Work Element 3 Deliverables.- 10% eliverables:10% Submittal: 40 Scale Scroll Plot and Engineer's Construction Cost estimate (Electronic PDF) Project Prospectus per Lag Manual Ch 21 WORK ELEMENT 4 — ENVIRONMENTAL PERMITTING 4.1 NEPA CE Form - The project will involve federal funds, administered by WSDOT, therefore adherence to the NEPA process through Local Programs is required. The Consultant will prepare a WSDOT NEPA Categorial Exemption Checklist, to satisfy NEPA. Based on the limited scope and scale of the project, the fact that all ground disturbance will occur within previously disturbed areas, no right-of-way acquisition will occur, and no net new PGIS will be generated by the project, the NEPA process should be relatively straightforward. For similar reasons, no critical areas will be impacted, Lastly, the project is located outside of SMP jurisdiction. The Consultant will prepare a Draft and Final WSDOT CE Form for the project to document compliance with NEPA. The CE Form will be completed per the guidance and requirements in the WSDOT Environmental Manual and the Local Programs CE Guidebook at the time a notice to proceed is received by Psomas. The consultant will complete the Draft CE Form using existing information from the technical reports completed for the project, the project design plans, and other available information. 4.2 Cultural Resources/Section 106 - The Consultant will coordinate with the City to define the project area of potential effects (APE) in order to initiate the Section 106 review with the Washington State Department of Transportation (WSDOT). Upon approval of the APE, Psomas will conduct necessary background archival research, as practical, at Department of Archaeology and Historic Preservation (DAHP), the University of Washington, King County Assessor Records, King County Archives, and online resources to identify recorded and potential archaeological and historic resources in and around the project area. We will also review available environmental and geological background information for the approved APE. This information will be used to prepare a Cultural Resources Technical Memorandum (memo) consistent with Chapter 456 of the WSDOT Environmental Manual/Section 4.3 of the CE Guidebook for submittal by WSDOT to the DAHP and the tribes to initiate Section 106 consultation. City of Tukwila S REV: February 14, 2025 Interurban Avenue South Overlay Project Scope of Work EXHIBIT A 4.3 Endangered Species Act Compliance - The Consultant will prepare a biological assessment (BA) to comply with Section 7 of the Endangered Species Act (ESA) as triggered through a federal nexus of federal funding from FHWA (and administered by WSDOT). The BA will include an evaluation of the potential direct and indirect effects of the project on federally listed threatened, endangered, and proposed species and critical habitats. The Consultant will also complete the analysis of the environmental baseline, interrelated and interdependent actions, cumulative effects, and address Essential Fish Habitat (EFH). The BA will be prepared following US Fish and Wildlife (USFWS) and National Marine Fisheries Service (NMFS) guidelines (collectively known as the Services) and will adhere to the standards of WSDOT. The federal funding through WSDOT will be secured for project construction and that WSDOT review of the BA will be required. Based on the known presence of listed species and habitats within the action area and a preliminary analysis of project impacts, the addition of stormwater treatment to treat replaced pollution generating impervious surface (PCIS) resulting from the project, as well as the lack of ability to fully infiltrate stormwater due to soil conditions, will result in a BA effect finding of "Likely to adversely affect" for both steelhead trout and Chinook salmon. Due to lack of distribution in the Action Area, a finding of "May effect, not likely to adversely affect' is appropriate for bull trout, while it appears that the appropriate effects determination for other listed species potentially present in the project vicinity is "no effect", based on lack of species distribution and lack of suitable habitat in the Action Area. WSDOT is currently pursuing a programmatic consultation for Local Programs stormwater projects. This consultation may be completed by spring or early summer of 2025. The Consultant will review the document when released, to determine whether the project can meet the terms and conditions in the Biological Opinion (such as the area and type of PGIS to be treated and the treatment BPM requirements). If the project can meet the requirements of the BO, the Consultant will prepare the necessary forms to initiate the consultation, thus potentially advancing the NEPA completion date by 2 to 3 years. Assumptions: The Consultant will prepare only the environmental permits and approvals specifically referenced above. The project is SEPA exempt under WAC 197-11-800 (2) (viii) (however the City should confirm this assumption with the Planning Department). With the exception of a single site visit/hazardous materials windshield survey, no additional fieldwork or surveys will be required. Delineation of wetland or stream features is not included in this scope. Surveys for fish, wildlife, or rare plants are not included in this scope. The project will not result in impacts to the critical areas or SMA regulated areas and therefore no reporting or mitigation will be required. There will be no ROW take or expansion of the roadway. An archaeological survey will not be required; if a survey is required, a separate scope of work will be prepared. City of Tukwila 6 REV: February 14, 2025 Interurban Avenue South Overlay Project Scope of Work EXHIBIT A No archaeological site/isolate forms, or Historic Property Inventory Forms will be needed or prepared and is not part of this scope. The APE will not include any buildings or structures that are already or will be 45 years or older at the time of project construction. If it is determined that historic buildings or structures are present within the APE, an amendment will be required to document and record the buildings/structures on Historic Property Inventory Forms. Work Element 4 Deliverables.