This easement is for the sole purpose of the construction, use and maintenance of a Storm Drainage System and Utilities, together with the right of ingress and egress for said construction, use and maintenance. 3. Grantee shall install said Storm Drainage System and Utilities at their sole cost and expense and shall continue to maintain and shall continue to bear all cost of repair and maintenance or repair of said Storm Drainage System and Utilities. 4. Grantee shall hold Grantor harmless from and against any and all claims which may be made against Grantor arising out of the installation, operation, maintenance or repair or said Storm Drainage System and Utilities. 5. The herein easement and agreement may be amended only with the written agreement of the Grantee herein. This easement agreement shall run with the land and shall be binding on all parties having or acquiring any right, title or interest in the land descried herein or any part thereof. It is the intent of the GRANTOR that this agreement shall not be extinguished by the doctrine of merger.
