Contract Termination
Dear Robert:
Following up on our August 11 Cure Notice to Remedy the Breach of Contract, and having received no
remedy, nor attempt to remedy the noted breach of contract within the allowed 15 -day period, this letter is to
notify you that contract 24-031 is officially terminated. Per Section 1-08.10(1) of the Contract Specifications,
the City is terminating the contract and pursuing the remaining contract work through other means.
Attached is the final payment to you for the contract, which reflects Change Order #1 work, minor change
work and liquidated damages, which were calculated per Section 1-08.9 of the Contract Specifications.
Please review and sign the attached pay estimate and return electronically via email to me, as usual.
Note that the Department of Labor and Industries ("LNI") requires you to file intents and affidavits of wages
paid for the work that was performed before this contract termination in order to release your retainage, which
is being held by the City. Once the City receives the proof of prevailing wages paid for this project and
certifications from LNI, the Department of Labor and the Employment Security Department, the City will file a
notice of completion with LNI and, pending City Council approval, release retainage to you.
