Dear Mr. Follansbee,
The Short Subdivision Committee has completed review of your boundary line adjustment (BLA) in the Clarion
business park (L16-0008), and determined that it complies with all applicable City code requirements. This boundary
line adjustment and lot consolidation application is categorically exempt from SEPA threshold determination,
pursuant to WAC 197-11-800.
This letter serves as the Notice of Decision per TMC 18.104.170. Based on the latest project submittal, preliminary
approval is granted subject to the conditions stated below. The conditions imposed are to ensure the boundary line
adjustment and lot consolidation are consistent with the Criteria for Preliminary Approval listed at TMC 17.12.020 C
in the Tukwila Subdivision Code.
PRELIMINARY APPROVAL CONDITIONS
Prior to Final Approval, the following comments need to be addressed:
1. Revise the Survey Site Map to address the following:
a. Add permit number (L16-0008) to the map.
b. Add the recording number for the 5.4' Ingress/Egress Easement shown on Survey Site Map
Sheet 3 of 4.
2. Provide a copy of 60' Ingress, Egress & Utilities Easement Rec. No. 8609081152.
3. Provide a copy of the recorded 5.4' Ingress/Egress Easement.
NEXT STEPS:
1. Final Approval: Submit documents for final approval. After complying with the conditions of approval,
submit the necessary boundary line adjustment and lot consolidation documents (survey, legal
descriptions, and other required paper work) for City signatures. All taxes and fees assessed against the
property must be current prior to final approval. Please check with the King County Assessor's Office
and the City of Tukwila Finance Department prior to submitting final documents. After the documents
have been found to be in order, and all of the requirements of the boundary line adjustment and lot
consolidation have been met, the Chair of the Short Subdivision Committee signs your boundary line
adjustment and lot consolidation survey site map which constitutes a grant of final approval.

2. Recording: The signature of the Chairman of the Short Subdivision Committee certifies that your boundary
line adjustment and lot consolidation application is ready for recording. It is your responsibility to record
the City approved boundary line adjustment and lot consolidation documents with the King County
Department of Records. You will need to pay the recording fees and submit your approved original
boundary line adjustment and lot consolidation survey site map to King County. The boundary line
adjustment and lot consolidation is not complete until the recording occurs and copies of the recorded
documents are provided to the Department of Community Development. The building permits on these
properties may not be issued until a copy of the recorded boundary line adjustment and lot consolidation
(or original) is returned to the Department of Community Development.
EXPIRATION OF PRELIMINARY APPROVAL
The final approved boundary line adjustment and lot consolidation must be filed with the King County Department of
Records within one year from the date of this preliminary approval or the application will expire. The City may grant
a single one year extension if requested in writing prior to the expiration date.
APPEAL RIGHTS
This boundary line adjustment and lot consolidation approval decision may be appealed to the Hearing Examiner.
One administrative appeal of the decision on the boundary line adjustment and lot consolidation, excluding
challenges to the DNS, is permitted. If no valid appeals are filed within the time limit, the decision of the Department
will be final.
In order to appeal the decision a written notice of appeal must be filed with the Department of Community
Development within 21 days of the issuance of the Notice of Decision. The requirements for such appeals are set
forth in Tukwila Municipal Code 18.116.
Appeal materials shall include:
1. The name of the appealing party.
2. The address and phone number of the appealing party; and if the appealing party is a corporation, association
or other group, the address and phone number of a contact person authorized to receive notices on the
appealing party's behalf.
3. A statement identifying the decision being appealed and the alleged errors in the decision, including any
specific challenge to an MDNS.
4. The Notice of Appeal shall identify (a) the specific errors of fact or errors in application of the law in the
decision being appealed; (b) the harm suffered or anticipated by the appellant, and (c) the relief sought.
The scope of an appeal shall be limited to matters or issues raised in the Notice of Appeal.
S. Appeal fee per the current fee schedule, additional hourly charges may apply. In addition all hearing
examiner costs will be passed through to the appellant.

Any appeal shall be conducted as an open record hearing before the Hearing Examiner. The Hearing Examiner's
decision on the appeal is the City's final decision. A party who is not satisfied with the outcome of the
administrative appeal process may file an appeal in King County Superior Court from the Hearing Examiner's
decision pursuant to the procedures and time limitations set forth in RCW 36.70C. An appeal challenging a DNS,
an MDNS or an EIS may be included in such an appeal.

