Minkler at 8:00 p.m. The following council members were in attendance: D. R. Gardner,
J. R. Johanson, G. D. Hill, P. F. Dunning, A. G. Radford and J. D. Sterling.
Mr. Gardner made a motion the absence of Councilman Bowen be excused. Motion seconded
by Mr. Johanson and carried.
The minutes of the previous meeting were approved.

APPROVAL OF CLAIMS
Mr. Gardner made a motion claims approved by the Finance Committee be paid with warrants
drawn in their respective amounts. Motion seconded by Mr. Sterling and carried. Follow—
ing the Claims. Claims Fund Warrants No. 568 through No. 618 in the amount of $16,329.66
and Urban Arterial Street Fund Warrants No. 256 through 258 in the amount of $5,002.50.
PUBLIC HEARING STREET VACATION PORTION MACADAM ROAD
A public hearing was held on the vacation of a portion of Macadam Road as set forth in
Resolution No. 262. Mayor Minkler called the Public Hearing to order.
Mr. Hodge explained the portion of street to be vacated. Under the terms of Ordinance
183 which annexed the property to the City of Tukwila, a portion of Macadam Road was to
be vacated. This had never been done. Now a portion of the road right of way will be
needed for the U.A.B. Project. Mr. Hodge recommended the City vacate the portion of the
road not needed by the City for the street project and that the street be vacated under
the statutes in effect at the time Ordinance 183 was adopted.
Mr. Hill stated it did not seem right to vacated land at no cost and then not take needed
right of way in exchange.
Mr Hodge explained this would be correct if it were not for the provisions of Ordinance
183 which stated the street would be vacated.
Mr. Charles 0. Baker stated this took place when he was in office. That many years ago
the boundary of the City of Tukwila followed Macadam Road which wandered back and forth
across South 154th. When Golden Arrow came to the City requesting annexation, they also
requested the vacation of Macadam Road in that area. The Council at that time agreed
that when the property was annexed they would vacate the street. Mr. Baker further ex—
plained that while the street had never been vacated, it had not been used as a street
for many years. At the time of the annexation, state laws were written under the assump—
tion that owners of property had given land for street purposes therefore when they were
no longer needed, the property reverted back to the owners.
Mayor Minkler explained Councilman Radford had been called away from the Council table
due to an illness in his family. Mr. Hill made a Motion Mr. Radford's absence be excused.
Motion seconded by Mr. Sterling and carried.
The Public Hearing resumed. Mayor Minkler explained the Council had a moral obligation
to follow the terms of Ordinance 183.
Mr. Hill questioned Mr. Baker if South 154th was completed when it was proposed to vacate
Macadam Road. Mr. Baker replied it was then much as it is today.
There being no further discussion, Mr. Dunning made a motion the Public Hearing be closed.
Motion seconded by Mr. Johanson and carried.
Mr. Sterling made a motion the City grant the proposed vacation in accordance with
Ordinance 183 with the exception of the deleted portion needed for the UAB project.
Motion seconded by Mr. Johanson and carried.
BID OPENING OPEN END ASPHALT PAVING
Mr. Hill reported a call for bids had been sent to four asphalt paving companies, how—
ever only one bid had been received. This was from Rainier Asphalt Paving Company in
the amount of $9.75 per ton in place. Over 5,000 tons, the price would be $9.55 per ton.
Mr. Hill reported original estimates were around $11.00 per ton therefore, he felt this
was a good bid.

Mr. Hill made a motion the City accept the bid of Rainier Asphalt Paving Company on the t
unit price. Motion seconded by Mr. Sterling and carried.

