I. PROJECT INFORMATION Project File Number: L18-0035 Applicant: Barbara Brunetti, Ramada Inn Type of Permit: Shoreline Tree Permit Project Description: Request to approve removal (after the fact) of three trees over 20-inches in diameter in the shoreline jurisdiction and replace with 24 trees. Replacement trees include a mix of deciduous and coniferous trees. Location: 15901 West Valley Highway (parcel #0005800030) Associated Files: PL18-0025 (Project File), CE17-0393 (Code Enforcement File) Comprehensive Plan Tukwila Urban Center/Transit Oriented Development District (TUC-TOD) Designation/Zoning District: II. DECISION SEPA Determination: The City SEPA Responsible Official has previously determined that this application does not require a SEPA threshold determination because it is categorically exempt. Decision on Substantive Permit: The City Planning Supervisor has determined that the application for a Shoreline Tree Permit does comply with applicable City and State Code requirements and has approved the application with the following conditions: 1. Cost estimates on the bond worksheet shall be revised to include the full scope of maintenance and monitoring costs for each year of the 5-year maintenance and monitoring period. A bond Page 1 of 4 • • L18-0035: Ramada Inn Shoreline Tree Removal Staff Report and Notice of Decision August 29, 2018 or other financial assurance shall be submitted for 150% of the cost of the maintenance, monitoring and replacement planting costs in case of failure prior to the initial inspection and acceptance of the planting area. 2. Planting and maintenance shall be in accordance with best management practices for landscaping to ensure the vegetation's long-term health and survival per TMC 18.54.130.3.c(3) and as per the maintenance and monitoring plan submitted by the applicant. 3. Trees should be planted between October 15 and April 15th to ensure the best start for tree health and retention for the mitigation and monitoring period and beyond. The applicant shall contact the project planner Jaimie Reavis at Jaimie.ReavisPTukwilaWA.eov or (206)431-3659 to schedule an inspection by the City after planting. 4. All burlap, string, and wire basket shall be completely removed from the root ball and the roots examined for circling roots. Prune roots as necessary to ensure a healthy root system. 5. Three inches of compost should be placed on top of soil in planting area and incorporated (rototilled) to a depth of at least 10 inches. 6. Entire planting area should be mulched with 3-4 inches of medium bark or wood chips. Mulch should not be placed against the trunks of the trees — leave a 4-inch circle around the trunk free of mulch. 7. Trees should be watered weekly during the dry months (generally July -September or as necessary depending on conditions) for the first two growing seasons. 8. Applicant shall submit annual photos of all twenty-four (24) trees to the city's Urban Environmentalist to ensure proper maintenance and a 100% survival rate for five years following initial landscaping inspection. III. FINDINGS On December 8, 2017, a Tukwila Code Enforcement Officer observed three mature Cottonwood trees to have been partially removed. The upper portion of each of the trees was chopped, leaving behind tree stumps at least 20 feet in height. The size of the three trees, as measured by diameter -at -breast -height (DBH), were 56 inches DBH, 37 inches DBH, and 20 inches DBH. The three trees were located along the riverbank of the Green River, within the 200-foot Shoreline Management Area. Per TMC 18.44.080(B), removal of any significant tree or native vegetation in the Shoreline Jurisdiction requires a Shoreline Tree Removal and Vegetation Clearing Permit and is generally only allowed on sites undergoing development or redevelopment. A Shoreline Tree Removal and Vegetation Clearing Permit is required to be submitted prior to any tree removal or site clearing, but was submitted to the City on May 1, 2018, after the tree removal had already occurred. - Per the Tree Replacement Requirements of 18.44.080, eight replacement trees are required for each tree removed larger than 20 inches DBH. This project proposes 24 replacement trees in the same general area along the riverbank where the trees were removed. A mix of deciduous and evergreen tree species native to the Pacific Northwest are proposed, including Bigleaf Maple (Acer macrophyllum), Douglas Fir (Pseudotsuga menziesii), Oregon Ash (Fraxinus latifolia), and Western Red Cedar (Thuja plicata). A bond worksheet was submitted for the maintenance and monitoring period. The maintenance and monitoring period for this project will be for a period of five years beginning once the new trees have been installed and inspected by Department of Community Development staff. The maintenance and monitoring cost estimates on the bond worksheet do not include the full five-year period, nor do they Page 2 of 4 L18-0035: Ramada Inn Shoreline Tree Removal Staff Report and Notice of Decision August 29, 2018 match the scope of work for the maintenance and monitoring described on the project plans. As a condition of approval, cost estimates on the bond worksheet shall be revised to include the full scope of maintenance and monitoring each year over the full 5-year period. A bond or other financial assurance shall be submitted for 150% of the cost of the maintenance and monitoring prior to the initial inspection/acceptance of the planting area. The height of the tree stumps which have been left in place is tall for wildlife snags, and the height of these stumps has the potential to threaten the stability of the riverbank and/or the building if they are left as -is in their current condition. The City's recommendation is either full removal of the tree stumps, or additional cutting of the tree stumps to leave wildlife snags for habitat that are no taller than 10 feet. IV. YOUR APPEAL RIGHTS The Decision on this Permit Application is a Type 1 decision pursuant to Tukwila Municipal Code §18.104.010. Other land use applications related to this project may still be pending. One administrative appeal to the City Hearing Examiner of the Decision on the Permit itself is permitted. A party who is not satisfied with the outcome of the Hearing Examiner appeal process may file an appeal in King County Superior Court from the Hearing Examiner's decision. V. PROCEDURES AND TIME FOR APPEALING To appeal the Planning Supervisor's decision on the Permit Application, a written notice of appeal must be filed with the Department of Community Development within 14 days of the issuance of this Decision. The requirements for such appeals are set forth in Tukwila Municipal Code Ch. 18.116. All appeal materials shall be submitted to the Department of Community Development. Appeal materials MUST include: 1. The name of the appealing party. 