Along the southeast side of the yard is a hrge structure with an aluminurn roof and a large white tarp draped in front. The carport is against / attached to this structure. Along the back property line, on the north side of the carport are materials and debris that belong to a construction compariy which inch.ide but not Hvnited to exterWoan ladders, air compressor, roofing and s'idirg materials, hand tools,, The northwest corner of the backyard are plastic drums, a small shed, stack of PVC pipes with other materials, several pliies covered in tarps, a stack of automotive tires. Observing the adjacent property (parcel # 0170002500( from 50th Pi 5, stacks of PVC pipe of ci ferent diameters and materials stacked around these pipes that are used for construction pro,(ects. Across foram these pipes on the backside of the structure observed from S 11241h St, are materials covered with tarps. Corrective Action: 1. Cease the operation of the contractor's storage on both properties (parcel #'s 0179002265 and 0179002690. 2. Remove all materials, barrels, piping, and all other items associated with the contractor's storage yard and the business these are used for from both properties or store them in an enclosed, permitted structure. 3. Once the two properties are no longer a contractor's storage yard and all items associated with the business have been removed from the property or properly stored in an enclosed, permitted structure, this condition must be maintained for the life of the property. This concrete is used for vehicle parking and storage of materilsis used in the construction industry. Research: Reviewing the City's permit tracking system, I did not find any permits applied for or issued for the installation of this concrete on either parcel. Corrective Action: 1. Bring both properties into compliance with Tukwila Municipal Code (TMC) 18.10.060 Basic Development Standards. Contact a City of Tukwila Planner for information regarding Basic Development Standards. Call 206-431-3670 and ask to speak with a planner. Please tell the planner the case number. 2. If concrete or other materials must be removed to bring the properties into compliance, the removed materials must be removed from the properties and disposed of at a facility that accepts these materials. 3. Once the materials have been removed, the bare soil must be mitigated with landscape quality soils and reseeded with grass seed. 4. Once both properties have been brought into compliance, this condition must be maintained for the life of the property. Parking and vehicle storage limitations on properties devoted to single-family residential use shall be as follows:' 1. Motor vehicles on property devoted to single-family residential use shall be parked on an approved durable uniform surface that is designed to retain surface water on-site and without causing impacts. If necessary, surface water may drain to street if no other design is feasible. Motor vehicles, other than those specified in TMC Section 18.56.065.A.2, shall not be parked in setbacks except in front or secondary front -yard setbacks from streets, when in a driveway that provides access to an approved parking location, and is in conformance with TMC Title 18, as that title currently exists or as it may be subsequently amended. Parking in the rear setback for a single-family home is permitted where the parking is connected to a rear alley. 2. Recreational vehicles, boats or trailers shall be parked, kept or stored on an approved durable uniform surface and shall not be parked, kept or stored in required front yard setbacks, except for a driveway. Recreational vehicle parking in the side or rear yard setbacks is allowed, provided no recreational vehicle is parked so as to prevent access by emergency responders to all sides of a structure. 3. No more than 50% of the front yard or 800 square feet, whichever is smaller, may be approved durable uniform surface. An approved durable uniform surface exceeding this requirement prior to August 25, 2004 may be maintained, but shall not be expanded. The Director of Community Development may approve exceptions to this requirement for an access driveway, particularly on pie -shaped or other odd shaped lots where it is infeasible to meet this requirement. VeNcles are parking in the backyard and both side yards. Research: Reviewing aerial photographs beginning on July 7, 2017, the property with the house (parcel # 0179002265) had gravel on majority of the backyard, but the side yard is still bare soil. The gravel in the backyard allows access to S 124th St. The front and the other side yard have been completely covered with landscape stone to create a patio. The adjacent parcel, parcel # 0179002690, is covered in concrete with access to 50th PI S. Corrective Action: 1. Bring both properties into compliance with Tukwila Municipal Code (TMC) 18.56.065 Residential Parking and Storage Requirements. Compliance Date: September 1, 2014 Violation # 4 BUILDING PERMITS REQUIRED Code Reference: • 2021 IRC R105.1 (as adopted by TMC 16.04.020) Required. Any owner or owner's authorized agent who intends to construct, enlarge, alter, repair, move, demolish or change the occupancy of a building or structure, or to erect, install, enlarge, alter, repair, remove, convert or replace any electrical, gas, mechanical or plumbing system, the installation of which is regulated by this code, or to cause any such work to be performed, shall first make application to the building official and obtain the required permit. • 2021 IRC R105.1 (as adopted by TMC 