Tukwila, WA 98168 RE: Bual Short Plat L16-0020 15415 65th Ave S Parcel#3597000321 Dear Mr. Palmaffy and Mr. Bual, The Short'Subdivision Committee has completed review of your short plat application (No. L16-0020), and determined that it complies with all applicable City code requirements. The City SEPA Responsible Official has previously determined that this application does not require a SEPA threshold determination because it is categorically exempt. This letter serves as the Notice of Decision per TMC 18.104.170. Based on the latest project submittal, preliminary approval is granted subject to the conditions stated below. The conditions imposed are to ensure the short plat is consistent with the Criteria for Preliminary Approval listed at TMC 17.12.020 C in the Tukwila Subdivision Code. Preliminary Approval Conditions 1. Submit Sheet 1 of 2 of the short plat survey, to include signature blocks, existing and proposed legal descriptions for the lots and other content, as listed in TMC 17.04.060. A template is available for download and use from the Tukwila website. Please note that the email in the upper left-hand corner should be changed as specified in comment #2 below. 2. Change the City email in the upper left hand corner of both pages of the survey to the following: PlanningcETukwilaWA.gov. 3. A new Private fire hydrant with an 8-inch water line connecting to the water main within 65th Ave. South, was installed as part of Building permit no. D12-233. Show Private fire hydrant & 8- inch water main located within the South 5 feet of the New Lot 4, as within an easement for the benefit of Lots 1 and 2. Also, please note that the mailbox for Lot 2 appears to be located within the southeastern corner of future Lot 4. This area can be included as part of this easement, Bual Short Plat, L16-0020 April 7, 2017 Page 2 unless the mailbox will be relocated. Please check with the postmaster to determine the appropriate location of the mailbox for Lot 2 and include in easement or relocate the mailbox. 4. Revise the legend to include the symbol in the southeastern corner of Lot 4, which has a square with a triangle in the middle. Additional easements or corrections to the survey may be needed based on what is represented by this symbol. 5. Prepare a Private 20' Shared Access Easement and Maintenance Agreement for Lots 3 and 4 of this Short Plat. (1) This document should either be shown on the short plat map with legal descriptions or be recorded as a separate easement document prior to recording of the Final Short Plat Map with the recording number shown on the short plat map. (2) The Private 20' Shared Access Easement and Maintenance Agreement should include language stating who will maintain the shared driveway, and by what portion. (See sample - enclosed) Alternatively, the shared access from 65th to Lot 3 and Lot 4 can be removed from the short plat. Driveways to each lot can be constructed as part of the building permit for each lot. 6. Revise the Short Plat Survey Map including the EASEMENT NOTE. See enclosed redlined comments. 7. Clarify whether the sewer connection for Lot 4 is located, or will be located within the 25' access and utility easement for Lot 1 and Lot 2. This is currently shown on Sheet 2 of 2, but it was our understanding that sewer connections to lots 3 and 4 would be from 65th Ave. S. If the sewer connection for Lot 4 will be in this easement area, then the easement note should be revised to reflect this. 8. Owner/Applicant to complete a Traffic Concurrency Certificate Application and pay a Transportation Concurrency Test Fee in the amount $300 for three new houses as part of this Short Plat - L16-0020. NEXT STEPS: 1. Construction permits: Install all required site improvements, including those proposed in the application and those identified above as conditions of approval. You will need to obtain all required permits prior to beginning any construction. For City of Tukwila utilities, contact Tukwila Public Works at (206) 433-0179 for a Public Works (PW) Type 'C' permit. For utilities provided by other entities, contact the individual providers. 2. Final Approval: Submit documents for final approval. After installing the required site improvements and complying with the conditions of approval submit the necessary short plat documents (survey, legal descriptions, and other required paper work) for city signatures. All Bual Short Plat, L16-0020 A pr:1 -z-o17 Page 3 taxes and fees assessed against the property must be current prior to final approval. Please check with the King County Assessor's Office and the City of Tukwila Finance Department prior to submitting final documents. After the documents have been found to be in order, and the all the requirements of the short plat have been met, the Chair of the Short Subdivision Committee signs your short plat which constitutes a grant of final approval. 