YOUR APPEAL RIGHTS The Decision on this Permit Application is a Type 2 decision pursuant to Tukwila Municipal Code §18.104.010. Other land use applications related to this project may still be pending. No administrative appeal of a DNS or an EIS is permitted. One administrative appeal to the City Hearing Examiner of the Decision on the Permit itself is permitted. If an MDNS was issued, any person wishing to challenge either the conditions which were imposed by the MDNS decision or the failure of the Department to impose additional conditions in the MDNS must raise such issues as part of the appeal to the Hearing Examiner. A party who is not satisfied with the outcome of the Hearing Examiner appeal process may file an appeal in King County Superior Court from the Hearing Examiner's decision. IV. PROCEDURES AND TIME FOR APPEALING In order to appeal the Community Development Director decision on the Permit Application, a written notice of appeal must be filed with the Department of Community Development within 14 days of the issuance of this decision. The requirements for such appeals are set forth in Tukwila Municipal Code ch. 18.116. All appeal materials shall be submitted to the Department of Community Development. Appeal materials MUST include: 1. The name of the appealing party. 2. The address and phone number of the appealing party; and if the appealing party is a corporation, association or other group, the address and phone number of a contact person authorized to receive notices on the appealing party's behalf. 3. A statement identifying the decision being appealed and the alleged errors in the decision, including any specific challenge to an MDNS. 4. The Notice of Appeal shall identify (a) the specific errors of fact or errors in application of the law in the decision being appealed; (b) the harm suffered or anticipated by the appellant, and (c) the relief sought. The scope of an appeal shall be limited to matters or issues raised in the Notice of Appeal. 5. APPEAL HEARINGS PROCESS Any administrative appeal regarding the Permit shall be conducted as a closed record hearing before the Hearing Examiner based on the information presented to the Community Development Director, who made the original decision. No new evidence or testimony will be permitted during the appeal hearing. Parties will be allowed to present oral argument based on the information presented to the Community Development Director before their decision was issued. The Hearing Examiner's decision on the appeal is the City's final decision. Any party wishing to challenge the Hearing Examiner's decision on this application must file an appeal pursuant to the procedures and time limitations set forth in RCW ch. 36.70C. An appeal challenging a DNS, an MDNS or an EIS maybe included in such an appeal. If no appeal of the Hearing Examiner's decision is properly filed in Superior Court within such time limit, the Decision on this permit will be final. The City's decision to issue a DNS, an MDNS or an EIS is final for this permit and any other pending permit applications for the development of the subject property. VI. The project includes: • Removal of three (3) existing panel antennas and replacement with three (3) new panel antennas in the existing cupola. The existing concealed building mounted cellular facility does not extend beyond the roofline. The proposed modifications do not alter the existing height. Existing Development This concealed building mounted wireless facility is located in a cupola in the Hampton Heights Apartments, a multi -family development located in a residential area of the city. Surrounding Land Uses The subject property is zoned High Density Residential (HDR). The surrounding parcels to the north, south, east and west are also zoned HDR. Background In 2006, the City adopted a Wireless Facilities Chapter (TMC 18.71) to the Zoning Code. The chapter provides specific location and design requirements for the placement of WCF within the City of Tukwila. The WCF being modified was originally approved by the City in 2002 (L02-011) through a conditional use permit. In 2011 the WCF was approved for modifications (L11-022) through a Type 2 Wireless Facilities permit and SEPA environmental review (E11-001). Location Selection Tukwila Municipal Code (TMC) provides a hierarchy of appropriate locations within the City. Generally, co - locations and utilizing existing structures are favored over the development of new standalone WCF within the City. This decision does not require the use of any new facilities for placement of the new antennas, radios, and cabinet equipment. There is no proposed new cabinet equipment. Design Standards The City provides specific design standards for the placement of WCF within the City of Tukwila. The table below indicates if the applicant's proposal complies with required standards. The design of all buildings and ancillary structures shall use materials, colors, textures, screening, and landscaping that will blend the tower facilities to the natural setting and built environment. The antennas must be concealed from view by blending with the architectural style of the building. X The antennas will be housed in the existing cupola (stealth).. 