Home My WebLink About24-062 - Otak Inc - Riverton Creek Flapgate Removal Construction Management24-062 Contract Number: City of Tukwila Council Approval N/A 6200 Southcenter Boulevard, Tukwila WA 98188 PROFESSIONAL SERVICES AGREEMENT (Includes consultants, architects, engineers, accountants, and other professional services) THIS AGREEMENT is entered into between the City of Tukwila, Washington, hereinafter referred to as Ðthe CityÑ, and OTAK, INC., hereinafter referred to as Ðthe ConsultantÑ, in consideration of the mutual benefits, terms, and conditions hereinafter specified. 1.Project Designation. The Consultant is retained by the City to perform construction engineering services in connection with the project titled Riverton Creek Flapgate Removal Project. 2.Scope of Services. The Consultant agrees to perform the services, identified on Exhibit ÐAÑ attached hereto, including the provision of all labor, materials, equipment and supplies. 3.Duration of Agreement; Time for Performance. This Agreement shall be in full force and effect for a period commencing upon execution and ending December 31, 2024, unless sooner terminated under the provisions hereinafter specified. Work under this Agreement shall commence upon written notice by the City to the Consultant to proceed. The Consultant shall perform all services and provide all work product required pursuant to this Agreement no later than December 31, 2024 unless an extension of such time is granted in writing by the City. 4.Payment. The Consultant shall be paid by the City for completed work and for services rendered under this Agreement as follows: A.Payment for the work provided by the Consultant shall be made as provided on Exhibit ÐBÑ attached hereto, provided that the total amount of payment to the Consultant shall not exceed $25,000.00 without express written modification of the Agreement signed by the City. B.The Consultant may submit vouchers to the City once per month during the progress of the work for partial payment for that portion of the project completed to date. Such vouchers will be checked by the City and, upon approval thereof, payment shall be made to the Consultant in the amount approved. C.Final payment of any balance due the Consultant of the total contract price earned will be made promptly upon its ascertainment and verification by the City after the completion of the work under this Agreement and its acceptance by the City. D.Payment as provided in this section shall be full compensation for work performed, services rendered, and for all materials, supplies, equipment and incidentals necessary to complete the work. E.The ConsultantÓs records and accounts pertaining to this Agreement are to be kept available for inspection by representatives of the City and the state of Washington for a period of three (3) years after final payments. Office of the City Attorney CA revised May 2020 Page 5 EXHIBIT A SCOPE OF WORK DESIGN/ENGINEERING SERVICES City of Tukwila Riverton Creek Flapgate Removal OTAK Project No. 32740.002 February 2024 Introduction and Background th LOCATION: 3225 S 116 St DESCRIPTION: Otak previously worked on a contract with the City to provide design and construction support services for the Riverton Creek Flapgate Removal project. The scope discussed in this document is to provide additional construction engineering support services for contractor correction of tieback wall retrofit. The task numbering in this scope was developed to match the task numbering from the previous contract for continuity in project management. SCHEDULE: The anticipated project schedule is to have notice to proceed in February 2024 with Construction closeout for additional construction support to occur by June 30, 2024. The Scope of Services is described in detail in the following sections. Scope and Budget Modifications 10.0 Construction Observation Support 10.3 Construction Revision Support 10.3.A Construction Revision Engineering Support Otak will provide additional construction support services to include on-site observation of tieback wall repairs. Repairs are assumed to include removing and reinstalling anchor cover plates, removal of portions of existing paint, preparation of wall surface for painting, and painting the wall. While cover plates are removed, Otak will observe the condition of visible portions of anchors and backfill, and advise the City of actions needed, if any, prior to replacing the cover plates. A summary of site observations will be emailed to the City within five (5) working days of the observation. After completion of the wall repairs, Otak will edit the previous memo titled ÐRiverton Creek-Tieback Wall and Existing Concrete Wall Post- Construction ConditionÑ, addressing WSDOT comments to include a summary of the wall repairs. The final memo will address comments from the City and WSDOT and will be stamped and signed by an Engineer licensed in the State of Washington. 10.3.B Construction Revision Testing Services If requested, Terracon Testing will be engaged as a direct cost vendor to provide verification testing for paint thickness, structural welding, and grout testing. Task 10.3 Deliverables ¤ Review comments on ContractorÓs wall repair plan submittal (email) ¤ Site observation summaries (email) ¤ Draft and final memo summarizing wall repairs and addressing previous WSDOT comments (PDF via email) Task 10.3 Assumptions ¤ Contractor will prepare a Wall Repair Plan submittal for review by Otak and WSDOT (consider reference to correcting defective work) ¤ The City will continue to provide Construction Administration such as management of submittals and primary correspondence with the Contractor and WSDOT. ¤ Up to four (2) days of site observation (8 hours per day) ¤ WSDOT will provide one round of comments on the draft wall memo.
