Parties
1.1 This Covenant for Inspection and Maintenance of Storrawater Facilities and Best
Management Practices ("Covenant") is made by and between [property owner(s)], as Grantor, and the City of
Tukwila, a Washington Municipal Corporation, as Grantee. Grantor and Grantee (also denoted as City herein)
are each a Party and collectively the Parties to this Agreement.
2. Recitals
2.1 Grantor applied to City for issuance of 1724-Q1. on 8/11/2025 -
2.2 Pursuant to TMC 14,30,060, application for and issuance of such permit requires the property
owner to enter into this Covenant,
2.3 The subject of the Covenant is the real property located in King County, Washington, bearing
King County Tax Parcel No. 15474j 4 . and legally described in the attached Exhibit A
incorporated herein ("Property').
2.4 The City approved the applications which consist of the following documents, attached and
incorporated herein:
2A 1 City issued Permit No, D24-0168 , Exhibit B.
2.4.2 Stormwater Facility/BMP Site Plan, Exhibit C.
2.4.3 Operations & Maintenance Plan including schedule, Exhibit D.
3. Terms of Agreement
NOW THERE -FORE, in consideration of the foregoing recitals and other good and valuable
consideration including approval and issuance of City of Tukwila Permit [number and date], the sufficiency
and receipt of which are acknowledged, Grantor hereby irrevocably covenants as follows:
3.1 The foregoing Recitals and references to documents are incorporated as material terms of this
Covenant.
32 The Grantor(s) for itself and its successors in interest having any ownership interest in the
Property (collectively Owners) shall at their sole cost and expense retain, uphold, operate, maintain, and repair
the stormwater facilities and best management practices ("BMPs") located on the Property pursuant to the
schedule within the Operations & Maintenance Plan.
3.3 The obligations required under Section 3.2 above shall be taken consistent the following:
3.3.1 The City shall have the right of ingress and egress over those portions of the Property
necessary to perform inspections of the stormwater facilities and BMPs and conduct other activities specified
in this Declaration of Covenant and in accordance with Tukwila Municipal Code ("TMC") 14.30.80. This
right of ingress and egress, right to inspect, and right to perform required maintenance or repair shall be as
provided for in subsection 33.2 below,

3.12 If the City determines that maintenance or repair work is required to be done to any
of the stormwater facilities or BMPS, the Director of Public Works or designee (the "Director") shall give
notice of the specific maintenance and/or repair work required pursuant to TMC 14.30.080, The Director shall
also set a reasonable time in which such work is to be completed by the Owner, If the above required
maintenance or repair is not completed within the time set by the Director, the City may perform the required
maintenance or repair, and is hereby granted access to the Property for such Purposes. Written notice will be
mailed to the Owner stating the City's intention to perform such work. Titis work will not commence until at
least seven (7) days after such notice is mailed. If, within the sole discretion of the Director, there exists an
imminent or present danger, the seven (7) day notice period will be waived and maintenance and/or repair
work will begin immediately.
3A If at any time the City reasonably determines that a stormwater facility or BMP on the
Property presents an imminent hazard, as identified by TMC 14.30.080 and herein incorporated by reference,
the Director or equivalent municipal successor's official may take measures specified therein.
3.5 The Owner shall assume all responsibility for the cost of any maintenance or repair work
completed by the City as described in Covenant. Such responsibility shall include reimbursement to the City
within thirty (30) days of the receipt of the invoice for any such work performed. Overdue payments will
require payment of interest at the current legal rate as liquidated damages. All such costs and expense shall
constitute a lien against the Property,
3.6 The Owners shall obtain a Type C Public Works permit from the City prior to filling, piping,
cutting, or removing vegetation (except in routine landscape maintenance such as replacement of plants and
pretreatment mulch) in open vegetated stormwater facilities (such as swales, channels, ditches, ponds, etc.),
or performing any alterations or modifications to the stormwater facilities and BMPS referenced in this
Covenant. Prior to the final approval and issuance of the new permit, a new Covenant with updated exhibits
reflecting the changes to the stormwater facilities shall be recorded at the Owner's sole cost and a copy of the
new recorded Declaration of Covenant provided to the City.
3.7 Any notice or consent required to be given or otherwise provided for by the provisions of this
Declaration of Covenant shall be effective upon personal delivery, or three (3) days after mailing by Certified
Mail, return receipt requested, to the address listed below for that party:

3,9 With regard to the matters addressed herein, this Covenant constitutes the entire agreement
between the parties, and supersedes all prior discussions, negotiations, and all agreements whatsoever whether
oral or written. This Covenant shall be governed by the laws of the State of Washington. Any suit to enforce
or relating to this Covenant shall only be filed in IS County Superior Court; King County, Washington, and
the Parties consent to the jurisdiction triereor, in the event of any Icyaj action ay vivior rarEy rotating to thio
Covenant, the Parties shall pay their own costs or fees.

