(obo T-Mobile) Type of Permit Applied for: Type 1 Wireless Facilities Permit Project Description: Approval of a Type 1 Telecommunications Facilities Permit to replace 3 panel antennas on an existing rooftop base station wireless facility. The applicant also proposes to add 3 RRUS (one per sector), and 2 baseband modules to be located within an existing cabinet. The project is categorically exempt from SEPA [WAC197-11-800(25)]. No ground disturbance or expansion of the existing compound is proposed. Location: Parcel # 1157200017. This facility is located at 15215 52nd Ave S, Tukwila, WA 98188. DECISION SEPA Determination: The City SEPA Responsible Official has previously determined that this application does not require a SEPA threshold determination because it is categorically exempt. Decision on Substantive Permit: The City Community Development Director has determined that the application for a Type 1 Wireless Communication Facilities Permit does comply with applicable City and state code requirements and has approved that application. III. YOUR APPEAL RIGHTS The Decision on this Permit Application is a Type 1 Wireless Communication Facilities permit decision pursuant to Tukwila Municipal Code § 18.104.010. Other land use applications related to this project may still be pending. No administrative appeal of a DNS or an EIS is permitted. One administrative appeal to the City Hearing Examiner of the Decision on the Permit itself is permitted. If an MDNS was issued, any person wishing to challenge either the conditions which were imposed by the MDNS decision or the failure of the Department to impose additional conditions in the MDNS must raise such issues as part of the appeal to the Hearing Examiner. A party who is not satisfied with the outcome of the Hearing Examiner appeal process may file an appeal in King County Superior Court from the Hearing Examiner's decision. IV. PROCEDURES AND TIME FOR APPEALING In order to appeal the Community Development Director decision on the Permit Application, a written notice of appeal must be filed with the Department of Community Development within 14 days of the issuance of this Decision, that is by December 20, 2016. The requirements for such appeals are set forth in Tukwilla Municipal Code Ch. 18.116. All appeal materials shall be submitted to the Department of Community Development. Appeal materials MUST include: 1. The name of the appealing party. 2. The address and phone number of the appealing party; and if the appealing party is a corporation, association or other group, the address and phone number of a contact person authorized to receive notices on the appealing party's behalf. 3. A statement identifying the decision being appealed and the alleged errors in the decision, including any specific challenge to an MDNS. 4. The Notice of Appeal shall identify (a) the specific errors of fact or errors in application of the law in the decision being appealed; (b) the harm suffered or anticipated by the appellant, and (c) the relief sought. The scope of an appeal shall be limited to matters or issues raised in the Notice of Appeal. Page 2 5. Appeal fee per the current fee schedule, additional hourly charges may apply. In addition, all hearing examiner costs will be passed through to the appellant. V. APPEAL HEARINGS PROCESS Any administrative appeal regarding the Permit shall be conducted as a closed record hearing before the Hearing Examiner based on the information presented to the Community Development Director, who made the original decision. No new evidence or testimony will be permitted during the appeal hearing. Parties will be allowed to present oral argument based on the information presented to the Community Development Director before their decision was issued. The Hearing Examiner's decision on the appeal is the City's final decision. Any party wishing to challenge the Hearing Examiner's decision on this application must file an appeal pursuant to the procedures and time limitations set forth in RCW Ch. 36.70C. An appeal challenging a DNS, an MDNS or an EIS may be included in such an appeal. If no appeal of the Hearing Examiner's decision is properly filed in Superior Court within such tirne limit, the Decision on this permit will be final. The City's decision to issue a DNS, an MDNS or an EIS is final for this permit and any other pending permit applications for the development of the subject property. VI. INSPECTION OF INFORMATION ON THE APPLICATION Project materials including the application, any staff reports, and other studies related to the permits are available for inspection at the Tukwila Department of Community Development, 6300 Southcenter Blvd., Suite 100, Tukwila, Washington 98188 from Monday through Friday between 8:30 a.m. and 5:00 p.m. The project planner is Lindsay Brown, who may be contacted at 206.433.7166 for further information. This project should be land use exempt and administratively approved under Rule 6409(a). 1. For towers other than towers in the public rights -of -way, does it increase the height of the tower by more than 10% or by the height of one additional antenna array with separation from the nearest existing antenna not to exceed twenty feet, whichever is greater; for other eligible support structures, does it increase the height of the structure by more than 10% or more than ten feet, whichever is greater. Applicant Response: The existing tip height of the antennas is 35.7 feet. The proposed antennas are slightly longer and have a proposed tip height of 38.7 feet. This minor change in antenna tip height increases the height of the structure by less than 10% and by less than loft. Additionally, matching the existing toe height of the antennas is necessary to prevent RF interference caused by the rooftop parapet. 