Site Plan and Project Narrative Introduction The applicant seeks a conditional use permit to allow a school facility within a Low Density Residential zone. A public hearing was held on the application on March 6, 2017, at the Department of Community Development, 6300 Southcenter Boulevard, Tukwila, WA. Represented at the hearing were: the Department, by Maxwell Baker, Assistant Planner ("City"); and the applicant, Tukwila School District ("District"), by Lisa Klein. No members of the general public testified at the hearing. L16-0077 FINDINGS AND DECISION Page 2 of 4 For purposesof this decision, all section numbers refer to the Tukwila Municipal Code ("TMC" or "Code") unless otherwise indicated. After considering the evidence elicited during the appeal hearing, the Hearing Examiner enters the following findings of fact, conclusions, and decision on the application. Findings of Fact 1. The subject site is addressed as 4060 S 144th St. ("Property"). The site is a 49,684 square foot lot. The site is developed with a 5,250 square foot building that is used for the King County Foster Library ("Library"). The Library is re -locating to an adjacent property to the west, and the District has purchased the Property for use as technology and maintenance department offices. 2. The subject property is located at the northwest corner of S 144th Street and 42nd Avenue S in Tukwila. The property to the north contains the Normandy Court Condominium Complex, a forty six unit apartment building. The adjacent City owned parcels to the west are being redeveloped as part of the Tukwila Village project, and include the new Library location. Across S 144th Street to the south of the Property are parcels occupied by single-family homes, and which are zoned Low Density Residential. Foster High School occupies the land across 42' Avenue S to the east of the Property. 3. Except minor adjustments to rooftop mechanical equipment on the existing structure, no exterior improvements are planned for the project. All project improvements will be interior. Signage on the building will be replaced with no change in size. 4. The proposal will improve traffic circulation for surrounding land uses over the existing traffic conditions, because the proposal will generate traffic volumes equal to or less than existing traffic volumes. In addition, the District's use of the building will be primarily limited to normal business hours, whereas the Library is open most week nights until 9 PM, and is also open on weekends. Thus, District hours of use will reduce local traffic impacts in the evening and on weekends compared to the current Library use. The site may serve on some occasions as overflow parking for special events at Foster High School, which will help to reduce parking demand on nearby residential streets. 5. The property is zoned Low Density Residential. Schools are allowed as a conditional use within the Low Density Residential zone. TMC Title 18 Table 3. 6. The criteria for granting of a conditional use permit are set forth in TMC 18.64.050: (1) the proposed use will not be materially detrimental to the public welfare or injurious to the property or improvements in the vicinity; (2) the proposed use shall meet or exceed the same standards for parking, landscaping, yards and other development regulations that are required in the district it will occupy; (3) the proposed development shall be compatible generally with the surrounding land uses in terms of traffic and pedestrian circulation, building and site design; (4) the proposed development shall be in keeping with the goals and policies of the Comprehensive Land Use Policy Plan; and (5) • L16-0077 FINDINGS AND DECISION Page 3 of 4 all measures have been taken to minimize the possible adverse impacts which the proposed use may have on the area in which it is located. 7. No public comments were received concerning the proposal. Conclusions 1. The Hearing Examiner has jurisdiction over this application pursuant to TMC 18.104.010.3, which provides that a decision on a conditional use permit application is a quasi-judicial decision by the Hearing Examiner. 2. The proposal will not be injurious to the property or improvements in the vicinity, because the proposal is for interior improvements only, and will not noticeably alter the property and will not affect improvements in the vicinity. The proposed use will not be materially detrimental to the public welfare, because the proposed use is consistent with the school use to the east of the Property, and will reduce impacts such as noise and traffic that are currently generated by the public Library. 3. The existing parking, landscape, and other onsite elements conform to the Code, and will not change from current conditions. Therefore, the proposal will meet or exceed the same standards for parking, landscaping yards and other development regulations that are required in the district it will occupy. 4. The proposed use is compatible with the surrounding land uses. The Property is separated from single family homes to the south by S 144th Street, and an existing fence obstructs the Property from adjacent uses to the west and north. The school use of the Property is an extension of, and is consistent with, the school use to the east. Traffic and parking conditions in the area will be improved by the proposal. 