A one-year extension was granted until July 11, 2019 to submit a completed application. (PBS) is submitting this proposal to provide a Buffer Restoration Plan for the property located at 13232 40th Avenue South in Tukwila, WA. The plan will focus on critical areas review comments from the City of Tukwila, as provided by the Client. This proposal outlines our project approach, scope of work, schedule, and budget for PBS services based on our understanding of the project, information provided to us to date, and experience with similar projects. PROJECT UNDERSTANDING AND APPROACH PBS understands that you received Notice of Violation from the City of Tukwila dated 5/17/2018 for clearing and grading without proper permits in environmentally critical areas or buffers. Potential critical areas present include a type 4 stream and associated 50-foot buffer. The City's memorandum and a phone conversation on with Lindsey Brown (City of Tukwila) on 6/12/2018 detailed the City's requirements for addressing the violations and allowing the permit review to proceed. These items are shown below under the Scope of Work. SCOPE OF WORK The following tasks may be included in this scope of work. 1. Background Review (review of material and coordination with City of Tukwila permit staff) 2. Coordination (ongoing coordination with the client and City via phone and email) 3. Prepare a Memorandum (documents the stream boundary flagging and providing narrative text for the buffer restoration/mitigation plan, performance standards, and monitoring plan) 4. Prepare Bond Quantity Worksheet 5. Prepare Buffer Restoration Plan 6. Annual Monitoring and Reporting for a 5 year period LIMITATIONS OF SCOPE This scope does not include additional permitting support or submittals not identified above, which could be required by the City of Tukwila or other regulatory agencies. The scope also does not include a detailed site plan or topographic survey. It includes all labor, expenses, materials, transportation, and equipment required to complete the work described. PBS will charge only for actual hours spent and expenses incurred. We will not exceed the above estimate without written consent from the client. The fees and terms under which these services are provided will be in accordance with the attached PBS General Terms and Conditions for Professional Services (Rev. 01/2017). The Terms and Conditions and this proposal constitute the entire agreement (Agreement) between the parties and may not be changed without prior written consent of the parties. The pricing and other information contained in this proposal document are proprietary and shall not be duplicated, used, or disclosed, in whole or in part, to other parties without the permission of PBS. SCHEDULE PBS is available to begin work on this project immediately upon receipt of a signed copy of this Agreement. It is anticipated that we can complete this work within approximately 2 months. We realize that the City has requested the information by June 1, 2018. In addition all approvals must be consistent with the Tukwila Comprehensive Plan (TMC 18.100.030). Tukwila Municipal Code Title 18. Planning Division Staff are available to discuss the decision criteria you must respond to and necessary supporting materials. PARICNG DEVIATION • Covenant Parking: where required parking is provided off -site (TMC 18.56.070(B)); • Complementary Parking: where up to 10% of a development's useable floor area is determined to be linked to remaining area, such that it need not provide the normally required parking (TMC 18.56.070(D)); • Reduction of the minimum required parking of up to 10%, through an administrative variance (TMC 18.56.140). A parking reduction may be allowed after: 1. All shared parking strategies are explored. 2. On -site park and ride opportunities are fully explored. 3. The site is in compliance with the City's commute trip reduction ordinance or, if not an affected employer as defined by the City's ordinance, agrees to become affected. 4. The site is at least 300 feet away from a single-family residential zone. 5. A report is submitted providing a basis for less parking and mitigation necessary to offset any negative effects. In addition to the above requirements, the Director may require specific measures not listed to ensure that all impacts with reduced parking are mitigated. Any spillover parking that cannot be mitigated to the satisfaction of the Director will serve as the basis for denial. LANDSCAPE DEVIATIONS • The landscape perimeter may be averaged if the total required square footage is achieved, unless the landscaping requirement has been increased due to proximity to LDR, MDR or HDR. Landscape perimeter averaging may be allowed as a Type 2 special permission decision if all of the following criteria are met: 1. Plant material can be clustered to more effectively screen parking areas and blank building walls. 2. Perimeter averaging enables significant trees or existing built features to be retained. 3. Perimeter averaging is used to reduce the number of driveways and curb cuts and allow joint use of parking facilities between neighboring businesses. 4. Width of the perimeter landscaping is not reduced to the point that activities on the site become a nuisance to neighbors. 5. Averaging does not diminish the quality of the site landscape as a whole. • In the MDR and HDR zones up to 20% of the minimum required front yard landscaped area may be developed for pedestrian and transit facilities. • In the RCC and TUC zones required landscaping may include a mix of plant materials, pedestrian amenities and features, outdoor cafe -type seating and similar features. A survey/plat plan to scale of the property, showing the stream, wetland flags, 50 ft. buffer area, and area of disturbance. If you intend on disturbing more area than already disturbed, indicate so and depict this on the survey/plan. 2. The report from your wetlands biologist. 3. A wetlands biologist needs to prepare a mitigation and planting plan for the disturbed areas (1:1 ratio). Include the planting plan on a survey/plan of the site. I've attached an example. The work will need to be bonded and monitored for 5 years. 4. Fill out the attached quantity worksheet in preparation for bonding. 5.