3,9 This Covenant is intended to protect the value and desirability of the real property described
in Exhibit A, promote the efficient and effective management of stormwateT drainage, and shall inure to the
benefit of all the citizens of the, City and its municipal successors and assigns. References herein to the TMC
shall include subsequent amendments to such statutes and all successor statutes.
110 This Covenant shall run with the land and shall be binding upon the Owners as defined in
Section 3.2 above.
111 This Covenant may be amended or terminated only with the advance express written consent
of the City as determined pursuant to its discretion.

All provisions of law and ordinances governing this work will be complied with, whether specified herein or not.
The granting of this permit does not presume to give authority to violate or cancel the provisions of any other
state or local laws regulating construction or the performance of work.
This permit shall become null and void if the work is not commenced within 180 days for the date of issuance, or if
the work is suspended or abandoned for a period of 180 days from the last inspection.
PERMIT CONDITIONS:
1: Condition Notes
2: Work shall be installed in accordance with the approved construction documents, and any changes made
during construction that are not in accordance with the approved construction documents shall be
resubmitted for approval.
3: All permits and approved construction documents shall be kept at the site of work and shall be open to
inspection by the Building Inspector until final inspection approval is granted.
4: The special inspections and verifications for concrete construction shall be as required by IBC Chapter 17,
Table 1705.3.
S: When special inspection is required, either the owner or the registered design professional in responsible
charge, shall employ a special inspection agency and notify the Building Official of the appointment prior to
the first building inspection. The special inspector shall furnish inspection reports to the Building Official in
a timely manner.
6: A final report documenting required special Inspections and correction of any discrepancies noted in the
inspections shall be submitted to the Building Official. The final Inspection report shall be prepared by the
approved special inspection agency and shall be submitted to the Building Official prior to and as a
condition of final inspection approval.

7: Truss shop drawings shall be provided with the shipment of trusses delivered to the job site. Truss shop
drawings shall bear the seal and signature of a Washington State Professional Engineer. Shop drawings
shall be maintained on the site and available to the building inspector for inspection purposes.
8: All construction shall be done in conformance with the Washington State Building Code and the
Washington State Energy Code.
9: All wood to remain in placed concrete shall be treated wood.
10: There shall be no occupancy of a building until final inspection has been completed and approved by
Tukwila building Inspector. No exception.
11: A Certificate of Occupancy shall be issued for this building upon final inspection approval by Tukwila
building inspector.
12: All construction noise to be in compliance with Chapter 8.22 of the City of Tukwila Municipal Code. A copy
can be obtained at City Hall in the office of the City Clerk.
13: Water heaters shall be anchored or strapped to resist horizontal displacement due to earthquake motion.
Strapping shall be at points within the upper one-third and lower one-third of the water heater's vertical
dimension. A minimum distance of 4 -inches shall be maintained above the controls with the strapping.
14: All electrical work shall be inspected and approved under a separate permit issued by the City of Tukwila
Permit Center.
15: Preparation before concrete placement: Water shall be removed from place of deposit before concrete is
placed unless a tremae Is to be used or unless otherwise permitted by the building official. All debris and ice
shall be removed from spaces to be occupied by concrete.
16: VALIDITY OF PERMIT: The issuance or granting of a permit shall not be construed to be a permit for, or an
approval of, any violation of any of the provisions of the building code or of any other ordinances of the City
of Tukwila. Permits presuming to give authority to violate or cancel the provisions of the code or other
ordinances of the City of Tukwila shall not be valid. The issuance of a permit based on construction
documents and other data shall not prevent the Building Official from requiring the correction of errors in
the construction documents and other data.
17: Under RCW 18.106.440 and RCW 18.27.110 the City of Tukwila is required to provide this written notice to
the building permit applicant that there are contractor registration laws and the potential risk and
monetary liability to the homeowner for using an unregistered contractor.
18: Manufacturers installation instructions shall be available on the job site at the time of inspection.
19: No changes shall be made to applicable plans and specifications unless prior approval is obtained from the
Tukwila Building Division,
20: All plumbing and gas piping systems shall be installed in compliance with the Uniform Plumbing Code and
the Fuel Gas Code.

22: All mechanical work shall be inspected and approved under a separate permit issued by the City of Tukwila

PRIVATE GARAGES, repair garages, automotive motor -fuel dispensing facilities and parking garages shall be

26: All permits, inspection record card and approved construction documents shall be kept at the site of work
and shall be open to inspection by the Building Inspector until final inspection approval is granted.

