1. Recitals.
A. The Grantor is the owner of that certain real property legally
described above.
B. This instrument sets forth the terms and conditions under which the
Grantor will grant the Grantee an easement.

2. Grant of Easement.
A. For and in consideration of TEN DOLLARS ($10.00), and other valuable
consideration, the receipt of which is hereby acknowledged, RESILIENCE
HOLDINGS, LLC ("Grantor") grants, conveys, and warrants to the CITY OF
TUKWILA, ("Grantee") for the purposes hereinafter set forth, a non-exclusive
perpetual easement under, across, and over the easement area, a legal
description of said Easement Area being attached hereto as Exhibit 'A' and as
depicted in Exhibit `B', which are attached and incorporated herein by this
reference.
3. Purpose of Easement.
The Grantee shall be entitled to use the easement under, across, and over
the Easement Area in perpetuity for the purpose or purposes of:
Use by the Public of Public Sidewalk; and construction, maintenance, and
use of Public Sidewalk and Utilities, within the Easement Area.
4. General Provisions.
A. Access. Grantee shall have the right of access to the easement
under, across, and over the Easement Area to enable Grantee to exercise its
rights hereunder. Grantee shall not materially interfere with the use and
enjoyment of the Property, or any business operations thereon, by Grantor or its
officers, agents, employees, tenants, or invitees.
B. Indemnification. Grantee shall hold the Grantor harmless from all
costs, claims, or liabilities of any nature, including attorneys' fees, costs, and
expenses for or on account of injuries or damages sustained by any persons or
property resulting from the negligent activities or omissions of the Grantee
resulting from this easement.
Grantor shall hold the Grantee and its officers, agents, employees, tenants,
and invitees harmless from all costs, claims or liabilities of any nature including
attorneys' fees, costs and expenses for or on account of injuries or damages
sustained by any persons or property resulting from the negligent activities or
omissions of the Grantor, or Grantor's agents or employees resulting from this
easement.

C. Attorneys' Fees. In the event that any suit or other proceeding is
instituted by either party to this instrument arising out of or pertaining to this
instrument or the relationship of the parties, including but not limited to the filing of
a lawsuit, a request for an arbitration, mediation, or other alternative dispute
resolution process (collectively, "Proceeding"), and any appeals and collateral
actions relative to such a Proceeding, the substantially prevailing party as
determined by the court or as determined in the Proceeding shall be entitled to
recover its reasonable attorneys' fees and all costs and expenses incurred relative
to such Proceeding from the non -prevailing party, in addition to such other relief
as may be awarded.
D. Binding Effect. This instrument shall be binding upon and inure to
the benefit of the parties and their successors, heirs, assigns, and personal
representatives and all persons claiming by, through or under the parties hereto.
The easement created by this instrument shall be appurtenant, shall touch and
concern the real property identified on Page 1 of this Easement, and shall run with
the land.
E. Applicable Law. This instrument shall be governed by and
construed in accordance with the laws of the State of Washington. Jurisdiction
over and venue of any suit arising out of or related to this instrument shall be
exclusively within the state or federal courts of King County, Washington.
F. Entire Agreement. This instrument contains the entire agreement
between the parties with respect to this matter. It may not be modified except in a
writing signed by both parties.
G. Waiver. Any waiver by a party of a breach of any provision of the
agreement contained within this instrument by the other party shall not operate or
be construed as a waiver of any subsequent breach by that party. No waiver shall
be valid unless in writing and signed by the party against whom enforcement of
the waiver is sought.
H. Severability. If for any reason any portion of this instrument or any
agreement contained herein shall be held to be invalid or unenforceable, the
holding of invalidity or unenforceability of that portion shall not affect any other
portion of this instrument or agreement and the remaining portions of the
instrument shall remain in full force and effect.

