WELCOME TO THE TUKWILA CITY COUNCIL MEETING
The Tukwila City Council encourages community participation in the local government process and
welcomes attendance and public comment at its meetings.
MEETING SCHEDULE
Regular Meetings are held at 7:00 p.m. on the 1st and 3rd Mondays of each month. The City Council takes
formal action in the form of motions, resolutions and ordinances at Regular Meetings.
Committee of the Whole Meetings are held at 7:00 p.m. on the 2nd and 4th Mondays of each month. The
City Council considers current issues, discusses policy matters in detail, and coordinates the work of
the Council at Committee of the Whole meetings.
PUBLIC COMMENTS
Members of the public are given the opportunity to address the Council for up to 5 minutes on items both on
and not on the meeting agenda during Public Comments. The City Council will also accept comments on an
agenda item when the item is presented in the agenda, but speakers are limited to commenting once per
item each meeting.
When recognized by the Presiding Officer, please go to the podium if on -site or turn on your microphone if
attending virtually and state your name clearly for the record. The City Council appreciates hearing from you
but may not respond or answer questions during the meeting. Members of the City Council or City staff may
follow up with you following the meeting.
PUBLIC HEARINGS
Public Hearings are required by law before the Council can take action on matters affecting the public
interest such as land -use laws, annexations, rezone requests, public safety issues, etc. The City Council
Rules of Procedure provide the following guidelines for Public Hearings:
1. City staff will provide a report summarizing and providing context to the issue at hand.
2. City staff shall speak first and be allowed 15 minutes to make a presentation.
3. The applicant is then allowed 15 minutes to make a presentation.
4. Each side is then allowed 5 minutes for rebuttal.
5. After City staff and the applicant have used their speaking time, the Council may ask further
clarifying questions of the speakers.
6. Members of the public who wish to address the Council on the hearing topic may speak for 5
minutes each.
7. Speakers are asked to sign in on forms provided by the City Clerk.
8. The Council may ask clarifying questions of speakers and the speakers may respond.
9. Speakers should address their comments to the City Council.
10. If a large number of people wish to speak to the issue, the Council may limit the total amount of
comment time dedicated to the Public Hearing.
11. Once the Presiding Officer closes the public hearing, no further comments will be accepted, and the
issue is open for Councilmember discussion.
12. Any hearing being held or ordered to be held by the City Council may be continued in the manner as
set forth by RCW 42.30.100.

SUBJECT: Confirmation of Marty Wine as City Administrator
ISSUE
I am pleased to appoint Marty Wine as the City Administrator and to seek confirmation of that
appointment at the July 15, 2024, meeting. Ms. Wine was hired as the City's Deputy City
Administrator and Director of Administrative Services in December 2023 and has been serving as
the Interim City Administrator since February 3, 2024. Her background serving as the City Manager
for Monmouth, Oregon from 2020-2023 and City Manager for Tigard, Oregon from 2011-2020 as
well as her previous work experience demonstrate that she is more than qualified for the position.
Ms. Wine's experience has been focused on helping communities and leaders improve performance,
wisely use public resources, build regional relationships, and engage the community. Her colleagues
find her management style to be collaborative, practical, customer -focused, and diplomatic. She
chose city management because she has a passion for local government services that are managed
well and she believes that city services make an important difference in people's lives, and cities
need to be innovative to constantly improve services.
RECOMMENDATION
I am recommending the appointment of Marty Wine as City Administrator be confirmed by Council at
the July 15, 2024, Council meeting and am requesting authorization to execute the attached
Employment Agreement with Ms. Wine.

EMPLOYMENT AGREEMENT
This Agreement, made and entered into this day of 2024, by and between the City of
Tukwila, a municipal corporation of the state of Washington, (hereinafter "Employer" or "City") and
Martha L. Wine (hereinafter "Employee"), an individual who has education, training, and experience
in local government management, both of whom agree as follows:
Section 1: Duties and Authority
A. The Employer agrees to employ Employee as City Administrator to perform the functions and
duties specified in Title 35A of the Revised Code of Washington ("RCW") and the Tukwila
Municipal Code ("TMC") and to perform other legally permissible and proper duties and
functions as the Mayor may from time to time assign in accordance with RCW 35A.12.100 or,
if applicable, the TMC.
B. The Employee shall exercise general supervision over the administrative affairs of the City
and shall faithfully perform the duties as prescribed in the City's job description and as may
be lawfully assigned by the Mayor. Employee will further comply with all legal requirements
established by the City Council pursuant to RCW 35A.11.020 and the TMC, federal and state
law, and such legally adopted City policies and rules that may currently exist or as may be
enacted (or amended).
C. The Employee shall perform the duties of City Administrator of the Employer with reasonable
care, diligence, skill, and expertise. The Employee shall assist the Mayor with the
performance of the Mayor's administrative responsibilities and shall be supervised by the
Mayor in the performance of the Employee's duties.
D. Employee is expected to adhere to the highest professional standards and conform to the
International City/County Management Association (ICMA) Code of Ethics and the ethics
rules, regulations, and laws of the State of Washington. Consistent with these standards, the
employee shall not endorse candidates, make financial contributions, sign or circulate
petitions, or participate in fundraising activities for individuals seeking or holding elected
office. Employer will support Employee in keepingthese commitments by refrainingfrom any
order or request that would require an ethical violation, and to handle any matter of
personnel only on a basis of fairness, impartiality, and merit.
E. Employer agrees to promptly communicate and provide Employee a reasonable opportunity
to cure all substantive criticisms, complaints, and suggestions with respect to Employee's
performance of services pursuant to this Agreement.
F. All duties assigned to the Employee by the Mayor shall be appropriate to and consistent with
the professional role and responsibility of the Employee.
Section 2: Term
This Agreement shall commence upon confirmation of the Mayor's appointment by the City Council
and shall continue until terminated by the Employer or the Employee as provided in Sections 10
and/or 11 of this Agreement.

