YOUR APPEAL RIGHTS The Decision on this Permit Application is a Type I decision pursuant to Tukwila Municipal Code § 18.104.010. Other land use applications related to this project may still be pending. No administrative appeal of a DNS or an EIS is permitted. One administrative appeal to the Hearing Examiner of the Decision on the Permit itself is permitted. If an MDNS was issued, any person wishing to challenge either the conditions which were imposed by the MDNS decision or the failure of the Department to impose additional conditions in the MDNS must raise such issues as part of the appeal to the Hearing Examiner. A party who is not satisfied with the outcome of the administrative appeal process may file an appeal in King County Superior Court from the Hearing Examiner decision. IV. PROCEDURES AND TIME FOR APPEALING In order to appeal the Community Development Director's decision on the Permit Application, a written notice of appeal must be filed with the Department of Community Development within 14-days of the issuance of this Decision, which is by April 26, 2016. The requirements for such appeals are set forth in Tukwila Municipal Code 18.116. All appeal materials shall be submitted to the Department of Community Development. Appeal materials MUST include: 1. The name of the appealing party. 2. The address and phone number of the appealing party; and if the appealing party is a corporation, association or other group, the address and phone number of a contact person authorized to receive notices on the appealing party's behalf. 3. A statement identifying the decision being appealed and the alleged errors in the decision, including any specific challenge to an MDNS. 4. The Notice of Appeal shall identify (a) the specific errors of fact or errors in application of the law in the decision being appealed; (b) the harm suffered or anticipated by the appellant, and (c) the relief sought. The scope of an appeal shall be limited to matters or issues raised in the Notice of Appeal. 5. Appeal fee per the current fee schedule, additional hourly charges may apply. In addition all hearing examiner costs will be passed through to the appellant. V. APPEAL HEARINGS PROCESS Any administrative appeal regarding the Permit shall be conducted as an open record hearing before the Hearing Examiner based on the testimony and documentary evidence presented at the open record hearing. The Hearing Examiner decision on the appeal is the City's final decision. Any party wishing to challenge the Hearing Examiner decision on this application must file an appeal pursuant to the procedures and time limitations set forth in RCW 36.70C. An appeal challenging a DNS, an MDNS or an EIS may be included in such an appeal. If no appeal of the Hearing Examiner decision is properly filed in Superior Court within such time limit, the Decision on this permit will be final. The project includes: • Replacement of three (3) panel antennas • Addition of three (3) FRLB units on an existing monopole • Addition of two (2) FBBC sub -module within an existing cabinet Existing Development The existing building is located within the Avis Rent -a -Car property, which is within a commercial area. Surrounding Land Uses The property is separated from an area zoned Urban High Density Residential to the south by S 160`' Street, which is outside of the city limits (within Sea Tac). The parcel to the west (across Tukwila International Blvd. and in the City of Sea Tac) is an air cargo and hangers facility, owned by Sea-Tac International Airport (in an area zoned Community Business Urban Center). The parcel immediately adjacent to the east is a shuttle parking lot for the airport and is also zoned Regional Commercial. WA-518 West abuts the property to the north. Background In 2006, the City adopted a Wireless Facilities Chapter (TMC 18.71) to the Zoning Code. The chapter provides specific location and design requirements for the placement of WCF within the City of Tukwila. Location Selection Tukwila Municipal Code (TMC) provides a hierarchy of appropriate locations within the City. Generally, co -locations and utilizinc existing structures are favored over the development of new standalone WCF within the City. This decision does not require the use of any new facilities for placement of the new antennas. The height of the three (3) proposed replacement antennas is 100', which is the same height as the existing antennas. The proposed modifications are considered a Type I decision as replacement antennas and new FRLB units are proposed to be mounted on an existing tower and the associated equipment is proposed to be located within an existing facility in a commercial zone. The height of the tower (95.5') is not proposed to increase. Design Standards The City provides specific design standards for the placement of WCF within the City of Tukwila. The table below indicates if the applicant's proposal complies with required standards. X No new buildings or structures are proposed; a small radio unit will be placed inside an existing cabinet. 7. Antennas shall have the same color scheme as the structure they are located on. X New antennas, feed lines, and cables will be painted to match existing equipment. 8. WCF poles and towers shall only have safety lights if required by a government agency. X No new lighting is proposed. 