCE 613 REGULATING SAUNA BATHS
A proposed ordinance regulating and licensing massage parlors and public
bath houses within the city of Tukwila was introduced. Mr. Gardner made
a motion the proposed ordinance be placed on its first reading by title
only. Motion seconded by Mr. Bowen and carried. Mr. Dunning made a motion
the proposed ordinance be placed on its second reading. Motion seconded
by Mr. Hill and carried. Mr. Bowen made a motion the proposed ordinance be
placed on its third and final reading for adoption by title only. Motion
seconded by Mr. Gardner and carried. This being Ordinance 613.
ORDINANCE 614 ESTABLISHING A REVOLVING FUND FOR TRAVEL EXPENSES
A proposed ordinance establishing a revolving fund for advance payment of
travel expenses to officials and employees of the City of Tukwila was .01
introduced. Mr. Dunning made a motion the proposed ordinance be placed on
its first reading. Motion seconded by Mr. Johanson and carried. Mr. Johansor
made a motion the proposed ordinance be placed on its second reading by
title only. Motion seconded by Mr. Hill and carried. Mr. Hill made a
motion the proposed ordinance be placed on its third and final reading for
adoption, by title only. Motion seconded by Mr. Dunning and carried. This
being Ordinance 614.
ORDINANCE 615 AMENDING ORD. 503 RELATING TO INTEREST RATES FOR LID 13
A propesed ordinance amending Ordinance No. 503 of the City of Tukwila
relating to interest rates for L. I. D. NO. 13 was introduced. Mr. Dunning
made a motion the proposed ordinance be placed on its first reading. Motion
seconded by Mr. Hill and carried. Mr. Gardner made a motion the proposed
ordinance be placed on its second reading. Motion seconded by Mr. Bowen
and carried. Mr. Johanson made a motion the proposed ordinance be placed
on its third and final reading for adoption, by title only. Motion seconded
by Mr. Hill and carried. This being Ordinance 615.

ORDINANCE 616 AMENDING ORD 515 RELATING TO INTEREST RATES FOR LID 15
A proposed ordinance amending Ordinance No. 515 of the City of Tukwila
relating to interest rates for L.I.D. No. 15 was introduced. Mr. Hill
made a motion the proposed ordinance be placed on its first reading. Motion
seconded by Mr. Dunning and carried. Mr. Johanson made a motion the
proposed ordinance be placed on its second reading by title only. Motion
seconded by Mr. Hill and carried. Mr. Gardner made a motion the proposed
ordinance be placed on its third and final reading for adoption, by title
only. Motion seconded by Mr. Dunning and carried. This being Ord. 616.
BUILDING PERMIT REPORT FOR MARCH
Mr. Zepp reported two permits had been issued during the month of March
with a valuation of $35,500. and permit fees of $119.
MEETING HOME OWNERS ABUTTING 58th AVENUE
Mayor Minkler announced a meeting would be held April 22nd for home owners
abutting 58th Avenue South to discuss the first phase of street construction
The meeting will be at 7:30.
CORRECTION TO ORDINANCE 612
Mr. Dunning made a motion seconded by Mr. Hill that the record show, in
the preamble of Ordinance 612 the following words be deleted: and placing
barrier stripes Motion carried.
There being no further business the meeting adjourned at 10:10 P.M.