Dear Mr. Follansbee:
Your application for a Type 2 Boundary Line Adjustment was deemed complete on February 29, 2016. Pursuant
to Tukwila Municipal Code 18.104.070(F), the fact that an application is deemed complete shall not prevent the
City from subsequently requesting additional information or studies regarding any aspect of a proposed project
which is deemed necessary to a complete review of the proposed project.
Technical review has been conducted. Departmental comments are listed below along with reviewer contact

1. Revise the survey site map to show "no build" setbacks. The revised property lines shall identify setback
or "no build" setback from existing buildings, where the setbacks meet current building codes to comply
with required setback for the type fire resistance ratings of the existing buildings. Type of building
construction of existing buildings with calculated height and areas shall determine where those property
lines shall be allowed. See attached.
Please submit your revisions at your earliest convenience. The revision submittal form is attached. Revision
submittals must be submitted in person at the Permit Center, 6300 Southcenter Boulevard, Suite 100, Tukwila,

THIS DECLARATION QF INGRESS- GRESS AND UTILITIES EASEMENT
("Agreement") is made this f day of I y , 2016, by LIT INDUSTRIAL
LIMITED PARTNERSHIP, a Delaware limited partnership ("Declarant").
RECITALS
M
A. Declarant is the owner of "New Parcel E" of the City of Tukwila Boundary
Line Adjustment No. L 15-0005, as recorded under Recording Number 20150318900001,
Records of King County, Washington ("Property"). The Property includes a sixty -foot private
roadway along its east boundary known as the "Segale Park Drive A" (the"Drive").
B. Declarant proposes to complete a boundary line adjustment of the Property
which will create the parcel legally described in Exhibit A ("Benefitted Property") as a
separate legal lot.
C. A strip of land is located between the Benefitted Property and the Drive, and
the Benefitted Property will require an easement over said strip for access to the Drive.
D. As used herein, "Remainder Property" means the Property excluding the
Benefitted Property, "Grantor" means Declarant in its capacity as owner of the Easement Area

and the Remainder Property, and "Grantee" means Declarant in its capacity as owner of the
Benefitted Property, and
AGREEMENTS
NOW, THEREFORE, Declarant declares and agrees, on behalf of its successors and
assigns, as follows:
1. Declaration of Easement for Ingress and Egress. Grantor hereby declares, reserves,
grants and conveys a perpetual, nonexclusive easement appurtenant to the Benefitted Property
for the purposes of vehicular and pedestrian ingress and egress over, upon and across that
portion of the Remainder Property legally described in Exhibit B attached hereto and depicted
on Exhibit C attached hereto (the "Easement Area"). Grantee's right to use the Easement
Area includes the right for Grantee, its successors and assigns, licensees, invitees, tenants,
agents, contractors and employees ("Permitted Users") to use the Easement Area for ingress
and egress to and from the Benefitted Property and the Drive. The Permitted Users shall not
park in the Easement Area. Grantee shall not have the right to construct or install
improvements or landscaping within the Easement Area, except for underground utilities
pursuant to Section 2 below, nor shall the Permitted Users have the right to use the Easement
Area for any purpose other than as set forth above.
2. Declaration of Easement for Utilities. Grantor hereby declares, reserves, grants
and conveys a perpetual, nonexclusive easement appurtenant to the Benefitted Property for
purposes of operating underground utilities in and under the Easement Area. Grantee may
also install, maintain and repair underground utilities within the Easement Area provided that
(i) such installation and maintenance shall not interfere with Grantor's use of the Remainder
Property, and (ii) Grantee shall first obtain Grantor's written consent to the plans and schedule
for utility work within the Easement Area, such consent not to be unreasonably withheld,
delayed or conditioned by Grantor.
3. No Dedication to the Public. Nothing contained herein shall be deemed to be a
gift or dedication of any portion of the Easement Area to the general public or for the general
public or for any public uses whatsoever other than those specifically granted herein, it being
the intention of Declarant that the Easements granted herein shall be strictly limited to and for
the purposes herein expressed.
4. Notices. Any notice, request, approval, consent, demand, or other
communication required or permitted to be given by any party to the other hereunder shall be
in writing and addressed to the other party at its address for property tax notices pursuant to
applicable King County records or at such other address as such party shall have last
designated by notice to the other and shall be deemed to have been duly given when delivered
personally or one (1) business day after deposit with reputable overnight courier or three (3)
days after deposit as prepaid certified mail (return receipt requested) with the United States
Postal Service.