I. Grantee shall pay, as its sole obligation, all costs and expenses to
install, maintain and keep in repair the utilities Grantee locates under, across, over
or on the Easement Area.
J. Notices. Any notice required or desired to be given under this
instrument shall be deemed given if it is in writing and actually delivered to the
party, or sent by certified mail to the address listed below for that party:

Dear Mr. Everett,
The Short Subdivision Committee has completed review of your short plat application (No. L16-0030), and determined
that it complies with all applicable City code requirements. The City SEPA Responsible Official has previously
determined that this application does not require a SEPA threshold determination because it is categorically exempt.
This letter serves as the Notice of Decision per TMC 18.104.170. Based on the latest project submittal, preliminary
approval is granted subject to the conditions stated below. The conditions imposed are to ensure the short plat is
consistent with the Criteria for Preliminary Approval listed at TMC 17.12.020 C in the Tukwila Subdivision Code.
Preliminary Approval Conditions
1. Add permit number L16-0030 to Survey Site Map Sheet 1 of 2.
2. Add a note to the Survey Site Map stating "New residential homes shall be equapped with a fire sprinkler
system."
3. Show and label Public Sidewalk and Utilities Easement within Northern most 10' of the new Lot 1 on
Survey Site Map and Short Plat Site Development Plan. Public Works will prepare easement for signature
with Notary.
4. Contact the Fire Marshal for addresses for the new Tots. The addresses should be included on the final
Survey Sitq Map. The Fie Marshal can be reached at 206.575.4407 or Don.Tomaso@TukwilaWA.gov.

5. Public Sidewalk and Utilities Easement within the Northern most 10' of the new Lot 1 will be required
prior to Final Short Plat.
6. Review draft copy of the 25' Private Access & Utilities Easement and Maintenance Agreement. This
document shall be recorded prior to recording of the Final Short Plat Map, and the recording number
must be shown on the Short Plat Survey Site Map. The 25' Private Access & Utilities Easement and
Maintenance Agreement should include language stating who will maintain the paved area and utilities,

7. Pursuant to TMC 18.50.050, the front door of the home on Lot 1 shall face S. 144th Street. Only a four
feet opaque fence is allowed along the street front and it will need to include a break for access to the
front door.
8. Applicant shall fill out and submit Traffic Concurrency Certificate Application and associated fee to Public
Works. See attached Traffic Concurrency Certificate Application.
9. Verify with Valley View Sewer District if separate sanitary sewer easement is needed for new sanitary
side sewer constructed within Private Access Road.
10. A new fire hydrant is required. For short plat developments of four single-family homes of less and
individual single-family homes, fire hydrants shall be placed so that a hydrant is no more than 250 feet
by line of vehicular travel to the nearest point of the building.
Informational Items:

of this permit and require bonding, insurance, and a Hold Harmless Agreement; for work in the Public
Right -of -Way.
2. Pavement mitigation fee applies for open cuts within S. 144th Street. Reference Pavement Mitigation
and Transportation Impact Fees Bulletin no. A3 — enclosed.
3. All utilities including power are required to be underground, per City of Tukwila ordinance.
4. A Transportation Impact Fee applies to future Building permits. Transportation Impact Fee in Zone 3 is
$1,013.88 per single-family residence.
5. The water meter and associated water supply piping shall be sufficient to support the required
residential fire sprinkler system for each new lot.
6. Each lot shall require a copy of the geotechnical report to be provided with future building permits. Soil
reports shall include recommendations for footing and roof water disbursement to a designed trench
or storm drains.
7. The final grading plan must show a flat area below any second story rescue windows for Fire
Department ground ladder placement. If unable to provide a suitable flat area adjacent to the houses,
please contact the Tukwila Fire Marshal's office at 1.206.575.4407.
8. Proposed homes shall meet TMC 18.50.050 design standards. These will be reviewed at the time of
building permit review.
9. Applicant shall contact Post Master at 1.800.275.8777 for mailbox location approval.
10. Pursuant to TMC 18.54.050, clearing of up 5 or more significant trees on a site currently zone and
developed for single-family resident use within a 36-month period outside of mapped environmentally
sensitive areas will require a Tree Removal permit.
NEXT STEPS:
1. Construction permits: Install all required site improvements, including those proposed in the application
and those identified above as conditions of approval. You will need to obtain all required permits prior to

