City of Tukwila Thomas McLeod, Mayor INFORMATIONAL MEMORANDUM TO: Community Services & Safety Committee FROM: Eric Dreyer, Chief of Police BY: Todd Rossi, Investigations Commander CC: Mayor McLeod DATE: June 19, 2024 SUBJECT: Accurint Virtual Crime Center ISSUE In 2019, the Police Department contracted with LexisNexis Risk Solutions for the use of their Accurint Virtual Crime Center (VCC) product suite. Since 2019, the subscription has been renewed on an annual basis with the total annual costs split into monthly payments. The Police Department would like to subscribe to additional modules available within the VCC increasing the total annual subscription cost from $16,336.40 to $20,400. Per the proposed contract, the annual subscription cost will increase 4% per year after the initial 12-month term. BACKGROUND In 2016, the Police Department contracted with Spillman Technologies to replace Justice, the aging records management system (RMS) that had been in use for more than 20 years. Modules of the Spillman RMS included software developed by BAIR Analytics. BAIR Analytics was purchased by LexisNexis Risk Solutions, and Spillman Technologies was purchased by Motorola Solutions. Eventually the modules developed by BAIR Analytics were removed from the Spillman RMS. To maintain the capabilities offered by the module and additional analytic capabilities, the PD subscribed to the LexisNexis VCC offering in 2019. Due to the continued and increasing demand of electronic device analytic capabilities during investigations, solutions to meet the demand were sought. One of the solutions found, TraX and Virtual Pen Register, is offered by LexisNexis Risk Solutions as a module to their VCC. A second option evaluated, offered by PENLiNK, provides capabilities similar to TraX and Virtual Pen Register, however the annual cost is substantially more ($18,7701 for the 1st year and $14,275.43 for following years) TraX and Virtual Pen Register technology can quickly find and track cell phones and other mobile devices in real time. This is used during investigations when a judge has approved a search warrant for specific information. This tracking is crucial for locating suspects and their devices involved in serious crimes. TraX and Virtual Pen Register will provide the Police Department with vital investigative tools which will aid in the investigation and prosecution of the most serious crimes. FINANCIAL IMPACT The current contract signed in 2019 with LexisNexis Risk Solutions for the Accurint VCC product suite was in the base amount of $12,800 annually, with a 5% annual increase, leading to the current annual cost of $16,336.40 inclusive of fees. The addition of TraX and Virtual Pen register is $4,063.60, increasing the annual cost of VCC to $20,400 with a 4% annual increase after the initial 12-month term. Assuming this request is approved, and the Police Department continues to renew the contract with LexisNexis Risk Solutions over the next 5 years, the total cost to City will be $110,492.99 vs. the current anticipated expenditure of $90,268.93. The LN Services herein shall be provided by LexisNexis Risk Solutions FL Inc. ("LN"). Customer acknowledges that the services provided under this Schedule A are non-FCRA services and are not "consumer reports" within the meaning of the FCRA and Customer agrees not to use such reports in any manner that would cause them to be characterized as "consumer reports". 1. SCHEDULE A TERM The term of this Schedule A will be 12 months beginning April 1, 2019 (the "Initial Term"). Following the Initial Term, this Schedule A shall automatically renew for additional periods of twelve (12) months (each one, a "Renewal Term"), unless written notice of termination is provided to either party at least sixty (60) days prior to the expiration of the Initial Term or any Renewal Term. If an account is activated after the first day of a calendar month, charges will not be pro -rated. 2. ACCURINT VIRTUAL CRIME CENTER FEES 2.1 Subscription Fees: Beginning on the effective date hereof, each 12-month period ("Year") Customer shall pay to LN $12,800.00 ("AVCC Annual Subscription Fee" ), to be invoiced in equal monthly installments, in exchange for unlimited use of Accurint Crime Analysis, Accurint for Law Enforcement Plus (as further described in Section 2.3) and Accurint for Law Enforcement Mobile. 2.2 Accurint for Law Enforcement Plus Premium Features: Email Search, Real Time Phones, Real Time MVR and Virtual Identity Search & Report, including when these features are report components. 2.3 Accurint for Law Enforcement Plus Subscription: All of the searches and reports included in the attached Price Schedules are referred to as the "Features". For purposes of the Agreement and this Schedule A, all applicable LexisNexis Risk Solutions entities shall be individually and collectively referred to as "LN". Customer acknowledges that the services provided under this Schedule A are non-FCRA services. 1. SCHEDULE A TERM The term of this Schedule A will be 12 months beginning July 1, 2024 (the "Initial Term"). Following the Initial Term, this Schedule A shall automatically renew for additional periods of twelve (12) months (each one, a "Renewal Term"), unless written notice of termination is provided to either party at least sixty (60) days prior to the expiration of the Initial Term or any Renewal Term. If an account is activated after the first day of a calendar month, charges will not be pro -rated. 2. ACCURINT VIRTUAL CRIME CENTER FEES 2.1 Subscription Fees: Beginning on the effective date hereof, each 12-month period ("Year") Customer shall pay to LN $16,336.40 ("AVCC Annual Subscription Fee"), to be invoiced in equal monthly installments, in exchange for unlimited use of Accurint Virtual Crime Center, Accurint for Law Enforcement, Accurint for Law Enforcement Plus (as further described in Section 2.2) and Accurint for Law Enforcement Mobile. 