DECISION SEPA Determination: The City SEPA Responsible Official has determined that this application does not require a SEPA threshold determination because it is categorically exempt. Decision on Substantive Permit: The Community Development Planning Manager has determined that the application for a Wireless Telecommunication Facility does comply with applicable City and state code requirements and has approved that application. 0 III. YOUR APPEAL RIGHTS The Decision on this Permit Application is a Type II decision pursuant to Tukwila Municipal Code § 18.104.010. Other land use applications related to this project may still be pending. No administrative appeal of a DNS or an EIS is permitted. One administrative appeal to the Hearing Examiner of the Decision on the Permit itself is permitted. If an MDNS was issued, any person wishing to challenge either the conditions which were imposed by the MDNS decision or the failure of the Department to impose additional conditions in the MDNS must raise such issues as part of the appeal to the Hearing Examiner. A party who is not satisfied with the outcome of the administrative appeal process may file an appeal in King County Superior Court from the Hearing Examiner decision. IV. PROCEDURES AND TIME FOR APPEALING In order to appeal the Community Development Director's decision on the Permit Application, a written notice of appeal must be filed with the Department of Community Development within 14-days of the issuance of this Decision, which is by May 12, 2016. The requirements for such appeals are set forth in Tukwila Municipal Code 18.116. All appeal materials shall be submitted to the Department of Community Development. Appeal materials MUST include: 1. The name of the appealing party. 2. The address and phone number of the appealing party; and if the appealing party is a corporation, association or other group, the address and phone number of a contact person authorized to receive notices on the appealing party's behalf. 3. A statement identifying the decision being appealed and the alleged errors in the decision, including any specific challenge to an MDNS. 4. The Notice of Appeal shall identify (a) the specific errors of fact or errors in application of the law in the decision being appealed; (b) the harm suffered or anticipated by the appellant, and (c) the relief sought. The scope of an appeal shall be limited to matters or issues raised in the Notice of Appeal. 5. Appeal fee per the current fee schedule, additional hourly charges may apply. In addition all hearing examiner costs will be passed through to the appellant. V. APPEAL HEARINGS PROCESS Any administrative appeal regarding the Permit shall be conducted as an open record hearing before the Hearing Examiner based on the testimony and documentary evidence presented at the open record hearing. The Hearing Examiner decision on the appeal is the City's final decision. Any party wishing to challenge the Hearing Examiner decision on this application must file an appeal pursuant to the procedures and time limitations set forth in RCW 36.70C. An appeal challenging a DNS, an MDNS or an EIS may be included in such an appeal. If no appeal of the Hearing Examiner decision is properly filed in Superior Court within such time limit, the Decision on this permit will be final. p The City's decision to issue a DNS, an MDNS or an EIS is final for this permit and any other pending permit applications for the development of the subject property. VI. The project includes: • Replace six (6) existing antennas with six (6) new antennas. • Upgrade existing distribution and amplification equipment. Existing Development The existing building is located within a commercial, transit -oriented area that is expected to continue to infill and intensify with more retail, services, and entertainment uses. Surrounding Land Uses All surrounding developments are within the Tukwila Urban Center (TUC) zone, however the sub -zoning designation varies. The property to the south and south-east is zoned TUC -Pond, The parcels to the west (across Southcenter Parkway) are zoned TUC —Commercial Corridor, and the parcels to the north and east are zoned TUC -Regional Commercial. Background In 2006, the City adopted a Wireless Facilities Chapter (TMC 18.71) to the Zoning Code. The chapter provides specific location and design requirements for the placement of WCF within the City of Tukwila. Location Selection Tukwila Municipal Code (TMC) provides a hierarchy of appropriate locations within the City. Generally, co -locations and utilizing existing structures are favored over the development of new standalone WCF within the City. The applicant is proposing to replace antennas and equipment on the roof of an existing building. This decision does not require the use of any new facilities for placement of the new antennas. The replacement antennas have a greater surface area than those they are replacing, therefore, the project does not qualify for the exemption in TMC 18.58.030 (see Figure 1). The height of the proposed replacement antennas is 77.0', which is less than the maximum height for the RC zoning district (85'). The proposed modifications are considered a Type 2 decision as the WCF is non -concealed and building attached within a commercial zone. Ficure 1. The table below indicates if the applicant's proposal complies with required standards. The proposed modifications will not alter the surrounding land uses in terms of traffic and pedestrian circulation, building or site design. 