5. The proposal is consistent with the goals and policies of the Tukwila Comprehensive Land Use Policy Plan. According to the Tukwila Comprehensive Plan, the Low Density Residential land use designation is primarily characterized for single- family residential structures, as well as educational and institutional uses. The proposed use is part of the District's campus, and is consistent with the purpose of the Low Density Residential zone. The site is also within the Urban Renewal Overlay, which is intended to promote community development. The uses allowed in the Overlay are the same as the underlying zoning. The Tukwila Comprehensive Plan calls for growth. As Tukwila schools modernize and expand, the proposed new administrative office building is necessary to increase education services to help accommodate that growth. An implementation measure of Tukwila's Economic Development goals (Element 2) is to collaborate with local school districts to improve the educational opportunities for Tukwila schoolchildren. The proposal is important in supporting the educational opportunities for students. L16-0077 FINDINGS AND DECISION Page 4 of 4 6. All measures have been taken to minimize the possible adverse impacts which the proposed use may have on the area. As indicated above, only interior modifications are proposed, and traffic and parking conditions in the area will be improved by the proposal. 7. The application meets all criteria for a conditional use permit, and should be approved. Decision The Conditional Use Permit is hereby GRANTED. Entered this 16th day of March, 2017. Applicant's response to Conditional Use Permit criteria Findings Background The 49,684 square foot subject site is developed with a 5,250 square foot building that has historically been and currently is used for the King County Foster Library. The Tukwila School District (TSD) recently purchased the library, which is itself relocating to a new facility along Tukwila International Boulevard in the spring of 2017. TSD will be using the existing building for technology and maintenance department offices that are currently located on the Foster High School campus and other facilities around the district. The building itself was constructed in 1994. No exterior improvements are planned for the project, with the exception of minor adjustments to the rooftop mechanical equipment. All improvements will be interior. Existing building signage will be replaced with no change in size. See Attachments B and C. Surrounding Land Uses The subject property is located at the northwest corner of S 144th St and 42nd Ave S in Tukwila. Across 42nd Ave S to the east is Foster High School. The adjacent northern parcel contains the Normandy Court Condominium Complex, a 46 unit apartment/condo building. The adjacent parcels to the west are owned by the City of Tukwila and are being redeveloped as part of the Tukwila Village project and where the new King County library replacing Foster Library is set to be located. The parcels to the south of the site are zoned Low Density Residential and contain single family homes. See Attachment B. Conditional Use Permit Criteria The proposed project must comply with criteria detailed in the Conditional Use Permit Chapter of the Tukwila Municipal Code (TMC 18.64.050). The property is zoned Low Density Residential and schools are listed as a conditional use. The applicant's response to the conditional use permit criteria is Attachment G to this staff report. Staff makes the following Findings using the Code's conditional use permit criteria (TMC 18.64.050) listed in italics: 1. The proposed use will not be materially detrimental to the public welfare or injurious to the property or improvements in the vicinity. The Tukwila School District currently owns and operates the 24 acres of property on which Foster High School and Showalter Middle School across the street are located. A description of the school district and the 2016 Construction Bond are included as Attachment A. 2. The proposed use shall meet or exceed the same standards for parking, landscaping yards and other development regulations that are required in the district it will occupy. The existing parking, landscape and other onsite elements conform to the Tukwila Municipal Code development regulations and will not change from current conditions. There are no requested deviations from the adopted development standards. The proposal) does not include any exterior modifications to the site; however, the existing parking meets/exceeds the requirements in Figure 18-7 of the TMC for schools (1.5 per staff member). The building meets minimum setbacks per TMC 18.10.060. The site meets/exceeds perimeter landscaping standards set in TMC 18.52.020 and internal landscaping standards set in TMC Chapter 18.52.035(b). 