2021 IPMC SECTION 113 DEMOLITION 113.1 General. The code official shall order the
owner or owner's authorized agent of any premises upon which is located any
structure, which in the code official's or owner's authorized agent judgment after
review is so deteriorated or dilapidated or has become so out of repair as to be
dangerous, unsafe, insanitary or otherwise unfit for human habitation or occupancy,
and such that it is unreasonable to repair the structure, to demolish and remove such
VIOLATION:
structure; or if such structure is capable of being made safe by repairs, to repair and
make safe and sanitary, or to board up and hold for future repair or to demolish and
remove at the owner's option; or where there has been a cessation of normal
construction of any structure for a period of more than two years, the code official
shall order the owner or owner's authorized agent to demolish and remove such
structure, or board up until future repair. Boarding the building up for future repair
shall not extend beyond one year, unless approved by the building official.
CORRECTIVE ACTION REQUIRED:
1. Obtain a Building Demolition Permit from the City of Tukwila. For more information regarding how
to obtain said permit, please contact the City of Tukwila Department of Community Development,
Permit Center, at 206-431-3670.
2. Obtain additional permits, required by the TMC, related to the remodel and addition. For more
information regarding how to obtain said permit, please contact the City of Tukwila Department of

TMC 8.45.110 Appeal to Hearing Examiner
A. The person(s) / business responsible named on this Notice of Violation and Order issued by
the Code Enforcement Officer, pursuant to TMC Section 8.45.070, may appeal the Notice by
requesting such appeal within 10 calendar days after being served with the Notice pursuant to
TMC Section 8.45.070.
File the Appeal with the Tukwila City Clerk a written notice of appeal along with payment of the
$340 appeal fee, containing the following:
i.The Code Enforcement case file number.
2.A brief statement setting forth the names, mailing address(es), and legal interest of each of the
persons appealing this notice and order.
3.A brief statement of the specific order or action protested, together with any supporting facts.
4. A brief statement of the relief sought, and the reasons why it is claimed that the notice and order
should be reversed, modified, or otherwise set aside.
TMC 8.45.120 Penalties
A. VIOLATIONS OF THE TUKWILA MUNICIPAL CODE:
2. Notice of Violation and Order:
a. A Notice of Violation and Order shall carry with it a cumulative monetary penalty of $250.00 per
day for each violation from the compliance date until compliance with the Notice of Violation and
Order is achieved.
2021 IPMC SECTION 109 [A] 109.3 Prosecution of violation. Any person failing to comply with a notice of
violation or order served in accordance with Section 111.4 shall be deemed guilty of a misdemeanor or
civil infraction as determined by the local municipality, and the violation shall be deemed a strict liability
offense. If the notice of violation is not complied with, the code official shall institute the appropriate
proceeding at law or in equity to restrain, correct or abate such violation, or to require the removal or
termination of the unlawful occupancy of the structure in violation of the provisions of this code or of the
order or direction made pursuant thereto. Any action taken by the authority having jurisdiction on such
premises shall be charged against the real estate upon which the structure is located and shall be a lien