2. The address and phone number of the appealing party; and if the appealing party is a corporation, association or other group, the address and phone number of a contact person authorized to receive notices on the appealing party's behalf. 3. A statement identifying the decision being appealed and the alleged errors in the decision, including any specific challenge to an MDNS. 4. The Notice of Appeal shall identify (a) the specific errors of fact or errors in application of the law in the decision being appealed; (b) the harm suffered or anticipated by the appellant, and (c) the relief sought. The scope of an appeal shall be limited to matters or issues raised in the Notice of Appeal. 5. Appeal fee per the current fee schedule, additional hourly charges may apply. APPEAL HEARINGS PROCESS Any administrative appeal regarding the Permit shall be conducted as a closed record hearing before the Hearing Examiner based on the information presented to the Planning Supervisor who made the original decision. No new evidence or testimony will be permitted during the appeal hearing. Parties will be allowed to present oral argument based on the information presented to the Planning Supervisor before their decision was issued. The Hearing Examiner's decision on the appeal is the City's final decision. Any party wishing to challenge the Hearing Examiner's decision on this application must file an appeal pursuant to the procedures and time limitations set forth in RCW Ch. 36.70C. If no appeal of the Hearing Examiner's decision is properly filed in Superior Court within such time limit, the Decision on this permit will be final. VII. There is a wide asphalt fire lane running along the back of the building between the trees and the building. Cultural miscommunication happened and the trees were pruned more than they should have been. They should have asked permission to prune the trees in the river buffer and they did not. Code violation issued a red tag and they cleaned up the downed branches, however the majority of the trees are still remaining and and in good health. Carol and Andrea wanted us to cut the trees down and grind the stumps. I did not want to cut the trees down because they would come up as suckers and ruin the fire lane requiring repaving of the fire lane and a huge costs to Ramada. We wanted to have a meeting on Wed to review the trees, they have recovered very nicely. CA The pruning completed earlier is no more than the damage a storm would have done to these trees. We would like a reassessment of the need to replace these trees. Couple of additional things.'i.% I am not sure we can even work in the shoreline with out a Federal Shorelines Permit. Second Barb is very worried she will be fired if she has to go to corporate for the cost of all this work. I do not think the pruning of these trees should cost her a job and her retirement. Please keep an open mind when we meet on Wed. It doesn't matter to me, I am not on the hook for this, I just hate to see personal consequences beyond the actual damage done when the trees have recovered to 99%. Box 1442 Maple Valley, WA 98038 Re: City of Tukwila File Numbers L18-0035, PL18-0025, and CE17-0393 Dear Mr. Bethune, Thank you for your submittal of an arborist report and request letter regarding the 3 cottonwood trees that were pruned/topped along the shoreline behind the Ramada Inn in response to our meeting on October 4, 2018. While we agree with the arborist that additional pruning should be conducted to create a more stable crown and Tess potentially hazardous limbs, this act does not address the mitigation required by City and State code for vegetation removal in a Shoreline buffer (see code references below). Topping the existing trees has resulted in shortening their long-term viability. Retaining and pruning the existing trees may add some canopy in the short term but will not lead to their long-term recovery. While it may be easier and more cost effective to leave the existing tree trunks in place, tree replacement is required for trees that have been topped. • Per TMC 18.44.080.B.9: Topping of trees is prohibited unless absolutely necessary to protect overhead utility lines. Topping of trees will be regulated as removal and tree replacement will be required. • Per TMC 18.44.6.4, the replacement requirement for a tree of 20 inches or more in diameter is 8 trees, therefore 24 trees are required as replacement. • Per TMC 18.44.080.L.5(c): Monitoring of buffer alterations shall be required for three to five years. All other alterations shall be monitored for minimum of 5 years. Standard practice in Tukwila for shoreline vegetation monitoring is 5 years. In areas with heavy invasive species pressure, this is especially important. We also agree with the arborist that planting under the damaged trees will be difficult, however on your permitted landscape plan, most of the trees are proposed to be planted outside of the dripline of the trees. Adjustments can be made (vertically up and down the slope) if necessary, during planting to facilitate planting of new trees away from existing roots. A mixture of coniferous and deciduous trees is recommended due to the difference in growth rates, tolerance to drought, and overall ecological benefit. Conifers, while ultimately desired along the river, grow much more slowly and are more difficult to establish in areas with invasive pressure and drought concerns. Experience in restoration projects in the area has shown more need for replacement of conifers on these projects then for deciduous species. The