- Cultural eliverables:Cultural Resources Literature Review and APE Correspondence, Draft and Final (electronic PDF) Inadvertent Discovery Plan, Draft and Final (electronic PDF) Draft and Final NEPA CE Form (electronic PDF and MS Word) Draft and Final Biological Assessment (electronic PDF and MS Word) WORK ELEMENT 5 — STORMWATER ANALYSIS This Work Element includes efforts required for analysis/design of on-site stormwater management systems and technical documentation in accordance with current versions of the City of Tukwila's Infrastructure Design & Construction Standards and Surface Water Comprehensive Plan, as well as the 2021 King County Surface Water Design Manual (KCSWDM). 5.1. Agreement Number: LAI 1030 Exhibit H - Local Agency A&E Professional Services Cost Plus Fixed Fee Consultant Agreement Revised 02/01/2021 Page 1 of 1 Exhibit I Alleged Consultant Design Error Procedures The purpose of this exhibit is to establish a procedure to determine if a consultant's alleged design error is of a nature that exceeds the accepted standard of care. In addition, it will establish a uniform method for the resolution and/or cost recovery procedures in those instances where the agency believes it has suffered some material damage due to the alleged error by the consultant. Step 1 Potential Consultant Design Error(s) is Identified by Agency's Project Manager At the first indication of potential consultant design error(s), the first step in the process is for the Agency's project manager to notify the Director of Public Works or Agency Engineer regarding the potential design error(s). For federally funded projects, the Region Local Programs Engineer should be informed and involved in these procedures. (Note: The Director of Public Works or Agency Engineer may appoint an agency staff person other than the project manager, who has not been as directly involved in the project, to be responsible for the remaining steps in these procedures.) Step 2 Project Manager Documents the Alleged Consultant Design Error(s) After discussion of the alleged design error(s) and the magnitude of the alleged error(s), and with the Director of Public Works or Agency Engineer's concurrence, the project manager obtains more detailed documentation than is normally required on the project. Examples include: all decisions and descriptions of work; photographs, records of labor, materials and equipment. Step 3 Contact the Consultant Regarding the Alleged Design Error(s) If it is determined that there is a need to proceed further, the next step in the process is for the project manager to contact the consultant regarding the alleged design error(s) and the magnitude of the alleged error(s). The project manager and other appropriate agency staff should represent the agency and the consultant should be represented by their project manager and any personnel (including sub -consultants) deemed appropriate for the alleged design error(s) issue. Step 4 Attempt to Resolve Alleged Design Error with Consultant After the meeting(s) with the consultant have been completed regarding the consultant's alleged design error(s), there are three possible scenarios: • It is determined via mutual agreement that there is not a consultant design error(s). If this is the case, then the process will not proceed beyond this point. It is determined via mutual agreement that a consultant design error(s) occurred. If this is the case, then the Director of Public Works or Agency Engineer, or their representatives, negotiate a settlement with the consultant. The settlement would be paid to the agency or the amount would be reduced from the consultant's agreement with the agency for the services on the project in which the design error took place. The agency is to provide LP, through the Region Local Programs Engineer, a summary of the settlement for review and to make adjustments, if any, as to how the settlement affects federal reimbursements. No further action is required. • There is not a mutual agreement regarding the alleged consultant design error(s). The consultant may request that the alleged design error(s) issue be forwarded to the Director of Public Works or Agency Engineer for review. If the Director of Public Works or Agency Engineer, after review with their legal counsel, is not able to reach mutual agreement with the consultant, proceed to Step 5. Agreement Number: LAI 1030 Exhibit I - Local Agency A&E Professional Services Cost Plus Fixed Fee Consultant Agreement Revised 02/01/2021 Page 1 of 2 Step 5 Forward Documents to Local Programs For federally funded projects all available information, including costs, should be forwarded through the Region Local Programs Engineer to LP for their review and consultation with the FHWA. LP will meet with representatives of the agency and the consultant to review the alleged design error(s), and attempt to find a resolution to the issue. If necessary, LP will request