a Public Works (PW) Type 'C' permit. For utilities provided by other entities, contact the individual
providers.
2. Final Approval: Submit documents for final approval. After installing the required site improvements and
complying with the conditions of approval submit the necessary short plat documents (survey, legal
descriptions, and other required paper work) for city signatures. All taxes and fees assessed against the
property must be current prior to final approval. Please check with the King County Assessor's Office
and the City of Tukwila Finance Department prior to submitting final documents. After the documents
have been found to be in order, and the all of the requirements of the short plat have been met, the Chair
of the Short Subdivision Committee signs your short plat which constitutes a grant of final approval.
3. Recording: The signature of the Chairman of the Short Subdivision Committee certifies that your short plat
application is ready for recording. It is your responsibility to record the City approved short plat documents
with the King County Department of Records. You will need to pay the recording fees and submit your
approved original short plat to King County. The short plat is not complete until the recording occurs and
copies of the recorded documents are provided to the Department of Community Development. After
recording, the County returns the recorded original to the City of Tukwila within 4-6 weeks, at which time
your short plat is considered complete. You can shorten this processing time by hand -delivering a copy of the
recorded short plat to the project planner. In many circumstances, building permits on the short platted
property may not be issued until a copy of the recorded short plat (or original) is returned to the Department
of Community Development.
EXPIRATION OF PRELIMINARY APPROVAL
The final approved short plat must be filed with the King County Department of Records within one year from
the date of this preliminary approval or the application will expire. The City may grant a single one *ear
extension if requested in writing prior to the expiration date.
APPEAL RIGHTS
This short plat approval decision may be appealed to the Hearing Examiner. One administrative appeal of the
decision on the short plat, excluding challenges to the DNS, is permitted. If no valid appeals are filed within the time
limit, the decision of the Department will be final.
In order to appeal the decision a written notice of appeal must be filed with the Department of Community
Development within 21 days of the issuance of the Notice of Decision. The requirements for such appeals are set
forth in Tukwila Municipal Code 18.116.
Appeal materials shall include:
1. The name of the appealing party.
2. The address and phone number of the appealing party; and if the appealing party is a corporation, association
or other group, the address and phone number of a contact person authorized to receive notices on the
appealing parry's behalf.
3. A statement identifying the decision being appealed and the alleged errors in the decision, including any
specific challenge to an MDNS.

4. The Notice of Appeal shall identify (a) the specific errors of fact or errors in application of the law in the
decision being appealed; (b) the harm suffered or anticipated by the appellant, and (c) the relief sought.
The scope of an appeal shall be limited to matters or issues raised in the Notice of Appeal.
5. Appeal fee per the current fee schedule, additional hourly charges may apply. In addition all hearing
examiner costs will be passed through to the appellant.
Any appeal shall be conducted as an open record hearing before the Hearing Examiner. The Hearing Examiner's
decision on the appeal is the City's final decision. A party who is not satisfied with the outcome of the
administrative appeal process may file an appeal in King County Superior Court from the Hearing Examiner's
decision pursuant to the procedures and time limitations set forth in RCW 36.70C. An appeal challenging a DNS,
an MDNS or an EIS may be included in such an appeal.

4. LIMITATION OF OUR LIABILITY
Our only obligation is to issue to you the Policy referred to in this Commitment, when you have met its
Requirements. If we have any liability to you for any Toss you incur because of an error in this
Commitment, our liability will be limited to your actual loss caused by your relying on this Commitment
when you acted in good faith to:

DEFINITIONS

(A) "Security Instrument" means this document, which is dated July 05, 2013, together with all Riders to this
document.
(B) "Borrower" is LARRIE CHMELA AND JACALYN CHMELA, HUSBAND AND WIFE. Borrower is the
trustor under this Security Instrument.
(C) "Lender" is Wells Fargo Bank, N.A. Lender is a national bank organized and existing under the laws of

(D) "Trustee" is Wells Fargo Financial National Bank.
(E) "Debt Instrument" means the loan agreement or other credit instrument signed by Borrower and dated July