30: Work affecting traffic flows shall be closely coordinated with the Public Works Inspector. Traffic Control
Plans shall be submitted to the Inspector for prior approval.
31: The City of Tukwila has an undergrounding ordinance requiring the power, telecommunications, and cable
service lines be underground from the point of connection on the pole to the house.
32: Flagging, signing and coning shall be in accordance with MUTCD for Traffic Control. Contractor shall
provide certified flagmen for traffic control. Sweep or otherwise clean streets to the satisfaction of Public
Works each night around hauling route (No flushing allowed). Notify Public Works Inspector before 12:00
Noon on Friday preceding any weekend work.
33: Any material spilled onto any street shall be cleaned up immediately.
34: Clean and remove debris from City catch basin in and around hauling routes. Provide adequate temporary
access as not to interfere with other vehicle movement or cause trucks to travel over curbs. All vehicles
must make a complete stop prior to entering public right-of-way.
35: Temporary erosion control measures shall be implemented as the first order of business to prevent
sedimentation off-site or into existing drainage facilities per Appendix D of the 2021 KCSWDM.
36: The site shall have permanent erosion control measures in place as soon as possible after final grading has
been completed and prior to the Final Inspection.
37: From October 1 through April 30, cover any slopes and stockpiles that are 30:1V or steeper and have a
vertical rise of 10 feet or more and will be unworked for greater than 12 hours. During this time period,
cover or mulch other disturbed areas, if they will be unworked more than 2 days. Covered material must
be stockpiled on site at the beginning of this period. Inspect and maintain this stabilization weekly and
immediately before, during and following storms.
38: From May 1 through September 30, inspect and maintain temporary erosion prevention and sediment at
least monthly. All disturbed areas of the site shall be permanently stabilized prior to final construction
approval.
39: It is strongly recommended that storm drainage designs be prepared and stamped by a Washington State
licensed engineer. Otherwise, the owner assumes liability for the design and any subsequent related
damages.
40: Downspouts, driveway, patio and drainage from other impervious areas shall be collected in an on-site
storm drain system. Drains shall be 4" minimum diameter, PVC schedule 40 or corrugated polyethylene
pipe with a minimum 1% slope for gravity discharge to location approved by the Public Works Department.
Downspouts shall not connect to footing drains. Footing drain and downspouts may share a single
discharge pipe downstream of the lowest footing drain.
41: All private storm drain pipe shall be either concrete or reinforced ADS pipe. Treated corrugated metal pipe
may be used for detention facilities.
42: Pre -construction storm drainage patterns shall be met during and after construction.
43: The property owner is responsible for the maintenance of its storm drainage system and, for this purpose,
shall have a maintenance plan in place and the responsibility for maintenance assigned prior to Public
Works final.
44: The water meter box shall be located within City right-of-way at the property line or a recorded utility
easement.
4S: Driveways shall comply with City residential standards. Driveway width shall be a 10' minimum and 20'
maximum. Slope shall be a maximum of 150. Turning radii shall be a minimum of S'.

47: Driveways shall be paved for a minimum distance of 20' from the edge of the existing road pavement.
48: An overlay of matching asphalt within trenching. Grind pavement, to include pedestrian path, and provide
2" overlay may be required at the discretion of the Project Inspector,

51: A bond or cash equivalent in the amount of 150% x cost of construction within the City right-of-way made
out to the City of Tukwila for possible property damages caused by activites.
52: A copy of the Certificate of Insurance Coverage (minimum of $2,000,000 naming the City of Tukwila as
additionally insured).
53: Prior to issuance of this permit, Owner/Applicant shall provide a Traffic Concurrency Certificate Application
and pay $400.00 under PW permit CXX-OXX. Fee based on

C.2.4 BASIC DISPERSION
0.2.4.6 MAINTENANCE INSTRUCTIONS FOR BASIC DISPERSION
If the basic dispersion flow control BMP is proposed furs project, the following maintenance and
operation instructions must be recorded as art attachment to the required declaration of covenant and
grant of casement per Requirement 3 of Section C. 1,14 (p. C-23). The intent of these instructions is to
explain to future property owners, the purpose of the BMP and how it must be maintained and operated.
These instructions are intended to be a minimum; DLS-Permitting may require additional instructions
based on site-specific conditions. Also, as the County gains more experience with the maintenance and
operation of these BMPs, future updates to the instructions will be posted on King County's Surface Water
Design Manual website.
A reproducible copy of the instructions, prepared for inclusion with the declaration of covenant, is located
in Reference M.
Your property contains a stormwater management flow control BMP (best management practice) called
"basic dispersion," which was installed to mitigate the stormwater quantity and quality impacts of some or
all of the impervious surfaces or non-native pervious surfaces on your property. Basic dispersion is a
strategy for utilizing any available capacity of onsite vegetated areas to retain, absorb, and filter the runoff
from developed surfaces. This flow control BMP has two primary components that must be maintained: (1)
the devices that disperse runoff from the developed surfaces and (2) the vegetated area over which runoff
is dispersed.
The dispersion devices used on your property include the following as indicated on the flow control BMP
site plan: 0 splash blocks, 0 rock pads,A gravel filled trenches, U sheet flow. The size, placement,
composition, and downstream flowpaths of these devices as depicted by the flow control BMP site plan
and design details must be maintained and may not be changed without written approval either from the
King County Water and Land Resources Division or through a future development permit from King
County.
Dispersion devices must be inspected annually and after major storm events to identify and repair any
physical defects. When native soil is exposed or erosion channels are present, the sources of the erosion
or concentrated flow need to be identified and mitigated. Concentrated flow can be mitigated by leveling
the edge of the pervious area and/or realigning or replenishing the rocks in the dispersion device, such as
in rock pads and gravel filled trenches,
Vegetated Flowpaths
The vegetated area over which runoff is dispersed must be maintained in good condition free of bare spots
and obstructions that would concentrate flows.