3. The proposed project is in keeping with the goals and policies of the Comprehensive Land Use Policy Plan. RECOMMENDATIONS The recommendation to the Director of Community Development is to approve this application for a Type II Wireless Telecommunication Facility permit, as applied for by LDC on behalf of Verizon Wireless. To Whom it May Concern: Commercial Infrastructure Residential BACKGROUND: Verizon Wireless has an existing Wireless Telecommunications Facility (WTF) located at 16400 Southcenter Parkway. The antennas and equipment are mounted on the rooftop of the building. Verizon Wireless is seeking the City's approval to conduct maintenance work at this site. Verizon regularly services their sites to maintain peak performance and network integrity. The subject parcel is zoned TUC -Tukwila Urban Center. PROPOSAL: Verizon has made application to the City of Tukwila for a building permit (D16- 0092) to replace some existing antennas, and upgrade the remote radios and distribution equipment on the roof top. Six of the existing antennas will be swapped out with newer technology antennas. Distribution and amplification equipment will be swapped out and upgraded. Existing antenna pole mounts will be retained. The height of the replacement antennas will remain the same and conforms to TMC 18.58.110. Furthermore, the color of the replacement antennas will be off-white to match the existing color scheme of the building. No additional power or other infrastructure is required. Access to the site is unchanged. There will be no signs or advertising other than the wireless operator signs with emergency contact information and the required regulatory signs. Parking is plentiful in the building's parking lot and the need for parking will not change; thus all conforming to TMC 18.58.070. The proposal is a maintenance project and as such does not involve any substantial change: proposed increase in height, nor do the appurtenances protrude more than 20' from the edge of the existing structure. This therefore qualifies as an eligible Facilities Modification Request under section 6409 (a) of the Spectrum Act. JUSTIFICATION: Verizon Wireless provides crucial services to its business customers. Consumers rely on Verizon Wireless' high quality and excellent capacity. The Verizon facility will be modified by the replacement of six (6) panel antennas on the existing antenna mounts atop the roof of the project building at 16400 South Center Parkway, in Tukwila, King County, Washington 98118. DESCRIPTION OF VERIZON WIRELESS OPERATIONS According to information furnished by Verizon representatives, all of the Verizon antennas will be mounted and centered approximately 73 feet or higher above grade. All of the Verizon antennas will be mounted well above head height for persons inside the project building, or standing anywhere at ground level near the project site. RF exposure conditions within the project building, and on adjacent properties, due to the combined contributions from all of the Verizon antennas will be below the FCC Public exposure limit, and the limits given in King County code K.C.C. 21A.26.100 "NIER exposure standards." Access to the project building roof appears to be restricted. It is unlikely that a casual visitor to the roof would dwell long enough in the vicinity of the Verizon antennas to cause that person's RF exposure to exceed FCC limits. However there may be certain rooftop locations where a person could stand close to the active apertures of the Verizon antennas. These areas should be designated as "exclusion zones". The Verizon wireless facility is expected to be compliant with FCC rules and guidelines regarding public RF exposure provided that direct access to the Verizon antennas is positively restricted by clearly demarcated and enforced roof top exclusion zones. Hatfield & Dawson Consulting Engineers 0 0 Persons standing on the roof outside of the exclusion zones will not be subjected to excessive RF exposure conditions due to the Verizon Wireless operations. Personal wireless panel and microwave antennas are highly directional; these antennas project the majority of the transmitted RF energy horizontally away from the project building, and well above all nearby occupied areas. It is expected that RF exposure conditions within the project building and on adjacent properties, due to the contributions from all of the Verizon wireless operations in combination with any co -located wireless facilities, will be well below FCC and local public exposure limits, and the limits given in King County code K.C.C. 21A.26.100 "NIER exposure standards." RF EXPOSURE CONDITIONS DUE TO VERIZON FACILITY Ambient exposure conditions in nearby areas below the roof are expected to be a fraction of the 100% FCC Public MPE (Maximum Permissible Exposure) limit due to all Verizon operations at the site. To verify that the Verizon facility will be in compliance with FCC and City rules regarding public exposure to RF fields, I have calculated the maximum power density and exposure condition likely to exist near ground level on the project site and on adjacent properties. Personal wireless and microwave facilities are required to comply with the FCC "Rules & Regulations" 47 CFR §1.1310, Radiofrequency radiation exposure limits. The exposure limits shown in the table titled "NIER Exposure Standards (1) (6)" in K.C.C. 21A.26.100 "NIER exposure standards" are generally in agreement with FCC exposure guidelines and limits. In any case, since the FCC exposure limits supersede the limits shown in the aforementioned table, then compliance is determined by comparing RF field