The Grantor.,s, James Gasper and Leola Stark and
for and in consideration of the
sum of ONE DOLLAR ($1,00) in hand paid, receipt whereof is hereby acknowledged, do
hereby grant, sell and convey to the City of Tukwila
Washington, a municipal corporation, Grantee, its successors
and assigns, an easement and right -of -way, over, through, under across, upon and in
the following described real property situate in King County, Washington,
TO -WIT:
Portion of Foster Stephen Donation Claim No. 38
Beginning on the westerly line Duwamish- Renton Junction Road 317.08' southeasterly
from ic=_ intersection with the southeasterly line of Foster Street; thence South
40 0 36 1 00 West 190' to True Point of Beginning; thence South 49 12'30" West
77.20 thence South 23 30'30" East 121.77'; thence North 40 0 36'00" 129.94
thence North 49 0 24'00" West 100' to True Point of Beginning, together with
15' strip adjacent northwesterly line subject to road easement. A permanent
utility easement being the northwesterly 15' described as 15' strip adjacent to
northwesterly line subject to road easement of the above described property. TOGETHER
WITH a temporary construction easement being the southwesterly 10' of the northerly 80'
of the above described property, also a temporary construction easement being the
southeasterly 10' of the easterly 50' of the above described property.
for the construction, operation, maintenance and /or repair and /or replacement of
a utility line or lines and appurtenances_ thereto, together
with the right of ingress and egress to and from said easement and right -of -way
for all purposes necessary and related thereto.
This easement is granted with the understanding that the property
affected will be returned to a condition equal to its original condition upon
completion of construction. The Grantee also agrees to indemnify and save harm
less the Grantors from ary liability arising from the construction contemplated
herein.
