The City SEPA Responsible Official has previously determined that this application does not require a SEPA threshold determination because it is categorically exempt. This letter serves as the Notice of Decision per TMC 18.104.170. Based on the latest project submittal, preliminary approval is granted subject to the conditions stated below. The conditions imposed are to ensure the short plat is consistent with the Criteria for Preliminary Approval listed at TMC 17.12.020 C in the Tukwila Subdivision Code. Preliminary Approval Conditions Prior to the Final Short Plat approval: 1. Revise Short Plat Map sheets 1 & 2 of 2 to conform with Planning Division short plat template. Add L16-0047 to Short Plat Number. See enclosed sample short plat map for information only. 2. Revise the survey map with the following changes: Add the following notes: a) "As part of construction of a residence on Parcel 'A', the property owner shall install a new fire hydrant to meet the requirement of a hydrant within 250 feet by line of vehicular travel to the nearest point of the building." Water supply lines shall be sized to accommodate this requirement" c) "The final grading plan for the construction of the dwelling unit on Parcel A must show a flat area below any second story rescue windows for Fire Department ground ladder placement" d) "The proposed structure on Parcel A shall be located within approximately 150 feet from the 53rd Ave right-of-way; or the dead-end fire apparatus access road must be provided with an approved turnaround." Please note that 150 feet is measured from the edge of ROW (53rd Ave. S) to the front corner of the proposed structure on parcel A. e) Add addresses on the survey for each lot. Addresses are assigned by the Fire Marshal's Office for this project. Parcel "A" address will be 13945 53 Ave S. Parcel "B" shall retain the address of 1.3951 53 Ave S. f) Provide a Private Ingress/Egress & Utility Easement and Maintenance Agreement NOTE on the short plat map. The Private Ingress/Egress & Utility Easement and Maintenance Agreement should include language stating who will maintain the paved area and utilities, and by what portion. The applicant should add the following language to the Private Ingress/Egress & Utility Easement and Maintenance Agreement. "It is the intent of the Grantor that this agreement shall not be extinguished by the doctrine of merger". Attain recording number for easement and include within the short plat map. Additionally, it is not possible for property owner(s) to grant an easement to themselves. a. Owner/Applicant to complete a Traffic Concurrency Certificate Application and pay a Transportation Concurrency Test Fee in the amount $300 as part of this Short Plat — L16- 0047. (See enclosed.) 4. Demolition of structures over 200 square feet and/or connected to utilities requires a Demolition permit. Please contact the Building Division at 206.431.3670. Demolition permit shall be finaled prior to the final short plat approval. Informational Items: • City project to improve 53rd Ave. South adjacent to this short plat may begin construction by Spring of 2017. Design stage is currently at 30% plans for this project. Work within 53rd Ave. South will include curb, gutter, sidewalk, storm drainage, street paving, and driveway access. Therefore, any work associated with the short plat shall be completed within 53rd Ave. South prior to start of City project. The applicant shall apply for a Public Works (PW) type 'C' permit for approval. A Street Use will be part of this permit and require bonding, insurance, and a Hold Harmless Agreement; for work within the Public Right -of -Way. • Transportation Impact Fee applies to the future Building Permit. See Pavement Mitigation and Transportation Impact Fees Bulletin no. A3 — enclosed. • City of Tukwila is Water and Sanitary Sewer provider. Water meter charge and Cascade Water Alliance Fee apply to the future Building permit. NEXT STEPS: 1. Construction permits: Installation of site improvements and utilities is required as part of construction on Parcel A.. You will need to obtain all required permits prior to beginning any construction. For City of Tukwila utilities, contact Tukwila Public Works at (206) 433-0179 for a Public Works (PW) Type 'C' permit. For utilities provided by other entities, contact the individual providers. 2. Final Approval: Submit documents for final approval. After installing the required site improvements and complying with the conditions of approval submit the necessary short plat documents (survey, legal descriptions, and other required paper work) for city signatures. All taxes and fees assessed against the property must be current prior to final approval. Please check with the King County Assessor's Office and the City of Tukwila Finance Department prior to submitting final documents. After the documents have been found to be in order, and the all of the requirements of the short plat have been met, the Chair of the Short Subdivision Committee signs your short plat which constitutes a grant of final approval. 