Section 3. Hours of Work
It is recognized that the Employee must on occasion devote time outside the normal office hours to
Employer -related business, and to that end, the Employee shall be allowed to establish an
appropriate work schedule. The schedule shall be appropriate to the needs of the Employer and shall
allow the Employee to faithfully perform her assigned duties and responsibilities.
Section 4. Outside Activities
The Employee is expected to devote her full time and attention to her duties as City Administrator.
Any outside activities that might materially interfere with her duties shall require approval by the
Mayor. None of the aforementioned duties shall be construed to limit the City Administrator's
participation in and contribution to her professional associations.
Section 5: Compensation
A. Base Salary: Employer agrees to pay Employee an annual base salary of $236,000, payable in
installments on the same cycle as non -represented employees of the Employer are paid.
B. This Agreement shall be automatically amended to reflect any cost -of -living salary adjustments
that are provided or required by the Employer's compensation policies on the same basis as
applied to non -represented employees. In addition, consideration shall be given annually to an
increase in compensation dependent upon the results of a performance evaluation conducted
under the provisions of Section 8 of this Agreement.
C. The Employer will include the City Administrator position and any subsequent changes to
compensation based on the results of a classification/compensation/market salary study of
non -represented employees.
D. If Employer deems it necessary to reduce all city employee salaries on account of a significant
budget or revenue shortfall, Employee's salary shall be subject to reduction in the same
percentage as other non -represented employees, subject to Section 11.D, below.
Section 6. Benefits
A. Vacation. As of December 4, 2024, the Employee shall accrue vacation time at the rate offered
to all other exempt employees with 20 years of service. The Employee is FLSA Exempt, not
overtime -eligible, and will not receive additional compensation for hours worked over 40 per
week.
B. Benefits. The Employee shall be entitled to such benefits as are available to other Exempt
Employees according to the City's personnel policies, rules, or regulations, as they exist or
hereafter may be enacted or amended from time to time and consistent with her total length of
service with the City, unless specifically covered in this Agreement.

C. Dues and Subscriptions. The Employer agrees to budget and to pay for the professional
membership dues and subscriptions of the Contractor necessary for the Contractor's full
participation in national, regional, state, and local associations and organizations reasonably
necessary for the good of the Employee and the Employer, subject to approval of the Employer.
Section 7. Retirement
The Employee will be enrolled in the Washington state Public Employees' Retirement System (PERS),
and the Employer shall make monthly contributions on behalf of the Employee to PERS or other
alternate plan, but the amount of contribution shall be limited to what the Employer would be
required to pay on the Employee's behalf to PERS.
Section 8. Performance Evaluation and Professional Development
The Mayor shall annually review and evaluate the performance of the Employee on or about the
anniversary date of the Employee's date of hire (December 4, 2023).
The City shall support the Employee's status to re -credential as an ICMA Credentialed Manager,
including providing opportunities to maintain the credential and permitting her to conduct a multi -
rater assessment every five years beginning in 2029. The Employer agrees to budget and pay for travel
and subsistence expenses of the Employee for professional and official travel, meetings, and
occasions to adequately continue the professional development of the Employee and to pursue
necessary official functions for the Employer, including but not limited to the ICMA Annual
Conference, WCMA conferences, and such other national, regional, state, and local governmental
groups and committees in which Employee serves as a member, subject to approval by the
Employer.
The Employer also agrees to budget and pay for travel expenses of the Employee for educational
opportunities that are necessary for the Employee's professional development and for the good of
the Employer, subject to approval by the Employer.
Section 9. Other Terms and Conditions of Employment
A. The Mayor may assign such additionalterms and conditions of employment, as determined from
time to time, relating to the Employee's job duties and performance, provided such terms and
conditions are not inconsistent with or in conflict with the provisions of this Agreement or any
applicable law. No amendment of this Agreement will be required.
B. Should any disagreement arise over the interpretation of the provisions of this Agreement, the
parties shall first meet and attempt to resolve the issue in good faith. Should this fail to resolve
the issue, the parties agree to mediate their dispute promptly, with each party bearing its own
costs and one-half of the costs of such mediation. Each party retains its right to pursue all legal
remedies in court.
Section 10. Suspension and Termination
The parties acknowledge that the Employee is an "at -will" employee. Subject to the clauses

