This letter serves as a notice of decision and is issued pursuant to TMC 18.104.170 on the following
project and permit approval.

Shoreline Tree Removal and Vegetation Clearing Permit
Decision on Substantive Permit: The City Planning Supervisor has determined that the application for a
Tree Permit does comply with applicable City and State Code requirements and has approved the
application with the following conditions:
• Planting and maintenance shall be in accordance with best management practices for
landscaping to ensure the vegetation's Tong -term health and survival per TMC
18.54.130.3.c(3).
• Trees should be planted as specified in the attached planting detail, entitled "TREE w/ BERM
(EXISTING SOIL MODIFIED)".
• Three inches of compost should be placed on top of soil in planting area and incorporated
(rototiilled) to a depth of at least 10 inches.
• Entire planting area should be mulched with 3-4 inches of medium bark or wood chips.
Mulch should not be placed against the trunks of the trees — leave a 4 inch circle around the
trunk un-mulched.
• Trees should be watered weekly during the dry months (generally July -September or as
necessary depending on conditions) for the first two growing seasons.
Applicant shall submit annual photos of all five (5) trees to the city's Urban Environmentalist
to ensure proper maintenance and a 100% survival rate for three years following initial
landscaping inspection.
III. FINDINGS
This tree clearing permit application is a request to remove three (3) sugar maple trees and replace
them with twenty-four (24) trees. Per TMC 18.44.080 in the shoreline jurisdiction, each tree removed
with a diameter over 20" must be replaced with eight (8) trees. Replacement trees will include a mix of
Western Red Cedar, Douglas Fir, Pacific Willow and Sitka Willow, 30 in total, to be located along a
nearby riverbank as an expansion of the Interurban Avenue Shoreline Improvement project, L14-0022.
As of August 9th, 2017, the 30 replacement trees have been planted and will undergo monitoring for
five years as outlined in the Decision section of this document.
Karen Walter, Watersheds and Land Use Team Leader for the Muckleshoot Indian Tribe Fisheries
Division, provided comments regarding the tree replacement plan. Ms. Walter was concerned that the
original Interurban Avenue Shoreline Improvement (L14-0022) project did not provide the required
number of replacement trees for that project, and that the proposed 30 additional trees for L16-0071
would not meet the replacement needs for both projects. After speaking with Ross Widener, the
landscape contractor for L14-0022, it was found that 30 replacement trees were required for L14-0022
and 24 replacement trees were required for L16-0071. A total of 60 trees have been planted, meeting
the replacement planting needs for both projects.

IV. YOUR APPEAL RIGHTS
The Decision on this Permit Application is a Type 1 decision pursuant to Tukwila Municipal Code
§18.104.010. Other land use applications related to this project may still be pending.
One administrative appeal to the City Hearing Examiner of the Decision on the Permit itself is
permitted.
A party who is not satisfied with the outcome of the Hearing Examiner appeal process may file an
appeal in King County Superior Court from the Hearing Examiner's decision.
V. PROCEDURES AND TIME FOR APPEALING
To appeal the Planning Supervisor's decision on the Permit Application, a written notice of appeal must
be filed with the Department of Community Development within 14 days of the issuance of this
Decision.
The requirements for such appeals are set forth in Tukwila Municipal Code Ch. 18.116. All appeal
materials shall be submitted to the Department of Community Development. Appeal materials MUST
include:
1. The name of the appealing party.
2. The address and phone number of the appealing party; and if the appealing party is a
corporation, association or other group, the address and phone number of a contact person
authorized to receive notices on the appealing party's behalf.
3. A statement identifying the decision being appealed and the alleged errors in the decision,
including any specific challenge to an MDNS.
4. The Notice of Appeal shall identify (a) the specific errors of fact or errors in application of
the law in the decision being appealed; (b) the harm suffered or anticipated by the
appellant, and (c) the relief sought. The scope of an appeal shall be limited to matters or
issues raised in the Notice of Appeal.
5. Appeal fee per the current fee schedule, additional hourly charges may apply. In addition all
hearing examiner costs will be passed through to the appellant.