5. Reservation. Grantor, as owner of the Remainder Property, reserves the right
to use the Easement Area for any and all purposes (including granting additional easements
and usage rights) which do not materially interfere with Grantee's use of the Easement Area
for the purposes stated herein and are not otherwise inconsistent with the rights herein
contained.
6. Attorneys' Fees. In the event either party employs an attorney to enforce or
interpret any of the provisions of this Agreement, the prevailing party shall be entitled to
recover its costs and reasonable attorneys' fees in connection with such action.
7. Assignment; Binding Effect. The Easements hereby granted and the conditions
herein contained shall be a covenant running with the land and shall inure to the benefit of and
be binding upon the parties hereto and their successors and assigns, including any subsequent
owners of the Easement Area, the Benefitted Property and the Remainder Property. The
Easements granted herein are intended solely for the benefit of the Benefitted Property and the
easements and other rights and interests granted herein shall not be assigned or extended to
any properties other than the Benefitted Property.
8. No Merger. It is the intention of the parties that the easements granted herein
and covenants made herein shall not extinguish or terminate by operation of the doctrine of
merger or otherwise by reason of existing or future common ownership of the real property
described herein as the Remainder Property, the Easement Area and/or the Benefitted
Property.

9. Miscellaneous. Time is of the essence hereof. The headings contained herein
shall not be used to interpret the provisions hereof. This Agreement shall be construed under
and governed by the laws of the State of Washington. Either party's failure to enforce any
provision hereof shall not constitute waiver thereof in any future instance. If any provision
hereof is held to be unenforceable, the remaining provisions shall continue in full force and
effect.

(v) a document executed under a falsified, expired, or otherwise invalid power of attorney;
(vi) a document not properly filed, recorded, or indexed in the Public Records including failure to perform
those acts by electronic means authorized by law; or
(vii) a defective judicial or administrative proceeding.
(b) The lien of real estate taxes or assessments imposed on the Title by a governmental authority due or payable,
but unpaid.
Any encroachment, encumbrance, violation, variation, or adverse circumstance a Tecling the Title that would be
disclosed by an accurate and complete land survey of the Land. The teen "encroachment" includes

c. Setback of the structure from the property lines of the Land
d. Height of the structure, or
e. Number of parking spaces.
3. There shall be no liability under this endorsement based on:
a. the invalidity of the zoning ordinances and amendments until after a final decree of a court of competent
jurisdiction adjudicating the invalidity, the effect of which is to prohibit the use or uses;
b. the refusal of any person to purchase, lease or lend money on the Title covered by this policy.

EXCLUSIONS FROM COVERAGE
The following matters are expressly excluded from the coverage of this policy, and the Co:npat•,y will not pay loss or damage, costs, attorneys' fees, or expenses that arise by reason
of:
1, (a)
Any law, ordinance, permit, or government:4 regulation (including :'hose relating to building and zoning) restricting, regulating, prohibiting, or relating to
(i) the occupancy, use, or enjoyment of the Land;
(il) the character, dimensions or location or any improvement erected on the Land;
(lit) the subdivision of land; or
(iv) environmental protection;
or the effect of any violation of these laws, ordinances, or governmental regulations. This Exclusion ': ta) does not modify or limit the coverage provided under Covered Risk 5.
(h) Any governmental police power. This Exclusion 1(b) does not modify or pith the coverage provided under Covered Risk 6.
2. Rights of eminent domain. This Exclusion does not modify or limit the coverage provided under Covered Risk 7 or 8,
3. Defects, liens, encumbrances, adverse claims, or ether matters;
(a) created, suffered, assumed, or agreed to by the. Insured Claimant:
(b) not Known to the Company, not recorded in the Public Records at Date of Policy, but Known to the Insured Claimant and not disclosed in writing tc f to Company by the

