This letter serves as a notice of decision and is issued pursuant to TMC 18.104.170 on the following

II. DECISION
SEPA Determination: The City SEPA Responsible Official has previously determined that this application
does not require a SEPA threshold determination because it is categorically exempt.
Decision on Substantive Permit: The City Community Development Department has determined that the
application for a Type 1 Wireless Communications Facility does comply with applicable City and state code
requirements and has approved that application with the following condition:

1. Prior to final approval of the building permit, T-Mobile shall secure a business license from the
City of Tukwila for this specific location (applicant has applied under BUS-0100769).
III. YOUR APPEAL RIGHTS
The Decision on this Permit Application is a Type 1 decision pursuant to Tukwila Municipal Code
§ 18.104.010. Other land use applications related to this project may still be pending.
One administrative appeal to the City Hearing Examiner of the Decision on the Permit itself is permitted.
A party who is not satisfied with the outcome of the Hearing Examiner appeal process may file an appeal in
King County Superior Court from the Hearing Examiner's decision.
IV. PROCEDURES AND TIME FOR APPEALING
In order to appeal the Community Development Director decision on the Permit Application, a written
notice of appeal must be filed with the Department of Community Development within 14 days of the
issuance of this decision. The requirements for such appeals are set forth in Tukwila Municipal Code ch.
18.116. All appeal materials shall be submitted to the Department of Community Development. Appeal
materials MUST include:
1. The name of the appealing party.
2. The address and phone number of the appealing party; and if the appealing party is a corporation,
association or other group, the address and phone number of a contact person authorized to receive
notices on the appealing party's behalf.
3. A statement identifying the decision being appealed and the alleged errors in the decision, including
any specific challenge to an MDNS.
4. The Notice of Appeal shall identify (a) the specific errors of fact or errors in application of the law in
the decision being appealed; (b) the harm suffered or anticipated by the appellant, and (c) the relief
sought. The scope of an appeal shall be limited to matters or issues raised in the Notice of Appeal.
5. Appeall fee of S541.
V. APPEAL HEARINGS PROCESS
Any administrative appeal regarding the Permit shall be conducted as a closed record hearing before the
Hearing Examiner based on the information presented to the Community Development Director, who
made the original decision. No new evidence or testimony will be permitted during the appeal hearing.
Parties will be allowed to present oral argument based on the information presented to the Community
Development Director before their decision was issued. The Hearing Examiner's decision on the appeal is
the City's final decision.
Any party wishing to challenge the Hearing Examiner's decision on this application must file an appeal
pursuant to the procedures and time limitations set forth in RCW ch. 36.70C. An appeal challenging a
DNS, an MDNS or an EIS may be included in such an appeal. If no appeal of the Hearing Examiner's
decision is properly filed in Superior Court within such time limit, the Decision on this permit will be
final.
VI. INSPECTION OF INFORMATION ON THE APPLICATION
Project materials including the application, any staff reports, and other studies related to the permits are
available for inspection at the Tukwila Department of Community Development, 6300 Southcenter Blvd.,
Suite 100, Tukwila, Washington 98188 from Monday through Friday between 8:30 a.m. and 5:00 p.m. The
project planner is Minnie Dhaliwal, who may be contacted at 206-431-3685 or via email at
Minnie.Dhaliwal@tukwilawa.gov for further information.
Property owners affected by this decision may request a change in valuation for their property tax purposes.
Contact the King County Assessor's Office for further information regarding property tax valuation changes.

Please accept the following response to your letter titled "Notice of Incomplete Application"
dated 17 March 2016.
T-Mobile proposes modifying an existing wireless communication site at the above -referenced
address.
47 CFR 1.40001
Because the proposal does not substantially change the physical dimensions of the wireless
facility it qualifies as an eligible facility as defined by 47 CFR 1.40001 and recent federal
regulation requires approval within sixty (60) days of a request for a qualifying modification of
an existing tower or base station that does not substantially change the physical dimensions of
such tower or base station is provided herein below.
In this case, the regulation requires approval of a proposed modification to a communications
support structure when:
• It increases the height of the support tower by twenty feet or less.
o No increase in height is proposed.
o Existing structure height: 60'.
o Proposed structure height: 60'.
o No change.
• New antennas extend horizontally from the edge of the support tower by twenty feet or
less.
o Proposed is the replacement of two antennas on existing mounts that are within
20' of the support tower.
o No change in the horizontal extension of antennas from the support structure is
proposed.

• Four or fewer new equipment cabinets are added.
o No new equipment cabinets are proposed.
• All work shall take place on private property outside of the right-of-way and within the
existing fenced compound.
Base on the foregoing, this project qualifies as an eligible facility as defined in 47 CFR 1.40001.
Submitted herewith is a copy of 47 CFR § 1.40001.
18.58.090 Adding Antennas to Existing WCF Tower -Specific Development Standards.
• Height: No change in height of the tower approved by the City of Tukwila is proposed.
• Antenna aesthetics: Antennas shall be painted to match the color scheme of the tower.

