You had taken over this project for Mr. Steve Bell, who had originally filed the application to remove trees in the shoreline jurisdiction along West Valley Highway and replace them with more appropriate trees. The tree removal permit application was determined to be incomplete on July 21, 2016 and additional information was requested (copy attached). In our July 21' letter to Mr. Bell, the City gave notice that if we did not receive the requested information within 90 days of the date of the letter the application will expire, unless an extension is requested. It has been almost 6 months since our last communication. Can you please give me an update on this project? Please let me know if you have any questions or if you need assistance in providing the additional information requested in our July 215t letter to Mr. Bell. If I do not hear back from you by February 3; 2017, this application will expire. Thank you very much. I didn't mention on the phone that I am assuming that the new trees that are to be planted will be placed in the area where the current trees are being removed. If that is not the case, then please provide a small site plan that shows where the replacement trees will be planted. Since the trees that are being removed are within 200 feet of the shoreline, we require that native trees be used as replacements. When you meet with your landscaper, that person can recommend some native tree species to use — they can be all evergreen or deciduous, or a mix depending on your goals for that area (such as are you trying to screen the area behind the fence?). We would be happy to review your landscaper's recommendations prior to your finalizing the choice and submitting them to us. Planning Division staff is available to discuss the decision criteria you must respond to and the necessary supporting materials. The request to remove trees and vegetation from the shoreline jurisdiction will be reviewed against the standards in TMC 18.44.080, Vegetation Protection and Landscaping section of the Shoreline Overlay District which are summarized in Section I. Please see TMC 18.44.080 for verbatim text. TREE AND VEGETATION REMOVAL APPROVAL CRITERIA The Tree Removal and Vegetation Clearing Permit will be reviewed to ensure the following items have been adequately addressed: 1. Site preparation specifications and vegetation planting details shall be in accordance with best management practices for ensuring the vegetation's long-term health and survival. Site preparation shall include removal of invasive species and soil preparation, in accordance with best management practices for ensuring the vegetation's long-term health and survival. Removal of invasive species shall be done by hand or with hand-held power tools. 2. A mix of native trees, shrubs and groundcovers (including grasses, sedges, rushes and vines) shall be planted to replace any removed vegetation. Plants listed in the "Riparian Restoration and Management Table" of the 2004 Washington Stream Habitat Restoration Guidelines (Washington Dept. of Fish and Wildlife, Washington Dept. of Ecology and U.S. Fish and Wildlife Service, Olympia, WA, as amended (http://wdfw.wa.gov/publications/01374/ see 2012 Guidelines, Table 10 — or request a copy of the table from DCD) shall provide the basis for plant selection. Site conditions, such as topography, exposure, and hydrology shall be taken into account for plant selection. Plants shall meet the current American Standard for Nursery Stock (American Nursery and Landscape Association-ANLA). 3. Buffer planting material that follows the minimum size standards below (smaller plant sizes - generally one gallon, bareroot, plugs, or stakes, depending on plant species - are preferred for buffer plantings): Buffer Vegetation Planting Densities Plant Material Type Planting Density Stakes/cutting along the river bank (willows, red osier dogwood) 1-2 feet on center or per bioengineering method. Willow stakes must be at least'/2- inch in diameter Shrubs 3-5 feet on center, depending on species Trees 15-20 feet on center, depending on species Groundcovers, grasses, sedges, rushes, other herbaceous plants 1-1.5 feet on center, depending on species Native seed mixes 5-25 lbs. per acre, depending on species 6. Plants shall be installed from the Ordinary High Water Mark to the upland edge of the River Buffer unless site conditions would make planting unsafe. Plantings close to and on the bank shall include native willows, red osier dogwood and other native vegetation that will extend out over the water, to provide shade and habitat functions when mature. Species selected must be able to withstand seasonal water level fluctuations. Plants may be selected and placed to allow for public and private view corridors and/or access to the water's edge. On properties located behind publicly maintained levees an applicant is not required to plant native vegetation within the buffer. 