TOASTMASTERS CLUB CORRESPONDENCE
Mayor Minkler read a letter from the Spacemaker's Toastmasters Club requesting per—
mission to give a short presentation of the value of Toastmasters at the Council meeting.
Mr. Whisler, Mr. J. Hill and Mr. Bud Graves were present and gave a short talk on the
subject inviting any interested person to attend their meetings which are held every
Tuesday at 5:30 p.m. at the Riverside Inn in Tukwila.
AIR POLLUTION NOTICE OF CIVIL PENALTY
Mayor Minkler read a Notice of Civil Penalty from the Puget Sound Air Pollution Control
Agency citing that the City of Tukwila was in violation of Section 9.02 of Regulation I
and a fine of $250.00 is assessed against the City. This violation involved the burning
of the charred lumber from the Fire Station fire.
Mayor Minkler explained that the City had made several contacts attempting to obtain
permission to burn this matter. That while the City had been denied a permit, the County
had been issued one and burned all day on the river bank the same day as the City was
in violation. He explained he had talked with Mr. Dammkoehler, Air Pollution Control
Officer about the problem when the City was attempting to obtain permission. Mr. Damm—
koehler promissed to investigate and return the call but he never called back.
Mr. Hill made a motion the City apply for a hearing on the matter. Motion seconded by
Mr. Dunning and carried. Mr. Hodge was instructed to request a hearing.
STREET LIGHTING
Mr. Zepp reported a survey of the budget indicates sufficient moneys to replace the
present incadescent lights with 7000 lumen mercury vapors. This would be an increase
of 850 per month per light under the new rate structure. He requested authority to ask
Puget Power to replace the lights.
Mr. Hill made a motion Mr. Zepp be authorized to notify Puget Power to convert the inca—
descent lights to mercury vapor lights. Motion seconded by Mr. Dunning and carried.
BOUNDARY REVIEW BOARD KENT ANNEXATION
Mr. Hall reported he had received a call from a member of the Boundary Review Board in—
quiring if Tukwila would be represented at a meeting of the Board next Thursday in regard
to a proposed annexation by the City of Kent of the O'Connell Dairy Farm. The City of
Tukwila had not received prior notice of this meeting due to an oversight of the Boun—
dary Review Board staff, however he felt it was important that the City of Tukwila be
represented. The meeting is to be held Thursday, May 20th at 7:30 p.m. in the King
County Council Chambers. Mr. Hall, Mr. Sterling and Mr. Baker are to attend.
RIBCO REPORT
Mr. Hall reported on the two latest meetings on RIBCO held May 4th and May 14th. The
next meeting will be held Friday, May 21st.
RIVER PARK GREEN BELT
Mr. Hall reported he had attended a Green River Coordinators meeting and requested Council
permission to set up a meeting with representatives of the Army Engineers, Soil Conser—
vation Service, Planning Specialist from the King County Planning Staff and members of
the Council to further discuss this project. Permission was granted to include this in
next Monday's work meeting.
Mr. Hall stated the mini parks now being developed along the Green River and the strip
park donated by Puget Western could be applied in lieu of cash momies as matching funds
for other financing. Mayor Minkler reported he would contact Puget Western for title
to the river bank area.
COMPLAINT ON HORSES
A complaint was received from a citizen on the odor caused from horses being kept in a
back yard. Mr. Zepp reported that sharp shod animals were causing a problem to the City
streets. After further discussion Mr. Johanson suggested the Council approach this
matter in a work meeting A work meeting was scheduled for Monday, May 24th at 7 :30 p.m.
METRO
Mayor Minkler reported he was under the impression that a recent bill passed by the
State Legislature would include the City of Tukwila in METRO. He asked Mr. Hodge to
obtain a copy of this bill.
ORDINANCE NO. 671 VACATING A PORTION OF MACADAM ROAD
A proposed ordinance vacating a portion of Macadam Road was introduced. Mr. Dunning
made a motion the proposed ordinance be placed on its first reading. Motion seconded
by Mr. Johanson and carried. Mr. Gardner made a motion the proposed ordinance be placed
on its second reading by title only. Motion seconded by Mr. Johanson and carried. Mr.
Sterling made a motion the proposed ordinance be placed on its third and final reading
for adoption, by title only. Motion seconded by Mr. Dunning and carried. This being
Ordinance No. 671.
PHASE II SOUTH 144th et al
Mr. Zepp announced there would be a meeting of the property owners involved in the
second phase of the South 144th et al project Wednesday evening at the City Hall.
There being no further business, the meeting adjourned at 9:35 p.m.