2.2 Accurint for Law Enforcement Plus Subscription: All of the searches and reports included in the attached Price Schedules are referred to as the "Features". The AVCC Annual Subscription Fee includes unlimited access to all Features, excluding those Features identified herein as Excluded Features but including the Premium Features listed in Section 2.3. 2.3 Accurint for Law Enforcement Plus Premium Features: Email Search Premium, Real Time Phones, Real Time MVR and Virtual Identity Search & Report, including when these features are report components. 2.4 Jail Booking Search & Report Option: Access to the Jail Booking Search & Report features are included in the AVCC Annual Subscription Fee. SUBJECT: Approval of FY24-26 Veterans, Seniors, and Human Services Levy Contract ISSUE The City of Tukwila Parks & Recreation Department has been awarded a $229,500 contract from the King County Department of Community and Human Services (DCHS) for the remainder of Fiscal Year 2024 and Fiscal Years 2025 and 2026 as a part of the Veterans, Seniors, & Human Services Levy (VSHSL). Staff are required to secure council approval before the mayor may sign the contract for execution. BACKGROUND The VSHSL is a voter approved six -year property tax levy that envisions senior centers in King County as inclusive central hubs where diverse groups of older adults can form community bonds and access a variety of senior programming and services. Tukwila Parks & Recreation has received VSHSL funding for several years. The last VSHSL levy expired in December 2023 with the newest version (2024 - 2029 Levy) having been approved by voters in August 2023. Staff had previously come to Council this year with a VSHSL contract that was offered by King County as a bridge while funding decisions were made for the new levy, this contract had been amended by King County to expire on June 30, 2024. DISCUSSION Staff applied in March of this year for the renewal of our VSHSL contract via the RFP issued by King County and were informed of an awarded application in early May. While it is a continuation of previously received funding, it is under a new contract number, which per city policy, requires council approval to be signed. Some program highlights of the VSHSL include: • Providing services such as fitness passes, art classes, and community engagement opportunities to 843 unique participants in FY23 • Hosting 19,546 senior fitness membership scans in FY23 • Providing "Hub" partner events with the City of Burien for veterans such as a picnic, Mariners game, Veteran's Day event, waterways cruise, and the 12 Days of Goodness with the Seattle Seahawks. A "Hub" refers to services or events being coordinated by multiple community centers such as Tukwila and Burien At this time, staff do not have the contract in hand from King County, but know it will be for $229,500 in total and have a Period of Performance from July 1, 2024 through December 31, 2026, it is staff's understanding that King County has the option to renew its contract with the City of Tukwila at that time without the need for participating in another RFP. In previous years, the awarded amount per year had been $60,000 per fiscal year. We have confirmed with King County our awarded amounts per fiscal year are as follows: Fiscal Year Amount Awarded 2024 (July — December) 2025 $45,000 $90,000 2026 $94,500 $229,500 This represents a total increase in secured funding of $79,500 from July of 2024 through December of 2026 when considering the previous $60,000/year baseline. Tukwila Parks and Recreation is excited to utilize these increased funds in service to our senior and veteran members of the Tukwila and King County community. FINANCIAL IMPACT This grant award is in the form of a reimbursement grant. The value of said slabs exceeds $500 and therefore a resolution by City Council is recommended per Resolution 2097 — City Purchasing & Contract Policy. BACKGROUND In 2018, a large maple tree fell on the grounds of Foster Golf Links during a storm. At the time this maple tree was one of the largest maple trees west of the Mississippi River. City staff had the tree cut into slabs for carpentry use at the time, with several tables and other features being created for multiple departments from the wood. At this time, the remaining slabs are stored in the now decommissioned Annex Fire Station 52. Parks & Recreation staff have identified a buyer of the remaining slabs and seek to complete the sale to maximize value and return on investment to Fund 411. DISCUSSION Initial disposal of the slabs was done via reassignment to other city departments during the original conversion of the wood into slabs. Since then, the remaining slabs have been stored at Annex Fire Station 52, a decommissioned site that exposes them to environmental conditions detrimental to their preservation and resale value. Failure to properly and promptly dispose of the remaining slabs may render them worthless economically. FINANCIAL IMPACT Fund 411 would receive the revenues from the sale of these materials; therefore, no General Fund (Fund 000) inflows or outflows are created through approval of this asset sale. RECOMMENDATION Department staff recommend the Community Services and Safety Committee forward this surplus resolution request to the July 15th Regular Meeting Consent Agenda for final approval by the Tukwila City Council. The Parks & Recreation Department will work with the Public Works Department to have this line item included in the year-end surplus resolution that will come before City Council this October/November.