4. Any claim, by reason of the operation of federal bankruptcy, state insolvency, or similar creditors' rights laws, that the transaction vesting the Title as shown in Schedule A, is
(a) et fraudulent conveyance or fraudulent transfer; or-
(b) a preferential transfer for any reason not stated in Covered Risk 9 of this policy.
5, Any lien on the Title for real estate. taxes or assessments Unposed by governmental authority and created or attaching between Date ofPohcyand the date of recording of the deed or
other instrument of transfer in the Public Records that vests Tine as shown in Schedule A.
1. DEFINITION OF TERMS
The following toms when used in this policy mean:
(a) "Amount of Insurance": The amount stated in
Schedule A. as may be iltct'eased or decreased by
endorsement to this policy, increased by Section S(b), or
decreased by Sections 10 and I I of these Conditions.
(b) "Date of Policy": The date designated as 'Date
of Policy' in Schedule A.
(c) "Entity": A corporation, partnership, trust,
limited liability company. or other similar legal entity.
(d) ,:Insured": The insured named in Schedule A,
(I) The term "Insured" also includes
(A) successors to the Title of the
Insured by operation of law as distinguished from
purchase, including heirs, devisees, survivors, personal
representatives, or next of kin;
(B) successors to an Insured by
dissolution, merger, consolidation, distribution, or
reorganization;
(C) successor;; to an Insured by its
conversion to another kind of Entity; •
(I)) a grantee or an. Insured under
deed delivered without payment of actual valuable
consideration conveying the Tirie
(1) if the stock, shares,
incmherships, or other equity interests of the grantee are,
wholly -owned by the named Insured.
(2) if the grantee wholly owns
the narned Insured,
(3) if the grantee is wholiy-
owned by an affiliated Entity of the named Insured,
provided the affiliated Entity and the named Insured are
both wholly -owned by the same person or Entity, or
(4) if the grantee is a trustee or
beneficiary of a trust created by a written instrument
established by the Insured mimed in Schedule. A for estate

(ii) With regard to (A), (R).C), and (C)
reserving, however, all rights and defenses as to any
successor that the Company would have had against any
predecessor Insured.
(c) "Insured Claimant": An Insured claiming loss
or damage.
(f) "Knowledge" or "Known"! Aetral knowledge.
not constructive knowledge of notice that may be imputed
to an insured by reason of the Public Records or any other

(g) Land": The land described in Schedule A, and
affixed improvements that by law constitute real property.
The term `Land" does not include any' property beyond the
lines of the area described in Schedule A, nor any right,
title-, interest, estate, or easement in abutting streets, roads,
avenues, alleys, lanes, ways, or waterways, but this does
not modify or limit the extent that a right of access to and
from the Land is insured by this policy.
(h) "Mortgage": Mortgage, deed of trust, trust
deed, or other 'security instrument, including otEC evidonecd
by electronic means authorized by taw.
(i) "Public Records": Records established under
state statutes at Dare of Policy for the purpose of imparting
constructive notice of matters relating to real property to
purchasers for value and without Knowledge. With rwpeet
to Covered Risk 5d),'.Public Records" shall also include
environmental pmtcetion liens filed in the records of the
clerk of the United States District Court for the district
whore the Land is located.
6} Title": The estate or interest described in
Schedule A.
(k) "Unmarketable Title": Title affccied by an
alleged or apparent matter that would permit a prospective
purchaser or lessee of the Title or `ender on the Title to be
released from the obligation to purchase, lease, or lend if
there is a contractual condition requiring the delivery of
inarketabie title.
2. CON'T'INt1A7'ION OF INSURANCE
The coverage of this policy shall continue in force as
of'Date of Policy is favor of an Insured, hot only so long as
the Insured retains an estate o: internist in the Land. Of

