TONIGHT’S PURPOSE
The Tukwila South development agreement (DA) expires on June 23, 2025. Segale Properties and
the City are negotiating a new DA for Council’s consideration with a public hearing scheduled for
5/12 and decision on 6/2.
The purpose of tonight’s agenda item is to provide context in preparation for the public hearing.

PRIOR COUNCIL ACTION
Staff updated City Council on 7/1/24
The update included context of the 2009 development agreement and Segale Properties’ 2024 request to extend it
Council approved a six-month extension of the current DA on 12/9/24

CONTEXT
Council approved the current Development Agreement in 2009. The current DA has 5
amendments/addendums and is set to expire on June 23, 2025.
Staff and Segale Properties are negotiating a new DA. Segale Properties would like the new DA to
start before the current one expires. MAS will also be a party to the DA.
Segale Properties believes the new DA is important to encourage future development.
The City’s approach to negotiations are to agree to Segale Properties’ requests unless it puts the
City at significant legal or other risks. We also tried to simplify the DA for ease of use.
Staff plans to issue a SEPA addendum updating the 2005 EIS
Segale Properties updated the 2009 traffic analysis and determined that no new mitigation
measures are needed and staff has accepted it.
Staff and Segale Properties have invested significant amounts of time during negotiations.

Term through December 31, 2040
Vesting to current Tukwila South Overlay zoning
Segale Properties to apply to eliminate underlying zoning classifications
“Implementing Approvals” vested to substantive standards in 2025 codes
Fees and processes in effect at time of permit application, unless otherwise stated in DA
Development limited to trip ceiling of 10,166 net new trips (10.3 million square feet)
Transportation concurrency regulations and approval up to 10,166 net new trips
Traffic impact fee credit for Existing Development Trips
Addition of Expansion Areas to DA

City commitment to maintain sanitary sewer capacity to serve future development
Vesting to City’s 2009 sanitary sewer connection rates
Future revision to the bike/pedestrian trail easement on levee system so that the easement moves if the levee
moves
Provisions to ensure six 14-foot wide publicly accessible east-west pedestrian corridors connecting Southcenter
Parkway to the bike/pedestrian trail are completed
Grading permit PW10-064 to remain in effect indefinitely
Future vacation of former Southcenter Parkway and donation of City right of way at no charge.

100% of the Development Area may be cleared and graded
Up to 85% of the land served by each stormwater facility may be covered with impervious surfaces
Parcel Builders may choose to waive vesting and develop according to one or more TMC chapters in effect at
time of filing a complete building permit application on a parcel by parcel basis
Orillia Road Connector or Alternative Mitigations based on traffic analysis
Confirms SEPA compliance up to 10,166 Net New Trips
Dispute resolution process
Major Amendments subject to approval by City Council. Minor Amendments approved by DCD Director.

NEXT STEPS
City and Segale Properties would like a three-month extension to continue discussions on stormwater.
The three-month extension is scheduled for Council:
5/12 for public hearing
6/2 for decision
City and Segale will continue discussions on stormwater and will return to Council for decision on a new DA
prior to expiration.
