A special meeting of the Tukwila City Council was called to order by Mayor Stan
Minkler at 8:00 P.M. Council members present were: R. A. Bowen, D. R. Gardner,
J. R. Johanson, G. D. Hill, P. F. Dunning, A. G. Radford and J. R. Sterling.
The purpose:.of the special meeting was to hold a Public Hearing to consider the
recommendation of the Tiakella .P]anning Commissiiin am the .fit far rezoning of
the Reslock property. (Lott.. 27 Block 15) Hillman "s
Seattle Garden Tracts;.
Mayor Minkler opened the Public Rearing. Mr. Johanson reviewed the recommendation
of the Planning Commission as presented to the Counc it at an earlier date. Hie
read a letter from the Planning Commission dated September 21, 1970 which recommended
granting of a rezone to R-3 on the property.
Mayor Minkler read a letter from Leo Johnson, 14210 -58th Avenue South protesting
the change in zoning on the property.
Mr. Harold Green,. 1500 id'ioge Building, attorney representing Mr. Reslock spoke in
behalf of the rezone petition. HIe stated Mr. Reslock accepted the finding of the
Planning Commission and agreed to all conditions of the rezone except the one
concerning the deeding to the City of 10 feet. of Mr. Reslock "s property for street
right of way on South 142nd. This condition was not acceptable to them.
Mr. Green stated he felt the granting of the rezone was in the public interest and
would relieve Mr. Reslock of the great hardship he is currently laboring under.
Mr. Green introduced maps and pictures previously introduced at the Planning
Commission hearing, pointing out the property was surrounded on three sides by
streets; the widening, of 58th Avenue has increased the traffic flow; while the
property previously looked over undeveloped land, it now looks out over industries;
and that the noise factor had greatly increased.
Mr. Green stated Mr. Reslock was not a developer, but simply a land owner who
had built an attractive building on one of the lots. Mr. Reslock plans to build'
one more similar structure if the request is granted. He would demolish the
present unattractive house and replace it with an attractive triplex building.
Mr. Green stated their objection to the condition in the Planning Commission
recommendation that Mr. Resolock: deed a 10 foot strip of land along South 142nd
for right of way was based on the following: The present R -1 structure was close
to South 142nd when Mr. Reslock purchased the proper'ttyf and the 10 foot dedication
of land would cause the right of way to pass through the existing residence.
therefore necessitating the demolition of the existing residence; access to the
existing triplex building is down a grade and if the strip was deeded to the City
it would shorten the drive to the triplex making the grade too steep for use.
Mr. Green completed his presentation with the statement that changed conditions
may require change in zoning. The granting of a limited rezone request would not
set a precident for future rezone requestt.
Mayor Minkler reported the present 58th Avenue Street improvement is now completley
on city property and outside of the Reslock property entirely.
In answer to questions of the Council, Mr. Green stated plans for the property
would provide for the building of one more unit similiar to the present one, a
maximum of two buildings, the existing and one more. When Mr. Reslock is able to
build the new unit, he will tear down the present old single residential structure.
Mayor Minkler asked if there was anyone else to speak for the rezone. There being
no response, Mayor Minkler asked if there was anyone wishing to speak against the
rezone.
Leo Johnson, 14210 58th Avenue South spoke:
He stated his property was largea: and also bound on three sides by streets. His
property is in the same position on the Reslock property, overlooks the same view;
has the same noise factor.. He stated anyone on South 142nd has the same problems.
Mr. Johnson stated the only reason for zoning is to protect the property owners
from real estate coming in placing undesirable buildings in a residential area.
He does; not want apartments across the street from his house with the resulting
problems of cars, garbage cans. If the Reslock property is not suited for single
units it is certainally not suited for four more. He is against the rezoning of
this property on any basis.
James Barnard, 14241 59th Avenue South spoke:
He statea$he is basically concerned the rezone would be inconsistant with the
preservation of a central core of R -1 zoning. It would set a president and the
lot directly east would also have the same arguments.for rezone. A lot on a
peninsula would provide for a beautiful R -1 development.
Fred Linstra, 14228 59th Avenue South spoke:
He stated rental units do not cause for good landscaping. In general they are
not an asset to a R -1 neighborhood..
Ted Finkas, 14 59th Avenue South spoke:

stated the people on the hill do not want to look on apartments. There are
enough apartment now.
Dwane Traynor, 14910 58th Avenue South spoke:
Hie Mated that of the current Tukwila population 62% of the people currently live
in apartments. There are currently 167 acreas land zoned for apartments on the
hill and heights area. Thirty one of the 167 acres is currently developed. If the
remaining presently zoned apartment land is developed 90% of Tukwiles population
will be apartment residents. The City does not need to zone any more land for
apartments..
Mrs. James Bernard, 14241- 59th Avenue South spoke:
She stated_the zoning is a creeping thing. Other land owners on 59th are interest:,.
ed in rezone if this request is granted. She does not want this.
Mrs. Peterson, 14217- 58th Avenue South spoke:
She stated the proposed driveway entrance to the property was located in the worst
possible location.
Mayor Minkler reported the City has made the curb cut in the new street project
at, the location of the present drive because the city had not received an easement
from Mir. Resiock and could not do anything else.
There being no further discussion Mr. Bowen made a motion the Public hearing be
closed. Motion seconded by Mr. Dunning and carried.
Mayor Minkler instructed the Council they had the following alternatives
Accepting the Planning Commission recommendation
2. Turning down the Planning Commission recommendation
3. Modifying the Planning Commission recommendation
4. Taking the matter under advisement until a later date
5. Taking a recess to discuss the matter and giving a decision tonight.
After some discussion, Mr. Bowen made a motion the council defer action and take
the matter under advisement With the decission to be announced at the next. regular
Council Meeting, Monday, November 2nd. Motion seconded by Mr. Gardner and carried.
The meeting adjourned.