9. No advertising is permitted on WCF X No advertising is proposed. 10. Each service provider shall be limited to an equipment enclosure of 360 square feet. If the applicant wishes to expand the equipment enclosure from what was approved by the City or County under the previous application, the applicant shall seek a wireless communication facility (Type 2) application for only the equipment enclosure increase. X No expansion of equipment enclosures is proposed. Setbacks shall not apply when an applicant installs new antennas on an existing tower and uses an existing equipment enclosure. As demonstrated in Tables 1 and 2, the project meets all applicable development standards for a Type I WCF. 2. The proposed modifications will not alter the surrounding land uses in terms of traffic and pedestrian circulation, building or site design. 3. The proposed project is in keeping with the goals and policies of the Comprehensive Land Use Policy Plan. RECOMMENDATIONS The recommendation to the Planning Manager of the Department of Community Development is to approve this application for a Type I Wireless Telecommunication Facility permit as applied for by Crown Castle on behalf of T- Mobile without conditions. It has 12 sides and is evenly tapered from 37.001" (flat -flat) at the base to 12.000" (flat -flat) at the top. The structure is galvanized and has no tower lighting. This tower is a 95.5 ft Monopole tower designed by FWT INC. in October of 1996. If the existing conditions are not as represented on the tower elevation contained in this report, we should be contacted immediately to evaluate the significance of the discrepancy. This is not a condition assessment of the tower or foundation. This report does not replace a full tower inspection. The tower and foundations are assumed to have been properly fabricated, erected, maintained, in good condition, twist free, and plumb. The engineering services rendered by GPD in connection with this Structural Analysis are limited to a computer analysis of the tower structure and theoretical capacity of its main structural members. No allowance was made for any damaged, bent, missing, loose, or rusted members (above and below ground). No allowance was made for loose bolts or cracked welds. This analysis is limited to the designated maximum wind and seismic conditions per the governing tower standards and code. Wind forces resulting in tower vibrations near the structure's resonant frequencies were not considered in this analysis and are outside the scope of this analysis. Lateral loading from any dynamic response was not evaluated under a time -domain based fatigue analysis. GPD does not analyze the fabrication of the structure (including welding). It is not possible to have all the very detailed information needed to perform a thorough analysis of every structural sub -component and connection of an existing tower. GPD provides a limited scope of service in that we cannot verify the adequacy of every weld, plate connection detail, etc. The purpose of this report is to assess the capability of adding appurtenances usually accompanied by transmission lines to the structure. It is the owner's responsibility to determine the amount of ice accumulation in excess of the code specified amount, if any, that should be considered in the structural analysis. The attached sketches are a schematic representation of the analyzed tower. If any material is fabricated from these sketches, the contractor shall be responsible for field verifying the existing conditions, proper fit, and clearance in the field. Any mentions of structural modifications are reasonable estimates and should not be used as a precise construction document. Precise modification drawings are obtainable from GPD, but are beyond the scope of this report. Miscellaneous items such as antenna mounts, etc., have not been designed or detailed as a part of our work. We recommend that material of adequate size and strength be purchased from a reputable tower manufacturer. Towers are designed to carry gravity, wind, and ice loads. All members, legs, diagonals, struts, and redundant members provide structural stability to the tower with little redundancy. Absence or removal of a member can trigger catastrophic failure unless a substitute is provided before any removal. Legs carry axial loads and derive their strength from shorter unbraced lengths by the presence of redundant members and their connection to the diagonals with bolts or welds. If the bolts or welds are removed without providing any substitute to the frame, the leg is subjected to a higher unbraced length that immediately reduces its load carrying capacity. If a diagonal is also removed in addition to the connection, the unbraced length of the leg is greatly increased, jeopardizing its load carrying capacity. Failure of one leg can result in a tower collapse because there is no redundancy. Redundant members and diagonals are critical to the stability of the tower. GPD makes no warranties, expressed and/or implied, in connection with this report and disclaims any liability arising from material, fabrication, and erection of this tower. GPD will not be responsible whatsoever for, or on account of, consequential or incidental damages sustained by any person, firm, or organization as a result of any data or conclusions contained in this report.
