HomeMy WebLinkAboutOrd 0364 - Boundary of Disputed Electrical Public Utility Service Area J' E:p11 8 -28 -62 (2) ORDINANCE NO 364 An ordinance adopted pursuant to Ordinance No. 353, Sections 3 and 5, determining and locating the boundary of a disputed elec- trical public utility service area within the City of Tukwila. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF TUKWIIA: WHEREAS, pursuant to Ordinance No. 353, of the City of Tuk- wila, the franchised electrical public utilities, Puget Sound Power and Light Company and the Lighting Department of the City of Seattle, have filed with the City Clerk maps showing the boundaries of areas within the city which the respective utilities claimed to be their exclusive service areas on January 1, 1962, and WHEREAS, one area within the limits of the City of Tukwila was claimed by both electrical public utilities to be their exclu- sive service area, and WHEREAS the City Council has referred the dispute to the city engineer for investigation and report and, has referred certain aspects of the investigation to the city attorney for further report, and has received additional filings of evidence from the respective utilities, and WHEREAS, the City Council has reviewed the report of the city engineer, city attorney, and the evidence submitted by the respective utilities, and WHEREAS, in the interests of public health, safety and welfare the elimination of duplicate electrical facilities and the attendant hazards all as set forth in Ordinance No. 353, it is desirable to establish service areas for franchised electrical public utilities, and to resolve the dispute between them. -1- ULLIN, EHRLICHMAN♦ CARROLL 8 ROBERTS UNITED PACIFIC BUILDING MU. 2 -2882 SEATTLE 4, WASH. NOW, THEREFORE, (1) There is attached hereto and incoporated by this reference as though fully set forth, a map showing a portion of the City of Tukwila and environs wherein the undisputed service areas of the respective franchised electrical utilities are shown and the boundary line between them defined by a green line. Said boundary line is in all respects ratified and confirmed to be the boundary line between the exclusive service areas of the respective franchised electrical utilities except as more particularly set forth herein with respect to the disputed area. (2) There is shown on the attached and referenced map an area bounded by a red line denominated 31 disputed service area It is hereby ordained and determined that that portion of the dis- puted service area cross hatched in green at the northerly boundary thereof, which boundaries are intended to be coincident with the boundaries of the Seattle First National Bank Branch Office property on the south side of the Renton- Three -Tree Point Road, be and the same is hereby declared to be the exclusive service area of the Lighting Department of the City of Seattle by reason of a contract for service existing between that utility and the Seattle First National Bank on January 1, 1962 and presently in full force and effect. (3) That portion of the disputed service area cross hatched in blue and shown as "sub- station site" in the southeast corner thereof is not now served by either franchised electrical utility and no determination of entitlement to such service area is made by the council at this time. (4) The balance of the disputed service area shown on the map is sub- stantially the are of the South Center Shopping Center. As of January 1, 1962 this area was a joint service service area by virtue of Seattle City Lighting Department's service of the Morrison- Knudson maintenance shops and Puget Sound Power and Light's service of an office and an advertising sign therein. In March, 1962 the lighting department's customer discontinued that service and contracted with Puget Sound Power and Light Company. Such area is all presently being served by Puget Sound Power and Light Company. Insofar as service is being made at all to that area. The area is all held by one ownership, Southcenter Corporation. Further, a valid and subsisting contract exists between Puget Sound Power and Light- Company,and South Center Corporation for the continued service of the area as additional electrical requirements are needed. There fore, it is ordained and determined that the balance of the disputed service area, other that as spec- ifically set forth in preceding paragraphs above, be the exclusive service area of Puget Sound Power and Light Company. (5) The city engineer is hereby directed to prepare and file with the City Clerk a map of the City of Tukwila defining all of the electrical public utilities service areas within the city in accordance with this ordinance, Ordinance No, 353, the map attached to this ordinance and the maps filed by the respective franchised ,,,electrical public utilities pursuant to Ordinance No. 353.
