Permits - Required. Any owner or owner's authorized agent who intends to construct, enlarge, alter, repair, move, demolish or change the occupancy of a building or structure, or to erect, install, enlarge, alter, repair, remove, convert or replace any electrical, gas, mechanical or plumbing system, the installation of which is regulated by this code, or to cause any such work to be performed, shall first make application to the building official and obtain the required permit. 2021 IBC Section 110.1. Inspections - General. Construction or work for which a permit is required shall be subject to inspection by the building official and such construction or work shall remain visible and able to be accessed for inspection purposes until approved. Approval of an inspection shall not be construed to be an approval of a violation of the provisions of this code or of other ordinances of the jurisdiction. Inspections presume to give authority to violate or cancel the provisions of this code or of other ordinances of the jurisdiction shall not be valid. It shall be the duty of the holder of the building permit or their duly authorized agent to notify the building official when work is ready for inspection. It shall be the duty of the permit holder to provide access to and means for inspections of such work that are required by this code. Observed Conditions: On November 3., 2024, during a scheduled rental inspection, I observed several recent n codifications to the subject property, An Accessory Dwelling Unit (ADU) has been constructed at the rear of the property, and a tenant is currently occupying the unit, Additionally, multiple water heater tanks were found to be improperly installed® raising concerns about safety and code compliance. Flectricai work throughout the property was noted to prevent potential hazards, requiring further evaluation. I also observed a greenhouse and/or laundry trait, connected to the main home and ADU, had been constructed Research: Reviewing the City's permitting system, I discovered the City previously issued eight permits for the property for development, electrical, mechanical, and plumbing and gas work. However, all the applied permits expired prior to final City approval. Corrective Action: 1. Obtain a Single -Family Residential Remodel and Addition Permit (Exhibit B) from the City of Tukwila. To apply for said Permit, new plans must be submitted for the remodel of the interior / exterior of the house which do not match approved plans in City Permit No. D22-0024. Plans must include, but not limited to the following: a. Structural engineer reports and plans, which include, but not limited to, all foundations, all exterior walls and rafters' structural members; locations where exterior and/or interior walls have been removed or proposed to be removed, locations where exterior windows / doors have been removed or locations where new windows / doors have been installed, decks, roofs. b. Architectural plans which show the existing floor plan and the proposed floor plan which include but are not limited to the new roof, electrical, plumbing, mechanical, and windows. 2. Obtain additional permits, as required by the TMC, related to the remodel / addition, including Electrical, Plumbing & Gas, and Mechanical; For more information, please contact the Department of Community Development on 206-431-3670 and ask to speak with a Building Plans Examiner regarding additional permit requirements for the house. 3. Pay all applicable permit fees. Construction started before the Building Permit was approved and issued, therefore an additional fee will be due before the building permit is issued. Other additional fees will be required for Electrical, Plumbing and Gas, Mechanical, and any other required permit(s). A. The property owner is responsible for obtaining an inspection of each rental unit and submitting the Inspection Checklist to the official code no later than September 30 of the year the Certificate of Compliance expires. B. When a unit changes from owner occupancy to a rental, the inspection must occur before the unit is occupied by the tenant.... C. Owners of complexes with 5 or more units are required to utilize a non -City inspector who meets the qualifications defined herein and who is preapproved by the City. Owners of rental properties with fewer than 5 units may utilize a city inspector or a non -City inspector.... TMC 5.06.100 VIOLATIONS. If an inspection of a rental unit conducted pursuant to this chapter reveals deficiencies of 25 points or more on the Inspection Checklist, the violation must be cured within 30 days.... TMC 5.06.110 RE -INSPECTIONS. A rental unit that exhibits deficiencies of 25 points or more on the Inspection Checklist shall be subject to a re -inspection and re -inspection fee as set forth in the City's fee schedule adopted pursuant to this chapter. Research: According to City records, the property owner has failed to submit a Rental Inspection Checklist or valid Certificate of Compliance for the subject property's rental units, as required by the City's Residential Rental Business License program. On January 5, 2024, a rental inspection was conducted at the listed single-family Observation: property. The inspection identified several hazards, including the absence of egress for a downstairs bedroom, missing smoke and carbon monoxide detectors, inadequate heating, improperly installed water heaters, and unpermitted construction. A reinspection report and failure notice were sent to the property manager and owner on January 9, 2024, with a compliance deadline of February 1, 2024. Corrective Action: 1. Cease use of the property as a residential rental unit or 2. Obtain a rental inspection of the property and submit a corresponding rental inspection report to the City that shows deficiencies of less than 25 points on the City Inspection Checklist. Contact the Rental Housing Program at 206-431-3674 to schedule an inspection with a city inspector or schedule an inspection with a city approved private inspector and have the private inspector forward the inspection results to the City's Rental Housing Program. Every rental unit owner shall obtain an annual residential rental business license, pursuant to Title 5 of the Tukwila Municipal Code, prior to operating, leasing, or causing a rental unit to be leased. Rental unit owners must file a written application annually with the Department for each rental location to be leased. To be considered for approval, residential rental business license applications must be complete and include: 1. Completed and signed Residential Rental Business License Application provided by the city. Appropriate application fee as set forth in the fee schedule adopted by resolution of the City Council. Late fees will be due for applications filed March 1st or later. 3. For multi -family buildings with 2 or more units, documentation of an ongoing integrated pest management (IPM) program. This could be provided by a property manager trained in IPM or a contract with a pest control company. Failure to obtain a residential rental business license will result in the inability to rent the unit.
