In addition to restoration required as part of the code violation, the applicant is requesting to reduce the buffer of a Category III wetland to increase the paved area of the storage yard, and proposes wetland enhancement and wetland buffer restoration within the remaining area of the buffer and its associated wetland to mitigate for previous impacts from the fill as well as proposed impacts of this project. DETERMINATION: The project falls under the planned action guidelines, and is therefore designated as a planned action. The decision is final with no administrative appeal. The project includes wetland and wetland buffer enhancement and restoration. The proposal is recommended for approval as a SEPA Planned Action. 1. BACKGROUND/PROPOSAL Tukwila's Manufacturing and Industrial Center (MIC) is one of the Puget Sound region's major industrial centers. Industrial development over most of the sub -area was evaluated in multi -site environmental review. In 1992, a programmatic environmental impact statement (EIS) was prepared for the Duwamish Corridor master plan, a proposal to redevelop Boeing properties in the MIC over a 10-year period. In 1998, sub -area plan/EIS updates extended the previous analysis of the corridor's Boeing properties (about 650 acres) to the entire MIC sub -area (about 1,370 acres). The current proposal is to construct an outdoor truck and contractor's storage yard, including paving the access to the site from Boeing Access Road and approximately one acre for i:he storage area. The project involves restoration of the wetland buffer in response to a code enforcement action from 2014 during which the site was cleared of vegetation and filled with construction debris and other materials. In addition to restoration required as part of the code violation, the applicant is requesting to reduce the buffer of a Category III wetland to increase the paved area of the storage yard, and proposes wetland enhancement and wetland buffer restoration within the remaining area of the buffer to mitigate for previous impacts from the illegal fill as well as the proposed impacts of this project. II. DECISION CRITERIA This proposal was identified as a potential Planned Action because of its location within the subarea subject to the Tukwila Manufacturing/Industrial Center Integrated GMA Implementation Plan and Environmental Impact Statement. The determination of whether a project fits the Planned Action criteria is divided into two phases. Each phase is described below, including a response that explains how the current proposal meets the criteria. 1) In the first phase, a determination is made whether the project satisfies all the following characteristics (contained in TMC 21.04.152 Planned Actions Identified): 1. The action is a "permitted use" located within the MIC/L (TMC 18.36.020) and MIC/H (TMC 18.38.020) zones and/or is an accessory use (TMC 18.36.030 and 18.38.030 respectively). 2. The action is: a. not an "essential public facility" as defined in RCW 36.70.200 and TMC 18.06.270, b. not a conditional or unclassified use, in the respective MIC/L or MIC/H zones, c. not a development, any portion of which includes shoreline modifications waterward of the ordinary high water mark, d. not a development associated with 16th Avenue Bridge construction activities. Response: Use of the site as a truck and contractor's storage yard is a permitted use in the MIC/H zone. Will all the impacts of the proposal be mitigated by the time the project is complete? Please document all mitigation measures, using attachments if necessary. Response: Based on the answers provided in the Endangered Species Act (ESA) Screening Checklist, the project does not constitute a "take" under ESA. The following provides clarification for items answered "yes" in the ESA Screening Checklist. Compliance with existing codes will mitigate any impacts related to grading, storm water, and hazardous substances. (1) Grading and clearing —The project includes grading and clearing associated with construction of the parking area and wetland buffer restoration. A Temporary Erosion and Sedimentation Control Plan has been prepared for the project. A mitigation plan has been prepared to enhance the existing wetland and to restore the wetland buffer with new plantings. The mitigation area will be subject to maintenance and monitoring to ensure the success of the newly enhanced and restored areas. (2) Processing or handling, storage, or treatment of hazardous substances— The applicant has stated that the site will be used for storage of dump trucks and construction materials including wood and metal scaffolding, forms, and trench holdbacks. No loose or organic material is proposed to be stored. Applicant shall be responsible for obtaining any applicable permits required from other agencies for the proposed paving and mitigation work, as well as any required permits for activities associated with the business on the site. (3) Construction of new impervious surfaces —Construction of new impervious surfaces includes pavement for the new driveway to the site from Boeing Access Road and the storage yard. An oil/water separator and a bioswale are proposed for management at stormwater at the south end of the storage yard, adjacent to the wetland buffer. The project shall comply with the 2016 King County Surface Water Design Manual and is required to obtain a NPDES Construction Stormwater permit. Compliance with stormwater requirements and implementation of BMPs will mitigate impacts of new impervious surfaces to stormwater. B. Is the proposal consistent with the applicable sections of