EASEMENT
THIS AGREEMENT, Made and entered into this 4th day of October, 2003 by
and between Robert Sullivan, Party of the First Part, which expression shall include his,
her, or their heirs, executors, administrators, agents, or assigns where the context so
requires or admits, and Kim Poulson, Party of the Second Part, which expression shall
include his, her, or their heirs, executors, administrators, agents, or assigns where the
context so requires or admits,
WITHESSETH
WHEREAS, The Party of the First Part owns and has title to that real estate and.
real property located in the Cannty, of King, State of Washington, described as follows:
BLOCK 3 LOT 10 ADAMS HOME TRACK, N 160.7 FT
And
WHEREAS, the Party of the Secou4Part desires to use the South 2 FT of the
above described property. , >
NOW, THEREFORE, IT IS HEREBtAbiEED As follows:
The Party of the First Part does herby grant, assigns, and set over to the Party of the
Second Part the right -to construct a permanent access driveway that includes the South 2
FT of the above described property. Also, a retainingwtl and fence may be constructed
on said property.
The Party of the First Part shall fully use and enjf the aforesaid premises, except
as to the rights herein granted; and the Party of the Secortd=Part hereby agrees to hold and
save the said Party of the First Part harmless from any and all damage arising from his
use of the right, easement and right of way herein granted and agrees to pay any damages
or damages which may arise to the property, premises or rights to the Party of the First
Part through Second Parry's use, occupation and possession of the rights herein granted.
To have and to hold the said easement, right, and right of wayunto the Party of
the Second Part, his successors, or assigns until such time that the Party of the Second
Part, his successors, or assigns no longer require use of the said property for permanent
access.
IN WITNESS WHEREOF, The parties hereto have hereunto set their hands the