3. Recording: The signature of the Chairman of the Short Subdivision Committee certifies that your short plat application is ready for recording. It is your responsibility to record the City approved short plat documents with the King County Department of Records. You will need to pay the recording fees and submit your approved original short plat to King County. The short plat is not complete until the recording occurs and copies of the recorded documents are provided to the Department of Community Development. After recording, the County returns the recorded original to the City of Tukwila within 4-6 weeks, at which time your short plat is considered complete. You can shorten this processing time by hand -delivering a copy of the recorded short plat to the project planner. In many circumstances, building permits on the short -platted property may not be issued until a copy of the recorded short plat (or original) is returned to the Department of Community Development. EXPIRATION OF PRELIMINARY APPROVAL The final approved short plat must be filed with the King County Department of Records within one year from the date of this preliminary approval or the application will expire. The City may grant a single, one year extension if requested in writing prior to the expiration date. APPEAL RIGHTS This short plat approval decision may be appealed to the Hearing Examiner. One administrative appeal of the decision on the short plat, excluding challenges to the DNS, is permitted. If no valid appeals are filed within the time limit, the decision of the Department will be final. To appeal the decision a written notice of appeal must be filed with the Department of Community , Development within 14 days of the issuance of the Notice of Decision. The requirements for such appeals are set forth in Tukwila Municipal Code 18.116. Appeal materials shall include: 1. The name of the appealing party. 2. The address and phone number of the appealing party; and if the appealing party is a corporation, association or other group, the address and phone number of a contact person authorized to receive notices on the appealing parry's behalf. Bual Short Plat, L16-0020 April 1, 2417 Page 4 3. A statement identifying the decision being appealed and the alleged errors in the decision, including any specific challenge to an MDNS. 4. The Notice of Appeal shall identify (a) the specific errors of fact or errors in application of the law in the decision being appealed; (b) the harm suffered or anticipated by the appellant, and (c) the relief sought. The scope of an appeal shall be limited to matters or issues raised in the Notice of Appeal. 5. Appeal fee per the current fee schedule, additional hourly charges may apply. In addition, all hearing examiner costs will be passed through to the appellant. Any appeal shall be conducted as an open record hearing before the Hearing Examiner. The Hearing Examiner's decision on the appeal is the City's final decision. A party who is not satisfied with the outcome of the administrative appeal process may file an appeal in King County Superior Court from the Hearing Examiner's decision pursuant to the procedures and time limitations set forth in RCW 36.70C. Tukwila, WA 98168 Dear Mr. Palmaffy and Mr. Bual, The City of Tukwila has completed review of the Bual Short Plat (permit number L16-0020. Items in blue italics below are repeated from the previous correction letter we sent on July 29, 2016. Additional information needed to address this item follows the italicized text. Planning Division 1. Per 17.20.030, F, 1 (arrangement of lots), "side lot lines shall be at right angles to street lines or radial to curved street lines. Each lot must have access to a public street that is approved at the time of plat review; however, rather than designing flag lots, access shall be accomplished with common drive easements." Lot lines for Lott and Lot 4 shall be reconfigured so that the existing driveway is within an easement across Lot 4 rather than as a flag portion of Lott. Legal descriptions for any easements, as well as easement language (purpose and maintenance responsibility) shall be added to the plat for ingress, egress, and utilities. To address the comment above, the driveway area was changed to a tract. The change to a tract addresses the flag lot issue. However, the tract creates irregular lot lines for the lots served by the tract, especially Lot 2. The City requires new lot lines to be as straightforward and easy to identify as possible in order to minimize property line disputes between neighbors. The southern lot line for Lot 2 should be a straight line. The fire access/emergency vehicle turn around area that will be on Lot 2 can be recorded as an easement as part of the plat, with maintenance responsibility included on the face of the plat similar to the ownership and maintenance responsibility language to be added for Tract A. 2. Show on survey map the location, dimension and purpose of existing and proposed easements. Include the recording number for any easements or agreements already in place. Water meters and a fire hydrant are shown on the survey map as being located within Lot 4. Additionally, PSE and Century Link utility boxes were observed to be located