regarding termination and severance, the Mayor may suspend or terminate the Employee's
employment at any time, with or without cause.
Section 11. Severance
A. Employee serves at the Mayor's pleasure and employment may be terminated at any time, with
or without cause, in accordance with this Agreement and applicable law.
B. Except as otherwise provided in this Agreement, in the event Employee's employment and/or
this Agreement is terminated by the Mayor during such time that Employee is willing and able to
perform duties of City Administrator, then in that event Employer agrees to:
1. Pay Employee a six-month severance in equal installments according to the City payroll
schedule ("severance amount"). During this time, the Employee shall be paid an amount
equal to the COBRA premium for continuation of the Employee's medical coverage. The
Employee shall also be compensated for all accrued vacation time and sick time, subject to
the limits for Department Directors.
2. Should Employee be terminated for cause including, without limitation, the willful breach or
habitual neglect of the duties that Employee is required to perform under the terms of this
Agreement; conviction of any felony; conviction of any crime involving moral turpitude; or
removal from office by the Grand Jury; then, in that event, City has no obligation to pay any
severance designated in this Section except benefits which otherwise vested in Employee.
C. The foregoing notwithstanding, City's obligation to pay Employee health benefits terminates
upon the employment of Employee by another employer providing similar benefits on the date
such benefits are effective for Employee.
D. In the event City, at any time during the employment term, reduces the salary or other financial
benefits of Employee in a greater percentage than an applicable across-the-board reduction of
other non -represented City employees, or in the event City refuses, following written notice, to
comply with any other provision benefiting Employee herein, or Employee resigns following a
formal written request by the Mayor; then, in that event, Employee may, at her option, have her
employment be deemed "terminated" at the time of such reduction, or after such request is
made, in which case, Employee is entitled to be paid severance pay and receive the other
severance benefits described in this Section.
E. In the event Employee voluntarily resigns her position with City before expiration of the aforesaid
term of employment, the Employee must give City a minimum of 30 calendar days' prior written
notice. In that event, Employee is not entitled to severance.
Section 12. Indemnification.
The Employer shall provide indemnity, representation, and defense for claims against the Employee
as City Administrator and as an individual arising out of the Employee's performance of duties within
the scope of the Employee's position, as provided under the terms of the City's coverage with the
Washington Cities Insurance Authority and Chapter 2.105 of the Tukwila Municipal Code.

Section 13. Notices.
Notices pursuant to this Agreement shall be given by deposit in the custody of the United States
Postal Service, postage prepaid, addressed as follows:

Alternatively, notices required pursuant to this Agreement may be personally served in the same
manner as is applicable to civil judicial practice. Notice shall be deemed given as of the date of
personal service or as of the date of deposit of such written notice in the course of transmission in
the United States Postal Service.
Section 14. General Provisions
A. Integration. The text herein shall constitute the entire agreement between the parties. Any prior
discussion or representations by or between the parties are merged into and rendered null and
void by this Agreement. The parties by mutual written agreement may amend any provision of
this Agreement during the life of the Agreement. Such amendments shall be incorporated and
made a part of this Agreement.
B. Binding Effect. This Agreement shall be binding on the Employer and the Employee as well as
their heirs, assigns, executors, personal representatives and successors of interest.
C. Severability. The invalidity or partial invalidity of any portion of this Agreement will not affect the
validity of any other provision. In the event that any provision, or any portion thereof, contained
in this agreement is held unconstitutional, invalid or unenforceable, the remaining provisions
shall be deemed to be in full force and effect as if they have been executed by both parties
subsequent to the expungement or judicial modification of the invalid provision.
D. Venue. This Agreement is subject to the laws of the State of Washington including, without
limitation, Title 35A of the RCW. Venue for any action arising from this Agreement will be in the
state or federal court with jurisdiction over the Employer.
E. Precedence. In the event that any provision of this Agreement conflicts with a provision of the
City's Personnel Rules or other City policy, the provisions of this Agreement govern. In the event
any provision of this Agreement conflicts with state law or the Tukwila Municipal Code, state law
or the TMC shall govern.

ISSUE
The city will be renewing the services of the law firm of Foster Garvey, P.C. to assist in
collective bargaining negotiations for police contracts set to expire in December 2024. Due to
the number of contracts, the city anticipates the contract to exceed the mayor's threshold of
$60,000. The city is requesting a contract renewal with Foster Garvey with a not to exceed
amount of $120,000.
BACKGROUND
The city has worked with Foster Garvey for lead negotiation services for previous collective
bargaining negotiations and would like to continue to do so.
RECOMMENDATION
The Council is being asked to consider and approve the renewal of the contract for services
with Foster Garvey with a not to exceed amount of $120,000.

PROFESSIONAL SERVICES AGREEMENT
(Includes consultants, architects, engineers, accountants, and other professional services)
THIS AGREEMENT is entered into between the City of Tukwila, Washington, hereinafter
referred to as "the City", and Foster Garvey PC, hereinafter referred to as "the Consultant", in
consideration of the mutual benefits, terms, and conditions hereinafter specified.
1. Project Designation. The Consultant is retained by the City to perform collective bargaining
legal services in connection with the project titled Teamsters 117 and United Steelworkers
negotiations.
2. Scope of Services. The Consultant agrees to perform the services, identified on Exhibit "A"
attached hereto, including the provision of all labor, materials, equipment and supplies.
3. Duration of Agreement; Time for Performance. This Agreement shall be in full force and
effect for a period commencing upon execution and ending December 31, 2025, unless sooner
terminated under the provisions hereinafter specified. Work under this Agreement shall
commence upon written notice by the City to the Consultant to proceed. The Consultant shall
perform all services and provide all work product required pursuant to this Agreement no later
than December 31, 2025 unless an extension of such time is granted in writing by the City.
4. Payment. The Consultant shall be paid by the City for completed work and for services
rendered under this Agreement as follows:
A. Payment for the work provided by the Consultant shall be made as provided on Exhibit
"B" attached hereto, provided that the total amount of payment to the Consultant shall not
exceed $120,000 without express written modification of the Agreement signed by the
City.
B. The Consultant may submit vouchers to the City once per month during the progress of
the work for partial payment for that portion of the project completed to date. Such
vouchers will be checked by the City and, upon approval thereof, payment shall be made
to the Consultant in the amount approved.
C. Final payment of any balance due the Consultant of the total contract price earned will be
made promptly upon its ascertainment and verification by the City after the completion of
the work under this Agreement and its acceptance by the City.
D. Payment as provided in this section shall be full compensation for work performed,
services rendered, and for all materials, supplies, equipment and incidentals necessary to
complete the work.
E. The Consultant's records and accounts pertaining to this Agreement are to be kept
available for inspection by representatives of the City and the state of Washington for a
period of three (3) years after final payments. Copies shall be made available upon
request.

