Tukwila, WA 98188 RE: Short Plat L16-0014 Tax Parcel: 7346600128 Dear Mr. MacVeigh: Allan Ekberg, Mayor Jack Pace, Director The Short Subdivision Committee has completed review of your short plat application (No. L16- 0014), and determined that it complies with all applicable City code requirements. The City SEPA Responsible Official has previously determined that this application does not require a SEPA threshold determination because it is categorically exempt. This letter serves as the Notice of Decision per the Permit Application Types and Procedures Chapter of the Zoning Code (TMC 18.104.170.) Based on the project submittal, preliminary approval is granted subject to the conditions stated below. The conditions imposed are to ensure the short plat is consistent with the Criteria for Preliminary Approval listed in the in the Tukwila Subdivision Code. (TMC 17.12.020 C.) Preliminary Approval Conditions 1) Revise the Short Plat as follows: a) Label the assigned addresses as follows on sheet 2 of 2: i. Lot 1-2914 S 135 Street ii. Lot 2 - 2916 S 135 Street b) Add a "Note" to the Private Access, Drainage, Utilities and Emergency Turnaround Easement. SAMPLE for Information only - This short plat contains an easement for access; utilities, such as drainage, sanitary sewer, water, electricity, cable; and an emergency turnaround for the benefit of the owners of tots 1 and 2 of this short plat. Ownership of said lots 1 and 2 within this short plat includes an equal and undivided responsibility for the maintenance of said easement and the construction, maintenance, repair, and replacement of improvements contained therein." c) You may remove the word "drainage" from the above label as "utilities" includes that function and would potentially confuse property owners as the access and utility easement leading to the property does not spell out "drainage." d) Add a note indicating: "New residential homes shall be equipped with a fire sprinkler system." e) Add note that the owner of lot 1 shalt obtain a separate sanitary sewer permit from Valley View Water District. f) Label and correct the "required building setback" so that the south is 20 feet the east and west are 5 feet and the north is 10 feet. g) Add recording number for the proposed private easement for sanitary sewer after confirmation that there is adequate legal connection to public right of way. (see 3 below) h) Remove or label the dashed lines adjacent to the proposed new private easement for access and utilities. i) Label the square footage shown as "proposed new lot size" 2) Submit the attached Traffic Concurrency Test Application to Public Works and pay the $300.00 application fee. 3) Provide a copy of the private sewer easement that will be used to connect the proposed new sewer easement to the public right of way thereby verifing that the new easement has a legal connection. Informational Items that will apply to future construction permits: 1. Transportation Impact Fee applies to the future Building Permit(s). See Pavement Mitigation and Transportation Impact Fees Bulletin no. A3 — enclosed. 2. Fire Sprinkler system shall be installed in new single family dwellings.. Ensure the water supply line and water meter are sized to accommodate the required residential fire sprinkler systems water flow demand. 3. The final grading plan must show a flat area below any second story rescue windows for Fire Department ground ladder placement. if unable to provide a suitable flat area adjacent to the houses for fire ladder access, please contact the Tukwila Fire Marshal's office at (206) 971-8719. 4. Tree Retention - Every reasonable effort shall be made to preserve existing trees and vegetation and integrate them into home's design (TMC 17.20.030.A.2) 5. All utilities including power are required to be underground per the Tukwila Municipal Code. 6. Provide a copy of the recorded document with King County Assessor parcel numbers to the Fire Marshal's Office once it is completed. NEXT STEPS: 1. Construction permits: Install all required site improvements, including those proposed in the application and those identified above as conditions of approval. You will need to obtain all required permits prior to beginning any construction. For City of Tukwila utilities, contact Tukwila Public Works at (206) 433-0179 for a Public Works (PW) Type 'C' permit. For utilities provided by other entities, contact the individual providers. 2. Final Approval: Submit documents for final approval. After installing the required site improvements and complying with the conditions of approval submit the necessary short plat documents (survey, legal descriptions, and other required paper work) for city signatures. All taxes and fees assessed against the property must be current prior to final approval. Please check with the King County Assessor's Office and the City of Tukwila Finance Department prior to submitting final documents. After the documents have been found to be in order, and the all of the requirements of the short plat have been met, the Chair of the Short Subdivision Committee signs your short plat which constitutes a grant of final approval. 