HomeMy WebLinkAboutOrd 0175 - Quit Claim Deed of Land (Water Tank Site)ORDINANCE NO 175 AN ORDINANCE AUTHORIZING THE RETURN TO THE FORMER OWNERS OF THE LAND ON WHICH THE WATeR TANK ONCE STOOD, AND GRANTING PERMISSION TO REMOVE THE TOWER, RELIEVING THE TOWN OF ALL RESPONSIBILITY AND LIABILITY. WHEREAS, O.J.Christensen and Erna T. Christensen, his wife, did convey and warrant to the Town of Tukwila the following described real estate to be used by the said Town as a site for a water tank and subject to the condition that if said Town at any time ceased to use the land for the purpose described then and in that event the title and use of the land should revert to the Grantors, and WHEREAS, the following described real estste is no longer used as a site for a water tank, BE IT ORDAINED BY THE TOWN COUNCIL OF THE TOWN OF TUKWILA: SECTION 1_. That this land described herein shall revert to the Grantors, O.J.Christensen and to heirs of Elma T.Christensen, his deceased wife. SECTION 2. That the Mayor and Clerk be authorized to sign a QUIT CLAIM DEED to carry out these instructions. Commencing at a point on the east line of tract 20, Brookvale Garden Tracts; now a part of the Town of Tukwila, sixty feet (60) from the south- east corner of said tract and running north one hundred feet (100); thence west one hundred feet (100); thence south one hundred feet(100);; thence east one hundred feet(100) to the place of begin nthg, a parcel of high ground 100 x 100 situated in the County of King, State of Washington. SECTION 3. That permission be granted to Chas.Shults to re- move the section of tower now standing, removal to be complet- ed within six months. SECTION 4. That Chas. Shults guarantee to the Town that he will assume all responsibility and. expense in the removal of said tower, relieving the Town of any liability to person or property. This ordinance shall be in full force and effect immediately after its passage, approval and posting asprovided for by law.