the Tukwila Comprehensive Plan? The proposed project meets the following goals and policies of the Tukwila Comprehensive Plan: Goal 11.1: Support for existing industrial activities in the Manufacturing/Industrial Center and development of new industrial activity, in order to maximize the employment and economic benefits to the people of Tukwila and the region, while minimizing impacts on residential neighborhoods. Policy 11.1.5: Allow uses that are commonly associated with manufacturing and industry, including those directly supporting such activity, such as offices and laboratories, while prohibiting unrelated uses. III. PUBLIC COMMENTS A Notice of Application was distributed by mail on March 29, 2017 to owners and tenants of properties within 500 feet of the project site, as well as agencies that may have an interest in the project. The Notice of Application was also posted on the project site. Three comments were received in response to the Notice of Application, from the Washington State Department of Ecology, Sound Transit, and the Muckleshoot Indian Tribe. These comments are attached, along with City of Tukwila and applicant's responses to the comments. Several conditions of approval will be added to the Special Permission permit associated with this SEPA application to address comments from the Department of Ecology and the Muckleshoot Indian Tribe. IV. CONCLUSION The current proposal to construct a storage yard and associated wetland restoration and enhancement of a Category III wetland is consistent with the criteria for approval as a Planned Action. The proposed use of the site as a storage yard is a permitted use in the MIC/H zone, and satisfies all other criteria contained in TMC 21.04.152 regarding the proposed use of the site. Proposed actions associated with the proposal are consistent with Tukwila's Comprehensive Plan, and impacts associated with the current proposal will be mitigated. Sound Transit considered a portion of this site for a multimodal station for Sounder commuter rail and Link light rail. The Sounder commuter rail station did not advance through ST3 planning, and now Sound Transit is considering alternative locations in the vicinity, along E. Marginal Way, for the Link light rail infill station. The proposed development would be in the vicinity of Sound Transit's existing light rail guideway. It would be important that the development of this project not interfere with maintenance access to the light rail guideway during construction or operation of the proposed storage yard. What are the known dates of the wetland and/or wetland buffer violations on this site? The Dec 2, 2016 letter from Altmann Oliver Associates implies that there were further violations post the City's 10/27/2014 Violation Order? Were there further violations of clearing and grading of this wetland or its buffer? There were no violations of clearing and grading of this wetland or its buffer after the 10/27/2014 Violation Order. See applicant's response for further information. 2. The Violation Order specifically states that the mitigation plan was to be installed by November 30, 2014. Since this work appears to not have been done yet, what is the mitigation for the temporal Toss of wetland functions and wetland buffer functions as a result of the previous clearing and grading actions that have not been mitigated? There is no mention of these mitigation measures in the materials we reviewed. It should be noted that the site may be limited in its ability to fully mitigate for project impacts; therefore, the applicant may need to look at off -site areas, including King County's ILF program. We are planning to issue the Special Permission permit with a condition of approval requiring that the mitigation work shall be started as soon as possible (prior to, and - if needed - independent of, the storage yard construction schedule). 3. Where is the analysis to demonstrate how the requested wetland buffer reduction meets TMC 18.45.080(F)? See applicant's response. The 2014 violation consisted of clearing and grading on top of a portion of the previously filled area and included a relatively small area of degraded wetland buffer in the southern portion of the proposed development area. 2. The Violation Order specifically states that the mitigation plan was to be installed by November 30, 2014. Since this work appears to not have been done yet, what is the mitigation for the temporal loss of wetland functions and wetland buffer functions as a result of the previous clearing and grading actions that have not been mitigated? There is no mention of these mitigation measures in the materials we reviewed. It should be noted that the site may be limited in its ability to fully mitigate for project impacts; therefore, the applicant may need to look at off -site areas, including King County's ILF program. There has been no temporal loss of wetland functions since no wetlands have been recently filled. Furthermore, the total area of wetland buffer actually impacted on the site by the recent clearing is relatively small and was not functioning at a high level prior to impact. The City of Tukwila's municipal code specifically allows buffer reduction with the implementation of a buffer enhancement plan. We have prepared a buffer enhancement plan (Figures 1 through 8) that will significantly increase the plant species and structural diversity of the degraded buffer on the site Early on in the project an agreement was reached with the City that the buffer restoration would be conducted in conjunction with the proposed project to avoid restoring areas that would then be subsequently impacted as part of a development proposal. The proposed enhancement of the degraded on -site buffer should fully mitigate for the proposed code - allowed buffer reduction and no off -site mitigation is necessary. 