HomeMy WebLinkAbout25-095 - Contract - Katelyn Saechao - Term Limited Emplyment AgreementCITY OF TUKWILA 25-095 Council Approval N/A Term -Limited, Grant Funded Agreement THIS AGREEMENT ("Agreement") is made and entered into effective March 18, 2025, between the City of Tukwila (hereinafter referred to as "City" and Katelyn Saechao (hereinafter referred to as "Contractor"), an individual. The City and the Contractor are referred to collectively herein as "the Parties." NOW, THEREFORE, in consideration of the mutual covenants and conditions set forth herein, the Parties agree as follows: Section 1. Term. Parties understand that this position is grant -funded, and as such this Agreement shall remain in full force and effect for one year ending March 18, 2026. Furthermore, both parties understand that the term of the contract may be terminated at any time, upon completion of the applicable funded project or the exhaustion of the funding ("Term") whichever occurs first, unless sooner terminated pursuant to the terms of this Agreement. Section 2. Duties Employee shall perform the duties set forth in the Scope of Duties, as established in Exhibit A, attached and incorporated herein. The Contractor shall report to the Sustainable Transportation Manager for the performance of specific duties under this Agreement. Section 3. Compensation. In consideration of the services rendered by the Contractor, the City agrees to pay the Contractor a rate of $30/hour. The Contractor understands that they will not receive COLA, CPI, or other compensation bonuses afforded to full-time employees. Section 4. Working Hours and Schedule. The working hours of the Contractor shall not exceed forty (40) hours per week on an hourly basis as determined by Sustainable Transportation Manager Section 5. Benefits. The City shall provide the Employee with the following fringe benefits: 5.1 Vacation — Four hours per pay period with carry over provisions for the duration of this Agreement. No pay-off upon termination of this Agreement. 5.2 Sick Leave — Four hours per pay period with carry over provisions for the duration of this Agreement. With carry over provisions for the duration of this Agreement. No pay-off upon termination of this Agreement 5.3 Medical Insurance — The Term -Limited Employee shall receive medical insurance for themself only through Kaiser Permanente or the City's Self -Insured plan at the choice of the Term -Limited Employee, at 5% cost share paid by the Term -limited Employee and 95% cost share paid by the Employer. 5.4 Dental Insurance — The Contractor shall receive dental insurance for themselves only through the City's Self -Insured plan. 5.5 Vision Insurance — The Contractor shall receive vision insurance for themselves only through the City's Self -Insured plan. 5.6 _Holidays — 11 holidays recognized by the City throughout the duration of this agreement. 5.7 ORCA Card — A transit pass will be provided throughout the duration of this agreement. 5.8 Direct Deposit — Yes. Section 6. Equipment. The City agrees to provide the Contractor with a city email address, laptop and access to a phone. The Contractor agrees to abide by the city policies and procedures for city equipment. The Contractor agrees to return all city equipment at the termination of this contract in the same or similar manner it was received at the start of the contract. Section 7. Taxes. All federal income tax, FICA tax, industrial insurance, and other payments as they pertain to the Contractor's contributions under this Agreement shall be deducted by the City and appropriately distributed as provided for under the grants. The City will make all required employer payments for FICA, industrial insurance and similar accounts. Section 8. Termination. This is an at -will agreement and can be cancelled for any reason at any time by either party. Termination will cease the obligations of both Parties under this agreement and no salary or benefits will be due the Contractor past the effective termination date. The Contractor agrees that the city retains the right to terminate the contract immediately in the case of an egregious policy violation (ex. Gross negligence, violence, fraud, etc) Section 9. General. 9.1 This Agreement sets forth the entire agreement and understanding of the Parties, and supersedes all prior agreements, arrangements, and understandings. 9.2 No representation, promise, or inducement has been made by either party that is not embodied in this Agreement, and neither party shall be bound by or liable for any alleged representation, promise, or inducement not so set forth. The section headings contained herein are for reference purposes only and shall not in any way affect the meaning or interpretation of this Agreement. 9.3This Agreement may be amended, modified, superseded, cancelled, renewed or extended, and the terms or covenants may be waived, only by a written instrument executed by both of the Parties, or in the case of a waiver, by the party waiving compliance. The failure of either party at any time or times to require performance of any provisions hereof shall in no manner affect the right at a later time to enforce the same. No waiver by either party of the breach of any term or covenant contained in this Agreement, whether by conduct or otherwise, in any one or more instances, shall be deemed to be, or construed as, a further or continuing waiver of any such breach, or a waiver of the breach of any other term or covenant contained in this Agreement. 9.4This Agreement shall be governed by and construed according to the laws of the State of Washington. Under the direction of the Sustainable Transportation Program Manager, the Sustainable Transportation Communications Specialist will develop social marketing campaigns, maintain the Program's web presence, and create promotional materials and educational resources. The position will support residents, workers, visitors, employers, property managers, and students by identifying solutions to transportation barriers and addressing the specific needs of those who travel in Tukwila and South King County; and Scope of Duties: • Track rewards program participation, communicate with participants, fulfill rewards, and process mailings. • Provide customer service and support to employers and property managers including correspondence, data entry, and recordkeeping. • Create content and manage communications for newsletters and social media posts. • Manage website content and updates. • Create presentations, training materials, and educational resources. • Create promotional materials such as signs, ads, videos, brochures, flyers, and mailers. • Develop and implement social marketing campaigns to influence behavior change and encourage sustainable transportation choices. • Participate in outreach efforts, presentations, and trainings. • Participate in grant writing and reporting.