Any administrative appeal regarding the Permit shall be conducted as a closed record hearing before
the Hearing Examiner based on the information presented to the Planning Supervisor who made the
original decision. No new evidence or testimony will be permitted during the appeal hearing. Parties
will be allowed to present oral argument based on the information presented to the Planning
Supervisor before their decision was issued. The Hearing Examiner's decision on the appeal is the
City's final decision.
Any party wishing to challenge the Hearing Examiner's decision on this application must file an appeal
pursuant to the procedures and time limitations set forth in RCW Ch. 36.70C. If no appeal of the
Hearing Examiner's decision is properly filed in Superior Court within such time limit, the Decision on
this permit will be final.
VII. INSPECTION OF INFORMATION ON THE APPLICATION
Project materials including the application, any staff reports, and other studies related to the permits
are available for inspection at the Tukwila Department of Community Development, 6300 Southcenter
Blvd., Suite 100, Tukwila, Washington 98188 from Monday through Friday between 8:30 a.m. and 5:00

information.
Property owners affected by this decision may request a change in valuation for their property tax
purposes. Contact the King County Assessor's Office for further information regarding property tax
valuation changes.

Hi Mike,
Attached is the proposal for the Ft. Dent planting that we visited today. It shows two locations, so I am not sure if we
just missed the second due to blackberry regrowth or if they were never planted. Might ask Ross if he planted both sites,
as I don't remember.
The only tricky catch here that I see is that in the response from the City to the Tribe for the Interurban project, we said
that we would plant 51 trees (only 30 were required) for that project. That means that technically there were only 9
additional planted for your project, which wasn't enough. I don't know that it will come up, but in case she says
something, you may need to be prepared to have Ross go and plant 10 more trees. Again, I think it is ok as technically
only 30 were required, it is just the fact that we told them we were planting 51 for that project and now we are
effectively changing our minds. Does that make sense? We can chat about it next week if you would like, but for now I
would say submit your photos and map via Max and we will go from there.

Dear Mr. Baker:
Below is the scope of work for the Fort Dent Park BNSF Sewer Relocation.
In 1975 the City of Tukwila constructed a 4" diameter sanitary sewage line within the shoreline setback area in a steel sleeve
under the BNSF (BN) railroad tracks that conveyed sewage from Fort Dent Park to the King County Metro sewer treatment
plant on the east side of Monster Road (see exhibit 1). The BN is planning to install a third set of track and is requiring the City
of Tukwila to extend their existing steel sleeve under their tracks (see exhibit 2). The proposed sewer line needs to connect to
the existing sewer lines, and it is not possible to extend the sleeve for the existing sewer pipe under tracks and keep the Fort
Dent Park sewer system in operation. The City of Tukwila is proposing the installation of a new 6" diameter sanitary sewer line
parallel to the existing King County and Tukwila sewers that cross under the BN tracks (see exhibits 3 and 4).
The proposed sewer line requires the removal of 3 sugar maple trees for the installation of an approximate 140'x40' boring pit
on the west side of the BN tracks in the Green River shoreline setback area. It is not possible to have the boring pit outside of
the shoring line setback area and save the 3 sugar maple trees (see exhibit 5). On the east side of the project, the bore pit is
outside of the shoreline set back. The steel sleeve will be installed by drilling between the 2 pits under the BN tracks, and the
2 pits will be the only excavations for the project.
During the excavation of the 2 bore pits, a professional archaeologist, meeting the requirements of the State of Washington,
will be on site to monitor for native artifacts exposed during construction (see exhibit 6). After the project is completed, the
disturbed areas will be restored to match the conditions prior to construction. The 3 sugar maple trees will be replaced with 24
trees in an area near the Green River, on the west side of Fort Dent Park, under the Shoreline Substantial Development
Permit L14-0022 (exhibit 7).