assistance from the Attorney General's Office for legal interpretation. LP will also identify how the alleged error(s) affects eligibility of project costs for federal reimbursement. • If mutual agreement is reached, the agency and consultant adjust the scope of work and costs to reflect the agreed upon resolution. LP, in consultation with FHWA, will identify the amount of federal participation in the agreed upon resolution of the issue. • If mutual agreement is not reached, the agency and consultant may seek settlement by arbitration or by litigation. The following procedures should only be utilized on consultant claims greater than $1,000. If the consultant's claim(s) are a total of $1,000 or less, it would not be cost effective to proceed through the outlined steps. It is suggested that the Director of Public Works or Agency Engineer negotiate a fair and reasonable price for the consultant's claim(s) that total $1,000 or less. This exhibit will outline the procedures to be followed by the consultant and the agency to consider a potential claim by the consultant. Step I Consultant Files a Claim with the Agency Project Manager If the consultant determines that they were requested to perform additional services that were outside of the agreement's scope of work, they may be entitled to a claim. The first step that must be completed is the request for consideration of the claim to the Agency's project manager. The consultant's claim must outline the following: • Summation of hours by classification for each firm that is included in the claim; • Any correspondence that directed the consultant to perform the additional work; • Timeframe of the additional work that was outside of the project scope; • Summary of direct labor dollars, overhead costs, profit and reimbursable costs associated with the additional work; and • Explanation as to why the consultant believes the additional work was outside of the agreement scope of work. Step 2 Review by Agency Personnel Regarding the Consultant's Claim for Additional Compensation After the consultant has completed step 1, the next step in the process is to forward the request to the Agency's project manager. The project manager will review the consultant's claim and will met with the Director of Public Works or Agency Engineer to determine if the Agency agrees with the claim. If the FHWA is participating in the project's funding, forward a copy of the consultant's claim and the Agency's recommendation for federal participation in the claim to the WSDOT Local Programs through the Region Local Programs Engineer. If the claim is not eligible for federal participation, payment will need to be from agency funds. If the Agency project manager, Director of Public Works or Agency Engineer, WSDOT Local Programs (if applicable), and FHWA (if applicable) agree with the consultant's claim, send a request memo, including backup documentation to the consultant to either supplement the agreement, or create a new agreement for the claim. After the request has been approved, the Agency shall write the supplement and/or new agreement and pay the consultant the amount of the claim. Inform the consultant that the final payment for the agreement is subject to audit. No further action in needed regarding the claim procedures. If the Agency does not agree with the consultant's claim, proceed to step 3 of the procedures. Agreement Number: LAI 1030 Exhibit J - Local Agency A&E Professional Services Cost Plus Fixed Fee Consultant Agreement Revised 02101/2021 Page 1 of 2 Step 3 Preparation of Support Documentation Regarding Consultant's Claim(s) If the Agency does not agree with the consultant's claim, the project manager shall prepare a summary for the Director of Public Works or Agency Engineer that included the following: • Copy of information supplied by the consultant regarding the claim; • Agency's summation of hours by classification for each firm that should be included in the claim; • Any correspondence that directed the consultant to perform the additional work; • Agency's summary of direct labor dollars, overhead costs, profit and reimbursable costs associated with the additional work; • Explanation regarding those areas in which the Agency does/does not agree with the consultant's claim(s); • Explanation to describe what has been instituted to preclude future consultant claim(s); and • Recommendations to resolve the claim. Step 4 Director of Public Works or Agency Engineer Reviews Consultant Claim and Agency Documentation The Director of Public Works or Agency Engineer shall review and administratively approve or disapprove the claim, or portions thereof, which may include getting Agency Council or Commission approval (as appropriate to agency dispute resolution procedures). If the project involves federal participation, obtain concurrence from WSDOT Local Programs and FHWA regarding final settlement of the claim. If the claim is not eligible for federal participation, payment will need to be from agency funds. Step 5 Informing Consultant of Decision Regarding the Claim The Director of Public Works or Agency Engineer shall notify (in writing) the consultant of their final decision regarding the consultant's claim(s). Include the final dollar amount of the accepted claim(s) and rationale utilized for the decision. Step 6 Preparation of Supplement or New Agreement for the Consultant's Claim(s) The agency shall write the supplement and/or new agreement and pay the consultant the amount of the claim. Inform the consultant that the final payment for the agreement is subject to audit.