3. The proposed use shall be compatible generally with the surrounding land uses. The interior improvements and alterations are not expected to create any nuisances such as noise pollution or light pollution and, according to the Tukwila Comprehensive Plan, education and institutional uses are compatible with single-family areas. The traffic impacts of the administrative buildings are assumed to be equal or less than that of the existing Foster Library. In addition, contrasted with the current use of the building as a library, use of the building for the Tukwila School District's administrative offices will result in associated traffic in the residential neighborhood occurring primarily during normal business hours, with minimal to no impact during evening and weekend hours when residents are home. 4. The proposed use shall be in keeping with the goals and policies of the Comprehensive Land Use Policy Plan. The proposed administrative office is needed to service and support all schools within the Tukwila School District. These schools are considered a central part of their surrounding residential neighborhoods. The proposal is within the LDR zone. According to the Tukwila Comprehensive Plan, the LDR land use designation is primarily characterized for single-family residential structures, as well as education and institutional uses. The proposed use is part of the School District campus and consistent with the purpose of the LDR zone. The site is also within the Urban Renewal Overlay, which is intended to promote community development. The uses allowed in the Overlay are the same as the underlying zoning. The proposed project will not adversely impact the surrounding area, as no site changes are proposed. The interior tenant improvements will onVy modify the interior layout of the building and will not affect the site or its surroundings. Because the parking lot will also receive little use after business hours, the site may serve as overflow parking for special events at Foster High School, helping to reduce parking demand on nearby residential streets and positively impacting the surrounding area. Conclusions 1. The proposed use, an accessory structure directly related to a school's daily operations, is often found in residential zones where the surrounding low density residential uses are more sensitive to traffic and noise associated with this type of use. The uses surrounding the subject site should tolerate traffic to the site, which should be equal to or less than that of the Foster Library currently located on site. 2. Alterations will occur entirely within the interior of the existing building. No changes are proposed for the exterior, the building's setback, its parking area, or landscaping. 3. The proposed use will be compatible with the surrounding land uses. 4. The proposed use will not conflict with the goals and policies of the Comprehensive Plan. Recommendation Staff recommends adoption of the above findings and conclusions and approval of the conditional use permit. Utilizing the recordsand decisions of these earlier meetings and information from subsequent meetings held between March 2016 to present day with district staff, representatives of three architecture firms, many engineers, and appropriate city of Tukwila decision makers, early phases of the plans are moving along well and are aligned with the goals and objectives of appropriate projects. The bond proceeds for each project as of January 22, 2017 Is listed in the Table below. Eighty-three percent of the bond proceeds are allocated to Foster High School, Birth to Kindergarten and Showalter Middle School. Twelve percent of the bond proceeds are allocated to Cascade. The library is relocating to a new facility in the spring of 2017. The District will be using the existing building for technology and maintenance department (administrative) offices that are currently occurring on the Foster High School campus and other facilities around the District. The existing building is one story and 2,515 square feet. The property is 49,820 square feet and has 33 parking spaces. Access is provided via two driveways, one each on South 144th Street and 42nd Avenue South. The building was constructed in 1994. No exterior improvements are planned for the project, with the exception of minor adjustments to the rooftop mechanical equipment. All improvements will be interior, to include moving walls to provide conference rooms, kitchen, restrooms, and offices and cubicles for 18 regular employees. The existing building signage will be replaced with no change in size. Conditional Use Criteria The property is zoned Low Density Residential (LDR) and is located in the Urban Renewal Overlay (URO) District and Commercial Redevelopment Area. A CUP currently exists for the use of the property as a public library; however, a new CUP is required because the building will be converted to house administrative offices for the Tukwila School District. Responses below show consistency with the criteria for a CUP, as required in TMC 18.64.050: 1. The proposed use will not be materially detrimental to the public welfare or injurious to the property or improvements in the vicinity. The proposed use of the building will include technology and maintenance (administrative) offices for the Tukwila School District. The proposed project is for interior tenant improvements only and the proposed use will not affect the property or improvements in the vicinity. The proposed uses are already occurring on the other side of 144th Street on the Foster High School campus, as well as within other facilities in the district. The type of use will not generate any sort of public nuisance, such as noise or odor, and will likely generate less traffic than the existing library. The use is similar to a professional office. 