A permit is hereby granted to: City of Tukwila, Public Works Department to:
Repair and improve approximately 4,100 linear feet (0.78 mile) of Interurban Avenue from Fort Dent
Way to South 143`d Street. Approximately 1,200 feet (0.23 mile) of the project is within the 200 foot
shoreline jurisdiction of the Green River. The project involves installation of sidewalks, curb, gutter, a
new water main, storm drains, stormwater facilities, removal of an existing gabion wall and construction
of a new soldier pile wall in the same location; resurfacing the road, channelization, street lighting and
landscaping.
Upon the following property:

Development under this permit shall comply with the following conditions:
1. In the planting area just north of Ft. Dent Way, substitute 10 Western Red Cedars, five in each
planting area on either side of the driveway for either Red Osier Dogwood or snowberry.
2. Prior to starting construction, an ISA certified arborist shall examine, and trim if necessary any
tree branches in the area where the soldier pile wall is to be placed to avoid damage by
construction equipment.
3. A clean source of fill must be used for any fill placed in the shoreline jurisdiction.
4. Prior to final inspection of planted restoration trees and shrubs, submit a maintenance and
monitoring plan including performance standards.
5. As soon as possible, provide a detailed construction schedule to the Muckleshoot Indian Tribe to
ensure that any night time work does not interfere with tribal fishing in the area.
This permit is granted pursuant to the Shoreline Management Act of 1971 and nothing in this permit shall
excuse the applicant from compliance with any other Federal, State or local statues, ordinances or

Dear Mr. Cusick:
Thank you for contacting the Department of Archaeology and Historic Preservation (DAHP) regarding
your project. We have reviewed the information contained in the EZ-1 form provided to our office for the
above referenced project. The project area is either within or near precontct archaeological site 45K1 267.
Please be aware that archaeological sites are protected from knowing disturbance on both public and
private lands in Washington States. Both RCW 27.44 and RCW 27.53.060 require that a person obtain a
permit from our Department before excavating, removing, or altering Native American human remains or
archaeological resources in Washington. Failure to obtain a permit is punishable by civil fines and other
penalties under RCW 27.53.095, and by criminal prosecution under RCW 27.53.090.
Chapter 27.53.095 RCW allows the Department of Archaeology and Historic Preservation to issue civil
penalties for the violation of this statute in an amount up to five thousand dollars, in addition to site
restoration costs and investigative costs. Also, these remedies do not prevent concerned tribes from
undertaking civil action in state or federal court, or law enforcement agencies from undertaking criminal
investigation or prosecution. Chapter 27.44.050 RCW allows the affected Indian Tribe to undertake civil
action apart from any criminal prosecution if burials are disturbed.
We request a professional archaeological be onsite to monitor the excavation of the boring pits
under an archaeological monitoring plan reviewed by DAHP and the Tribes.

. Tsewerhe project will be the excavation of 3 boring pits for directional drilling for the installational of
600 feet +/- of 6" sewer forcemain from the southeast corner of Fort Dent Park, under the BNSF Railroad
tracks, to the west edge of Monster Road.
❑ Describe the existing project site conditions:
The work zone on the west side of Monster Road is near the gravel entrance to Manufactors Minerals,
a gravel processing company. The work zone on the west side of the project is 40 +/- north of the Green River
in a depressed area at the southeast corner of Fort Dent Park, west of the BNSF tracks, and adjacent to the
King County Metro sewer forcemain. The ground in this work area was disturbed by construction of Fort Dent
Park, Metro sewer force main, and the railroad tracks over 100 years ago. The area between the 2 zones is
used for gravel storage and railroad spur tracks that go to the Manufactors Minerals and King County Renton
sewage treatment plant. There will no ground disturbance between the 2 work zones.
❑ Describe the proposed ground disturbing activities:
There 3 temporary bore pits will be excavated, 2 at end and 1 at the other end of the project. The bore
pits will be about 30' +/- by 20' +/- by 10' +/- feet in depth.
❑ Check if building(s) will be altered or demolished. If so please complete a DAHP
Determination of Eligibility "EZ2 form" using our on-line Historic Property Inventory
Database for each building, 45 years or older, effected by the proposed project.

