On January 6, 2016, the applicant submitted an application for Special Permission from the Director to temporarily place one cargo container at 6841 South 180th Street, Vietnamese Martyrs Parish. 2. The Vietnamese Martyrs Parish property is zoned Tukwila Urban Center — Workplace District (TUC — WP), with a Shoreline overlay. Tukwila Municipal Code (TMC) 18.28.030 permits cargo containers as an accessory use in the TUC — WP zone provided they obtain special permission from the Director and meet the requirements of TMC 18.50.060. The Shoreline overlay requires a 125' buffer from the Ordinary High Water Mark (OHWM) for the leveed portions of the Green River. 3. TMC 18.50.060 (C) notes the following requirements in order to place a cargo container in the TUC-WP zone: A. Only two cargo containers will be allowed per lot, maximum length of 40 feet. B. The container is located to minimize visual impact to adjacent properties, parks, trails and right-of-way as determined by the Director. C. The cargo container is sufficiently screened from adjacent properties, parks, trails and rights -of -way, as determined by the Director. Screening may be a combination of solid fencing, landscaping, or the placement of the cargo containers behind, between or within buildings. D. If located adjacent to a building, the cargo container must be painted to match the building's color. E. Cargo containers may not occupy any required off-street parking spaces. F. Cargo containers shall meet all setback requirements for the zone. Outdoor cargo containers may not be refrigerated. H. Outdoor cargo containers may not be stacked. 4. The application materials submitted to the City included a site plan showing the proposed cargo container on the southern corner of the property. The container is proposed for only 2-3 months in a year. In 2016 the container is temporarily proposed at the location on Exhibit A. Starting in 2017 the container shall be situated at the indicated location on Exhibit D. The proposed location meets TUC — WP setback requirements and the location provides screening from existing landscaping. DISCUSSION It is the burden of any individual seeking land use approval to clearly demonstrate that: they can meet application requirements before having the application issued. The applicant has met this burden. The applicant provided a site plan that clearly demonstrates the proposed cargo container location and how it meets length, setback, and screening requirements. The applicant has also committed to provide additional screening with the placement of 5' potted plants (Thuja Occidentalis) and to paint the cargo container the same color as the adjacent building. The proposed cargo container will occupy three on -site parking stalls. The property must provide 238 parking stalls pursuant to TMC 18.28.080 off-street parking standard and currently provides 241 parking stalls. The three occupied stalls will bring the total provided to 238, still meeting the parking requirement. The applicant intends to place the cargo container on site annually between January and March. In 2017, the applicant agrees to move the cargo container to a revised area to comply with shoreline buffer requirements. The container will not be refrigerated, will not be stacked, and is not located in an off-street parking space, thus meeting code provisions as outlined in TMC 18.50.060. The application to locate one 40 foot container is accepted with the following conditions: 1. Applicant shall obtain a building permit prior to the placement of the container on the site. A building permit has been applied for the temporary location for this year. A new building permit is required for the permanent location starting in 2017. 2. Applicant shall schedule a planning inspection after the temporary and permanent installation. The application to locate one 40 foot container is accepted. This container may be placed. APPEALS This Notice of Decision may be appealed to the Hearing Examiner. If there are no valid appeals filed within the time limit the decision of the Department will be final. In order to appeal the decision, a written notice of appeal must be filed with the Department of Community Development within fourteen days of the issuance of the Notice of Decision (2013). The requirements for such appeal are set forth in the Tukwila Municipal Code 18.116. Appeal materials shall include: 1. The name of the appealing party. 2. The address and phone number of the appealing party; and if the appealing party is a corporation, association or other group, the address and phone number of a contact person authorized to receive notices on the appealing party's behalf. A statement identifying the decision being appealed and the alleged errors in that decision. The scope of an appeal shall be limited to matter or issues raised in the Notice of Appeal. Any appeal shall be conducted as an open record hearing before the Hearing Examiner. The Hearing Examiner's decision on the appeal is the City's final decision. A party who is not satisfied with the outcome of the administrative appeal process may file an appeal in King County Superior Court from the Hearing Examiner's decision pursuant to the procedures and time limitations set forth in RCW Chapter 36.70C. Hight, MCP Per the discussion during our last meeting on August 11, 2015, the Vietnamese Martyrs Parish is asking your assistance to prepare the ethnic food in celebration of the next coming Lunar New Year. We propose a shipping container as a shelter to prepare the "Banh Chung" ethnic food as follow: 1. The cooking activity will last from January through March annually. 2. Food preparation will be in the existing kitchen, inspected and approved by King County Health Department. 3. There will be ten VulcanVSP 100 kBTU, 2 Ring Burner appliances inside the cooking shelter. Each day, starting around 5 PM, these burners will be loaded with 55 gallons barrels which contain the rice cake (Banh Chung) and boiled overnight. There will be three attendants each night to watch the flame and ensure sufficient boiling water in each barrel to prevent fire hazard. One person will inspect the cooking barrel while the other two stay alert to assist. They will stay in the existing building and check the cooking shelter once each hour. 4. To prevent the heat build-up inside the cooking trailer, in addition to the attached ventilation plan, the three access doors will be open to serve as supply air, also allowing the attendant to check the flame and heat prior enter the shelter to check the boiling water barrel. 5. After each shift, the rice cakes are removed, cooled, and move back into the main kitchen for final wrapping and refrigerate and finally distribute among church members to be consume at their own residence as part of Lunar New Year celebration. As you may already be aware, we have used the same method last year and also many prior years at our previous location In Seattle without incident. Provide Type 11 hood plans (with exhaust calculations) Per our conversation, since the container is a steel, non-combustible structure it is. itself acting as a Type II hood, the exhaust calculations are included on the attached drawing. 3. Provide hood exhaust clearances to building/intakes There are no operable windows, doors or mechanical intakes within 4. Makeup air to be sized same as exhaust hood A note stipulating that the overhead doors will be in an open position whenever there is cooking and the exhaust fans are on has been added to the attached drawing. 5. Gas pipe sizing (1,100,000 btu's) from unit to gas meter Gas pipe sizing and demand calculations are included on the attached drawings. 6. Electrical panel and wiring plan An electrical permit will be obtained for the power associated with lighting and the exhaust fans. A preliminary diagram is attached for your consideration.. 7. Cargo manufacture manual/listing indicating acceptable cooking appliance installations have contacted two cargo manufacturers and there is no specific listing for cooking appliance installations. However, they did note that the City of Tukwila has already approved the use of a cargo container as a restaurant / cooking facility at the Starbucks located at 10100 East Marginal Way. I am not sure given the temporary nature of the intended use and the fact that we are talking about a pre - manufactured structure what else we can do to alleviate your concern. Also attached is a letter from the parish outlining the temporary use of the facility, cooking methods and a detailed description of the use. Please let me know if you have questions or concerns.