in this area. The survey map shall be modified to show graphically the existing PSE easement that has been recorded for the property, and the recording number for the easement shall be referenced. Additional easements across Lot 4 will also need to be shown, with language added to the survey stating maintenance responsibility of the easement area and improvements within it for owners of the short plat. These easements can be recorded with the short plat or as separate documents that are referenced on the short plat map. L16-0020 Bual Short Plat December 12, 2016 Page 2 3. Include on the survey map the description, location, and size of existing and proposed utilities, and storm drainage facilities in relation to the proposed lot lines. Improvements on one lot which serve another lot within the project site will require an easement. Same comment as above...easements are needed showing the location and maintenance responsibilities for improvements on one lot which serve other lots within the short plat. 4. Several trees have been removed from steep slope areas on this site. Replacement is required, which we have discussed with the property owner. Please provide a plan showing where replacement trees will be planted, based on the tree replacement ratios in 18.54.130, 3, b. Provide information on whether any additional trees are proposed to be removed with this short plat (17.20.030, A, 2). Fire Department 1. Addresses have been assigned to the new lots. Include the assigned address numbers on the survey, per redlined sheet. Public Works Department The following corrections must be made prior to issuance of final short plat approval. Items listed under Miscellaneous apply to future construction permits. 1. The configuration of this base lot makes having the new lot lines be parallel to the street near impossible and definitely impractical. A conversation at the counter verified this condition and determined the proposed lines deviation from the code was acceptable. 2. These are shown as an access and egress easement for the two lots on 65th Ave, and as a tract for the two lots to the rear. 3. The two lots facing 65th Ave will access directly from 65th Ave and the tract holds all of the existing utilities. 4. Building footprints have not been determined at this time but possible main floor elevations have been added to the lots. The curb cut has been reduced for 65th Ave by combining the access for the two lots. 5. None of the walls located on lot 2 are 48" or taller, except one. The wall adjacent to the garage is taller and was built with an engineered detail. All of the others are landscaping walls to produce terracing for landscaping purposes. 6. A review of the zoning for this lot showed the front setback to be 20ft, rear 10ft, and the sides 5ft. These setbacks have been added to the lots. 7. Please review this latest version for the required signature blocks. 8. The trees lost due to a wind storm have been removed from the survey. Public Works Department David McPherson The following is in response to your letter: 1. Please see attached application. 2. No Utility improvements are required for this short plat. Access for the lots is shown. Topography is shown on the short plat. There is no grading required for this short plat. 3. The new legal descriptions have been added to the Short plat. 4. The new Tract is the access and utility easement. A maintenance agreement will be drawn up for the use of the back two lots. 5. Include the expected location of new buildings and driveways, including finished floor elevations of the buildings. In order to reduce the number of curb cuts into the sidewalk along 65th Ave. S., access to Lot 4 (and Lot 3 if feasible) should be from the existing driveway instead of from 65th Ave S. 5. Indicate on the survey how tall the concrete block walls are on Lot 2. If the height of the walls is greater than four feet, the new property lines will need to be located so that walls meet setback requirements. 6. Make changes to per redlines on attached copy of the survey. For the section on Site Information, it's unclear whether the minimum lot size is meant to provide zoning information. The minimum lot size required by the zoning is 6,5oo square feet. Building setbacks as shown on the survey are incorrect: the front setback is 20 feet, side yard setbacks are 5 feet, and the rear yard setback is 10 feet. Please review this section of the TMC and add the required information and statements. A short plat survey template can be found on the City of Tukwila website. 8. Schematic designs to be provided regardless of purveyor (e.g. site line size, location, and size of public main). No capacity calcs, invert depth, valve locations or the like are needed. A storm drainage evaluation with narrative. Storm drainage design shall be at least go% mplete, which meets the King County Surface Water Design Manual (KCSWDM). Include a Te nical ormation Report (TIR) including feasibility analysis if required by the Manual. Call oh otal existing and proposed impervious surface in square feet.