3. Feed lines and cables should be located below the parapet of the rooftop. X All cables will follow existing routes inside the cupola, screened from view. 4. If cabinet equipment cannot be located within the building where the wireless communication facilities will be located, then the City's first preference is to located the equipment on the rooftop of the building. X There are no proposed changes to the cabinet equipment. 5. The proposed wireless communication facility must meet the setback of the applicable zoning category where the facility is to be located. X The modification will protrude no more than 6 feet from the edge of the structure, which is within the allowable setbacks for the HDR zoning district. CONCLUSIONS 1. The proposed modifications to the existing WCF will not significantly alter the conditions that currently exist and will not be materially detrimental to the public welfare or injurious to property or improvements in the vicinity. 2. As demonstrated in Tables 1 and 2, the project meets all applicable development standards for a Type 2 WCF. 3. The proposed modifications will not alter the surrounding land uses in terms of traffic and pedestrian circulation, building or site design. 4. The proposed project is in keeping with the goals and policies of the Comprehensive Land Use Policy Plan. RECOMMENDATIONS The recommendation to the Director of Community Development is to approve this application for a Type II Wireless Telecommunication Facility permit as applied for by Inte-Grat-Ed Design Solutions for AT&T with no conditions. ECE !1 ED t4PR 23 2016 Community Development at&t DATE: March 3, 2016 TO: The City of Tukwila Planning Department RE: Proposed Radio Site/Modification: WA6647 @ 5711 South 152nd St. Tukwila Dear Planner, The proposed facility noted above will transmit at frequencies in the range of 734 to 892 MHz and 1,930 to 2,360 MHz as licensed by the Federal Communications Commission. The worst case general population exposure limit per the FCC Public Standards OET Bulletin 65 occurs at 734 MHz and is 0.4893 mW/cm2. The worst case for the 1,500 to 100,000 MHz band is 1.0 mW/ cm2. The power density calculations for each sector of the proposed facility (typically will be within 5 to 50% of the FCC limit) will be well below the maximum FCC exposure levels. This particular site was measured by an independent 3rd party firm and had one location reading 48.5% of maximum FCC "General Public" values. The remaining measurement locations average readings were < 10%. The proposed facility will not cause other co -located facilities to exceed FCC exposure standards and is categorically proven as safe, according to Federal Guidelines. AT&T audits our facilities on a semi- annual basis to insure that FCC compliance levels are continuously met. The proposed facility should not interfere with other communications facilities. Our sites are monitored 24/7 by a national operations center to insure all is operating normally. In addition, we have local technicians who make routine visits to cell sites to make repairs when needed. I certify that this information is true to the best of my knowledge. Please refer to the Plan Set for more information. The existing WCF is located in the HDR zone in the City of Tukwila. The replacement antennas will be located at 49'-0", which is the same height as the existing facility. Please refer to elevation sheets of the Plan Set. This AT&T proposal qualifies as a modification under 6409(a) per the following reasons: • The proposed modification does not increase the height of the base station. The replacement antennas and the new antennas will be the same height as the original antennas — refer to Sheet A-4 of the Site Plans; • The modification will not protrude more than 6' from the edge of the structure; • The new antennas will be stealth • This proposal will not defeat any existing concealment elements or conflict with any of the existing conditions of approval. The existing site is located in the HDR zone, and the existing antennas do not extend more than 15' above the height of the tower. The existing antennas are currently screened. Therefore, this site will not defeat existing concealment elements. AT&T is only proposing a minor modification to an existing wireless facility. They will be replacing (3) antennas. Therefore, this proposal should qualify for review under 6409(a) because of this limited scope of changes and minimal visual impact. Moreover, the modification will enable AT&T to provide more reliable and seamless 4G coverage to its customers in the area.
