Brian Erickson of Evergreen Tree Care, requesting a revision to existing permit, L18-0001. The revision requests a change in the number of replacement trees to be planted onsite from 40 to 10. The additional mitigation for 30 trees would be paid via in -lieu fees. The applicant is requesting a reduction in the price per tree (currently $400/tree) to $114/tree due to the "inherent challenges of the original permitting process; the denial of the original mitigation request; lack of a site visit by a city representative... until this July; and the massive increase in the in lieu fee for mitigation..." This letter serves as notice that the City approves the request for a reduction in the number of trees to be planted onsite and an increase in in -lieu fees but does not approve the request for reduced fees as outlined below. Background In 2018, Cottage Creek HOA (via their arborist and agent, Kristin Tennant) applied for and received two tree removal permits -one for landscaping in the parking lot areas (L 18-0002) and one for removal/restoration in the creek area (L18-001). The application for L18-001, Sensitive Area tree removal, was submitted on January 11, 2018 and proposed mitigation for tree removal using shrubs or groundcovers. However, TMC Chapter 18.45 provides that tree removal will only be approved with replanting of trees (at the approved ratio) or via in -lieu fee payment, if the required number of replacement trees exceeds site capacity and replanting would be unfeasible. Thus, the City issued a corrections letter on February 22, 2018, informing the applicant that City code does not allow for variance to TMC 18.45 or 18.54 and therefore shrubs cannot be accepted as replacement. Additionally, the corrections letter indicated that in -lieu fees (of $124/tree) could be paid in exchange for onsite tree planting if requested. Tukwila City Hall • 6200 Southcenter Boulevard • Tukwila, WA 98188 • 206-433-1800 • Website: TukwilaWA.gov On March 2, 2018, the City issued the Notice of Decision (NOD) approving the removal of 15 trees to be replaced by 84—the replacement ratio in effect at the time of the permit, pursuant to TMC 18.54.130.2b—and the replanting plan that was prepared and submitted by the applicant. The approved permit proposed planting 40 trees onsite and paying $5,456 into the in -lieu tree fund account calculated at the rate of $124 per tree ($124 x 44 = $5,456). Payment of in -lieu fees was required at the time of permit issuance, and replacement trees were to be planted in the next season (fall/winter 2018-2019). A three-year monitoring period would begin after the City approved the tree planting. The entire permit processing time (submittal, review, revision, and approval) took less than two months, which is typical and within a reasonable processing time. The removal of the approved 15 trees started the following week, around March 14, 2018. No replacement trees have been planted to date. The in -lieu fee of $5,465 was paid in August 2019. Pursuant to the City's standard practice, a site visit was not conducted prior to issuing the permit as the applicant is a Certified Arborist. However, at the applicant's request, the City performed a site visit in July 2018 to discuss the applicant's desire to plant fewer onsite trees given the tight spacing on -site and instead pay additional in -lieu fees. At that time, the City stated that the applicant could submit a permit revision request with a new replacement ratio. The City and the applicant also discussed the increase in the in -lieu fee rate of $400/tree. As explained, the rate for in -lieu fees is tied to the Annual Land Use Fee Schedule and is updated every year per the updated Tree Code, TMC Chapter 18.54 (adopted in April 2018). Prior to this code update, the rate had not been substantially reviewed since 2009. The rate represents the cost of purchasing, planting, irrigating, and maintaining a tree for a period of three years. While the original permit, L18-001, was approved prior to adoption of the current TMC 18.54, there is no "grandfathering" or vesting for tree removal permits and associated in -lieu fees. The City recognizes that this is not a small increase in the amount of fees that will be due; however, the City must treat all applicants equally and must account for the significant change in the number of trees that will not be replaced. Furthermore, more than a year and a half has passed since the trees were removed and the revision request was submitted, which also contributed to the increase in the fees. As per City policy, the request for revision will be reviewed under the current code and fee structure, and, therefore, is subject to the current in -lieu fee of $400. In accordance with TMC Chapters 18.45 and 18.54, the City will approve the revision request to reduce the number of trees planted onsite from 40 to 10 with an additional in -lieu fee payment of $12,000 for the remaining 30 trees otherwise required to be replaced. Alternatively, the applicant may adhere to the previous approved permit conditions (40 trees planted onsite) or submit an alternate proposal for the City's review and approval. REVISED MITIGATION PLAN: • Cottage Creek HOA will install 10 trees within mitigation area detailed on original permit by or before November 1, 2020 • Cottage Creek HOA will pay in lieu fee for the remaining 30 trees that were slated for installation on site by or before January 30, 2020 IN LIEU FEE REQUEST: Given the inherent challenges of the original permitting process; the denial of the original mitigation request; lack of a site visit by a city representative regarding #L18-001 until this July and; the massive increase in the in lieu fee for mitigation (3.5 times the cost per tree, from $114 to $400), we are requesting that this amendment be applied at the established in lieu fee of $114 per tree which was in effect when the permit was originally applied for ("Grandfathered" in, if you will). This reasonable consideration (given the mitigating circumstances), will enable Cottage Creek to utilize their modest budget for additional tree care and stewardship of their EXTREMELY special micro -forest. The total additional mitigation in lieu fee related to #L18-001 that we are requesting would be $3,420 instead of a staggering $12,000. This approval would be a huge gesture of support of your constituents' (whose property is flanked on two sides by City property) and their desire to be the best stewards possible with their limited resources. We are hopeful for approval of this amendment so we can get back on track with the planning of the deferred maintenance and care of Cottage Creek HOA's beautifully wooded, five -acre property. I. DECISION SEPA Determination: The City SEPA Responsible Official has previously determined that this application do not require a SEPA threshold determination because it is categorically exempt. A total of 5 replacement trees must be installed on the property to replace 5 trees being removed. Approval is given to plant 5 incense cedar, Hinoki, or Castlewellen cypress trees as mitigation, or a combination of those tree species. • Planting and maintenance shall be in accordance with best management practices for landscaping to ensure the vegetation's long-term health and survival per TMC 18.54.130.3.c(3). • Entire planting area should be mulched with 3-4 inches of medium bark or wood chips. Mulch should not be placed against the trunks of the trees — leave a 4 inch circle around the trunk un- mulched. • The new trees shall be planted according to the planting plan (attached), with trees spaced at least 8' apart. Per TMC 18.54.130.3c.1, evergreen trees must be at least 6' tall at time of planting. • Trees should be watered weekly during the dry months (generally July -September or as necessary depending on conditions) for the first two growing seasons. • The City will perform an initial inspection after planting. Email Project Manager Lindsay Brown at Lindsay.brown@tukwilawa.gov after planting to schedule this inspection. • Applicant shall submit annual photos of the replacement tree to the city's Urban Environmentalist (Andrea.cummins@tukwilawa.gov) and the project manager (Lindsay.brown@tukwilawa.gov) to ensure proper maintenance and a 100% survival rate for three years following initial landscaping inspection. Final inspection to take place in 2021. III. FINDINGS This tree clearing permit application is a request to remove five (5) fir trees in a landscaped area of the property. The application materials show the firs are in poor health and must be removed; staff approves its removal and requires replacement on a 1:1 basis. IV. YOUR APPEAL RIGHTS The Decisions on this Permit Application is a Type 1 decision pursuant to Tukwila Municipal Code §18.104.010. Other land use applications related to this project may still be pending. One administrative appeal to the City Hearing Examiner of the Decision on the Permit itself is permitted. A party who is not satisfied with the outcome of the Hearing Examiner appeal process may file an appeal in King County Superior Court from the Hearing Examiner's decision. V. PROCEDURES AND TIME FOR APPEALING In order to appeal the Planning Supervisor's decision on the Permit Application, a written notice of appeal must be filed with the Department of Community Development within 14 days of the issuance of this Decision. All appeal materials shall be submitted to the Department of Community Development. Appeal materials MUST include: 1. The name of the appealing party. 2. The address and phone number of the appealing party; and if the appealing party is a corporation, association or other group, the address and phone number of a contact person authorized to receive notices on the appealing party's behalf. 3. A statement identifying the decision being appealed and the alleged errors in the decision, including any specific challenge to an MDNS. 4. The Notice of Appeal shall identify (a) the specific errors of fact or errors in application of the law in the decision being appealed; (b) the harm suffered or anticipated by the appellant, and (c) the relief sought. The scope of an appeal shall be limited to matters or issues raised in the Notice of Appeal. 5. Appeal fee per the current fee schedule, additional hourly charges may apply. In addition all hearing examiner costs will be passed through to the appellant. VI. APPEAL HEARINGS PROCESS Any administrative appeal regarding the Permit shall be conducted as a closed record hearing before the Hearing Examiner based on the information presented to the Planning Supervisor who made the original decision. No new evidence or testimony will be permitted during the appeal hearing. Parties will be allowed to present oral argument based on the information presented to the Planning Supervisor before their decision was issued. The Hearing Examiner's decision on the appeal is the City's final decision. Any party wishing to challenge the Hearing Examiner's decision on this application must file an appeal pursuant to the procedures and time limitations set forth in RCW Ch. 36.70C. If no appeal of the Hearing Examiner's decision is properly filed in Superior Court within such time limit, the Decision on this permit will be final. VII.