2. The proposed use shall meet or exceed the same standards for parking, landscaping, yards and other development regulations that are required in the district it will occupy. The existing parking, landscape, and other onsite elements conform to the municipal code development regulations and will not change from current conditions. There are no requested deviations from development standards. The proposal does not include any exterior modifications to the site; however, the existing parking provided meets/exceeds the requirements in Figure 18-7 of the TMC for schools (1.5 per staff member). The building meets minimum setbacks per TMC 18.10.060. The site meets/exceeds perimeter landscaping standards set in TMC 18.52.020 and internal landscaping standards set in TMC Chapter 18.52.035(b). 3. The proposed development shall be compatible generally with the surrounding land uses. The site is in the LDR zone and is surrounded by single-family, detached homes and apartment units. Tukwila International Boulevard is nearby to the west and Foster High School, Showalter Middle School, and the Tukwila Pool are nearby to the east. The interior improvements and alterations are not expected to create any nuisances such as noise pollution or light pollution and, according to the Tukwila Comprehensive Plan, education and institutional uses are compatible with single-family areas. The traffic impacts of the administrative buildings are assumed to be equal or less than that of the existing library. In addition, contrasted with the current use of the building as a library, use of the building for the Tukwila School District's administrative offices will result in associated traffic in the residential neighborhood occurring primarily during normal business hours, with minimal to no impact during evening and weekend hours when residents are home. 4. The proposed use shalt be in keeping with the goals and policies of the Comprehensive Land Use Policy Plan. The administrative offices proposed are needed to service and support all schools within the Tukwila School District. These schools are considered a central part of their surrounding residential neighborhoods. According to the Tukwila Comprehensive Plan, the LDR land use designation is primarily characterized for single-family residential structures, as well as education and institutional uses. The proposed use is consistent with the purpose of the LDR zone. The site is also within the URO, which is intended to promote community development. The Tukwila Comprehensive Plan calls for growth. As Tukwila schools modernize and expand, the proposed new administrative offices are necessary to accommodate that growth. An implementation measure of Tukwila's stated Economic Development goals (Element 2) is to collaborate with local school districts to improve the educational opportunities for Tukwila schoolchildren. The offices for the technology and maintenance departments are considered to be important in supporting the educational growth of students. Migration of these facilities into a separate location will also enhance the District's ability to grow and accept additional students. 5. All measures shall be taken to minimize the possible adverse impacts which the proposed use may have on the area in which it is located. The proposed project will not result in any adverse impacts to the surrounding area, as no site changes are proposed. The interior tenant improvements will only modify the interior layout of the building and will not affect the site or its surroundings. Because the parking lot will also receive little use after business hours, the site may serve as overflow parking for special events at Foster High School, helping to reduce parking demand on nearby residential streets and positively impacting the surrounding area. The Notice of Application for a Shoreline Substantial Development Permit must include a statement that any person desiring to submit written comments on the application or desiring to receive notification of the final decision on the application may do so within 30 days of the Notice of Application. If a hearing will be held on the application, the hearing notice must include the information that written comments may be submitted, or oral presentation made at the hearing. The library is relocating to a new facility in the spring of 2017. The District will be using the existing building for technology and maintenance department (administrative) offices that are currently occurring on the Foster High School campus and other facilities around the District. The existing building is one story and 2,515 square feet. The property is 49,820 square feet and has 33 parking spaces. Access is provided via two driveways, one each on South 144th Street and 42nd Avenue South. The building was constructed in 1994. No exterior improvements are planned for the project, with the exception of minor adjustments to the rooftop mechanical equipment. All improvements will be interior, to