predictions with the general population/uncontrolled environment (i.e., "Public") MPE limits allowed by the FCC rules and guidelines, as specified in 47 CFR §1.1310. Hatfield & Dawson Consulting Engineers ® 0 4 The Verizon facility may operate within the 700 MHz Upper Block "C" frequency band, the 800 MHz Cellular "B" frequency band, the 1.9 GHz Personal Communications Service (PCS) frequency bands, and the 2.1 GHz Advanced Wireless Service (AWS) band. COMPLIANCE WITH FCC REGULATIONS FOR RF EMISSIONS AND RF INTERFERENCE It is expected that the RF interaction between all of the Verizon Wireless operations will be low enough to preclude the likelihood of localized interference caused by the Verizon facility to the reception of any other communications signals. All of the Verizon antennas will be sufficiently high enough, and far enough removed from all occupancies, that they are unlikely to cause interference with nearby consumer receivers or other consumer electronic devices. Transmission equipment for the Verizon Wireless facility is certified by the FCC under the equipment authorization procedures set forth in the FCC rules and guidelines. This assures that the wireless facility will transmit within the desired base -station frequency bands at authorized power levels. The Verizon Wireless facility will operate in accordance with all FCC rules and guidelines regarding power, signal bandwidth, interference mitigation, and good RF engineering practices. The Verizon facility will comply with all FCC standards for radio frequency emissions. COMPLIANCE WITH LOCAL REGULATIONS Because the Verizon Wireless facility will be in compliance with federal rules and guidelines, it will also be in compliance with local regulations concerning RF emissions per K.C.C. 21A.26.090 "Interference." The following is the complete text of 47 U.S.C. § 332(c)(7)(B)(iv): "No State or local government or instrumentality thereof may regulate the placement, construction, and modification of personal wireless service facilities on the basis of the environmental effects of radio frequency emissions to the extent that such facilities comply with the Commission's regulations concerning such emissions." Hatfield & Dawson Consulting Engineers o COMPLIANCE WITH FCC AND LOCAL REGULATIONS The FCC has determined through calculations and technical analysis that personal wireless facilities, such as those operated by Verizon, are highly unlikely to cause human RF exposures in excess of FCC guideline limits. The operation of the Verizon facility will NOT create significant RF exposure conditions within any occupancy, habitable space or non - excluded publicly accessible area below the roof of the project building. The Verizon Wireless facility may cause localized areas of excessive exposure conditions on the roof. These designated exclusion zones are off-limits for persons without RF safety training. As long as these exclusion zones are clearly demarcated and enforced, the Verizon facility is presumed to be in compliance with FCC RF exposure guidelines. The public RF exposure environment outside of designated exclusion zones due to the Verizon operations will be below the FCC limits. Therefore the Verizon Wireless operations at the project site will not have a significant environmental impact as defined by the FCC Public MPE limits. Furthermore, the Verizon facility will not cause any nearby existing wireless facility to exceed non -ionizing electromagnetic radiation (N/ER) exposure standards. CONCLUSIONS BASED ON CALCULATIONS AND REGULATIONS The analysis presented in this report demonstrates that the Verizon Wireless facility "SEA MALL RATS" meets Federal requirements for allowed emissions. The facility will be in compliance with current FCC and local rules regarding radio frequency interference and public exposure to radio frequency electromagnetic fields provided that direct access to the antennas on the project site is positively restricted. This conclusion is based on information supplied by Verizon Wireless representatives, and estimates of future RF exposure conditions due to the Verizon facility in specific areas with the corresponding safe exposure guidelines set forth in the FCC rules and guidelines, and in King County K.C.C. Chapter 21A.26. Hatfield & Dawson Consulting Engineers ® 0 The FCC exposure limits are based on recommendations by federal and private entities with the appropriate expertise in human safety issues. Under the Commission's rules and guidelines, licensees are required to ensure compliance with the limits for maximum permissible exposure established by the FCC. These limits have been developed based on guidelines provided by the Institute of Electrical and Electronics Engineers, Inc. (IEEE) and the National Council on Radiation Protection and Measurements (NCRP). Both the NCRP and IEEE guidelines were developed by scientists and engineers with a great deal of experience and knowledge in the area of RF biological effects and related issues. The Verizon facility will be in compliance with NIER emissions standards as set forth by the FCC particularly with respect to any publicly accessible areas on or near the project site. To ensure full compliance with FCC rules and guidelines regarding human exposure to radio frequency electromagnetic fields, the Verizon transmitters should be turned off whenever maintenance personnel are required to work in the immediate vicinity of the Verizon antenna apertures. This safety procedure should apply to all existing and future wireless transmission facilities at the project site.
