Limits of Tukwila to Foster Interchange. KNOW ALL MEN BY THESE PRESENTS, That the Grantor, City of Seattle, for and in consideration of the sum of Two Hundred ($200.00) CD Dollars, in hand paid, the receipt whereof is hereby acknowledged, does hereby grant, warrant and convey to the State of Washington, CD to have and to hold forever an exclusive, permanent and perpetual easement in the lands (portion Cedar River Pipeline No. 4) hereinafter described as Parcels "A" and "B" for any and all purposes and uses embraced by or incidental to the construction, operation, maintenance and/or improvement of any and all roads, streets or highways or any other facilities which may be necessary or convenient for public purposes. This conveyance is hereby declared and agreed to be inclusive of but not limited to: (1) A full, free and exclusive right of way through the lands hereinafter described; (2) The exclusive right to grant permits, licenses, and/or franchises including but not limited to those contemplated by RCW 47.32.110, RCW 47.32.150 and RCW 47.44, within, upon, or above the lands hereinafter described; Except the grantor reserves the right to inspect and approve the plans and installation of transmission and distribution facilities of any public or private utility to be placed within the easement conveyed after date hereof. (3) The right to exercise any and all police powers which the State of Washington through the Department of Highways may determine to be necessary or convenient to the exercise of the easements hereby conveyed. fj The Grantor reserves the perpetual right to approve the IV location of and method of installation of all future utilities to be installed within the easement herein conveyed. The Grantor on behalf of itself, its successors or assigns, covenants and agrees to make no use of the servient estate -1- R /L,i 31-C- 602 T50l010 60 without first securing, in writing, the consent of the State of Washington, Department of Highways, existing installations excepted. The lands in which the grantor conveys to the grantee an easement upon the terms and conditions hereinabove contained, are situated in the County of King, State of Washington, and are described as follows: PARCEL "A" All that part of the following described Tract "X" lying westerly of the Center Line Survey of SR 181, South Corporate Limits of Tukwila to Foster Interchange and easterly of a line described as follows: Begin at a point 50 feet distant westerly, when measured at right angles from said Center Line at Highway Engineer's Station 159+00; thence North 8°51'30" west 100 feet; thence South 81°08'30" west 30 feet; thence North 8°51'30" west 30 feet to a point, and the end of this line description. PARCEL "B" A11 that part of said Tract "x" lying easterly of said. center Line and westerly of a line drawn parallel with and being 60 feet distant easterly, when measured at right angles from said Center Line. TRACT "X" A portion of Government Lot 9, Section 25, Township 23 North, Range 4 East, W.M., in King County, Washington, and of the Henry A. Meador Donation Land Claim No. 46, in said Section, described as follows: A strip of land 30 feet in width over and across the said lands, being 15 feet on each side of. the following described center line: Beginning at the northeast corner of said Govern- ment Lot 9; thence south on the east line thereof, a distance of 15 feet to the point of true beginning; thence North 87°18'12" west on a line parallel to the north line of said Lot 9, a distance of 749.19 feet to point of curve; thence southwesterly along the arc of a curve to the left, having a radius of 920 feet, and through a central angle of 19°56'15", a distance of 320.14 feat to a point of tangency; thence South 72°45'33" west along said tangent, a distance of 701.80 feet to point of curve; thence westerly along the arc of a curve to the right, having a radius of 137.55 feet and through a central angle of 20°01'15", a distance of 48.06 feet to point of tangency; thence North 87°13'12" west along said tangent, a distance of 3004.13 feet, -2- CD CD more or less, to the low water line on the easterly bank of the Green River abutting on said Donation Claire; EXCEPTING therefrom the portions of said strip lying and being within the rights of way of the several public highways crossing said strip, all bearing being referred to the Lambert Grid as used in the Aerial Survey for King County, Washington, and further EXCEPTING therefrom all that portion lying east of the westerly line of the existing Puget Sound Electric right of way. The lands subject or servient to the perpetual easement being herein acquired contain an area of 2,050 square feet, more or less, the specific details concerning all of which may be found within that certain map of definite location now of record and on file in the Office of the Director of Highways at Olympia, Washington, bearing date of approval May 16, 1968, revised April 17, 1969; and the center line of which is also of record in Volume 4 of Highway Plats, page 39, under Auditor's File No. 6379562, records of King County, State of Washington. It is understood and agreed that the delivery of this easement is hereby tendered and that the terms and obligations hereof shall not become binding upon the State of Washington unless and until accepted and approved hereon in writing for the State of Washington, Department of Highways, by the Chief Right of Way Agent, and it is further understood that if it is not so accepted it shall be returned to the grantor within sixty (60) days and be of no effect whatsoever.
