HomeMy WebLinkAbout1973 - Construction Easement - Nelson Esther - 73060805327306080532 CONSTRUCTION EASEMENT THIS INSTRUMENT made thislo day of ,P� 197_ by and between Esther Nelson herein called the "Grantor:, and the City of Tukwila a municipal corporation of King County, Washington,, herein called "Grantee." WITNESSETH: The Grantor, for valuable consideration, does hereby grant'unto the Grantee a temporary right -of -way or easement to be used only during construction of a sewer main on adjacent property, said temporary ease- ment to cease and determine upon acceptance of the sewer main for mainte- nance and operation by the Grantee. The said temporary right -of -way or easement shall be through and across the following described property situated in King County, Washington, more particularly described as follows: The East 10 feet of that portion of the Donation Land Claim of the heirs at law of henry Meader, deceased, designated as Claim No. 46, be- ing parts of Sections 24 and 25, Township 23 North, Range 4 East, W.M., described as follows: Beginning at the intersection of the Easterly margin of the Paci- fic Highway with the Northerly line of the said Donation Claim; thence Easterly along the Northerly line of said Donation Claim 394 feet more or less, to the Westerly margin of the right -of -way of the Puget Sound Electric Railway Company; thence Southerly along said Westerly margin to a line drawn parallel to and 55.28 feet Southerly of the Northerly line of the said Donation Claim; thence along said parallel line 394 feet more or less, to the Easterly margin of the Pacific High- way; thence Northerly along said Easterly margin 55.28 feet more or less, to the Point of Beginning, situated in King County, Washington; Subject, however, to a life estate in and to the use rents, and profits from said above described lands, reserved to the grantor dur- ing her natural lifetime. Nelson, Esther W. 973 Campbell Ave. Los Altos, CA. 94022 i Easement No. 24 -12 -19 s s The said Grantee shall have the riqht, without prior institution of any suit or proceeding at law, at such times as may be necessary to enter upon said above described property for the purpose of constructir.a sewer mains or making any connections therewith, without incurring anv legal obligation or liability therefore, provided that such constructin of such sewer main shall be accomplished in.such a manner that the fences lawn, shrubbery, dirves and walkways and land contours existing in the right -of -way shall not be disturbed or destroyed or in the event that thev are disturbed or destroyed, thev will be replaced in as good a condition as they were immediately before the property was entered upon by the Grantee.