3. Recording: The signature of the Chairman of the Short Subdivision Committee certifies that your short plat application is ready for recording. It is your responsibility to record the City approved short plat documents with the King County Department of Records. You will need to pay the recording fees and submit your approved original short plat to King County. The short plat is not complete until the recording occurs and copies of the recorded documents are provided to the Department of Community Development. After recording, the County returns the recorded original to the City of Tukwila within 4-6 weeks, at which time your short plat is considered com plete. You can shorten this processing time by hand -delivering a copy of the recorded short plat to the project planner. In many circumstances, building permits on the short platted property may not be issued until a copy of the recorded short plat (or original) is returned to the Department of Community Development. EXPIRATION OF PRELIMINARY APPROVAL The final approved short plat must be filed with the King County Department of Records within one year from the date of this preliminary approval or the application will expire. The City may grant a single one year extension if requested in writing prior to the expiration date. APPEAL RIGHTS This short plat approval decision may be appealed to the Hearing Examiner. One administrative appeal of the decision on the short plat. If no valid appeals are filed within the time limit, the decision of the Department will be final. In order to appeal the decision a written notice of appeal must be filed with the Department of Community Development within 21 days of the issuance of the Notice of Decision. The requirements for such appeals are set forth in the Appeal Process Chapter of the Tukwila Municipal Code (TMC18.116.) Appeal materials shall include: 1. The name of the appealing party. 2. The address and phone number of the appealing party; and if the appealing party is a corporation, association or other group, the address and phone number of a contact person authorized to receive notices on the appealing party's behalf. 3. A statement identifying the decision being appealed and the alleged errors in the decision, including any specific challenge to an MDNS. 4. The Notice of Appeal shall identify (a) the specific errors of fact or errors in application of the law in the decision being appealed; (b) the harm suffered or anticipated by the appellant, and (c) the relief sought. The scope of an appeal shall be limited to matters or issues raised in the Notice of Appeal. 5. Appeal fee per the current fee schedule, additional hourly charges may apply. In addition all hearing examiner costs will be passed through to the appellant. Any appeal shall be conducted as an open record hearing before the Hearing Examiner. The Hearing Examiner's decision on the appeal is the City's final decision. A party who is not satisfied with the outcome of the administrative appeal process may file an appeal in King County Superior Court from the Hearing Examiner's decision pursuant to the procedures and time limitations set forth in RCW ch. 36.70C. The increased volume is also a significant and conservative increase over the working sketch design. Also, catch basins with 4" tees were installed at both ends. On September 15, 2015 this office visited the site and observed the completed and fully graveled and piped trench. The catch basins were in place and correctly installed. The driveway is located in a 20 foot by approximately 150 foot access easement running from the right-of-way on the north side of S 135th street north to the subject property. In November 2014 this office prepared an engineered design for the driveway, including an engineered minor concrete retaining wall for use on either both sides or at least the east side of the driveway. The wall(s) were desired to level the run of the driveway which would otherwise "dip" too much along its run. This design has been submitted and substantially approved. During routine visits to the site to assist in the residential construction in June and July the construction of the east wall, the fill placement and the drainage trench installation were observed. All installations were of good construction and matched the recommendations and specifications of the engineered design. At this time the run of driveway from the street up to (and including) the site's parking pad are graded and ready for top course and asphalt paving. Prior to final occupancy an additional "turn -around" pavement section will be installed on the site west of the residence to meet Fire Department requirements. The grading required for this additional pavement has not been completed and it's paving will be done separately. Attached are photographs of the infiltration trench installation. The designed 5 foot by 45 foot trench was properly installed, and with a completed width typically at least one foot wider than the required 5 foot. After installing the required site improvements and complying with the conditions of approval submit the necessary short plat documents (survey, legal descriptions, and other required paper work) for city signatures. All taxes and fees assessed against the property must be current prior to final approval. Please check with the King County Assessor's Office and the City of Tukwila Finance Department prior to submitting final documents. After the documents have been found to be in order, and the all of the requirements of the short plat have been met, the Chair of the Short Subdivision Committee signs your short plat which constitutes a grant of final approval. 3. Recording: The signature of the Chairman of the Short Subdivision Committee certifies that your short plat application is ready for recording. It is your responsibility to record the City approved short plat documents with the King County Department of Records. You will need to pay the recording fees and submit your approved original short plat to King County. The short plat is not complete until the recording occurs and copies of the recorded documents are provided to the Department of Community Development. After recording, the County returns the recorded original to the City of Tukwila within 4-6 weeks, at which time your short plat is considered complete. You can shorten this processing time by hand -delivering a copy of the recorded short plat to the project planner. In many circumstances, building permits on the short platted property may not be issued until a copy of the recorded short plat (or original) is returned to the Department of Community Development. EXPIRATION OF PRELIMINARY APPROVAL The final approved short plat must be filed with the King County Department of Records within one year from the date of this preliminary approval or the application will expire. The City may grant a single one year extension if requested in writing prior to the expiration date. APPEAL RIGHTS 'k''w'r This short plat approval decision may be appealed to the Hearing Examiner. One administrative appeal of the decision on the short plat. If no valid appeals are filed within the time limit, the decision of the Department will be final. In order to appeal the decision a written notice of appeal must be filed with the Department of Community Development within 21 days of the issuance of the Notice of Decision. The requirements for such appeals are set forth in the Appeal Process Chapter of the Tukwila Municipal Code (TMC18.116.) Appeal materials shall include: 1. The name of the appealing party. 