Vicinity/Site Information:
The subject property is located at 14658 46th Avenue S. on the northeast corner of S. 148th Street and 46th
Avenue S. The site is zoned Low Density Residential and is 10,458 square feet. The neighboring properties are
also zoned LDR and have single-family homes. Some of the surrounding homes have a roof pitch less than 5:12

as they were constructed prior to the adoption of the roof pitch minimum requirement of 5:12 under Ordinance
2098 in 2005.
The proposed 1331 square foot detached garage will be located behind the existing home, on the east side of
the property, see Attachment B. The garage includes a roof top deck. The applicant states the 2:12 roof pitch
allows the deck to be completely hidden within the structure while at the same time allowing for anyone on the
roof top deck to enjoy territorial views. The applicant also states that at 5:12 roof pitch will completely enclose
the deck with high walls on all four sides and would defeat the purpose and the intent of the deck location. The
sloped portion of the roof will have 24-inch eaves. A variety of siding materials including stone, horizontal lap
siding, and Hardie panels will be used and will match the colors and materials of the existing home, see
Attachment D. The proposed detached garage meets the maximum building footprint and setbacks for the LDR
zone as listed in TMC 18.10.
Decision Criteria:
According to Tukwila Municipal Code (TMC) 18.50.050(6) Single Family Dwelling Design Standards require a
minimum roof pitch of 5:12. Upon approval as a Type 2 decision, according to TMC 18.50.055, a roof pitch flatter
than 5:12 may be permitted when:
a) The proposed roof pitch is consistent with the style of the house (for example modern, southwestern);
b) If a flat roof is proposed, the top of the parapet may not exceed 25 feet in height;
c) If a sloped roof is proposed, it must have at least 24-inch eaves; and
d) The house exhibits a high degree of design quality, including a mix of exterior materials, detailing,
articulation and modulation.
Since the proposed roof is flat, this application qualifies for review as a Type 2 decision..
Conclusions:
1. The proposed roof pitch is consistent with the style of the garage and the hidden roof top deck.
2. The proposed roof is not flat.
3. The sloped portion of the roof will have 24-inch eaves.
4. The proposed home exhibits a design that is in keeping with the surrounding single-family homes and is
consistent with the design of the existing home on the site. It has a style and a scale that is visually
consistent with the surrounding development and will be visually unobtrusive. The home uses a variety
of siding materials including stone accents, vertical lap siding, and Hardie panels.
The proposed roof meets the criteria to approve a roof pitch flatter than 5:12.
Informational Items:
1. As listed in TMC 18.10.02, one dwelling unit per lot is permitted in the LDR zone. No portion of the
detached garage may be used as a dwelling unit.
2. As listed in TMC 18.06.430, home occupations are not permitted in accessory structures.
II. DECISION
SEPA Determination: The City SEPA Responsible Official has previously determined that this application does
not require a SEPA threshold determination because it is categorically exempt.

Decision on Substantive Permit: The Community Development Director has determined that an application for Special
Permission does comply with applicable City and state code requirements and has approved that application, subject
to any conditions set forth in the Decision.
III. YOUR APPEAL RIGHTS
The Decision on this Permit Application is a Type 2 decision pursuant to Tukwila Municipal Code §18.104.010.
Other land use applications related to this project may still be pending.
No administrative appeal of a DNS or an EIS is permitted. One administrative appeal to the Hearing Examiner of the
Decision on the Permit itself is permitted.
A party who is not satisfied with the outcome of the administrative appeal process may fine an appeal in King County
Superior Court from the Hearing Examiner's decision.
IV. PROCEDURES AND TIME FOR APPEALING
In order to appeal the Community Development Director's decision on the Permit Application, a written notice of
appeal must be filed with the Department of Community Development within 14-days of the issuance of this
Decision.
The requirements for such appeals are set forth in Tukwila Municipal Code 18.116. Ail appeal materials shall be
submitted to the Department of Community Development. Appeal materials MUST include: •
1. The name of the appealing party.
2. The address and phone number of the appealing party; and if the appealing party is a corporation, association
or other group, the address and phone number of a contact person authorized to receive notices on the
appealing party's behalf.
3. A statement identifying the decision being appealed and the alleged errors in the decision, including any
specific challenge to an MDNS.
4. The Notice of Appeal shall identify (a) the specific errors of fact or errors in application of the law in the
decision being appealed; (b) the harm suffered or anticipated by the appellant, and (c) the relief sought.
The scope of an appeal shall be limited to matters or issues raised in the Notice of Appeal.
5. Appeal fee of $602.00.
V. APPEAL HEARINGS PROCESS
Any administrative appeal regarding the Permit shall be conducted as an open record hearing before the Hearing
Examiner based on the testimony and documentary evidence presented at the open record hearing. The Hearing
Examiner's decision on the appeal is the City's final decision.

