SEPA DETERMINATION: An environmental determination will be issued prior to City Council consideration. STAFF: Neil Tabor, AICP, Senior Planner, and Isaac Gloor, Senior Planner BACKGROUND In code amendments to comply with HB 1110, the City proposes to consolidate the Low Density Residential (LDR) and Medium Density Residential (MDR) zoning districts into a single new zoning district, titled Community Residential (CR). There are numerous references to LDR and MDR zoning districts throughout the Tukwila Municipal Code. While most of these references are found within Title 17, Subdivisions and Plats and Title 18 "Zoning", a single section of Title 19 "Vehicles and Traffic" also has references to the LDR and MDR zones, which would be made inconsistent with consolidation of these zoning districts into Community Residential. SUMMARY OF PROPOSED CHANGES To ensure consistency throughout the municipal code, the City proposes to update language in TMC 9.20.080 "Parking Class 3 and Class 4 vehicles in residential zones" to reflect the consolidation of the LDR and MDR zoning districts into a new Community Residential zone. Details of the proposed amendments can be seen in Exhibit A of the staff report. ANALYSIS Staff Report Criteria 707 Page 2 TMC 18.82.030 requires that staff reports for proposed amendments to development regulations address the five listed criteria in this section. As criteria pertain to both privately initiated code amendment applications and those proposed by staff, some criteria may not be as relevant for all code amendment proposals. Criteria and staff responses are listed below. 1. An evaluation of the application materials; Staff Response: Not applicable 2. Impact upon the Tukwila Comprehensive Plan and Zoning Code; Staff Response: The proposed code amendment is consistent with the comprehensive plan and does not require an amendment to the comprehensive plan. 3. Impact upon surrounding properties, if applicable; Staff Response: Not applicable 4. Alternatives to the proposed amendment; and Staff Response: 5. Appropriate code citations and other relevant documents. Staff Response: Not applicable Decision Criteria TMC 18.82.020, Decision Criteria provides criteria for the final City Council decision on proposed code amendments. Decision criteria are as follows: 1. Is the amendment consistent with the Comprehensive Plan? 2. Does the amendment meet at least one of the following criteria: a. Eliminates conflicts between TMC and the Comprehensive Plan; or b. Accomplishes policy directives of the Council or Administration; or c. Corrects an error or errors in the TMC. REQUESTED ACTION Staff is requesting that the Planning Commission forward a recommendation for adoption of the draft code amendments to the City Council. ATTACHMENTS A. This section shall apply to Class 3 vehicles and Class 4 vehicles. B. No person shall park any vehicle subject to this section on or along any street, alley or public right-of-way in a residential zoning district of the City; provided that this restriction shall not apply to pick-up trucks falling within the Class 3 vehicle rating. C. As used in this section, a street, alley or public right-of- way in a residential zoning district of the City shall be as defined and described in TMC Chapter 18.08, including the Community Residential (..... CR) zone, nsity Residentia-k ) zone, and the High Density Residential (HDR) zone. Mixed -use zoning districts shall not constitute a residential zoning district of the City for the purposes hereof. In order for a street, alley or public right-of-way to be considered in a residential zoning district of the City, the property on both sides of the roadway shall be zoned LDR, MDRCR, and/or HDR. D. Exceptions. The parking prohibitions outlined in this section do not apply to the following: 1. Pick-up trucks falling within the Class 3 vehicle rating. 2. Stopping or parking recreational vehicles in residential areas as regulated by TMC Section 9.20.090.