given by a purchaser from the Insured, or only so long as

3. NOTICE OF CLAIM TO BE GIVEN BY

is adverse to iheTitio, as insured, and that might cause loss
are damage for which the Company may be liable by virtue
of this policy, or (1Ei) if the Title, as insured, is rejected as
Unmarketable Title. If the 'Company is prejudiced by the
'failure of the insured Claimant to provide prompt notice,
the Company's liability to the Insured Claimant under the
policy shall be mistimed to the extent of the prejudice.
4, PROOF OF LOSS
In the eve :t the Company is unable to determine the
amount ()floss w' damage, the Company may, at its option.
require as a condition of payment that the Insured Claimant
furnish a signed proof of loss. The proof of loss must
describe the defect, lien, encumbrance, or other Planer
insured against by this policy that constitutes the. basis of
lose or damage and shall state, to the extent possible, the
basis of calculating the amount of the loss or damage.
5, DEFENSE AND PROSECUTION OF ACTIONS
(a) Upon written request by the Insured, and
subject to the options contained in Section 7 of these
Conditions, the Company, at its own; cost and without
unreasonable &.lay, shall provide ibt the defense of an
Insured in litigation in which any third party asserts a claim
covered by this policy adverse to the Insured. This
obligation is limited to only these stated causes of action
alleging matter insured against by this policy. This
Company shall have the right to select counsel of its Cimino
(subject to the right of the Insured to object for reasonable
cause) to represent the Insured as to those stated causes of
action. It shall not be liable for and will not pay the fees of
any other counsel. The Company will not pay any fees,
costs, or expenses incurred bythe insured in the defense of
those rauscs or action that allege matters not insured
against by this policy.
(b) The Company shall have the right, in addition
to the options contained in Section 7 of these Conditions,
at its own cost, to institute and prosecute any action or
proceeding or to do any other net that in its opinion may be
necessary or desirable to establish the. Title, as insured, or
to prevent or re.duce loss or damage to the Insured. The
Company may take any appropriate action under the terms
of this policy, whether or not it shall be liable to the
Insured. The exercise of these rights shall not be as
admission of liability or waiver of any provision of this
policy. If the. Company exorcises its rights under this
subsection, it must do so diligently,
(c) Whenever the Company brings an action nr
asserts a defense as required or permitted by this policy.

6, DUTY OF INSURED CLAIMANT TO
COOPERATE
(a) In all cases whcro this policy permits or
requires the Company to proaecntc or provide for the
defense of any action or proceeding and any appeals, the
Insured shall secure to the Company the right to so
prosecute or provide defense in the action or proceeding,
including the right to usc, at its option, the name of the
Insured for this purpose. 'Whenever requested by the
Company, the Insured, at the C'oinpany's expense, shall
give the Company all reasonable aid (i) in securing
evidence, obtaining witnesses, prosecuting or defending thc
action or proceeding, or effecting rettlernent, and (ii) in
any other lawful act that in the opinion of the Company
may bc necessary or desirable to establish the Title or any
other matter as insured, If the Company is prejudiced by
the failure of the Insured to furnish the required
cooperation, the Company's obligations to the Insured
under the policy shall terminate, including any liability or
oblige tian to defend, prosecute, or continue any litigation,
with regard to the matter or matters requiring such
cooperation.
(b) The Company may reasonably require the
Insured C'aiment to submit to examination under oath by
any authorized representative of the Company and to
produce for exatnination, inspection, and copying, at such
reasonable times and places as may be designated by the
authorized representative of the Company, all records, in
whatever medium maintained, including books, ledgers,
checks, memoranda, correspondence, reports, eanaits,
disks, tapes, and videos whether bearing a date before or
after Date of Policy. that reasonably pertain to the loss or
damage. Further, if requested by any a, horired
representative of the Company, the insured Claimant shall
grant its permission, in writing, for any authorized
representative of the Company to examine, inspect, and
copy all of these records in the custody or control ofa third
party that reasonably pertain to the toss or damage. All
information designified as confidential by the Insured
Claimant provided to the Company pursuant to this Section
shall not he disclosed to others unless, in the reasonable
judgment of the Company, it is necessary in the
administration of the claim. failure of the lnsuicd
Claimant to submit for examination rimier oath, produce
any reasonably requested information, or grant permission
to secure reasonably necessary information from third
parties as required in this subsection. unless prohibited by
law or governmental regulation, shall terminate any
liability of the Company under this policy as to that claim.
.. OPTIONS TO PAY OR OTHERWISE SETTLE
CLAIMS; TERMINATION OF LIABILITY
In ease of a claim under this policy, the Company
shall have the fo lowing additional options:
(a) Tc Pay or Tender Payment of the Amount of
Insurance.
TO pay or tender payment of the Amount of
Insurance under this policy together with any costs,
attorneys' fees, and expanses incurred by the Insured
Claimant that were authorized by the Company up to the
time of payment or tender of payment and that the
Company is obligated to pay.
Upon the exercise by the Company of this option, all
liability and obligations of the Company to the Insured
under this policy, other than to make ttac payment required
in this subsection, shall terminate, including any liability or
shligation to defend, prosecute, or contiar eanylitigatiori.