restoration site across from your project site is a good example - substantially more conifers will be replaced after Year 1 than will deciduous plants. The Notice of Decision for this project was issued in August 2018, and included the appeal rights, procedures and time for appealing the decision. Under the new regulations, removal or damage of trees(s) without applying for and obtaining required City approval is submitted to a fine of $1,000 per tree, or up to three times the marketable value of each tree removed or damaged, as determined by the Qualified Tree Professional (whichever is greater). Fines and replacement plantings are now required for tree removal which occurs prior to City approval. In your case, fines have not been assessed to date for tree removals prior to obtaining permits. Thank you for meeting with Barbara Brunetti, Ramada Inn, and myself to review the conditions of the Notice of Decision regarding the unauthorized pruning of the California Black Poplar/Populas trichocarpa trees on the outer edge of the stream buffer at the Ramada Inn at 15901 West Valley Highway, Tukwila, Washington. The Ramada Inn regrets attempting to prune these trees away from the building resulting in unauthorized pruning of the three the California Black Poplar/Populas trichocarpa by an uninformed, unregistered Tree Pruning Contractor. Based on the on -site conditions, recovery or the California Black Poplar/Populas trichocarpa trees and recommendations from state certified arborist Bryce Landrud, Thundering Oak, we are requesting modification to the approved Notice of Decision of August 29, 2018. Based on the recovery of the California Black Poplar/Populas trichocarpa and the 'attached 'review by arborist Bryce Landrud we request retaining the existing trees with a pruning program as outlined by Bryce(attached), reduction of the replacement trees, reduction of the maintenance period and reduction of the monitoring program. We are requesting the incorporation of the pruning program by Thundering Oak as part of the maintenance program. Specifically the conditions of the Notice of Decision requires 24 replacement trees, 5 years of maintenance and monitoring and a bond for 150% of the cost of tree installation, maintenance and monitoring. We request modification to the Notice of Decision as follows: Replacement trees: Notice of Dec.:si^. 24 replacement trees Maintenance: Notice of Decision 5 years of maintenance Monitoring: Notice of Decision 5 years of monitoring Modification Request 6 replacement conifer trees Modification Request 2 years of maintenance and inclusion of the pruning program recommended by Arborist Bryce Landrud Modification Request 2 years of monitoring Based on the recommendation of Arborist Bryce Landrud, and with the proper pruning or the Co.iifornia Black Poplar/Populas trichocarpa. the trees will recover and become a stronger short and king term resource than removing the trees and replanting. Retaining and pruning the existing trees and adding six conifer replacement trees will baiui,ee rectify the issue of the previous pruning in a much shorter time period. Based on Mr. Landrud's evaluation of retaining and structurally pruning the trees the actionproposed will replace the resource much quicker than the 20-30 years he estimates the replacement trees will take to evolve. Retaining the existing trees with structural pruning will replace what was lost by the initial unauthorized pruning of the trees. P.O. We request modification to the Notice of Decision based on retaining the trees with incorporation of the pruning program, two years of maintenance and two years of monitoring. We also acknowledge a mistake was made by unauthorized pruning and we believe six conifer trees should be planted to provide a long term resource for the riverbank. The incorporation of the modification request will provide an overall stronger resource for the river, better short and long term habitat, less impact to the buffer for construction and protection of the fire lane. These trees (3 in all) that were topped off between 20 and 30 feet high last year have all re -sprouted heavily and appear to be growing rapidly. The new shoot growth is between 2 and 4 feet long, and is relatively consistent among and between the three affected trees. Due to the specific location, size and growth attributes of these trees, it makes the most sense at present to leave the trees in place, perform periodic pruning to assist future development and symmetry, and save new plantings for areas likely to be unaffected by the very large surface root mass these individuals possess. The reasoning for this course of action includes the following points: Within a year or two the only evidence of the topping activity will be in the winter when the stems are bare. The new branches, limbs and tops will look natural, provide shade to the river faster, and consists of native species. The stems and stumps are too large (>36") to safely and `gently' remove without further slope or riverbank damage. The existing root system occupies most if not all of the first 18" of the soil profile from the center of the stem out at least 15 to 20 feet. Planting anything in this zone would require power equipment and would require excavating at least the upper 12" of the soil to remove roots and enable digging. Simply cutting the trees off at the stump would result in the same type of growth that is currently happening at the upper stem cuts; rapid shoot growth that could exceed 4' per year. This would likely be coupled with new shoots sprouting from numerous surface roots in an effort to replace foliar mass. Though pointless and erroneous tree topping is harmful, unsightly and often seriously damaging to trees, the best methods of remediation sometimes require the use of the same plants that were damaged. In this case, replacement of these three trees would require an enormous and costly effort that would involve many plants, trees, landscape features and hardscape items that have nothing to do with the trees themselves. The final result would likely be a few extra trees in number that would take 20-30 years to fully `replace' the 3 poplars. R ctfully su itted, Bryce I.S.A.