Thanks for all the information Andrea. I'll work with Michael and Carol Pennie (project manager) to
address archaeological requirements. Do you know what the Muckleshoot Indian Tribe has asked for
before? Unanticipated discovery plan in advance? Site investigation in advance of construction?
Monitoring during construction?
Rob Fritz (the biologist with my firm) worked for the Muckleshoots for six years and still has good
contacts there but I would prefer to know what they have requested in the past before contacting
them. Our firm does not have an archaeologist, so if that is required, we can assist in finding
additional help. For some low-level construction monitoring, Rob has been trained to provide this
and I believe he has done so for several stream projects - I'll check.

Hi Chad,
I have spoken with Minnlie, and we agree that a pre-app meeting is not necessary. Just go ahead and start the
permitting work and we will go from there.
Again, please submit a Shoreline Tree Removal permit that shows trees to be removed, replacement ratios,
and justification for why this alignment (which leads to the tree removal) is necessary. The current in lieu fee
for tree replacement is $124/tree. Ideally the trees would be planted on site, so please address why this isn't
possible. We will need a written letter, containing a basic project description, requesting a Shoreline
Exemption as this project is determined to be maintenance per WAC 173-27-040 (2)(b). A written
determination of exemption will be made by the City to submit to Ecology.
Also, another item, that I am not sure if is part of your scope of not...has an archeology survey been done? Do
you plan to have an archeologist on site during construction? This area is of concern for the tribe as it has the
possibility of a cultural site. The Muckleshoot have asked for this on prior projects so I think this needs to be
addressed if it has not already.

Hi Mike,
Excellent news about the exemption. I am forwarding an email from Chad; I think he was part of that conversation
perhaps? After your site visit with Minnie, it would be good to get it in writing that we're exempt if possible.
Chad has some budget that we set aside if we did not get an exemption. He can use that time to reach an agreement
with the City that a Tree Removal Permit is appropriate. Then we'll need to prepare the permit application and then
pursue the Renton Exemption.
I do not think he'll have enough hours to support us with the applications. KPFF will prepare supporting exhibits for this
effort.
I have a couple of questions about the specifications.
• Are you going to bid this using bid items verses lump sum?
• I propose we use as many standard bid items (2016 WSDOT) as possible. I think the actual drilling should be a
special provision (includes pipe, casing, drill pit etc).
• Do you happen to have any past Specials previous Tukwila jobs crossing BNSF that we can look at?
I am copying Chad and Mac on this. I am out of town the next two days. I am picking up my son from WSU and bringing
him home to the Nest!

Hi Carol - When I finally reached Minnie at Tukwila yesterday, Mike Cusick was already in her office, which
worked out great. It sounded like they were open to the shoreline exemption based on WAC 173-27-040 (2)(b)
at that time, but they still planned to do a site visit before finalizing their decision. I agree we should receive
something more formal, like a letter or e-mail from the planning department stating that the project is exempt
from the requirement to obtain a shoreline substantial development permit. But they may want to work out
issues for the Shoreline Tree Removal and Vegetation Clearing (Tree Removal) Permit first, since they are
related. For example, if the City decides we're not eligible for the Tree Removal Permit, it could push them to
either refuse to allow the trees to be removed or require a shoreline substantial development permit to
remove them. So we should focus on eligibility for the Tree Removal permit for now.
Regarding Mike's question about whether the Tree Removal permit is in our scope, it currently is not, but we
are able to provide the services. You did tell me in a previous e-mail that I can use the budget set aside for
Task 4 - Obtain Shoreline Exemption. I can use some of that time to obtain City agreement on whether a Tree
Removal Permit will work for the project. Then, we can work out the details on support for the actual permit
application.
If you are OK with that, I'll work with you to develop answers to the City's questions/concerns below, and
hopefully convince them that the project is eligible for coverage under the Tree Removal permit.

