DECISION SEPA Determination: The City SEPA Responsible Official has determined that this application does not require a SEPA threshold determination because it is categorically exempt. Decision on Substantive Permit: The Community Development Director has determined that the application for a Wireless Telecommunication Facility does comply with applicable City and state code requirements and has approved this application, with the following condition. 1. The applicant must apply for a business license to operate the wireless facility at this location. III. YOUR APPEAL RIGHTS The Decision on this Permit Application is a Type 1 decision pursuant to Tukwila Municipal Code §18.104.010. Other land use applications related to this project may still be pending. No administrative appeal of a DNS or an EIS is permitted. One administrative appeal to the City Hearing Examiner of the Decision on the Permit itself is permitted. If an MDNS was issued, any person wishing to challenge either the conditions which were imposed by the MDNS decision or the failure of the Department to impose additional conditions in the MDNS must raise such issues as part of the appeal to the Hearing Examiner. A party who is not satisfied with the outcome of the Hearing Examiner appeal process may file an appeal in King County Superior Court from the Hearing Examiner's decision. IV. PROCEDURES AND TIME FOR APPEALING In order to appeal the Community Development Director decision on the Permit Application, a written notice of appeal must be filed with the Department of Community Development within 14 days of the issuance of this Decision. The requirements for such appeals are set forth in Tukwila Municipal Code ch. 18.116. All appeal materials shall be submitted to the Department of Community Development. Appeal materials MUST include: 1. The name of the appealing party. 2. The address and phone number of the appealing party; and if the appealing party is a corporation, association or other group, the address and phone number of a contact person authorized to receive notices on the appealing party's behalf. 3. A statement identifying the decision being appealed and the alleged errors in the decision, including any specific challenge to an MDNS. 4. The Notice of Appeal shall identify (a) the specific errors of fact or errors in application of the law in the decision being appealed; (b) the harm suffered or anticipated by the appellant, and (c) the relief sought. Appeal fee per the current fee schedule, additional hourly charges may apply. In addition, all hearing examiner costs will be passed through to the appellant. V. APPEAL HEARINGS PROCESS Any administrative appeal regarding the Permit shall be conducted as a closed record hearing before the Hearing Examiner based on the information presented to the Community Development Director, who made the original decision. No new evidence or testimony will be permitted during the appeal hearing. Parties will be allowed to present oral argument based on the information presented to the Community Development Director before their decision was issued. The Hearing Examiner's decision on the appeal is the City's final decision. Any party wishing to challenge the Hearing Examiner's decision on this application must file an appeal pursuant to the procedures and time limitations set forth in RCW ch. 36.70C. An appeal challenging a DNS, an MDNS or an EIS may be included in such an appeal. If no appeal of the Hearing Examiner's decision is properly filed in Superior Court within such time limit, the Decision on this permit will be final. The City's decision to issue a DNS, an MDNS or an EIS is final for this permit and any other pending permit applications for the development of the subject property. VI. The project also qualifies as an Eligible Facilities Modification under § 6409 of the FCC's Spectrum Act, and Tukwila Municipal code 18.58.200, which requires the City to approve any eligible facilities request for a modification of an existing tower or base station that does not substantially change the physical dimensions of such tower or base station. Existing Development This telecommunications facility is preexisting. Surrounding Land Uses The property is zoned within the Manufacturing Industrial Center/ Heavy Industrial (MIC/H). Surrounding parcels are zoned within the Manufacturing Industrial Center/ Heavy Industrial (MIC/H). Background In 2006, the City adopted a Wireless Facilities Chapter (TMC 18.71) to the Zoning Code. The chapter provides location and design requirements for the placement of WCF within the City of Tukwila. In 2016 the city adopted amendments to this ordinance in compliance with the Federal Spectrum Act. The proposed modifications to the existing WCF will not significantly alter the conditions that currently exist and will not be materially detrimental to the public welfare or injurious to property or improvements in the vicinity. 2. As demonstrated in Table 1, the project meets all applicable development standards for a Type 1 WCF. 3. The proposed modifications will not alter the surrounding land uses in terms of traffic and pedestrian circulation, building or site design. 4. The proposed project is in keeping with the goals and policies of the Comprehensive Land Use Policy Plan. S. The project also qualifies as an Eligible Facilities Modification under § 6409 of the FCC's Spectrum Act, which requires the City to approve any eligible facilities request for a modification of an existing tower or base station that does not substantially change the physical dimensions of such tower or base station. RECOMMENDATIONS The recommendation to the Director of Community Development is to approve this application for a Type 1 Wireless Telecommunications Facility permit with the following conditions. 