5. Ownership and Use of Documents. All documents, drawings, specifications and other
materials produced by the Consultant in connection with the services rendered under this
Agreement shall be the property of the City whether the project for which they are made is
executed or not. The Consultant shall be permitted to retain copies, including reproducible
copies, of drawings and specifications for information, reference and use in connection with
the Consultant's endeavors. The Consultant shall not be responsible for any use of the said
documents, drawings, specifications or other materials by the City on any project other than
the project specified in this Agreement.
6. Compliance with Laws. The Consultant shall, in performing the services contemplated by
this Agreement, faithfully observe and comply with all federal, state, and local laws, ordinances
and regulations, applicable to the services rendered under this Agreement.
7 Indemnification. The Consultant shall defend, indemnify and hold the City, its officers,
officials, employees and volunteers harmless from any and all claims, injuries, damages,
losses or suits including attorney fees, arising out of or resulting from the acts, errors or
omissions of the Consultant in performance of this Agreement, except for injuries and damages
caused by the sole negligence of the City.
Should a court of competent jurisdiction determine that this Agreement is subject to RCW
4.24.115, then, in the event of liability for damages arising out of bodily injury to persons or
damages to property caused by or resulting from the concurrent negligence of the Consultant
and the City, its officers, officials, employees, and volunteers, the Consultant's liability
hereunder shall be only to the extent of the Consultant's negligence. It is further specifically
and expressly understood that the indemnification provided herein constitutes the Consultant's
waiver of immunity under Industrial Insurance, Title 51 RCW, solely for the purposes of this
indemnification. This waiver has been mutually negotiated by the parties. The provisions of
this section shall survive the expiration or termination of this Agreement.
8. Insurance. The Consultant shall procure and maintain for the duration of the Agreement,
insurance against claims for injuries to persons or damage to property which may arise from
or in connection with the performance of the work hereunder by the Consultant, its agents,
representatives, or employees. Consultant's maintenance of insurance as required by the
agreement shall not be construed to limit the liability of the Consultant to the coverage provided
by such insurance, or otherwise limit the City's recourse to any remedy available at law or in
equity.
A. Minimum Amounts and Scope of Insurance. Consultant shall obtain insurance of the
types and with the limits described below:
1. Automobile Liability insurance with a minimum combined single limit for bodily injury
and property damage of $1,000,000 per accident. Automobile Liability insurance
shall cover all owned, non -owned, hired and leased vehicles. Coverage shall be
written on Insurance Services Office (ISO) form CA 00 01 or a substitute form
providing equivalent liability coverage. If necessary, the policy shall be endorsed to
provide contractual liability coverage.
2. Commercial General Liability insurance with limits no less than $2,000,000 each
occurrence, $2,000,000 general aggregate. Commercial General Liability
insurance shall be at least as broad as ISO occurrence form CG 00 01 and shall
cover liability arising from premises, operations, stop -gap independent contractors
and personal injury and advertising injury. The City shall be named as an
additional insured under the Consultant's Commercial General Liability insurance
policy with respect to the work performed for the City using an additional insured
endorsement at least as broad as ISO endorsement form CG 20 26.
3. Workers' Compensation coverage as required by the Industrial Insurance laws of
the State of Washington.