3. Recording: The signature of the Chairman of the Short Subdivision Committee certifies that your short plat application is ready for recording. It is your responsibility to record the City approved short plat documents with the King County Department of Records. The short plat is not complete until the recording occurs and copies of the recorded documents are provided to the Department of Community Development. After recording, the County returns the recorded original to the City of Tukwila within 4-6 weeks, at which time your short plat is considered complete. You can shorten this processing time by hand -delivering a copy of the recorded short plat to the project planner. In many circumstances, building permits on the short platted property may not be issued until a copy of the recorded short plat (or original) is returned to the Department of Community Development. EXPIRATION OF PRELIMINARY APPROVAL The final approved short plat must be filed with the King County Department of Records within one year from the date of this preliminary approval or the application will expire. The City may grant a single one year extension if requested in writing prior to the expiration date. APPEAL RIGHTS This short plat approval decision may be appealed to the Hearing Examiner. One administrative appeal of the decision on the short plat, excluding challenges to the DNS, is permitted. If no valid appeals are filed within the time limit, the decision of the Department will be final. In order to appeal the decision a written notice of appeal must be filed with the Department of Community Development within 21 days of the issuance of the Notice of Decision. The requirements for such appeals are set forth in Tukwila Municipal Code 18.116. Appeal materials shall include: 1. The name of the appealing party. 2. The address and phone number of the appealing party; and if the appealing party is a corporation, association or other group, the address and phone number of a contact person authorized to receive notices on the appealing party's behalf. 3. A statement identifying the decision being appealed and the alleged errors in the decision, including any specific challenge to an MDNS. 4. The Notice of Appeal shall identify (a) the specific errors of fact or errors in application of the law in the decision being appealed; (b) the harm suffered or anticipated by the appellant, and (c) the relief sought. The scope of an appeal shall be limited to matters or issues raised in the Notice of Appeal. 5. Appeal fee per the current fee schedule, additional hourly charges may apply. In addition all hearing examiner costs will be passed through to the appellant. Any appeal shall be conducted as an open record hearing before the Hearing Examiner. The Hearing Examiner's decision on the appeal is the City's final decision. Would we be looking to grant Final Approval only after they have completed this work? This would require inspection on our part to ensure that all work was completed in order to issue the final short plat. The applicant would also need to submit a PW permit for the work within 53'd, as you know, so perhaps we should include language within the preliminary approval surrounding this? Thanks! The entire property drains to one basin with a contributing area of 0.43 acres. The general topography of the site slopes from southwest to northeast. Elevations on the site vary from a high point of 512 feet at the southwestern property line to 500 feet at the northeastern property line. The KCRTS equivalent soils group, as defined in Table 3.2.2.E of the 2009 King County Surface Water Manual (KCSWM), is till. Icm Till —Compact diamict containing submunded to well-rounded clasts in massive, silt- or sand -rich matrix. Glacially transported and deposited. Figure 3 — Soils Map Not -to -Scale Soils Investigation Soils on this property were investigated by a representative of The Concept Group. Three holes were excavated at the approximate location of the proposed location of the stormwater BMPs using a hand auger. In accordance with Section C.2.2.1 of the 2009 King County Surface Water Design Manual, soil logs were excavated to a depth of 5 feet. This test was conducted during the dry -season. No groundwater seepage was observed at the maximum depth of 5 feet. No hardpan or restrictive layer was not encountered at this maximum depth. The Concept Group Page 4 Binh Dinh Short Plat -Technical Information Report October 2016 A particle size distribution soils analysis for a representative soil sample was performed by A.A.R., Testing Laboratory Inc. on September 14, 2016. The analysis confirms that the soils at the site are composed of 233/0 fine sand and 42.7% medium sand or larger; the Unified Soil Classification System (USCS) classification of the sods is SM. Refer to Appendix A for the sieve results. The project adds more than 5,000 SF of new impervious surface; therefore, is subject to a drainage review. The eight (8) Core Requirements and five (5) Special Requirements of the SWM drainage requirements are detailed in this section. Table 1 provides a summary to the requirements. Core Requirement #3: Flow Control The project is exernpt from flow control requirements because the project proposes Tess than 10,000 SF of new and/or replaced impervious surface. Core Requirement #4: Conveyance System No conveyance system is proposed for this project. Core Requirement #5: Erosion and Sediment Control The project will provide erosion and sediment controls (ESC) to prevent, to the maximum extent practicable, the transport of sediment from the project site. Task 5: Mitigation of Existing or Potential Problems Flows from the development will be mitigated with infiltration trenches. No existing or potential flooding problems, capacity, or erosion problems were observed during the site visit. Based on the availability of existing drainage information, and the proposed drainage improvements, the developed site will not create or aggravate existing downstream conditions. It is located within the Duwamish River drainage basin. Discharge at Natural (Existing) Location Stormwater currently sheet flows northeast towards 53rd Avenue South and enters a public storm drain system which eventually discharges to the Duwamish River. Developed Site Hydrology The project proposes to construct one (1) new single-family structure, an access driveway, associated utilities and on -site stormwater management