(b) To Pay or Otherwise Settle With Parties Other
Than the Insured or With the Insured Claimant.
(i) To pay or otherwise settle with other
parties for er in the name ofan Insured Claimant any claim
insured against under this policy. In additinr:, the Company
Will pay any casts, attorneys' fees, end expenses incurred
by the Insured Claimant that were authorized by the
Company up to the time of payment end that the Company
is obligated to pay; or
(ii) To pay er otherwise settle with the
Insured Clamant the loss nt damage provided for finder
this policy, together with any costs, attorneys' fees, and
expenses incurred by the insured Claimant that were
authorized by the Company up to the time of payment and
that the Company is obligated to pay,
Upon the exercise by the Company of either of the
options provided for in subsections (h)(+.) or (ii), the
Company's obligations to the Insured under this poi icyfor
the claimed toss or damage, other than the payments
required to he made, shall terminate, ineludrngarty liability
or obligation to defend, prosecute, or continue any
litigation.
b. DETF;R':"cMINr9TION AND F.XFti;NT OF
LIABILITY
This policy is a contract of indemnity against actual
monetary loss or damage sustained or inured by the
Insured Claimant who has suffered toss or damage by
reason of matters insured against by this policy.
(a) The extent of liability of the Company for loss
or damage under this policy shall not exceed the Lesser of
(i) the Amount of Insurance; or
(ii) the difference between the value of the
Title as insured and the value nt Fin Titre subject to the risk
i:tstired against by this policy.
(b) If the Company pursues its rights under
Section 5 of these Conditions and is unsuccessfui in
establishing the Title, as insured,
(I) the Amount of insurance shall be
increased by 10%,and
(ii) the Insured Claimant shalt have the right
to have the toss or damage determined either as of the date
Mc claim was made by the insured Claimant or as of the
date it is settled and paid,
(c) In addition to the extent of liability under tea)
and (is), Inc. Company will also pay those costs. attorneys'
fees, and expenses incurred in accordance with Sceticns 5
and 7 of these Conditions.
9, LIMITATION OF I:IAIIILITY
(a) If the Company establishes the Title, or
removes the alleged defect, lien or encumbrance, or cures
the lack of e right of access to or from tic Land, or cures
the claim of Unmarkctahie Title, all as insured, in a
reasonably d€tigers manner by any method, including
litigation and the completion of any appeals, it shall have
fully performed its obligations with respect to that matter
and shall not be liable for any loss or damage caused to the
Insured.
(b) In the event of any litigation, including
litigation 'oy the Company or with the Company's consent,
the Company shall have no liability for toss or damage
until there has been a final determination by a court of
competent jurisdietion, and disposition of all appeals,
adverse to the Title, as insured.
(c) The Connpany shall not be liable for loss or
damage to the Ensured for liability voluntarily assumed by
the Insured in settling any claim or suit ;without the prior
written consent of thc Company,
10, REDUCTION OF INSURANCE; REDUCTION
OR TERMINATION OF LIABILITY
All payments under this policy, except payments
made for costs, attorneys' files, and expenses, shall reduce
the Amount of Insurance by the amount of the payment.
I1. LIABILITY NONCUMULATIVE
The mount of Insurance shall bc reduced by any
amount the Company pays tinder any policy insuring a
Mortgage to which exception is taken in Schedule I3 or to
which the Insured has agreed, assumed, or taken subject, or
which is excented by an Insured after Date of Policy and
which is a charge ur lien on the 'Title, and the amount so
paid shall be deemed a payment to the resumed under this
priticy,
12. PAYMENT OF LOSS
When liability and the extent °f loss or damage have
been definitely fixed in accordance with these Conditions,
the payment shall be made within 30 days.
13. RIGHTS OF RECOVERY UPON PAYMENT
OR SETTLEMENT
(s) Whenever the Company shall have settled and
paid a claim under this policy, it shall be subrogated and
entitled to the rights of the insured Claimant in the Title
and all other rights and rctnedics in respect to the claim
that the insured Claimant has against any person or
property, to the extent of the amount of any loss, costs,
attorneys' fees, and expenses paid by the Company. If
requested by the Company, the Insured Claimant shall
execute documents to evidence the transfer to the Company
of these rights and remedies. The Insured Claimant shall
permit the Company to sue, compromise, or settle in the
name of the ensured Claimant and to use the name of the
Insured Claimant in any transaction or litigation involving
arose tights and remedies.
If a payment on account of a claim does not hilly
covet the loss of the insured Claimant, the Company shall
defer the exercise of its right :o recover until after the
Insured Claimant shall have recovered its loss.
(b) The Company's right of subrogation includes
the rights of the Insured to indemnities, guaranties, other
policies of insurance, or bonds, notwithstanding any terns
or conditions contained in those instruments that address
subrogation rights,
14. ARBITRATION
Hither the Company or the Insured maydemand that
the claim or controversy shall be submitted to arbitration
pursuant to the Title Insurance Arbitration Rules of the
American Land Title Association ("Rules"). Except as
provident in the Rules, there shall bc no joinder or
consolidation with claims or controversies of other
persons. Arbitrable matters may include, but are not
limited to, any controversy er claim between the Company
and the Insured arising out of or relating to this policy, any
service in connection with its issuance or the breach of a
policy prevision, or to any other controversy or claim
arising out of the transaction giving risc to this policy. Alt
arbitrable matters when the Arnount of Lnsuranee is
S2,000,000 or less shall be arbitrated at the option of either
the Company or the leisured. Alt arbitrable matters when
the Amount of Insurance is in excess of S2,000,000 shall
be arbitrated only when agreed to by both the Company
and the Insured. Arbitration pursuant to this policy and
under the Rules shall be binding upon the parties.