4. Professional Liability with limits no less than $2,000,000 per claim and $2,000,000
policy aggregate limit. Professional Liability insurance shall be appropriate to the
Consultant's profession.
B. Public Entity Full Availability of Contractor Limits. If the Contractor maintains higher
insurance limits than the minimums shown above, the Public Entity shall be insured for the
full available limits of Commercial General and Excess or Umbrella liability maintained by
the Contractor, irrespective of whether such limits maintained by the Contractor are greater
than those required by this Contract or whether any certificate of insurance furnished to
the Public Entity evidences limits of liability lower than those maintained by the Contractor.
C. Other Insurance Provision. The Consultant's Automobile Liability and Commercial
General Liability insurance policies are to contain, or be endorsed to contain that they shall
be primary insurance with respect to the City. Any Insurance, self-insurance, or insurance
pool coverage maintained by the City shall be excess of the Consultant's insurance and
shall not be contributed or combined with it.
D. Acceptability of Insurers. Insurance is to be placed with insurers with a current A.M.
Best rating of not less than A:VII.
E. Verification of Coverage. Consultant shall furnish the City with original certificates and a
copy of the amendatory endorsements, including but not necessarily limited to the
additional insured endorsement, evidencing the insurance requirements of the Contractor
before commencement of the work. Upon request by the City, the Consultant shall furnish
certified copies of all required insurance policies, including endorsements, required in this
Agreement and evidence of all subcontractors' coverage.
F. Notice of Cancellation. The Consultant shall provide the City with written notice of any
policy cancellation, within two business days of their receipt of such notice.
G. Failure to Maintain Insurance. Failure on the part of the Consultant to maintain the
insurance as required shall constitute a material breach of contract, upon which the City
may, after giving five business days notice to the Consultant to correct the breach,
immediately terminate the contract or, at its discretion, procure or renew such insurance
and pay any and all premiums in connection therewith, with any sums so expended to be
repaid to the City on demand, or at the sole discretion of the City, offset against funds due
the Consultant from the City.
9. Independent Contractor. The Consultant and the City agree that the Consultant is an
independent contractor with respect to the services provided pursuant to this Agreement.
Nothing in this Agreement shall be considered to create the relationship of employer and
employee between the parties hereto. Neither the Consultant nor any employee of the
Consultant shall be entitled to any benefits accorded City employees by virtue of the services
provided under this Agreement. The City shall not be responsible for withholding or otherwise
deducting federal income tax or social security or for contributing to the state industrial
insurance program, otherwise assuming the duties of an employer with respect to the
Consultant, or any employee of the Consultant.
10. Covenant Against Contingent Fees. The Consultant warrants that he has not employed or
retained any company or person, other than a bonafide employee working solely for the
Consultant, to solicit or secure this contract, and that he has not paid or agreed to pay any
company or person, other than a bonafide employee working solely for the Consultant, any
fee, commission, percentage, brokerage fee, gifts, or any other consideration contingent upon
or resulting from the award or making of this contract. For breach or violation of this warrant,
the City shall have the right to annul this contract without liability, or in its discretion to deduct
from the contract price or consideration, or otherwise recover, the full amount of such fee,
commission, percentage, brokerage fee, gift, or contingent fee.

11. Discrimination Prohibited. Contractor, with regard to the work performed by it under this
Agreement, will not discriminate on the grounds of race, religion, creed, color, national origin,
age, veteran status, sex, sexual orientation, gender identity, marital status, political affiliation,
the presence of any disability, or any other protected class status under state or federal law,
in the selection and retention of employees or procurement of materials or supplies.
12. Assignment. The Consultant shall not sublet or assign any of the services covered by this
Agreement without the express written consent of the City.
13. Non -Waiver. Waiver by the City of any provision of this Agreement or any time limitation
provided for in this Agreement shall not constitute a waiver of any other provision.
14. Termination.
A. The City reserves the right to terminate this Agreement at any time by giving ten (10) days
written notice to the Consultant.
B. In the event of the death of a member, partner or officer of the Consultant, or any of its
supervisory personnel assigned to the project, the surviving members of the Consultant
hereby agree to complete the work under the terms of this Agreement, if requested to do
so by the City. This section shall not be a bar to renegotiations of this Agreement between
surviving members of the Consultant and the City, if the City so chooses.
15. Applicable Law; Venue; Attorney's Fees. This Agreement shall be subject to, and the
Consultant shall at all times comply with, all applicable federal, state and local laws,
regulations, and rules, including the provisions of the City of Tukwila Municipal Code and
ordinances of the City of Tukwila. In the event any suit, arbitration, or other proceeding is
instituted to enforce any term of this Agreement, the parties specifically understand and agree
that venue shall be properly laid in King County, Washington. The prevailing party in any such
action shall be entitled to its attorney's fees and costs of suit. Venue for any action arising
from or related to this Agreement shall be exclusively in King County Superior Court.
16. Severability and Survival. If any term, condition or provision of this Agreement is declared
void or unenforceable or limited in its application or effect, such event shall not affect any other
provisions hereof and all other provisions shall remain fully enforceable. The provisions of this
Agreement, which by their sense and context are reasonably intended to survive the
completion, expiration or cancellation of this Agreement, shall survive termination of this
Agreement.

18. Entire Agreement; Modification. This Agreement, together with attachments or addenda,
represents the entire and integrated Agreement between the City and the Consultant and

amendment or modification of this Agreement shall be of any force or effect unless it is in
writing and signed by the parties.

BACKGROUND
In 2018, a large maple tree fell on the grounds of Foster Golf Links during a storm. At the time this
maple tree was one of the largest maple trees west of the Mississippi River. City staff had the tree cut
into slabs for carpentry use at the time, with several tables and other features being created for multiple
departments from the wood.
At this time, the remaining slabs are stored in the now decommissioned Annex Fire Station 52. Parks &
Recreation staff have identified a buyer of the remaining slabs and seek to complete the sale to
maximize value and return on investment to Fund 411.
DISCUSSION
Initial disposal of the slabs was done via reassignment to other city departments during the original
conversion of the wood into slabs. Since then, the remaining slabs have been stored at Annex Fire
Station 52, a decommissioned site that exposes them to environmental conditions detrimental to their
preservation and resale value. Failure to properly and promptly dispose of the remaining slabs may
render them worthless economically.
FINANCIAL IMPACT
Fund 411 would receive the revenues from the sale of these materials; therefore, no General Fund
(Fund 000) inflows or outflows are created through approval of this asset sale.
RECOMMENDATION
Department staff recommend the Community Services and Safety Committee forward this surplus
resolution request to the July 15th Regular Meeting Consent Agenda for final approval by the Tukwila
City Council.
The Parks & Recreation Department will work with the Public Works Department to have this line item
included in the year-end surplus resolution that will come before City Council this October/November.

