CONSTRUCTION EASEMENT
THIS INSTRUMENT made this 9 day of 197 by

herein called the "Grantor and the City of Tukwila
a municipal corporation of King County, Washington, herein called "Grantee.
WITNESSETH:
The Grantor, for valuable consideration, does.hereby grant unto the
Grantee a temporary right -of -way or easement to be used only during
construction of a sewer main on adjacent property, said temporary ease-
ment to cease and determine upon acceptance of the sewer main for mainte-
nance and operation by the Grantee. The said temporary right -of -war or
easement shall be through and across the following described property
situated in King County, Washington, more particularly described as
follows:
The East 10 feet of that portion of Section 24, Township 23 North,
Range 4 East, W.M., in King County, Washington, being a portion of the
Henry Meader Donation Claim which is also called the Henry Meter Dona-
tion- Claim, described as follows:
Beginning at a point on a line 72.00 feet Easterly as measured
at right angles, from the 2M -line survey of Primary State Highway No. 1
as condemned in King County Superior Court Cause No. 598595, which point
would be 55.28 feet due South of the North line of the Henry Meader Dona-
tion Claim: Thence Easterly, parallel with and 55.28 feet distant from
said North line, a distance of 340 feet more or less, to an intersection
with a line 20 feet West of, measured radially from the Y -line survey
of said PSH No. 1 condemned in King County. Superior Court Cause No.
598595: Thence Southerly along said line which is 20 feet West of the
Y -line survey, to a point which would be due: South 125.28 feet from the
North line of said Henry Meader Donation Claim to said line 72.00 feet
Easterly of the 2M -line survey of said PSH No. 1: Thence Northerly along
said line which is 72.00 feet Easterly as measured at right angles from
said 2M -line survey, to the Point of Beginning, except any portion thereof
lying Southerly of the Boundary line established by agreement recorded May
26, 1969, in the Office of the Director of Records and Elections as
Receiving No. 65152.

The said Grantee shall have the right, without prior institution
of any suit or proceeding at law, at such times as may be necessary to
enter upon said above described nronerty for the purpose of constructirq
sewer mains or making any connections therewith, without incurring anv
legal obligation or liability therefore, provided that such constructi-:z
of such sewer main shall be accomplished in -such a manner that the fences_
lawn, shrubbery, dirves and walkways and land contours existinq in the
right- of-way shall not be disturbed or destroyed or in the event that
thev are disturbed or destroyed, they will be replaced in as good a
condition as they were immediately before the property was entered unon
by the Grantee.
This temporary construction easement shall be convenant running
with the land and shall be hindinq on the Grantor's successors, heirs,
and assiqns until acceptance of the sewer main for maintenance and
operation by the Grantee. "Ie" f