1. The applicant must apply for a business license to operate the wireless communications facility at this location. This noise survey extends from the proposed equipment to the nearest properties. The purpose of this report is to document the existing conditions and the impacts of the acoustical changes due to the proposed equipment. This report contains data on the existing and predicted noise environments, impact criteria and an evaluation of the predicted sound levels as they relate to the criteria. Ambient Conditions Existing ambient noise levels were measured on site with a Svantek 971 sound level meter on December 20, 2017. Measurements were conducted as close to the proposed location as possible and the property lines in accordance with the State of Washington code for Maximum Environmental Noise Levels WAC 173-60-020. The average ambient noise level was 65.7 dBA, due primarily to traffic noise on East Marginal Way South. Code Requirements The site is located within the City of Seattle zoning jurisdiction on property with a C1 zoning designation. All of the receiving properties are also zoned C1. Seattle Municipal Code 25.08.100 identifies DMC as being within a "Commercial" district. The proposed new equipment consists of an emergency generator. The generator will run once a week during daytime hours for maintenance and testing purposes only. Under Seattle Municipal Code Chapter 25.08.410, noise from equipment within ""ggbe tb district is limited as follows: V "Commercial" Receiver: Noise is limited to 60 dBA 24 hours a day. Therefore, the generator must not exceed 65 dBA when running during daytime hours for maintenance testing. The generator is exempt during emergency operation. Predicted Equipment Sound Levels 24-Hour Operation Equipment The proposed equipment cabinets are located within an existing equipment shelter. There is no direct path for sound to exit the shelter. Noise levels from the equipment will therefore be contained within the building and as such will be in compliance with the 60 dBA code limit. Emergency Equipment The proposed equipment includes one Generac SDC20 20 KW generator with a Level 1 sound enclosure and has a sound level of 65 dBA at 23 feet. The generator will be located at grade surrounded by a chain -link fence with privacy slats. The nearest receiving property to the south is approximately 28 feet from the generator. Generator equipment noise is expected to meet the code limits at all other receiving property lines. No further mitigation will be required. If it is not a substantial change then it could be processed expeditiously as required by the Spectrum Act. A substantial change as established by FCC rules is: The proposed scope of work is not a substantial change to the existing cell tower and should be processed expeditiously. Substantial Change. A proposed facilities modification will substantially change the physical dimensions of an eligible support structure if it meets any of the following criteria: a. For towers other than towers in the public rights -of -way, it increases the height of the tower by more than 10% or by the height of one additional antenna array with separation from the nearest existing antenna not to exceed 20 feet, whichever is greater; for other eligible support structures, it increases the height of the structure by more than 10% or more than 10 feet, whichever is greater. Changes in height should be measured from the original support structure in cases where deployments are or will be separated horizontally, such as on buildings' rooftops; in other circumstances, changes in height should be measured from the dimensions of the tower or base station, inclusive of originally approved appurtenances and any modifications that were approved prior to the passage of the Spectrum Act. b. For towers other than towers in the public rights -of -way, it involves adding an appurtenance to the body of the tower that would protrude from the edge of the tower more than 20 feet, or more than the width of the tower structure at the level of the appurtenance, whichever is greater; for other eligible support structures, it involves adding an appurtenance to the body of the structure that would protrude from the edge of the structure by more than 6 feet. c. For any eligible support structure, it involves installation of more than the standard number of new equipment cabinets for the technology involved, but not to exceed 4 cabinets; or, for towers in the public rights -of -way and base stations, it involves installation of any new equipment cabinets on the ground if there are no pre-existing ground cabinets associated with the structure, or else involves installation of ground cabinets that are more than 10% larger in height or overall volume than any other ground cabinets associated with the structure. d. For any eligible support structure: (1) it entails any excavation or deployment outside the current site; (2) it would defeat the concealment elements of the eligible support structure; or (3) it does not comply with conditions associated with the siting approval of the construction or modification of the eligible support structure or base station equipment, provided however that this limitation does not apply to any modification that is noncompliant only in a manner that would not exceed the thresholds identified in this section.