2. The address and phone number of the appealing party; and if the appealing party is a corporation, association or other group, the address and phone number of a contact person authorized to receive notices on the appealing party's behalf. 3. The Notice of Appeal shall identify (a) the specific errors of fact or errors in application of the law in the decision being appealed; (b) the harm suffered or anticipated by the appellant, and (c) the relief sought. The scope of an appeal shall be limited to matters or issues raised in the Notice of Appeal. 5. Appeal fee per the current fee schedule, additional hourly charges may apply. In addition all hearing examiner costs will be passed through to the appellant. Any appeal shall be conducted as an open record hearing before the Hearing Examiner. The Hearing Examiner's decision on the appeal is the City's final decision. A party who is not satisfied with the outcome of the administrative appeal process may file an appeal in King County Superior Court from the Hearing Examiner's decision pursuant to the procedures and time limitations set forth in RCW ch. 36.70C. The existing residence and its parking pad are infiltrated using an existing standard drywell for the residence. The access driveway in the 20 foot easement infiltrates with an installed standard trench with catch basins, and the on -site existing common paved turnaround pavement infiltrates with its own trench and catch basin. The new residence and its parking pad will be infiltrated via sized drywell similar to the existing residence's system. TECHNICAL INFORMATION REPORT (TIR): No substantial TIR is prepared for this short plat. There is no drainage construction required for this short plat. All common access driveways have in place completed infiltration systems. As mentioned above under the DRAINAGE discussion, the only drainage associated with this short plat is that for the future single family residence and its parking pad. Per the installed drywell for the existing residence (design prepared by this office), the drainage for the future new building feasible using a similar drainage system. The specifics of that future system will be determined and presented for formal plan review as part of that Residential Permit, when the new residence site layout is determined and accurate infiltration sizing calculations can be done. The 0 and M document for that system will also be prepared at that time. SCOPE OF REQUIRED COMMON CONSTRUCTED IMPROVEMENTS FOR SHORT PLAT APPROVAL All required common improvements were constructed or installed during the construction of the new residence on the east side of the parcel. The common access driveway and on -site turnaround are in place, including their drainage. All underground utilities for the future second residence are in place, including sewer line, water service line, gas and all wired utilities. As a result of this, there are no required common use required site improvements related to this short plat action. SOILS INFORMATION This information is from the soils investigation and residential drywell system previously designed and installed for the newly constructed residence on the east portion of the short plat site. This information is applicable in a general way to the future residential drywell design for a future new residence on the west portion of the short plat site following completion of the short plat. The specifics for the new house drainage must await the preparation of the Residential Permit plans and documents for that project. This soils information is appropriate for use with the new residence drainage design without further soils evaluation for the site. Below is the drainage design discussion for original house drainage system - The drywell for the second residence my vary slightly based on the impervious areas for the house and its driveway General This is an existing 13,950 sf parcel which is undeveloped. The new house will be 2,357 sf, with an additional 1,395 sf of driveway flows into the same trench as the entire new roof area. The total area to be infiltrated will therefore be 3,752 sf or 0.086 acres. Soils indicate on -site infiltration is feasible. Soil logs and percolation test results are attached. Infiltration Test: 25 SEP 13: EPA Falling Head percolation tests were done at SL 1 and SL 2 after a thorough pre- soak consisting of two each 12" drop runs. These two logs were used since they were approximately 3 feet lower in surface elevation than the last two Togs. Since the infiltration system will be placed in the part of the property higher than the logs used for the percolation tests, we can conclude that the deeper soils on the site will support infiltration deeper than the 48" in the upper logs. Soils on site were very consistent. Test Results: SL 1: 11:10 am to 2:00 pm 12" drop 170 min. 14.2 min./in. SL 2: 11:46 am to 2:00 pm 12" drop 134 min. 11.1 min./in. For design use the more conservative 14.2 min./in. is considered. This would be considered a very favorable infiltration rate. Based on the determined infiltration rate and the soils encountered, we may conclude that a drywell system is appropriate. Drvwell Sizing Per Appendix C of the King County Stormwater Design Manual, a drywell in Medium Sand should have 90 cubic feet of gravel per 1,000 square feet of impervious area served.
