The Grantors, WALTER M. NELSEN and CHA,nLO`".TE:..NELS:EN-,__.his 'i4ife,
for good and valuable consideration as hereinafter stated, hereby
grant and convey unto THE CITY OF TUKWILA, a municipal corporation
(f King County, State of Washington, an easement in, under and upon
the following described real property situated in,King County, State
of Washington, to-wit:
Beginning at a concrete post 1112 feet, more or less 0
That portion of Government Lot 2, Section 25, Township p
23, Range 4, East, W.M. described as follows:
south and 1363 feet west of the north quarter corner
of said Section 25; thence south 155 feet to the
True Point of Beginning on the west margin of the county
road; thence southerly along said road margin to an
intersection with the east line of said Government Lot 2.;
thence continuing south along said east line to the
point of intersection the easterly bank of Green
River; thence northerly along' said'easterly bank to a
point on a line at'right angle with the west margin of
the said county road at the.true point of beginning;
thence easterly to�the True Point of: Beginning.
Specifically, the easement granted.is within the,,following
described portion of the aforedescribed premises:
A strip of land 10 feet in width having 5 feet of such
width- each side of the following described centerline:
Beginning at the northeast corner of the above described
parcel of land; thence westerly along the north property
line of said parcel 10 feet more or less to the true point
of beginning; thence southerly at right angles to said
north line'a distance of fifteen feet to the terminus
of this easement.
This easement is given for the purpose of installation, maintenance,
operation, repairs to and replacement of a sewer pipe line and all
necessary connections and appurtenances thereto.
In addition, Grantors hereby grant unto the said Grantee a
temporary construction easement for the purpose of installation of
a sewer line over that portion of Grantors' aforedescribed ownership
designated as "Max. limitations of work area" as shown on that certain
drawing designed Puget Western Sanitary Sewer, drawing No. 3- 153 031 -20 -D1
dated November 30, 1972, a copy of which is attached hereto, marked
Exhibit "A and thereby made a part hereof.
The conveyance hereby of the aforedescribed easement and temporary
construction easement is made in consideration of and upon the following
terms and conditions:
(A) The period of time that Grantee or its agents shall be upon
the easement area for purposes of installation of the sewer
line shall not exceed three (3) working days; and restoration
of the premises, to be commenced immediately after installation
of the line within the easement area, shall be effected
within an additional period of four (4) working days.

(B) Grantee's agent shall advise Grantors in writing of
its intent to enter upon the easement area for purposes
'j of installation of the sewer line, which,notice shall
be given at least two•(2 days in advance of its
f entry goon the Grantors! premises.
(C) The easement and temporary construction easement areas
shall be restored to'the condition in which they
D existed at the time of entry by the Grantee or its
agents, and such restoration.shall include, but not
be limited to, replacement of all bushes, shrubbery
CD and fencing disturbed by reason of installation of `V1�;�'R1�� to\
Cpl the sewer line. In that connection it is understood
that the existing "fencing will not be disturbed for
a greater distance than 45 feet.
(D) In the event the easement area is disturbed following
the original installation of the sewer line, by reason
of maintenance, operation, repairs and /or replacement
of the line, then the .Grantee shall restore the
premises so disturbed to the condition in which they
existed as of the time of entry thereon for such purposes.
(E) The "work area" contemplated by the temporary construction
easement shall be confined north of the existing driveway
on the Grantors' premises. No use shall be made of the
driveway.It shall remain clear at all times, and there
shall be no impairment of ingress and egress via the
existing driveway.
(F) The cedar tree as shown on Exhibit "A" shall not be
disturbed or effected by reason of installation of
the sewer line.
(G) There shall be no interference with the electrical service
to Grantors' property by reason of installation of the
sewer line.
(H) The existing 3/4" pipe marker at the northeast corner
of the Grantors' property shall be restored with a
plug and tack.
(I) As part of the installation of the 'sewer line within the
easement wea, Grantee or its agents shall install a
"T" in the line, run a pipe out there from approximately thirteen
(13)feet in a southwesterly direction, install a clean -out
at the joint, and add another length of pipe towards the
Grantors' residence as illustrated on attached Exhibit "A
(J) There shall be no stub fee chargeable to either Grantors
or their successors in interest; however, it is understood
that upon connection of the Grantors' residence or other
improvements on the Grantors' property to the line
installed within the easement area, the Grantors or their
successors in interest shall be subject.to charges imposed
by ordinance of the Grantee, including a connection fee,
inspection fee and square foot charge in lieu of an L.I.D.
assessment.