3. Where is the analysis to demonstrate how the requested wetland buffer reduction meets TMC 18.45.080(F)? Jaimie Reavis May 30, 2017 Page 3 TMC 18.45.080.F allows for the reduction of a standard by up to 50% only on degraded buffers that do not contain slopes in excess of 15%. The buffer proposed for reduction with enhancement is relatively flat and has been significantly degraded through historic filling and the establishment of invasive plant communities. As part of the enhancement plan, fill material and invasive non-native species would be removed and the area re -planted with a wide variety of native species to increase the plant species and structural diversity of the wetland and buffer over existing conditions. These plantings would increase the wildlife habitat of the area while also providing increased screening to the wetland from the storage yard and would therefore meet the requirements of TMC 18.45.080.F. In addition, a water quality treatment area has been designed for the area adjacent the enhanced buffer. This stormwater facility would treat runoff from the storage yard prior to discharge into the buffer and wetland. 4. Has the rest of the property been surveyed for wetlands? The Property is located at 4113 S. Boeing Access Rd. in the City of Tukwila (Parcel # 3348401890). The area that was reviewed is on the northern half of the Property. Mr. John Altmann of Altmann Oliver Associates (AOA) is the project ecologist and I was asked to provide a secondary consultant review. The City of Tukwila has issued a Violation Notice & Order (# CE14-0439) that includes non -permitted grading and potential wetland impacts. Purpose The purpose of the Secondary Consultant Review is to provide a second professional opinion and assist with determining the wetland boundary specifically within an area that was filled years ago. I conducted a wetland inventory of approximate area on the subject Property for the City after the significant filling events had occurred. Methodology The wetland method used the Corps of Engineers Wetland Delineation Manual (1987), as required, for wetland identification. Currently the Regional Supplement to the Corps of Engineers Wetland Delineation Manual (Regional Supplement -May 2010) is also used specifically for Western Mountains, Valleys, and Coast Region. The wetland determination criteria (vegetation, soils, and hydrology) observed on -site was used to support the investigation findings. Typically "Group A" primary wetland hydrology indicators (surface water, high water table, saturation) listed in the Regional Supplement (2010) are absent during the summer. However, other primary indicators "Group B" - Evidence of Recent Saturation were observed. In addition the soil conditions are significantly disturbed on this site from past filling so obvious changes in topography were used. A map of the Property with approximate locations of wetland flagging is attached ("Tukwila Property" Approximate Wetland Boundary). Due to the amount of old till material the delineation did not install formal wetland data plots and soil pits. Mr. Daniel Assefa, Tukwila Property (Parcel # 3348401890) July 30, 2015 Page 2 Wetland Delineation The northern area of the Property was investigated on July 14, 2015 to review the presence of wetland area and the delineated wetland boundary. The wetland boundary was delineated with 10 plastic flags tied to vegetation. The flagged wetland boundary is shown as approximate on the attached map. This wetland boundary may be surveyed after City verification and approval. The site's topography is nearly flat but there is a gradient that slopes north to south due to past filling events. The recent filling and grading activity did not appear to add a significant amount of fill to the area. Clearing of vegetation is evident but it is a relatively narrow portion of the north Property area. The Vegetation has dominant tree cover black cottonwood (Populus balsamifera) throughout the north area. Shrub cover does change from dense Himalayan blackberry (Rubus discolor) to scattered patches of Douglas' spirea (Spiraea douglasii) in the wetland. Creeping buttercup (Ranunculus repens) and soft rush (Juncus effusus) are groundcover also growing in the identified wetland area. Changes in shrub and groundcover species composition are not abrupt between the wetland and upland but do reflect the presence or absence of seasonal ponded water. The Soil type is not mapped in this area but due to development activities is primarily old fill material. One location near the wetland boundary has visible fill material of about 3 feet in depth. It appears that there may be wetland area formed on top of the fill due to poor drainage and the amount of stormwater runoff that drains to this property. Primary wetland Hydrology indicators were observed on the site to determine the wetland boundary. Due to the time of year the Group A primary indicators (surface water or saturated soils) would not need to be present. However, Group B primary hydrology indicators (evidence of recent inundation) are present. These primary indicators include B 1 — water marks, B2 — sediment deposits, B6 — surface water cracks, B8 — sparsely vegetated concave surface, B9 — water stained leaves, and B 10 — drainage patterns. In summary, this Review assisted with delineating the wetland boundary for City permitting.
