The City SEPA Responsible Official has previously determined that this application does not require a SEPA threshold determination because it is categorically exempt. This letter serves as the Notice of Decision per TMC 18.104.170. Based on the latest project submittal, preliminary approval is granted subject to the conditions stated below. The conditions imposed are to ensure the short plat is consistent with the Criteria for Preliminary Approval listed at TMC 17.12.020 C in the Tukwila Subdivision Code. Preliminary Approval Conditions 1. Add permit number L16-0015 to Survey Site Map Sheet 1 of 1. 2. Revise the boundaries of Lot 2 to include access area in between Lots 1 and Lot 3, eliminating the need for the easement to extend to the east of the access drive. See attached red lined Survey Site Map. 3. Revise Survey Site Map to show the south and east boundaries of Lot 3 in solid heavy lines. 4. Add a note to the Survey Site Map stating system." 5. Civil plans show water meters inside the private access road: in front of future Lots 1 and 2. However, per Water District 125, water services shall be tapped from the water meters in S 150th Street and water meters shall be located along S 150th Street. 10. Applicant shall submit copies of all existing recorded easements. 11. Applicant shall fill out and submit Traffic Concurrency Certificate Application and associated fee to Public Works. See attached Traffic Concurrency Certificate Application. 12. Submit a Sensitive Area Hold Harmless Agreement executed with Notary. 13. Submit lot line closure tape. Informational Items: 1. The applicant shall apply for a Public Works (PW) type `C' permit for approval. 2. Future residence requires a sanitary sewer permit from the Valley View and water service/water meter permit from Water District #125. Each house will be required to install its own separate private pump system Valley View's pump station spec. 3. The water meter and associated water supply piping shall be sufficient to support the required residential fire sprinkler system for each new lot. 4. Each lot shall require a copy of the geotechnical report to be provided with future building permits. Soil reports shall include recommendations for footing and roof water disbursement to a designed trench or storm drains. 5. The final grading plan must show a flat area below any second story rescue windows for Fire Department ground ladder placement. If unable to provide a suitable flat area adjacent to the houses, please contact the Tukwila Fire Marshal's office at 1.206.575.4407. 6. Proposed homes shall meet TMC 18.50.050 design standards. These will be reviewed at the time of building permit review. 7. The private street sign shall be placed on S 150th Street at the intersection with the private road, 8. Applicant shall contact Post Master at 1.800.275.8777 for mailbox location approval. 9. For short plat developments of four single-family homes of less and individual single-family homes, fire hydrants shall be placed so that a hydrant is no more than 250 feet by line of vehicular travel to the nearest point of the building. For developments greater than four single-family homes, the hydrant shall be no more than 150 feet by line of vehicular travel to the nearest point of the building. NEXT STEPS: 1. Construction permits: Install all required site improvements, including those proposed in the application and those identified above as conditions of approval. You will need to obtain all required permits prior to beginning any construction. Comments from departments are listed below. A resubmittal of four updated site plans addressing the comments below is required for our continued review. The Revision Submittal form can be found at http://www.tukwilawa.gov/wp-content/uploads/DCD-Permits-Revision-Submittal.pdf. Public Works 1) Prior to final plat approval applicant shall pay $300.00 to Public Works for C17-0006 Traffic Concurrency Certification Application fee. 2) Submit a copy of a current title report. The one submitted is dated 2002. 3) There was a Record of Survey recorded in 2015 under King County recording no. 20151016900002, however it is not listed under Survey References on page 2 of 2 of your survey. 4) Submit Water Availability Letters from WD #125 and sewer availability letter from Valley View Sewer District; see attached forms. 5) The existing house is still on septic and shall be connected to Valley View sanitary sewer system prior to final plat approval, applicant submits short plat approval from King County Black River Environmental Health in Renton, phone 206 296-4932 since lot size will be substantially reduced. 6) If the existing house is going to be connected to sanitary sewer, note 4 on sheet 2 of 2 shall be modified to include info that the existing house is still on septic system, and a bond for sewer connection to the existing house will be required. 7) A new ingress/egress and utility easement is required since new lots are being created. This easement shall spell out maintenance responsibilities for the access road and any common utilities. It appears that the 30-ft wide easement is for O/H and U/G power only. 8) Add notes: a) Each lot shall require a geotechnical report with future building permit. This application will expire if we do not receive the additional information within ninety days of the date of this letter, unless an extension is granted pursuant to Tukwila Municipal Code 18.104.070(E). Final Approval: Submit documents for final approval. After installing the required site improvements and complying with the conditions of approval submit the necessary short plat documents (survey, legal descriptions, and other required paper work) for city signatures. AU taxes and fees assessed against the property must be current prior to final approval. Please check with the King County Assessor's Office and the City of Tukwila Finance Department prior to submitting final documents. After the documents have been found to be in order, and the all of the requirements of the short plat have been met, the Chair of the Short Subdivision Committee signs your short plat which constitutes a grant of final approval. 