ISSUE
In 2019, the Police Department contracted with LexisNexis Risk Solutions for the use of their
Accurint Virtual Crime Center (VCC) product suite. Since 2019, the subscription has been
renewed on an annual basis with the total annual costs split into monthly payments. The Police
Department would like to subscribe to additional modules available within the VCC increasing
the total annual subscription cost from $16,336.40 to $20,400. Per the proposed contract, the
annual subscription cost will increase 4% per year after the initial 12-month term.
BACKGROUND
In 2016, the Police Department contracted with Spillman Technologies to replace Justice, the
aging records management system (RMS) that had been in use for more than 20 years.
Modules of the Spillman RMS included software developed by BAIR Analytics. BAIR Analytics
was purchased by LexisNexis Risk Solutions, and Spillman Technologies was purchased by
Motorola Solutions. Eventually the modules developed by BAIR Analytics were removed from
the Spillman RMS. To maintain the capabilities offered by the module and additional analytic
capabilities, the PD subscribed to the LexisNexis VCC offering in 2019.
Due to the continued and increasing demand of electronic device analytic capabilities during
investigations, solutions to meet the demand were sought. One of the solutions found, TraX
and Virtual Pen Register, is offered by LexisNexis Risk Solutions as a module to their VCC. A
second option evaluated, offered by PENLiNK, provides capabilities similar to TraX and Virtual
Pen Register, however the annual cost is substantially more ($18,7701 for the 1 St year and
$14,275.43 for following years)
TraX and Virtual Pen Register technology can quickly find and track cell phones and other
mobile devices in real time. This is used during investigations when a judge has approved a
search warrant for specific information. This tracking is crucial for locating suspects and their
devices involved in serious crimes. TraX and Virtual Pen Register will provide the Police
Department with vital investigative tools which will aid in the investigation and prosecution of the
most serious crimes.
FINANCIAL IMPACT
The current contract signed in 2019 with LexisNexis Risk Solutions for the Accurint VCC product
suite was in the base amount of $12,800 annually, with a 5% annual increase, leading to the
current annual cost of $16,336.40 inclusive of fees. The addition of TraX and Virtual Pen
register is $4,063.60, increasing the annual cost of VCC to $20,400 with a 4% annual increase
after the initial 12-month term. Assuming this request is approved, and the Police Department
continues to renew the contract with LexisNexis Risk Solutions over the next 5 years, the total
cost to City will be $110,492.99 vs. the current anticipated expenditure of $90,268.93.
The City Attorney's office has reviewed and approved this contract amendment.

This Schedule A sets forth additional or amended terms and conditions for the use of the Accurint Virtual Crime
Center services ("LN Services"), as set forth in the services agreement between Customer and LN or LN's
affiliate(s) for the LN Services ("Agreement"), to which this Schedule A is incorporated by reference. The LN
Services herein shall be provided by LexisNexis Risk Solutions FL Inc. ("LN"). Customer acknowledges that the
services provided under this Schedule A are non-FCRA services and are not "consumer reports" within the
meaning of the FCRA and Customer agrees not to use such reports in any manner that would cause them to be
characterized as "consumer reports".
1. SCHEDULE A TERM
The term of this Schedule A will be 12 months beginning April 1, 2019 (the "Initial Term"). Following the Initial
Term, this Schedule A shall automatically renew for additional periods of twelve (12) months (each one, a
"Renewal Term"), unless written notice of termination is provided to either party at least sixty (60) days prior to
the expiration of the Initial Term or any Renewal Term. If an account is activated after the first day of a calendar
month, charges will not be pro -rated.
2. ACCURINT VIRTUAL CRIME CENTER FEES
2.1 Subscription Fees: Beginning on the effective date hereof, each 12-month period ("Year") Customer shall
pay to LN $12,800.00 ("AVCC Annual Subscription Fee" ), to be invoiced in equal monthly installments, in
exchange for unlimited use of Accurint Crime Analysis, Accurint for Law Enforcement Plus (as further described
in Section 2.3) and Accurint for Law Enforcement Mobile.
2.2 Accurint for Law Enforcement Plus Premium Features: Email Search, Real Time Phones, Real Time
MVR and Virtual Identity Search & Report, including when these features are report components.
2.3 Accurint for Law Enforcement Plus Subscription: All of the searches and reports included in the
attached Price Schedules are referred to as the "Features". The AVCC Annual Subscription Fee includes
unlimited access to all Features, excluding those Features identified herein as Excluded Features but including
the Premium Features listed in Section 2.2.
2.4 Features Not Included: The following Features ("Excluded Features") are not included in the AVCC Annual
Subscription Fee and shall in all cases be charged separately according to the pricing specified in the attached
Price Schedule:

