WHEREAS, in 2023, the Washington State Legislature adopted Senate Bill 5290 (SB 5290"), which made changes to the land use ipermitting process; and WHEREAS, the City desires to update language in the Tukwila Municipal Code (TMC), Title 18, "Zoning," in alignment with current practices, to improve clarity, and to bring the TMC into compliance with SB 5290; and WHEREAS, the City Council finds that the arnendments herein furtherturlher the public health, safety, and welfare of the residents of Tukwila; NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF TUKWLA, WASHINGTON, HEREBY ORDAINS AS FOLLOWS: Section 1. Adoption of Findings of Fact. The City. Council hereby adopts the foregoing recitals and incorporates them herein as support for these amendments. Section 2. Repealer. All ordinances as codified in Title 18, 'Zoning," and as referenced in Exhibit A, are hereby repealed, thereby eliminating Title 18 in its entirety. Section 3. TMC Title 18 Reenacted. Upon approval of the City Attorney, the City Clerk and the code reviser are authorized to make necessary corrections to this ordinance, including the correction of clerical errors; references to other local, state or federal laws, codes, rules, or regulations; or ordinance numbering and section/subsection numbering. Section 6. Severability. TMC Section 18.50.230, "Tiny Home Villages" was established by Ordinance No. 2732 but language as passed was inadvertently left out of the code, leading to that section being overwritten by subsequent ordinances. 2. Ordinance No. 2732 also established language in TMC 18.50.270 that was left out in the codification process. As Passed 1. The following language was established in TMC 18.50.279 per Ord. 2732, section 4: 6. Any other terms required for consistency with RCW 36A.21.360. Correction Needed 1. Given TMC 18.50.230 was overwritten by Ordinance 2758, we will recodify the original language per section 3 of Ordinance 2732 as TMC 18.50.235. 2. Subsection 6 will be re -added to TMC 18.50.279. 3. Ordinance 2732 should have been repealed by Ordinance 2741 (which repealed/reenacted the entirety of Title 18) and was not included in Exhibit A's list of repealers. It will need to be added to Exhibit A.