16.04.020) Types of inspections. For on-site construction, from time to time the building official, upon notification from the permit holder or his agent, shall make or cause to be made any necessary inspections and shall either approve that portion of the construction as completed or shall notify the permit holder or his or her agent wherein the same fails to comply with this code. • 2021 IRC R105.1 (as adopted by TMC 16.04.020) Inspection requests. It shall be the duty of the permit holder or their agent to notify the building official that such work is ready for inspection. It shall be the duty of the person requesting any inspections required by this code to provide access to and means for inspection of such work. • 2021 IRC R105.1 (as adopted by TMC 16.04.020) Approval required. Work shall not be done beyond the point indicated in each successive inspection without first obtaining the approval of the building official. The building official, upon notification, shall make the requested inspections and shall either indicate the portion of the construction that is satisfactory as completed, or shall notify the permit holder or an agent of the permit holder wherein the same fails to comply with this code. Any portions that do not comply shall be corrected and such portion shall not be covered or concealed until authorized by the building official. On the adjacent property, #x 0179002690, is a storage shed greater than 120 sq ft. On the subject property, (parcel #t 01.79002265) located along S124" Eta a cinder block wall has been constructed. This wall is over five (5) feet in height. There are cinder block walls less than three (3) feet in height constructed beneath the wirought iron fencing located along the north and west side of the properties" too. The two gates, one on S 124"° St and one on 50ph FI S, and the "walk through" gate on 50111 Pl S, Al have two columns constructed on either side of these gates. Corrective Action: 1. Obtain a Single -Family Residential Remodel and Addition for the construction of the carport and the structure(s) located next to the carport and the south property line, the cinder block wall, and the four (4) columns. Submit complete permit(s), plans, and any other required documents by the compliance date stated below. 2. Additional permits maybe required which include but are not limited to electrical, plumbing and gas, mechanical. 3. If the carport and the adjoining structures cannot obtain the required permits, the repair to all structures is to costly, or they are constructed within the required setbacks, all structures must be removed by the compliance date stated below. 4. There is no primary use on the adjacent property, # 0179002690, therefore the large storage shed must be removed by the compliance deadline stated below. 5. Once all structures have been brought into compliance, permitted, or removed, maintain this condition for the life of the property. Compliance Date: September 1, 2024 Violation # 5 HOME OCCUPATION Code Reference: TMC 18.50.240 Home Occupations A. Home occupations shall meet the following standards: 1. There shall be no change in the outside appearance of the surrounding residential development; 2. No home occupation shall be conducted in any accessory building. This provision shall not apply to adult family homes as defined in RCW 70.128.010 or community facilities as defined in RCW 72.05.020; 3. Traffic generated by a home occupation shall not exceed two (2) visitors at any given time, and no more than eight (8) total two-way visitor and non-resident employee trips per day; 4. The number of vehicles associated with a home occupation shall not exceed two (2) vehicles and must be parked on-site. Vehicles associated with the business shall not exceed: a. A gross vehicle weight of 10,000 pounds (Class 1 or Class 2); b. A height often (10) feet; or c. A length of 22 feet; 5. An off-street parking space shall be made available for any non-resident employee. All parking spaces shall meet all development standards; 6. The business shall not involve more than one person who is not a resident of the dwelling. This provision shall not apply to adult family homes as defined in RCW 70.128.010 or community facilities as defined in RCW 72.05.020; and 7. Outdoor storage of materials associated with a home occupation is prohibited. Corrective Action: 1. Bring both properties, parcels # 0179002265 and # 0179002690, into compliance with Tukwila Municipal Code (TMC) 18.50.240 Home Occupations. 2. VIOLATIONS OF THE TUKWILA MUNICIPAL CODE: 2. Notice of Violation and Order: a. A Notice of Violation and Order shall carry with it a cumulative monetary penalty of $2SO.00 per day for each violation from the compliance date until compliance with the Notice of Violation and Order is achieved. NOTE: TMC 18.56.065 Residential Parking and Storage Requirements A. Parking and vehicle storage limitations on properties devoted to single-family residential use shall be as follows: 5. No more than six motor vehicles shall be parked on a single-family residential property of 13,000 square feet or less outside of a carport or enclosed garage for a period of more than 48 hours. For purposes of this section, "single-family residential property" means any parcel containing a single-family residence or multiple parcels combined containing one single-family residence, typically identified by a single address located in the LDR zone. The parking limitations in this subsection shall apply to all motor vehicles as defined by state law with the exception of motorcycles and mopeds.