3. Recording: The signature of the Chairman of the Short Subdivision Committee certifies that your short plat application is ready for recording. It is your responsibility to record the City approved short plat documents with the King County Department of Records.You will need to pay the recordingfees and submityourapproved original short plat to King County. The short plat is not complete until the recording occurs and copies of the recorded documents are provided to the Department of Community Development.After recording, the County returns the recorded original to the City of Tukwila within 4-6 weeks, at which time your short plat is considered complete. You can shorten this processing time by hand -delivering a copy of the recorded short plat to the project planner. In many circumstances, building permits on the short platted property may not be issued until a copy of the recorded short plat (or original) is returned to the Department of Community Development. EXPIRATION OF PRELIMINARY APPROVAL The final approved short plat must be filed with the King County Department of Records within one year from the date of this preliminary approval or the application will expire. The City may grant a single one year extension if requested in writing prior to the expiration date. APPEAL RIGHTS This short plat approval decision may be appealed to the Hearing Examiner. One administrative appeal of the decision on the short plat, excluding challenges to the DNS, is permitted. If no valid appeals are filed within the time limit, the decision of the Department will be final. In order to appeal the decision a written notice of appeal must be filed with the Department of Community Development within 21 days of the issuance of the Notice of Decision. The requirements for such appeals are set forth in Tukwila Municipal Code 18.116. Appeal materials shall include: 1. The name of the appealing party. 2. The address and phone number of the appealing party; and if the appealing party is a corporation, association or other group, the address and phone number of a contact person authorized to receive notices on the appealing party's behalf. 3. A statement identifying the decision being appealed and the alleged errors in the decision, including any specific challenge to an MDNS. 4. The Notice of Appeal shall identify (a) the specific errors of fact or errors in application of the law in the decision being appealed; (b) the harm suffered or anticipated by the appellant, and (c) the relief sought. The scope of an appeal shall be limited to matters or issues raised in the Notice of Appeal. In addition all hearing examiner costs will be passed through to the appellant. Any appeal shall be conducted as an open record hearing before the Hearing Examiner. The Hearing Examiner's decision on the appeal is the City's final decision. A party who is not satisfied with the outcome of the administrative appeal process may file an appeal in King County Superior Court from the Hearing Examiner's decision pursuant to the procedures and time limitations set forth in RCW 36.70C. All taxes and fees assessed against the property must be current prior to final approval. Please check with the King County Assessor's Office and the City of Tukwila Finance Department prior to submitting final documents. After the documents have been found to be in order, and the all of the requirements of the short plat have been met, the Chair of the Short Subdivision Committee signs your short plat which constitutes a grant of final approval. 3. Recording: The signature of the Chairman of the Short Subdivision Committee certifies that your short plat application is ready for recording. It is your responsibility to record the City approved short plat documents with the King County Department of Records. You will need to pay the recording fees and submit your approved original short plat to King County. The short plat is not complete until the recording occurs and copies of the recorded documents are provided to the Department of Community Development. After recording, the County returns the recorded original to the City of Tukwila within 4-6 weeks, at which time your short plat is considered complete. You can shorten this processing time by hand -delivering a copy of the recorded short plat to the project planner. In many circumstances, building permits on the short platted property may not be issued until a copy of the recorded short plat (or original) is returned to the Department of Community Development. EXPIRATION OF PRELIMINARY APPROVAL The final approved short plat must be filed with the King County Department of Records within one year from the date of this preliminary approval or the application will expire. The City may grant a single one year extension if requested in writing prior to the expiration date. APPEAL RIGHTS This short plat approval decision may be appealed to the Hearing Examiner. One administrative appeal of the decision on the short plat, excluding challenges to the DNS, is permitted. If no valid appeals are filed within the time limit, the decision of the Department will be final. In order to appeal the decision a written notice of appeal must be filed with the Department of Community Development within 21 days of the issuance of the Notice of Decision. The requirements for such appeals are set forth in Tukwila Municipal Code 18.116. Appeal materials shall include: 1. The name of the appealing party. 2. The address and phone number of the appealing party; and if the appealing party is a corporation, association or other group, the address and phone number of a contact person authorized to receive notices on the appealing parry's behalf. 3.