Any party wishing to challenge the Hearing Examiner's decision on this application must file an appeal pursuant
to the procedures and time limitations set forth in RCW 36.70C. An appeal challenging a DNS, an MDNS or an EIS
may be included in such an appeal. If no appeal of the Hearing Examiner decision is properly filed in Superior
Court within such time limit, the Decision on this permit will be final.
The City's decision to issue a DNS, an MDNS or an EIS is final for this permit and any other pending permit
applications for the development of the subject property.
VI. INSPECTION OF INFORMATION ON THE APPLICATION
Project materials including the application, any staff reports, and other studies related to the permits are available for
inspection at the Tukwila Department of Community Development, 6300 Southcenter Blvd., Suite 100, Tukwila,
Washington 98188 from Monday through Friday between 8:30 a.m. and 5:00 p.m. The project planner is Laura

Property owners affected by this decision may request a change in valuation for their property tax purposes. Contact
the King County Assessor's Office for further information regardling property tax valuation changes. The notice board
must be removed at the expiration of the appeal period if no appeal is filed.

We are asking DCD Director for exceptions to design standards listed at 18.50.050 (5).
The structure has been designed to accommodate a roof top deck with minimal to no
visibility from main streets. The 2:12 roof pitch allows for the deck to be completely hidden
within the structure while at the same time allow for anyone on the roof top deck to enjoy
territorial views. A 5:12 roof pitch will completely enclose the deck with high walls on all 4
(four) sides, this would defeat the purpose and the intent of the deck location.
1. The proposed roof pitch is very much consistent with the style of the proposed modern
structure and a 5:12 pitch would appear awkward on this elevation.
2. Flat roof area over the staircase well is proposed and allows for a convenient and safe
access from the staircase well to the rooftop deck. Pitched roof will create challenges
with access to the rooftop.
3. 24-inch eaves are proposed at the sloped roof.
4. The structure indeed exhibits degree of design quality with a mixture of modern exterior
materials such as: stone, horizontal lap siding, Hardie panels (fiber cement) at the front
along with vertical siding at left and rear elevations further continue the modern mixture
of materials.

Design Standards Exception Request
This note is meant to accompany our architect's comments requesting special permission to build our
garage/storage structure with the 2:12 pitch roof to match the contemporary design and unique hidden
deck. In terms of style and design quality:
Image 1— Tukwila is growing "up" with examples of tall modern buildings being built in the Southcenter
and International Blvd areas. The Tukwila Tight rail station is a contemporary inspiration.
Image 2 — Our neighborhood developer lives in this castle on 146th completed in 2015. While it has
classic design cues, the key word here is scale.
Image 3 - Currently under construction a block and half away is this new residence roughly triple the size
of the original house on the lot.
Image 4 — Across the street (SE), this house peaks at 35 feet above street level blocking out the sun for
several 1950's style ranchers in the area.
Image 5 — Our house following completion of the kitchen enlargement, portico and modernization
project in 2014.
The exteriors of the new garage/deck structure will match the primary and trim colors, roofing material,
rock accents and door treatments of the current home.