CHOICE OF LAW; FORUM
(a) Choice of taw; The Insured acknowledges the
Company has underwritten the risks covered by this policy
and determined the premium charged therefor in reliance
upon the law affecting interests in real property and
applicable to the interpretation, rights, remedies, or
enforcement of policies of title insurance of the jurisdiction
where the Land is located.
Therefore, the court or an arbitrator shall apply the
law of the jurisdiction where the Land is located to
dcterinine the validity of claims against the Title that are
adverse to the insured and to interpret and enforce the
terms of this policy. In neither case shall the court or
arbitrator apply its eonfliets oflaw principles to determine
the applicable taw.
(b) Choice of Forum: Any litigation or other
proceeding brought by the Insured against the Company
must be fled only in a state or federal court within the
United States of America or its tenitories having
appropriate juri fiction.

(b) Vertical datum NAVD 1988 and horizontal datum NAD 83/91. Conversion calculations to
NGVD 1929, if in a flood zone or flood -prone area.
(c) Existing and proposed utility easements and improvements, on site and in street (water, sewer,
power, natural gas, telephone, cable). Schematic designs to be provided regardless of purveyor (e.g. site
line size, location, and size of public main). No capacity calcs, invert depth, valve locations or the like
are needed.
(d) Stormdrainage design at least 90% complete, which meets the King County Surface Water
Design Manual (KCSWDM). Include a Technical Information Report (TIR) including feasibility
analysis if required by the Manual. Call out total existing and proposed impervious surface in square
feet. Include all storm drainage conveyance systems, water quality features, detention structures,
maintenance access and safety features. For additional guidance contact Public Works or go to
http://www.tukwilawa.gov/pubwks/pwpermit.html.
(e) Locate the nearest existing hydrant and all proposed hydrants.
(f) Show the 100 yr. flood plain boundary and elevation as shown on FEMA maps.
(g) Plan, profile and cross-section for any right-of-way improvements.
(h) Show planned access to lots, driveways, fire access lanes and turn-arounds.