This Schedule A sets forth additional or amended terms and conditions for the use of the Accurint Virtual Crime
Center services ("LN Services"), as set forth in the services agreement for the LN Services between Customer
and the LexisNexis Risk Solutions entity as further defined therein ("Agreement"), to which this Schedule A is
incorporated by reference. For purposes of the Agreement and this Schedule A, all applicable LexisNexis Risk
Solutions entities shall be individually and collectively referred to as "LN". Customer acknowledges that the
services provided under this Schedule A are non-FCRA services.
1. SCHEDULE A TERM
The term of this Schedule A will be 12 months beginning July 1, 2024 (the "Initial Term"). Following the Initial
Term, this Schedule A shall automatically renew for additional periods of twelve (12) months (each one, a
"Renewal Term"), unless written notice of termination is provided to either party at least sixty (60) days prior to
the expiration of the Initial Term or any Renewal Term. If an account is activated after the first day of a calendar
month, charges will not be pro -rated.
2. ACCURINT VIRTUAL CRIME CENTER FEES
2.1 Subscription Fees: Beginning on the effective date hereof, each 12-month period ("Year") Customer shall
pay to LN $16,336.40 ("AVCC Annual Subscription Fee"), to be invoiced in equal monthly installments, in
exchange for unlimited use of Accurint Virtual Crime Center, Accurint for Law Enforcement, Accurint for Law
Enforcement Plus (as further described in Section 2.2) and Accurint for Law Enforcement Mobile.
2.2 Accurint for Law Enforcement Plus Subscription: All of the searches and reports included in the
attached Price Schedules are referred to as the "Features". The AVCC Annual Subscription Fee includes
unlimited access to all Features, excluding those Features identified herein as Excluded Features but including
the Premium Features listed in Section 2.3.
2.3 Accurint for Law Enforcement Plus Premium Features: Email Search Premium, Real Time Phones, Real
Time MVR and Virtual Identity Search & Report, including when these features are report components.
2.4 Jail Booking Search & Report Option: Access to the Jail Booking Search & Report features are included
in the AVCC Annual Subscription Fee. The Jail Booking Search & Report data provided under this Schedule A
shall only be used for the purposes of determining the arrest/incarceration status of particular individuals and
shall serve solely as a tip or lead from which Customer can then initiate its own independent investigation. Any
determination reached by Customer with regard to an individual or individuals featured in the Jail Booking
Search & Report shall be based solely on data gathered by Customer pursuant to its own internal investigations.
2.5 Features Not Included: The following Features ("Excluded Features") are not included in the AVCC Annual
Subscription Fee and shall in all cases be charged separately according to the pricing specified in the attached
Price Schedule:

LN standard pricing will be in effect for any new features made generally available by LN subsequent to
the execution of this Schedule A.
2.6 Accurint TraX with Virtual Pen Register Option: In addition to the other fees set forth herein, Customer
shall pay to LN each Year $4,063.60, to be invoiced in equal monthly installments, in exchange for access to the
Accurint TraX with Virtual Pen Register option.
2.7 Fee Increases: At the end of each Year, all fees herein will be increased 4.00%.
2.8 Amounts Payable: Customer agrees to pay LN in accordance with any invoice for the fees set forth above.
3. EXPIRATION
Unless otherwise accepted by LN, the terms herein are valid if the Schedule A is signed by the Customer and
received by LN on or before July 25, 2024.
4. CLOUD SERVICES
LN is executing a multi -year plan to move certain LexisNexis Risk Solutions products and services to a cloud
environment. Should you have questions regarding this plan, please direct them to your Account Manager.
5. CONFIDENTIAL INFORMATION
This Schedule A contains the confidential pricing information of LN. Customer acknowledges that the disclosure
of such pricing information could cause competitive harm to LN, and as such, Customer agrees to maintain this
Schedule A in trust and confidence and take reasonable precautions against disclosure to any third party to the
extent permitted by local and state law.

Staff is seeking approval to amend a contract with LexisNexis Risk Solutions to add additional
modules oftheirAccurint Virtual Crime Center product suite. The amendment will increase the
contract annual amount to $20,400 with a 4% annual increase after the first year.
Committee Recommendation:
Unanimous approval. Forward to July 15, 2024 Regular Meeting Consent Agenda.
B. Grant Agreement: 2024 Veterans, Seniors and Human Services Levy
Staff is seeking approval of a grant agreement with King County in the amount of $229,500 for
continued senior and veteran programming from 7/1/24-12/31/26

SUBJECT: Approval of FY24-26 Veterans, Seniors, and Human Services Levy Contract
ISSUE
The City of Tukwila Parks & Recreation Department has been awarded a $229,500 contract from the
King County Department of Community and Human Services (DCHS) for the remainder of Fiscal Year
2024 and Fiscal Years 2025 and 2026 as a part of the Veterans, Seniors, & Human Services Levy
(VSHSL). Staff are required to secure council approval before the mayor may sign the contract for
execution.
BACKGROUND
The VSHSL is a voter approved six -year property tax levy that envisions senior centers in King County
as inclusive central hubs where diverse groups of older adults can form community bonds and access a
variety of senior programming and services. Tukwila Parks & Recreation has received VSHSL funding
for several years. The last VSHSL levy expired in December 2023 with the newest version (2024 - 2029
Levy) having been approved by voters in August 2023.
Staff had previously come to Council this year with a VSHSL contract that was offered by King County
as a bridge while funding decisions were made for the new levy, this contract had been amended by
King County to expire on June 30, 2024.
DISCUSSION
Staff applied in March of this year for the renewal of our VSHSL contract via the RFP issued by King
County and were informed of an awarded application in early May. While it is a continuation of
previously received funding, it is under a new contract number, which per city policy, requires council
approval to be signed.
Some program highlights of the VSHSL include:
• Providing services such as fitness passes, art classes, and community engagement
opportunities to 843 unique participants in FY23
• Hosting 19,546 senior fitness membership scans in FY23
• Providing "Hub" partner events with the City of Burien for veterans such as a picnic, Mariners
game, Veteran's Day event, waterways cruise, and the 12 Days of Goodness with the Seattle
Seahawks. A "Hub" refers to services or events being coordinated by multiple community
centers such as Tukwila and Burien
At this time, staff do not have the contract in hand from King County, but know it will be for $229,500 in
total and have a Period of Performance from July 1, 2024 through December 31, 2026, it is staff's
understanding that King County has the option to renew its contract with the City of Tukwila at that time
without the need for participating in another RFP.