7. Plants shall be maintained (i.e. watering, weeding, replacement of dead plant material) over the long term. Irrigation for buffer plantings is required for at least two dry seasons or until plants are established. An irrigation plan is to be included as part of the planting plan, per TMC 18.44.080 C.2.e. Invasive plants (such as blackberry, ivy, knotweed, etc) shall be removed on a regular basis to prevent establishment of invasive species and to promote healthy growth of new plants. Replaced trees that do not survive must be replanted in the next appropriate season for planting. FREQUENTLY ASKED QUESTIONS ABOUT TREE PROTECTION, RETENTION AND REPLACEMENT 1. What trees are allowed to be removed? a. As many significant trees and as much native vegetation as possible must be retained on the site, taking into account the condition and age of the trees. The factors that will be considered in approving tree removal include, but are not limited to tree condition and health, age, risk to structure, and potential for root or canopy interference with utilities. b. Removal of trees and vegetation is generally allowed only on sites undergoing development or redevelopment. c. For sites not undergoing development, only trees that interfere with access and passage on public trails or trees that present an imminent hazard to existing structures or the public may be removed. Factors that will be considered in approving tree removal include, but are not limited to: tree condition and health, age, risks to structures and potential for root or canopy interference with utilities. If the hazard is not readily apparent, the City may require an evaluation by an International Society of Arborists (ISA)-certified arborist. 2. What are the requirements for site preparation? Removal of invasive species vegetation is to be done by hand or with hand-held power tools. Use of mechanized equipment must be approved through this permit. What are the standards for tree protection measures? For new development or re -development where trees are proposed for retention, tree protection zones shall be indicated on site plans and shall be established in the field prior to commencement of any construction or site clearing activity. A minimum 4 feet high construction barrier shall be installed around significant trees and stands of native trees or vegetation to be retained. Minimum distances from the trunk for the construction barriers shall be based on the approximate age of the tree (height and canopy) as follows: a. Young trees (have reached less than 20% of life expectancy): 0.75 feet per inch of trunk diameter. b. Mature trees (have reached 20-80% of life expectancy): 1 foot per inch of trunk diameter. c. Over mature trees (have reached greater than 80% of life expectancy): 1.5 feet per inch of trunk diameter. 4. What if all the required replacement trees cannot be accommodated on the site? If all required replacement trees cannot be reasonably accommodated on the site, off site tree replacement within the shoreline jurisdiction may be allowed at a site approved by the City. Priority for off -site tree planting will be at locations within the Transition Zone (located in the Lower Duwamish River area). If no suitable off -site location is available, the applicant shall pay into a tree replacement fund. The fee shall be based on the value of the replacement trees and their delivery, labor for site preparation and plant installation, soil amendments, mulch and staking supplies. 5. What trees have to be left for wildlife snags? a. Dead or dying trees located within the buffer or underdeveloped upland portion of the shoreline jurisdiction shall be left in place as wildlife snags, unless they present a hazard to structures, facilities or the public. b. When a tree suitable for use as large woody debris (LWD) is permitted to be removed from the shoreline buffer, the tree trunk and root ball (where possible) will be saved for use in a restoration project elsewhere in the shoreline jurisdiction. The applicant will be responsible for the cost of moving the removed tree(s) to a location designated by the City. If no restoration project or storage location is available at the time, the Director may waive this requirement. Trees removed in the shoreline jurisdiction outside the buffer shall be placed as LWD in the buffer (not on the bank) if feasible. Priority for LWD placement projects will be in the Transition Zone. 6. Is topping of trees allowed? Topping of trees is prohibited unless absolutely necessary to protect overhead utility lines. Topping of trees will be regulated as removal and tree replacement will be required. Trees and shrubs may only be pruned for safety, to maintain views or access corridors and trails by pruning up or on the sides of trees, to maintain clearance for utility lines and/or for improving shoreline ecological function.