facilities. Developed Onsite Assumptions The existing SFR located on the property will remain. New impervious surfaces for the additional lot are detailed in Table 2 below. Infiltration Trench Design Per the 2009 KCSWM Section C.2.2, infiltration trenches for projects with fine sand soils must be at least 75 feet in length per 1,000 square feet of new impervious roof surface based on a 2 feet wide bottom. An overflow outlet is proposed to sheet flow storm water during heavy rainfall events. Water Quality System This project is exempt from Water Quality requirements as defined by Core Requirement #8 based on the surface area exemption because only 2,072 square feet is pollution - generating impervious surface (PGIS). PGIS is defined as "an impervious surface considered to be a significant source of pollutants in surface and storm water runoff Such surfaces include those subject to vehicular use or storage of erodible or leachable materials, wastes, or chemicals, and which receive direct rainfall or the run-on or blow-in cf rainfall." Non-metal rooftops are not considered PGIS; therefore, are not included in the PGIS area calculations. Water quality is not required for this project because the project does not create more than 5,000 sq ft of pollution generating impervious surfaces. An Erosion and Sedimentation Control plan has been prepared to assist the contractor in complying with these requirements and designed to prevent sediment - laden run-off from leaving the site during construction. Refer to Appendix C for Erosion Control plans and details. The erosion potential of the site is influenced by four major factors: soil characteristics, vegetative cover, topography, and climate. Erosion/ sedimentation control is achieved by a combination of structural measures, cover measures, and construction practices that are tailored to fit the specific site. Construction Sequence and Procedure Prior to the start of any grading activity upon the site, all erosion control measures, including installation of a stabilized construction entrance, shall be installed in accordance with the construction documents. The best construction practice will be employed to properly clear and grade the site and to schedule construction activities. The planned construction sequence for the construction of the site is as follows: 1. Hold Erosion Sedimentation Control pre -construction meeting on site. 2. Initial Erosion Sedimentation Control (IESC) site inspection. 3. Hold Pre -Construction meeting. 4. Post sign with name and phone number of ESC Supervisor. 5. Flag or fence clearing limits as required by the approved plans, permit conditions or SEPA conditions. 6. Inspection and sign -off of clearing limits by representative of the Department of Planning and Community Development. 7. Install catch basin protection if required. 8. Grade and install construction entrance(s). 9. Install perimeter protection (silt fence, brush barrier, etc.). 10.Construct sediment ponds and traps (if required). 11.Inspection of ESC measures by the Public Works Inspector prior to commencement of grading activities. 12. Grade and stabilize construction roads. 13.Construct surface water controls (interceptor dikes, pipe slope drains, etc.) simultaneously with clearing and grading for project development. 14.Maintain erosion control measures in accordance with City of Tukwila and King County standards and manufacturer's recommendations. 15. Relocate erosion control measures or install new measures so that as site conditions change the erosion and sediment control is always in accordance with the King County Erosion and Sediment Control Standards. 16.Cover all areas that will be unworked for more than seven days during the dry season or two days during the wet season with straw, wood fiber mulch, compost, plastic sheeting or equivalent. 17. Stabi I ize all areas that reach final grade within seven days. 18. Seed or sod any areas to remain unworked for more than 30 days. Trapping Sediment Structural control measures will be used to reduce erosion and retain sediment on the construction site. The control measures will be selected to fit specific site and seasonal conditions. The following items will be used to control erosion and sedimentation processes: • Temporary gravel construction entrance • Filter fabric fences (Silt fences) • Ground cover measures such as straw cover and/or hydroseeding • Inlet protection Vehicle tracking of mud off -site shall be avoided. Installation of a gravel construction entrance will be installed at a location to enter the site. The entrances are a minimum requirement and may be supplemented if tracking of mud onto public streets becomes excessive. Proper maintenance is important for adequate functioning of the stormwater facilities. If it is unclear whether a problem exists, contact a Professional Engineer. At a minimum, infiltration and dispersion trenches must be maintained as follows: • Trenches must be inspected annually and after major storm events to identify and repair any physical defects. Maintenance and operation of the system should focus on ensuring the system's viability by preventing sediment -laden flows from entering the device. Excessive sedimentation will result in a plugged or non- functioning facility. • If the trench has a catch basin or yard drain, sediment accumulation must be removed on a yearly basis or more frequently if necessary. Prolonged ponding around or atop a device may indicate a plugged facility. • If the device becomes plugged, it must be replaced. • Keeping the areas that drain to infiltration and dispersion devices well swept and clean will enhance the longevity of these devices. • For roofs, frequent cleaning of gutters will reduce sediment loads to these devices.