MANUFACTURERSNENDORS SPECIFICATIONS UNLESS NOTED OTHERWISE OR WHERE LOCAL CODES OR
ORDINANCES TAKE PRECEDENCE.
7. ALL WORK PERFORMED ON THE PROJECT AND MATERIALS INSTALLED SHALL BE IN STRICT ACCORDANCE WITH
ALL APPLICABLE CODES, REGULATIONS, AND ORDINANCES. CONTRACTOR SHALL GIVE ALL NOTICES AND COMPLY
WITH ALL LAWS, ORDINANCES, RULES, REGULATIONS AND LAWFUL ORDERS OF ANY PUBLIC AUTHORITY,
MUNICIPAL AND UTILITY COMPANY SPECIFICATIONS, AND LOCAL AND STATE JURISDICTIONAL CODES BEARING ON
THE PERFORMANCE OF THE WORK.
8. GENERAL CONTRACTOR SHALL PROVIDE, AT THE PROJECT SITE, A FULL SET OF CONSTRUCTION DOCUMENTS
UPDATED WITH THE LATEST REVISIONS INVOLVED WITH THE PROJECT. THIS SET IS A VALID CONTRACT
DOCUMENT ONLY IF THE TITLE SHEET IS STAMPED IN RED INK FOR CONSTRUCTION" AND EACH SUCCESSIVE
SHEET BEARS THE ARCHITECTS/ENGINEER'S SIGNED WET STAMP.
9. THE CONTRACTOR IS RESPONSIBLE FOR ADEQUATELY BRACING AND PROTECTING ALL WORK DURING
CONSTRUCTION AGAINST DAMAGE, BREAKAGE, COLLAPSE, ETC. ACCORDING TO APPLICABLE CODES,
STANDARDS, AND GOOD CONSTRUCTION PRACTICES.
10. THE CONTRACTOR SHALL MEET ALL OSHA REQUIREMENTS FOR ALL INSTALLATIONS.
11. THE CONTRACTOR SHALL BE RESPONSIBLE FOR ALL DAMAGES TO THE EXISTING CONSTRUCTION AND REPAIR
ALL DAMAGES TO BETTER THAN NEW CONSTRUCTION. THE CONTRACTOR SHALL NOTIFY THE CONSULTANT OF
ANY DAMAGE TO THE BUILDING SITE OR ANY ADJACENT STRUCTURES AROUND THE PROJECT. THE T-MOBILE
REPRESENTATIVE SHALL BE SOLE AND FINAL JUDGE AS TO THE QUALITY OF THE REPAIRED CONSTRUCTION. ANY
ADDITIONAL MODIFICATIONS WHICH MUST BE MADE SHALL BE MADE AT THE CONTRACTOR'S EXPENSE.
12. WHERE NEW PAVING, CONCRETE SIDEWALKS OR PATHS MEET EXISTING CONSTRUCTION, THE CONTRACTOR
SHALL MATCH THE EXISTING PITCH, GRADE, AND ELEVATION SO THE ENTIRE STRUCTURE SHALL HAVE A SMOOTH
TRANSITION.
13. THE CONTRACTOR SHALL MODIFY THE EXISTING FLOORS, WALL, CEILING, OR OTHER CONSTRUCTION AS
REQUIRED TO GAIN ACCESS TO AREAS FOR ALL MECHANICAL, PLUMBING, ELECTRICAL, OR STRUCTURAL
MODIFICATIONS. WHERE THE EXISTING CONSTRUCTION DOORS, PARTITIONS, CEILING, ETC., ARE TO BE REMOVED,
MODIFIED, OR REARRANGED OR WHERE THE EXPOSED OR HIDDEN MECHANICAL, ELECTRICAL, SYSTEMS ARE
ADDED OR MODIFIED, THE GENERAL CONTRACTOR SHALL REPAIR, PATCH AND MATCH ALL EXISTING
CONSTRUCTION AND FINISHES OF ALL FLOORS WALLS AND CEILINGS. WHERE CONCRETE MASONRY
CONSTRUCTION IS MODIFIED, THE CONTRACTOR SHALL TOOTH IN ALL NEW CONSTRUCTION TO MATCH THE

APPLICABLE), UP TO TOWER LEG (IF APPLICABLE), & DISTRIBUTE
TO EACH ANTENNA DEVICE. FURNISH AND INSTALL A MINIMUM OF
(3) GROUND KITS PER COAXIAL CABLE ACCORDING TO
ELECTRICAL DRAWINGS. VERIFY NUMBER OF ANTENNAS, CABLE,
& CABLE DIAMETER WITH PROJECT MANAGER.