After a brief discussion with Minnie, I think we need a bit more documentation from you regarding the proposed tree
removal. Even though I understand you will not be getting a shoreline permit as you are determining this to be
maintenance, you still need to be substantively compliant with the SMP. Additionally, tree removal will require a
Shoreline Tree Removal and Vegetation Clearing Permit, http://tukwilawa.gov/wp-content/uploads/DCD-Apps-
ShorelineTreeVegClearingPermit.pdf. Tree retention is prioritized in the Shoreline so you will need to explain and defend
the need for the removal and detail the proposed mitigation. For instance, why can't the pipe be moved to avoid the
trees? That kind of explanation will be required. On -site mitigation is preferred so you will also need to detail the need
for off -site or in -lieu fee mitigation. All this is written in 18.44.080. You will also see the table with the tree replacement
ratios that we talked about this afternoon.
I'm happy to help out if you need it, just let me know. If you need someone in PW to help out with drafting the permit
application, Mike Perfetti might be a good choice.

I don't see that we ever issued a shoreline exemption letter for the sewer upgrade project. Are you planning on
submitting one? Here is the language from WAC 173-27-040(2)(b) Normal maintenance or repair of existing
structures or developments, including damage by accident, fire or elements. "Normal maintenance" includes
those usual acts to prevent a decline, lapse, or cessation from a lawfully established condition. "Normal repair"
means to restore a development to a state comparable to its original condition, including but not limited to its
size, shape, configuration, location and external appearance, within a reasonable period after decay or partial
destruction, except where repair causes substantial adverse effects to shoreline resource or environment.
Replacement of a structure or development may be authorized as repair where such replacement is the common
method of repair for the type of structure or development and the replacement structure or development is
comparable to the original structure or development including but not limited to its size, shape, configuration,
location and external appearance and the replacement does not cause substantial adverse effects to shoreline
resources or environment.
We will need a written description and plans of the project including an analysis how it meets the normal
maintenance definition noted above. We will then prepare a written letter approving it as an exemption and
send it to Department of Ecology.
Also, I am not sure if you followed up on the archaeological concerns at the site. Are you planning on doing an
archaeological survey and/or have an archaeologist on site during construction? This was required for past
projects in the area based on comments from the Muckleshoot Tribe and Department of Archaeology.

PERMIT CENTER
The scope of work for the Fort Dent Park BNSF Sewer Relocation is the replacement of the existing
sanitary sewer force main under the BNSF railroad track. The BNSF is constructing a third set tracks and
is requiring the City of Tukwila, to upgrade the sewer force main under their tracks to meet their current
engineering specifications.
The installation of the proposed force main will require the removal of 3 maple trees in Fort Dent Park,
near the Green River. Site constrains prevent the replacement of the tree in the area near the force
main construction. The trees will be replaced in an area near the Green River, on the west side of Fort
Dent Park, under the Shoreline Substantial Development Permit L14-0022.

A permit is hereby granted to: City of Tukwila, Public Works Department to:
Repair and improve approximately 4,100 linear feet (0.78 mile) of Interurban Avenue from Fort Dent
Way to South 143th Street. Approximately 1,200 feet (0.23 mile) of the project is within the 200 foot
shoreline jurisdiction of the Green River. The project involves installation of sidewalks, curb, gutter, a
new water main, storm drains, stormwater facilities, removal of an existing gabion wall and construction
of a new soldier pile wall in the same location; resurfacing the road, channelization, street lighting and
landscaping.

Development under this permit shall comply with the following conditions:
1. In the planting area just north of Ft. Dent Way, substitute 10 Western Red Cedars, five in each
planting area on either side of the driveway for either Red Osier Dogwood or snowberry.
2. Prior to starting construction, an ISA certified arborist shall examine, and trim if necessary any
tree branches in the area where the soldier pile wall is to be placed to avoid damage by
construction equipment.
3. A clean source of fill must be used for any fill placed in the shoreline jurisdiction.
4. Prior to final inspection of planted restoration trees and shrubs, submit a maintenance and
monitoring plan including performance standards.
5. As soon as possible, provide a detailed construction schedule to the Muckleshoot Indian Tribe to
ensure that any night time work does not interfere with tribal fishing in the area.
This permit is granted pursuant to the Shoreline Management Act of 1971 and nothing in this permit shall
excuse the applicant from compliance with any other Federal, State or local statues, ordinances or