FY25/26 BUDGET CONSIDERATIONS
King County VSHSL funding supports the vast majority of senior programming provided by the Tukwila
Parks and Recreation Department, either through expanded programming opportunities, or lowering
and/or removal of participant fees to lessen potential socioeconomic barriers to access. In previous
years, the awarded amount per year had been $60,000 per fiscal year. We have confirmed with King
County our awarded amounts per fiscal year are as follows:

This represents a total increase in secured funding of $79,500 from July of 2024 through December of
2026 when considering the previous $60,000/year baseline. Tukwila Parks and Recreation is excited to
utilize these increased funds in service to our senior and veteran members of the Tukwila and King
County community.
FINANCIAL IMPACT
This grant award is in the form of a reimbursement grant. The grant does not require a match from the
City and therefore does not create any net financial impact on the General Fund (000) and/or any other
City funds.
RECOMMENDATION
Staff recommends the grant details as presented, an eventual contract with King County DCHS for
$229,500 from 7/1/24 — 12/31/26 for senior and veteran programmatic services, be forwarded for
approval on the City Council Regular Meeting Agenda on Monday, July 15t"
Upon approval on July 15t" by the City Council and reception of necessary contract documents, staff
will seek a review by the City Attorney's Office before seeking the Mayor's signature for execution of
the proposed contract.

The City Administrator Report is meant to provide the Council, staff, and the community with an
update on the activities of the City and on issues that concern Tukwila. Please let me know if you
have any questions or need additional information about any of the following items.
I. Intergovernmental Update
• Chrome Book Distribution: TIS and Human Services coordinated and delivered Chrome
books to After School All Stars and Partners In Employment.
• State Auditor's Entrance Conference: On June 25 Mayor McLeod and Interim City
Administrator Wine met with the State Auditor's Office for the Entrance Conference for the
City's annual audit.
• Cascade Water Alliance 25th Anniversary Celebration: Mayor McLeod attended the Cascade
Water Alliance 25th Anniversary Celebration on June 27.
• Lower Green River Corridor Visioning Committee Workshop: On June 28 Mayor McLeod
participated in a Lower Green River Corridor Visioning Committee workshop.
• Meeting with Representative Bergquist: Mayor McLeod and Director Miles met with
Representative Steve Bergquist on June 24 regarding the Riverton Park United Methodist
Church asylee situation.
II. Community Events
• Southard Ribbon Cutting: On June 28 Mayor McLeod offered welcoming remarks at The
Southard ribbon cutting ceremony. Councilmember Sharp also attended the event.
• Park 'N' Play Program: The Park `N' Play program, a combination of the long-standing
Playground Program with last year's Mobile Recreation Program started July 9. Each day will
begin with lunch and some games at Cascade View Community Park and then include mobile
recreation to different locations around the city to provide opportunities for Tukwila
neighborhoods.
• Teen Late Night: Teen Late Night will continue to run during the summer months. In July
Late Night will be held on July 12,19, and 26.

III. Staff Updates
Public Safety
• Meeting with Challenge Seattle & WA Retail Association: On June 25 Deputy Chief Lund
attended a meeting with Challenge Seattle/WA Retail Association that is led by Christine
Gregoire regarding improving organized retail theft investigations.
Project Updates
• New Art Pieces at the Tukwila Community Center: The Tukwila Arts Commission added
three new art pieces to the Tukwila community displayed on a storage container at the
Tukwila Community Center. The art pieces are Jean Bradbury's Mushroom Celebration;
Gabrielle Abbott's My Wild Grandmother; and liana Zweschi's Supreme. In the near future an
Artist Talk will be offered to learn more about these impressive creators, their artistic process,
and these new works of art.
• Stewardship:
o Water and Soil Stewards worked at Riverton Park. They weeded the large planting bed
and worked on the pollinator garden by Gully Gardens P-Patch.
o An employee of BECU has volunteered to become the new Forest Steward of the Shoreline
Restoration Challenge. This site historically was stewarded by Forterra and BECU until
2018.
o Parks & Recreation Staff submitted a grant application to host Washington Conservation
Corps (WCC) through their Environmental Social Justice Pilot Program to continue the
large project at Tukwila Park and was awarded another 12 weeks of service for 2024/2025
valued around $100,000 of professional crew time. WCC will continue to focus on canopy
health and biodiversity of native plants in the park.

We welcome the City Council to encourage community members to apply for vacant Board &
Commission positions.