2. The computations, analysis, and resulting report and conclusions were based on applicable FCC guidelines and regulations for maximum permissible exposure to humans consistent with FCC OET Bulletin 65, Edition 97-01. Additionally, Centerline Solutions, LLC certifies that the assumptions are valid and that the data used within Centerline Solutions' control are accurate, including information collected as part of Centerline Solutions' field surveys. Melendez, P.E. 6/30/2016 Page 3 of 20 Executive Summary This report provides the results of an RF power density analysis performed for T-Mobile's site, SE03999A_Parkridge. Current Site Configuration: Three -sectored site operating with technologies including GSM in PCS band (1900 MHz), UMTS in PCS band (1900 MHz), UMTS in AWS band (2100 MHz), and LTE in AWS band (2100 MHz). Proposed Site Configuration: Installation and operation of GSM in PCS band (1900 MHz), UMTS in PCS band (1900 MHz), UMTS in AWS band (2100 MHz), LTE in. 700 MHz band, and LTE in AWS band (2100 MHz). Scope of Work: The proposed physical modifications will result in installations of antennas and radio hardware at this site. Installations on Rooftop: • Replace and install (3) new panel antennas • Installation of (3) FRLB radio modules behind antennas Installations on Ground equipment cabinets: • Installation of (1) new FBBA baseband submodule • Installation of (1) new FBBC baseband submodule Site Description: • Tower Type and Height- Rooftop building, 27.1' AGL top of parapet • Equipment Location- On the ground floor. • Other Antennas- None • Access- Antennas are restricted by a locked roof access door located on the 2nd floor that leads to a roof hatch. • Existing Signage- There are existing blue Notice and Guidelines signs posted at the roof hatch. Analysis: The analysis of the RF power density at this site indicates that emissions on the rooftop level exposures may exceed the FCC's Maximum Permissible Exposure (MPE) limit for General Population. However, RF emissions on the rooftop level will not exceed the Page 4 of 20 Occupational MPE limits. The peak rooftop level exposure in accessible area is calculated to be less than or equal to 316.2% of the FCC General Population limit, which is equivalent to 63.2% of the Occupational limit. Conclusion and Recommendations: • The results of the analysis indicate that the power density levels on the rooftop level may exceed the FCC's General Population MPE limits with the proposed modification plan. • The results of the analysis indicate that the power density levels in the generally accessible area on the rooftop level will not exceed the FCC's Occupational MPE limits with the proposed modification plan. • Centerline Solutions recommends placing a blue Notice sign and Guidelines sign at each sector to mitigate the general public/maintenance workers who may not have EME training or awareness. See Signage/Diagram section for more details on the existing and proposed signage locations. • This site will be operating in general compliance with the FCC"s OET Bulletin 65 following the implementation of the proposed mitigation plan outlined in this report. Page 5 of 20 Introduction The purpose of this analysis and report is to evaluate the cumulative power density levels of all antennas located on the rooftop to identify any areas of concern that require mitigation. This report also assesses the site's compliance with FCC OET Bulletin 65; "Guidelines for Human Exposure to Radio -frequency Electromagnetic Fields". As part of this analysis, the site was visited on 4/21/2016, to perform a complete field survey. The purpose of the survey was to verify antennas located at the site and identify co -located wireless facilities. The power density simulation performed for this site utilized RoofView® analysis software. All active antennas were assigned an operating frequency and transmit power and were deemed to be operating at 100% of their rated output power. . Page 15 of 20 Appendix A: FCC Compliance and RF Safety Policies In August of 1997, the FCC published OET Bulletin 65 Edition 97-01 to regulate methods for evaluating compliance with FCC guidelines for human exposure to radiofrequency (RF) electromagnetic fields. The FCC guidelines for human exposure to RF electromagnetic fields incorporate two categories of limits; namely "Controlled" (a.k.a. Occupational) and "Uncontrolled" (a.k.a. General Public). The guidelines offer suggested methods for evaluating fixed RF transmitters to insure that the controlled and uncontrolled limits deemed safe by the FC for human exposure are not exceeded. OET Bulletin 65 recommended guidelines are intended to allow an applicant to "make a reasonably quick determination as to whether a proposed facility is in compliance with the limits." In addition, the guidelines offer alternate supplementary considerations and procedures such as field measurements and more detailed analysis that should be used for multiple emitter situations. These guidelines define RF as emissions in the frequency range of 300 kHz to 100 GHz. The FCC define Maximum Permissible Exposure (MPE) limits within this frequency range based on limits recommended by the National Council on Radiation Protection and Measurement, the Institute of Electrical and Electronics Engineers (IEEE), and by the American National Standards Institute (ANSI). Page 16 of 20 For General Population/Uncontrolled limits, the FCC states that "General Population/ Uncontrolled exposures apply in situations in which the general public may be exposed, or in which persons that are exposed as a consequence of their employment may not fully be aware of the potential for exposure or cannot exercise control over their exposure." For purposes of this analysis, all limits are evaluated against the Power Density limits. Typical guidelines for determining whether Occupational/Controlled limits can be applied include insuring the environment (such as a rooftop) as limited/controlled access via locked doors or physical barrier that are preferably controlled by a landlord that is aware of the situation and can inform anyone going through the locked door of the existence of the RF emissions. Such notification/awareness is typically accomplished by means of signage on the door, or other access to the area of concern, as well as signage on or near the antennas. Page 17 of 20 Appendix B: Overview of RoofView® Functions and Assumptions RoofView® is a tool developed and supported by Richard Tell Associates, Inc. to be used for analysis of RF field levels at telecommunications sites produced by antennas of the type commonly used in cellular, paging, SMR, PCS and two-way radio communications services. Although its name suggests that the tool is only for use in evaluating emissions for roof top applications, it can also be used to evaluate ground level effects of tower facilities. RoofView® allows the user to apply near field, far field, or a combination of near and far field computational methods as desired by the user. For this analysis, near field computations are used for areas within the near field, and far field computations are used beyond the near field. Specific break points are dynamic based on the aperture of the antenna being analyzed. The near field methodology is based on a cylindrical model that assumes the power into an antenna is distributed as a cylinder around the aperture of the antenna. Research by Richard Tell Associates, Inc. found that using such a model, along with corrections for height and antenna pattern, is very accurate, if not slightly conservative in estimating RF exposure. FCC Bulletin 65 recognizes the use of the cylindrical model for near field calculations.