include moving walls to provide conference rooms, kitchen, restrooms, and offices and cubicles for 18 regular employees. The existing building signage will be replaced with no change in size. Conditional Use Criteria The property is zoned Low Density Residential (LDR) and is located in the Urban Renewal Overlay (URO) District and Commercial Redevelopment Area. A CUP currently exists for the use of the property as a public library; however, a new CUP is required because the building will be converted to house administrative offices for the Tukwila School District. Responses below show consistency with the criteria for a CUP, as required in TMC 18.64.050: 1. The proposed use will not be materially detrimental to the public welfare or injurious to the property or improvements in the vicinity. The proposed use of the building will include technology and maintenance (administrative) offices for the Tukwila School District. The proposed project is for interior tenant improvements only and the proposed use will not affect the property or improvements in the vicinity. The proposed uses are already occurring on the other side of 144th Street on the Foster High School campus, as well as within other facilities in the district. The type of use will not generate any sort of public nuisance, such as noise or odor, and will likely generate less traffic than the existing library. The use is similar to a professional office. 2. The proposed use shall meet or exceed the same standards for parking, landscaping, yards and other development regulations that are required in the district it will occupy. The existing parking, landscape, and other onsite elements conform to the municipal code development regulations and will not change from current conditions. There are no requested deviations from development standards. The proposal does not include any exterior modifications to the site; however, the existing parking provided meets/exceeds the requirements in Figure 18-7 of the TMC for schools (1.5 per staff member). The building meets minimum setbacks per TMC 18.10.060. The site meets/exceeds perimeter landscaping standards set in TMC 18.52.020 and internal landscaping standards set in TMC Chapter 18.52.035(b). 3. The proposed development shall be compatible generally with the surrounding land uses. The site is in the LDR zone and is surrounded by single-family, detached homes and apartment units. Tukwila International Boulevard is nearby to the west and Foster High School, Showalter Middle School, and the Tukwila Pool are nearby to the east. The interior improvements and alterations are not expected to create any nuisances such as noise pollution or light pollution and, according to the Tukwila Comprehensive Plan, education and institutional uses are compatible with single-family areas. The traffic impacts of the administrative buildings are assumed to be equal or less than that of the existing library. In addition, contrasted with the current use of the building as a library, use of the building for the Tukwila School District's administrative offices will result in associated traffic in the residential neighborhood occurring primarily during normal business hours, with minimal to no impact during evening and weekend hours when residents are home. 4. The proposed use shall be in keeping with the goals and policies of the Comprehensive Land Use Policy Plan. The administrative offices proposed are needed to service and support all schools within the Tukwila School District. These schools are considered a central part of their surrounding residential neighborhoods. According to the Tukwila Comprehensive Plan, the LDR land use designation is primarily characterized for single-family residential structures, as well as education and institutional uses. The proposed use is consistent with the purpose of the LDR zone. The site is also within the URO, which is intended to promote community development. The Tukwila Comprehensive Plan calls for growth. As Tukwila schools modernize and expand, the proposed new administrative offices are necessary to accommodate that growth. An implementation measure of Tukwila's stated Economic Development goals (Element 2) is to collaborate with local school districts to improve the educational opportunities for Tukwila schoolchildren. The offices for the technology and maintenance departments are considered to be important in supporting the educational growth of students. Migration of these facilities into a separate location will also enhance the District's ability to grow and accept additional students. 5. All measures shall be taken to minimize the possible adverse impacts which the proposed use may have on the area in which it is located. The proposed project will not result in any adverse impacts to the surrounding area, as no site changes are proposed. The interior tenant improvements will only modify the interior layout of the building and will not affect the site or its surroundings. Because the parking lot will also receive little use after business hours, the site may serve as overflow parking for special events at Foster High School, helping to reduce parking demand on nearby residential streets and positively impacting the surrounding area.
