HomeMy WebLinkAbout1973 - Construction Easement - Amelco Industries - 73060805377306080537 CONSTRUCTION EASEMENT THIS INSTRUMENT made this,�Yday of and between ad and Amelco Industries and and 1973- by herein called the "Grantor and the City of Tukwila a municipal corporation of King County, Washington, herein called "Grantee. WITNESSETH: The Grantor, for valuable consideration, does hereby grant unto the Grantee a temporary right -of -way or easement to be used only during construction of a sewer main on adjacent property, said temporary ease- ment to cease and determine upon acceptance of the sewer main for mainte- nance and operation by the Grantee. The said temporary right -of -way or easement shall be through and across the following described property situated in King County, Washington, more particularly described as follows: The South 10 feet of the North 15 feet, also the East 10 feet of that portion of the Henry Meader Donation Claim No. 46 in Section 24, Townshi 23 North, Range 4 East, W.M., in King County, Washington, described as follovj Beginning at a point 355.79 feet South of the Intersection of the Easterly margin of the Public Road known as State Secondary Highway No. 2 "also known as Secondary State Highway No. 5 -M" with the North line of said Henry Meader Donation Claim; thence Easterly parallel to the North line of said Donation Claim to the West Boundary line of the right -of -way of the Puget Sound Electric Railway Company; thence West- erly parallel with the North line of said Donation Claim 40 feet to the true point of beginning; thence continuing Westerly parallel with the North line of said Donation Claim 170 feet; thence Southerly parallel with the West line of said Puget Sound Electric Railway right -of -way 124.53 feet; thence Easterly parallel with the North line of a private. road easement "commonly known'as South 158th Street" as disclosed by instrument recorded under Auditor's File No. King County Auditor's No. 3480340, to a point 40 feet West of the West line of said Puget Sound Electric Railway right -of -way; thence Northerly parallel to the West line of said Puget Sound Electric Railway right -of -way 113 feet more or less, to the true point of beginning. Amelco Industries 103 Nelsen Avenue Renton, Washington 98055 (l Easement No. 24 -6 -19 The said Grantee,.shall have the right, without prior institution of any suit or proceeding at law, at such times as may be necessary to enter upon said above described property for the purpose of constructing sewer mains or making any connections therewith, without incurring any legal obligation or liability therefore, provided that such constructing of such sewer main shall be accomplished in such a manner that the fences, lawn, shrubbery, drives and walkways, and land contours existing in the right -of- -tray shall not be disturbed or destroyed or in the event that they are disturbed or destroyed, they will be replaced in as good a condition as thev were immediately before the property was entered upon by the Grantee.
